In accordance with the requirements of NCAC 2H.1000 (the stormwater rules), only those projects that are required to receive either an Erosion and Sedimentation Control Plan approval. for the disturbance of greater than 1 acre, or a CAMA Major Permit, or which add more than 10,000 square feet of new built -upon area, must submit for and receive a Stormwater Management Permit prior to construction. In this case, the plans stamped, signed and sealed on November 6, 2014, by your consultant, Stephen J. Ballentine, P.E., indicates that the project has not triggered any of the submittal requirements. The project does not currently hold a State Stormwater permit, it is not part of a common plan of development, it does not need an Erosion and Sedimentation Control plan approval, it does not require a CAMA Major Development Permit, and it is not proposing more than 10,000 square feet of new built - upon area, therefore, the Division is providing confirmation that the project is not subject to the State Stormwater requirements at this time. The project is within the drainage area of a BMP previously approved under permit number SW8 960918, issued to Mr. Edwin Ennis on December 13, 2013. Under that permit, the amount of built -upon area treated by the .pond from the redeveloped McDonald's site is limited to a maximum of 33,250 square feet. Based on the engineered plans, the proposed amount of built -upon area for this McDonald's is 29,663 square feet. Please keep in mind that this determination applies only to the current activity. If a CAMA Major Permit is required in the future, or if future disturbance occurs such that an Erosion and Sedimentation Control Plan is required, or if the construction of new impervious surfaces in excess of 10,000 square feet occurs, the project will be deemed subject and must submit a Stormwater Management Permit application prior to any construction.
