The Division of Water Resources (DWR)'s Raleigh Regional Office concludes that the unauthorized bypass violated G.S. 143-215.1(a)(1) and Permit Condition Part II Section 2 (1) of Permit WQ0028552. Pursuant to G.S. 143 215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143 215.1. This office requests that you respond to this Notice, in writing, within ten (10) business days after receipt. A review of your response will be considered along with any additional information provided in the submitted report. You will then be notified of any civil penalties that may be assessed regarding the violations.
