Based on our review of the project plans and specifications which limit the built -upon area to 4,420 square feet on each of the 68 lots identified, we have determined that the project complies with the Stormwater Regulations set forth in Title 15A NCAC 2H. 1003(a)(2). This Certification shall be effective from the date of issuance until rescinded and the project shall be constructed in accordance with the plans and specifications as filed with the Wilmington Regional Office. Said Deed Restrictions and Protective Covenants shall apply to the Oyster Bay Phase 3 Subdivision project in Sunset Beach, North Carolina as shown on design plans titled "Erosion Control and Stormwater Plan - Oyster Bay Phase 3 - Sea Trail Plantation" prepared by Houston and Associates, P.A. dated April 25, 1991: 'No more than 4,420 square feet of any lot shall be covered by structures and/or paved surfaces, including walkways or patios of brick, stone, slate, or similar materials. This covenant is intended to insure continued compliance with stormwater runoff rules adopted by the State of North Carolina and therefore benefits may be egforced by the State of North Carolina.
