Development Solutions Group LLC. has contracted Carolina Wetland Services, Inc. (CWS) to delineate the extent of jurisdictional features within the project area. Waterway: UT to Mundys Run Basin: Lower Catawba (HUC' 03050103) City: Weddington County: Union County Tax Parcel No(s): 06153009 (partial) Decimal Degree Coordinate Location of Project Site: 35.0129330 ,-80.7614620 USGS Quadrangle Name: Weddington, NC (2020) Current Land Use The project area consists of undeveloped forested areas, open herbaceous areas and a powerline Right -of -Way. On site elevations range from 680-720 feet above mean sea level (Figure 2). Land cover within the project area consists of deciduous forest, mixed forest, herbaceous areas, emergent wetlands, and woody wetlands. According to the United States Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS) Web Soil Survey of Union County2 (Figure 4) and the NRCS Published Soil Survey for Union County3 (Figure 5), on site soils consist of three different soil types (Table "'HUC" is the Hydrologic Unit Code. The National Wetlands Inventory (NWI), created by the U.S. Fish and Wildlife Service, is a program that provides wetland data and analysis to the public. A review of the NWI GIS layer depicts a freshwater pond in the southeastern corner of the project limits (Figure 6). FEMA National Flood Hazard FEMA National Flood Hazard Layer was reviewed for the project area (FEMA Panels 3710447600J. The Old Mill Road site is located within the Area of Minimal Flood Hazard Zone (Figure 7). Jurisdictional Delineation The U.S. Army Corps of Engineers (USACE) and the Environmental Protection Agency (EPA) define wetlands as: "Those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions."4 The USACE uses three parameters to identify jurisdictional wetlands. These parameters are as follows: 1) hydrophytic vegetation, 2) wetland hydrology, and 3) hydric soils. Except in certain atypical situations, all three parameters must be present in order for an area to be determined to be a jurisdictional wetland. Jurisdictional areas were delineated (flagged in the field), classified, and mapped with a sub -foot Trimble Geo7X GPS unit using the (USACE) Routine On -Site Determination Method. This method is defined in the 1987 Corps of Engineers Delineation Manual,' with further technical guidance from the 2012 Eastern Mountains & Piedmont Regional Supplement.' Data representative of on -site jurisdictional wetland areas and non -jurisdictional upland areas was collected and reported using Wetland Determination Data Forms (DP; Attachment A). Jurisdictional stream channels were classified (perennial, intermittent, or ephemeral) according to the North Carolina Department of Environmental Quality (NCDEQ) guidance based on biological, hydrological, and physical characteristics. These classifications include sampling Environmental Laboratory. 1987. Page 2 of 4 Old Mill Road Jurisdictional Delineation Report April 9, 2021 CWS Project No. 2021-0001 with a D-shaped dip net, collecting photographic documentation, and defining approximate breakpoints (location at which stream channel changes classification) within each on -site stream channel. NCDEQ Stream Classification Forms representative of on -site stream channels were used to document stream conditions (SCP; Attachment B). Representative photographs were taken of on -site jurisdictional features and existing site conditions (Attachment C). Locations of mapped wetlands and other waters, stream classification points, Wetland Determination Data Forms, and representative photographs are depicted on Figure 8. Results On March 31, 2020, Carolina Wetland Services, Inc. (CWS) scientists, Arnie Hoy, WPIT', and Sarag Ellingson, Staff Scientist I, delineated on site jurisdictional waters of the U.S., including wetlands. Based on the results of this field investigation, there are three jurisdictional waters of the U.S. located within the project boundary totalling approximately 0.46 acre. The potentially jurisdictional waters of the U.S. consist of two wetlands (Wetlands AA and BB) and one freshwater pond (Pond A). Table 2 summarizes the potential jurisdictional waters of the U.S. within the property. Table 2. Total Jurisdictional Waters of the U.S.: N/A 1 0.46 ac. Jurisdictional Wetlands Two jurisdictional wetlands (Wetland AA and BB) were delineated within the study area (Figure 8). Wetland AA consists of palustrine emergent and palustrine forested portions and is located in the south-central portion of the project limits (Photograph 1; DP1). The emergent portion of Wetland AA is dominated by soft rush (Juncus effusus) and shallow sedge (Carex lurida) in the herbaceous layer. Wetlands BB and a portion of Wetland AA are palustrine forested wetlands located in the south-central and southeastern portions of the project limits (Photographs 2 and 3; DP3). The forested portion of Wetland AA and Wetland BB are dominated by sweetgum (Liquidambar ' Wetland Professional in Training, The Society of Wetland Scientists Professional Certification Program. 8 Cowardin et al. Page 3 of 4 Old Mill Road Jurisdictional Delineation Report April 9, 2021 CWS Project No. 2021-0001 styraciflua), tulip poplar (Liriodendron tulipifera) in the sapling/shrub stratum, and soft rush, shallow sedge, sweet gum, and rattlesnake fern (Botrypus virginianus) in the herbaceous layer. Jurisdictional Open Waters There is one jurisdictional open water feature (Pond A) located within the property. Pond A is located in the southeastern portion of the project limits, and is approximately 0.37 acre in extent (Photograph 4). Pond A discharges via a pipe into Wetland BB. Non -Jurisdictional Areas No additional jurisdictional waters of the US were delineated within the project area (Figure 8). A Wetland Determination Data Form representative of non -jurisdictional upland areas is attached as DP2 (Photographs 5 and 6). Recommendations CWS recommends submitting the results of this delineation to the USACE for verification. Wetlands and other waters are present on the site, which are regulated by the USACE and/or NCDEQ. The jurisdictional delineation provided by CWS represents our best professional judgment regarding the boundaries of on -site wetlands, streams, and other water features that can be used for preliminary project planning. However, until a Jurisdictional Determination (JD) is issued by a regulatory agency (USACE), the delineation can only be considered preliminary and is not an official governmental approval. CWS recommends that before any construction or other earth disturbance activities occur on site, a formal JD should be obtained.
