The purpose of this letter is to inform you that the Division of Energy, Mineral, and Land Resources
(DEMLR) has reviewed and approved the amendment to amend Section 302(E)(2)(b) to establish an
overlay district where the 10/70 option applies in the Cape Fear WS-1V Protect Area and elimination of
an exemption that is no longer applicable with regard to the request received by our office on August 23,
2021. The County submitted the revised ordinance and map in compliance with the Water Supply
Watershed Protection Rules. DEMLR approved the ordinance and map in accordance with North
Carolina General Statute 143-214.5 and North Carolina Administrative Code 15A NCAC 2B .0100, .0200
and .0623.
