Tax Pin Nos.: 1851-70-1391, 1851-70-6543, 1851-80-1504,1851-82-3467, 1851-81-4197 To Whom It May Concern: This letter is official notification that on Tuesday, July 15, 2014 the Wake Forest Board of Commissioners voted to approve zoning case number RZ-14-02. As requested in your application, 131.49 acres of land located in the 5600 block of Copper Beech Lane was rezoned to GR10 (CD), General Residential-10 Conditional District. As part of this request, a Conditional District Subdivision Master Plan was approved for the "Tryon Subdivision" development which consists of a 279-lot single-family lots and 136 townhome lots. An approved copy of this plan attached. The approved plan is considered a condition of the approved Conditional District rezoning. In addition, the Board of Commissioners and the applicant also mutually agreed to the following conditions: 1. All heavy construction traffic shall use the Oak Grove Church Road entrance. 2. The connection to Oak Grove Church Road shall be constructed as part of the development of Phase 1, as shown on the subdivision master plan. 3. All improvements to the transportation network recommended in the traffic impact analysis must be constructed, including an $80,000 dollar contribution to the signal installation at Middlegame Way and NC-98. 4. Filling of wetlands may not occur until issuance of all required permits. 5. Removal of 7.92 acres from the Smith Creek Water Supply Watershed is subject to final approval of the stormwater management plan by the Town of Wake Forest Engineering Department. 6. A public greenway easement shall be dedicated along the stream located in the southeastern portion of the proposed development. Easement location will be determined by staff during construction plan review. The next step in the development process is to secure a valid construction permit within 2 years from the date of the approval of this case. If this project is not complete or a valid construction permit is not in place at the end of the 2-year period, the Board of Commissioners may take action to rescind the Conditional District, or extend the life of the Conditional District for a specified period of time. The rescission of the Conditional District shall follow the same procedure as outlined in Section 15.15 of the Wake Forest Unified Development Ordinance.
