Here is a quick history of what I found. Each line below has an associated file that will be attached to email. (I will be several emails because it is 40MB.) File name format will be "year month date description". 10/18/02: Original permit issued 8/15/03: D. Newsome certified that the pond was built appropriately. 3. 4/4/08: Permit modified to allocate impervious area to the various lots. No pond changes. 4. 2/24/16: Permit modified to reallocate impervious area. No pond changes. 5. 2/20/18: Permit renewed (no substantive permit changes, just a new expiration date). The Operation and Maintenance agreement starts on page 17 of this scan. Give this to your contractor. 6. 3/13/18: Notice of inspection 7. 4/30/18: Notice of inspection (follow up to 3/13/18) 8. 5/2/18: Summary diagram 1 - Excerpts of the 2002, 2008, and 2018 permitted plans and a photo of the extra pipe. 9. 5/2/18: Summary diagram 2 — Excerpt of the lot draining partially to your pond. The permit requires an engineer to certify/stamp that the pond was built appropriately, and Newsome did that in 2003 with no deviations noted on the form. The permit was modified twice (2008 and 2016) with no pond changes, as shown in the summary diagram provided for 48 above. The 3/13/18 inspection noted two pipes to the forebay as shown in the summary diagram. The summary diagram shows only one pipe into the pond in 2002, 2008, and 2016. Perhaps the pipe was added since the 2003 certification? I do not know. My letter originally asked that you revise the plans to show the second pipe (which makes the plan match the "ground".) But, if you don't want to do that a later letter asks that you plug the pipe so that here is only one pipe into the pond (which makes the "ground" match the plans.) As long as the "ground" and the plans match, and the pond is maintained you are fine. The package also included an application to modify SW8 070121 which will be formally accepted for review once the Transfer has been completed. In support of the permit transfer, the Division inspected both SW8 020502 and SW8 070121 on February 7, 2018, A letter requesting additional information was mailed on March 13, 2018, and a response was received on March 26, 2018. A second letter was mailed on April 18, 2018 and a response was received on April 26, 2018. The following summarizes the discussion to date. Please respond by May 15, 2018. SW8 020502, Schilsky Chiropractic Center: a. Maintenance Needed: i. 3/13 (DEMLR): Please maintain the pond per the enclosed O&M Agreement. (This agreement begins on Page 2 of the Wet Pond Supplement) The side slopes of the pond lack vegetative cover necessary to prevent erosion and rills are present of the western side slopes of the pond. The outlet pipe placement has resulted in a large scour hole, extremely erosive slopes and potential sediment damage to the adjacent wetlands. The presence of rills and scour hole at the outlet pipe appear to be the result of lack of maintenance. ii. 3/23 (Engineer): Dr. Schilsky has contacted his contracted pond maintenance firm to address the noted deficiencies we will notify your office when that work is complete. iii. 4/18 (DEMLR): Once the work is complete, please submit photos for the file. iv. 4/26 (Engineer): Maintenance is pending. v. 4/30 (DEMLR): Maintenance is pending. cs�.. or•,nraC.a�uf�.t' I -n .. rnt:-:Q� :-�. i':�I_;,Mi�t.-_.niil-;n ='aheng:onft.re Of'i r 112 State Stormwater Permit No. SW8 020502 & SW8 070121 Page 2 of 3 b. Minor Modification & Certification: i. 3/13 (DEMLR): An inlet pipe not shown on the approved plan was observed depositing into the forebay of the pond. Please apply for a minor modification to show the additional inlet pipe on the plan. (If the upcoming modification for SW8 070121 will impact the SW8 020502 plans, then please include those modifications as well.) The certification from August 15, 2013 is still valid for the current configuration. Please submit a partial certification showing that the new inlet pipe is installed to match the upcoming minor modification. ii. 3/23 (Engineer): The HDPE pipe to which you refer is "dormant" (not presently in use). We can only speculate that it was installed by the contractor to possibly facilitate serving the vacant lots across the street when/if they ever develop. If necessary, we can certainly modify the permit now as requested, however from our perspective, it makes more sense to wait until those lots are developed, as additional Permit Modifications would be necessary at that time. Please consider and advise. iii. 4/18 (DEMLR): If the pipe is not in use, is not currently needed, and you do not want to modify the permit now, then I recommend that you plug the pipe. If it is ever needed, then they can modify the permit to add it to the plans, and unplug it at that time. iv. 4/26 (Engineer): Your engineer did not have a problem plugging the pipe, but noted that it was already plugged on the upper end. v. 4/30 (DEMLR): I do not know where the "upper end" is located or who has control over that plug. For the sake of simplicity in establishing that that pipe isn't functioning, please plug that pipe. c. Master Table: i. 4/18 (DEMLR): The master table has been updated to clarify differences in lot numbers that are discussed in the next section of the letter. (It also clarifies some other items that I found during the review that are unrelated to the issue at hand, but will simplify things for you as you develop tracts in the future). Please review this table, and provide feedback if necessary. I will issue a permit correction to your permit, SW8 020502, concurrently with the offsite permit in review, SW8 070502. You do not need to apply for the correction or take any other action. ii.. 4/26 (Engineer): Your engineer reviewed the table and submitted comments. iii. 4/20 (DEMLR): See my minor modifications. 2. SW8 070121, Lot IA of Schilsky Chiropractic Center: a. Certification: i. 4/18 (DEMLR): The current permit is required to have been built in substantial conformance with the permit (see page 7 of the permit for the certification checklist). I do not see that this form has been submitted. Technically, a certification is a requirement for a permit transfer because permits must be in compliance to transfer and it has to be certified to be in compliance. However, since you have a pending modification for the project it does not make sense to certify the project in its current state and then shortly thereafter modify the permit causing it to have to be certified again. I recommend submitting a signed statement from the incoming permittee, Covert Operations of Jacksonville, LLC, attesting that they understand that they are accepting a permit transfer for a project that has not been certified and that they understand they will be responsible for certifying the project once it has been transferred to their name and constructed in configuration permitted under the upcoming modification. ii. 4/26 (Engineer): This item was not addressed. iii. 4/30 (DEMLR): Please address this item. 5t+r<^<:�. :,-t::c_a:r=lin.? I have been in a meeting all afternoon, and so I am just now getting around to voicemails. A tract in the subdivision has applied to modify its permit, and it drains to the pond that you received a permit for in 2002 (SW8 020502). Any time this happens, we do an inspection to make sure the pond is functioning. I talked to a man from Retention Pond Services on 3/19, and he seemed to be aware of the situation and was working on getting the maintenance resolved. The engineer, Dave Newsome, submitted a response on 3/26. 1 have not yet gone through what he sent in. But, it seems that the people you have working on it have been moving it forward. Once I have the opportunity to go through the information I received on 3/26 1 will be back in touch. We previously told them NOT to start work.... but obviously someone either didn't listen or didn't' understand. We will reiterate to them again that work should not proceed until the permitting complete. With regard to the second pipe into the forebay? I have no idea whatsoever. It looks to me that the pipe is not in use (i.e, Dry Pipe). Perhaps it was added to facilitate future growth on the north side of the project area? Anyway, like I said....) have no idea....but I have a call in to Dr Schilsky to ask him the purpose of the pipe .... who put it in....and when. The package also included an application to modify SW8 070121 which will be formally accepted for review once the Transfer has been completed. In support of the permit transfer, the Division inspected both SW8 020502 and SW8 070121 on February 7, 2018. Please find a copy of the completed form for each permitted facility entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. The following items are needed. Please respond by Apri113, 2018. SW8 020502, Schilsky Chiropractic Center: a. Maintenance Needed: Please maintain the pond per the enclosed O&M Agreement. (This agreement begins on Page 2 of the Wet Pond Supplement.) The side slopes of the pond lack vegetative cover necessary to prevent erosion and rills are present of the western side slopes of the pond. The outlet pipe placement has resulted in a large scour hole, extremely erosive slopes and potential sediment damage to the adjacent wetlands. The presence of rills and scour hole at the outlet pipe appear to be the result of lack of maintenance. b. Minor Modification Needed: An inlet pipe not shown on the approved plan was observed depositing into the forebay of the pond. Please apply for a minor modification to show the additional inlet pipe on the plan. (If the upcoming modification for SW8 070121 will impact the SW8 020502 plans, then please include those modifications as well.) c. Certification: The certification from August 15, 2013 is still valid for the current configuration. Operation and Maintenance Agreement (O&M): On file (document signed on 4/30/02 still valid) ii. Deed Restrictions: Deed restrictions for the lots that have been constructed and are required to have deed restrictions have been recorded. See the Master Table for SW8 020502. (Please be reminded that Lots BI (previously Lot 2) and Lot I are not currently constructed, but these lots will need to have deed restrictions recorded prior to sale.) SW8 070121, Lot IA of Schilsky Chiropractic Center: a. General: I have not yet reviewed the modification application. But, in quickly glancing through it, it appears that the permit will be split into two drainage areas. The portion of the project that will continue to drain to the SW8 020502 (Lot IA) appears to maintain the impervious area allocated to Lot 1A, 43,746sf. A second drainage area will be added to treat an additional 7,875sf of impervious area in a stormwater wetland. The new drainage area will be "onsite treatment" for SW8 070121. The application says that the runoff from the second drainage area will be diverted to and treated by a new stormwater wetland on Lot 1B. However, there is not a "Lot 1B" on the master permit, SW8 020502. It does not appear that the project area for SW8 070121 is expanding. The current (2008) plans show that the project area is 2.04ac, and the proposed application shows that the project area will be 2.03ac (with is likely off slightly due to rounding.) SW8 070121 is currently on Lot IA. i. Please verify that "Lot 1B" will be located inside what is currently permitted as "Lot lA". ii. Assuming Lot I will be subdivided into Lots lA and 1B, will Covert Operations of Jacksonville, LLC retain ownership of both lots? If so, you are not required to deed restrict the two lots. However, you are strongly encouraged to do so if you think that there is any possibility of selling either lot in the future because you will have to modify your permit to have it subdivided and deed restricted prior to sale. It is much easier to set up this possibility on the front end than after -the -fact. b. Inspection: The inspection found that the existing site conditions differ from the approved plans. It appears that the landscape island on the northwest side of the building has been removed and additional parking spaces have been installed. Additionally, the number of approved parking spaces on the southeast side of the building have been reduced and the landscape island appears to have been increased in area. Construction of additional impervious area on Lot IA was underway at the time of this inspection. i. Please be advised that Section II(10) of the permit dated April 4, 2008 requires a certification from an appropriate designer certifying that the permitted facility has been installed. This certification has not been received. Please be advised that you will be responsible for the certification once you become the permittee. ii. Please be advised that you are required to obtain a State Stormwater permit prior to installation of impervious surfaces other than the currently -permitted configuration.
