On November 6, 2020, Wilmington Regional Office staff of the Division of Energy, Mineral and Land
Resources (DEMLR) performed a Compliance Inspection of the subject project, located at Freedom Way,
Onslow County, North Carolina. The inspection was performed to determine the status of compliance
with Stormwater Permit Number SW8 980808 issued to you on November 2, 1998.

The project has been found in violation of Stormwater Permit Number SW8 980808; issued pursuant to
the requirements of the stormwater rules, I SA NCAC 2H.1000. The violations found are:
1. Failure to Mods the Permit. The SW8 980808 low density permit was issued based on a 111.16
acre project area, which Ms. Howard owned at the time the permit was issued. Per Design
Condition I.12 of the permit, further subdivision of the project area requires that the permit be
modified. Several parcels out of that 111.16 acre tract have been subdivided and conveyed to the
various entities listed below, all without benefit of approval from the Division to modify the
permit. The remaining acreage for low density is ±72.74 acres as reflected on the current Onslow
County GIS record for this parcel. Four of the parcels have been re -permitted, without
modification to this permit.
a. Robert & Debbie Fisher — 1.00 acre on January 26, 1999;
b. Onslow County — 0.92 acres on March 18, 2003;
c. Robert & Deborah Fisher — 4.24 acres on July 20, 2004; SW8 041225
d. ABJK, LLC — 10 acres on February 2, 2006;
e. Titan Carolina Concrete, LLC —10.05 acres on August 16, 2007; SW8 070210 (issued to
Two -Ten Investors, Inc.)
f. Deep Creek Landing, LLC — 2.37 acres on April 2, 2013; SW8 130806
g. Sharon Howard Quinn — 0.58 acres on April 18, 2016;
h. Robert & Deborah Fisher — 7.65 acres on December 6, 2017;
i. Robert & Deborah Fisher —1.40 acres on November 26, 2018; SW8 180302
A separate new permit application must be submitted under the 2017 rules if any "subject"
development has occurred within their parcel after ownership of the parcel was conveyed. Parcels
that have a permit already or do not have additional development, need to be transferred to the
new property owner or simply update the mailing address.
2. Failure to Operate and Maintain the Stormwater System. Per Section H Schedule of Compliance
#2, the Permittee shall provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The site is not utilizing sheet flow or
vegetated conveyances in the location of the asphalt and rock stockpiles, as detailed in the current
permit documents. Please note that the ability to utilize sheet flow and vegetated conveyances
will not be sufficient to meet the minimum treatment requirement if the density within the 10 acre
project area exceeds 12%.
As also stated in the permit, the approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals, including, but not limited to:
• Routine monthly inspections;
• Sediment Removal;
• Mowing and re -vegetation of side slopes;
• Immediate repair of eroded areas;
• Maintenance of side slopes in accordance with the approved plans and
specifications;
e Debris removal and unclogging of the outlet structure, orifice device and
catch basins and piping;
• Access to the outlet / bypass structure must be available at all times
To correct these violations you must:
1. Submit applications for modification of the original permit area.
2. The areas that have sybsequent permits need to be removed from this permit.
The Fisher tracts should be revised to include all development after 1998. The front metal
buildings and the associated parking lots are phased development in conjunction with SW8
041225 Fisher Rentals. The Fisher Rentals permit must be brought into compliance with the
permit including revising the plan to match field conditions and installation of stormwater
control measures.

4. The asphalt plant area must revise the plan or submit a new permit application to accommodate
the density of the area.
Please provide a "Plan of Action" by January 1, 2021 to DEMLR that states how and when these
violations will be corrected. If we do not receive your plan of action by this date you will be in violation
of 15A NCAC 2H.1000, which could result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Onslow County Building Inspector, this office is requesting that the Building
Inspector consider withholding building permits and Certificates of Occupancy for this project until this
matter is satisfactorily resolved.

standard 7. The permit requires revised plans anytime there is any revision to the approved plans

Other areas of the permitted area have been developed with other stormwater permits or without
stormwater permits. Fisher properties have additional permits: SW8 180302 (not constructed post offic
and SW8 041225 (not constructed according to plans). The two metal buildings on the Fisher Properti
should have been included in thier SW8 041225 permit as phased development. Those properties will
need to find a permitting solution.
The Titan Carolina Concrete LLC Property is permitted under SW8070210, which will need to be
transferred.
Deep Creek Landing LLC obtained SW8130806. The SW8 980808 permit should have been modified
exclude these areas.

Dear Ms. Howard and Mr. Brown:
On March 11, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project, located at Waterfront Road in Onslow County to
determine the status of compliance with State Stormwater Management Permit Number SW8
980808 issued to you on November 2, 1998. DEMLR file review and site inspection revealed that
the site is not in compliance with the terms and conditions of this permit. A copy of the March 11,
2019 inspection report was mailed to you on March 12, 2019. This letter provides further
clarification to the March 12, 2019 letter. Please note the following additions and revisions to the
previous letter:
The SW8 980808 low density permit was issued based on a 111.16 acre project area, which Ms.
Howard owned at the time the permit was issued. Per Design Condition 1.12 of the permit, further
subdivision of the project area requires that the permit be modified. Several parcels out of that
111.16 acre tract have been subdivided and conveyed to the various entities listed below, all without

The original 1998 stormwater permit application indicates that Ms. Howard is the legally responsible
party for the facility, i.e., the proposed asphalt plant. However, it now appears that she was the
owner of the 111.16 acre property and leased part of the property to Onslow Asphalt, Inc. for the
asphalt plant. In 2006, Ms. Howard sold a 10 acre parcel containing the asphalt plant to ABJK, LLC.
Please submit a modified application by May 12, 2019, for the current SW8 980808 permit, which
reflects the loss of 38.42 acres of project area and which includes any development within the
remaining 72.74 acre tract that has occurred and is not shown on the current approved plans.

The Division will contact each owner of the nine parcels that were subdivided and sold from the
original 111.16 acre tract as noted above, about the requirement to submit a separate new
stormwater permit application under the 2017 rules if any "subject" development has occurred
within their parcel after ownership of the parcel was conveyed. For those projects that have a permit
already, some may need to be transferred to the new property owner or simplyupdate the mailing
address.
ABJK, LLC will need to apply for a separate new permit. That site is not being maintained in
accordance with the SW8 980808 approved plans. The site is not utilizing sheet flow or vegetated
conveyances in the location of the asphalt and rock stockpiles, as detailed in the current permit
documents. Please note that the ability to utilize sheet flow and vegetated conveyances will not be
sufficient to meet the minimum treatment requirement if the density within the 10 acre project area
exceeds 12%. The Division is requesting that ABJK, LLC submit a new permit application to the
Division by May 12, 2019 for their 10 acre parcel.
Please be advised that until a Permit Transfer Application Form is submitted to the Division and the
Division approves the transfer of the permit, the permittee is required to comply with the terms,
conditions and limitations of the Stormwater Management Permit SW8.980808 issued under Title
15A NCAC 02H.1000 and North Carolina General Statute 143-214.7, including the requirement to
maintain overall low density, to modify the permit prior to the subdivision and sale of the property,
and to notify the Division of any change of ownership or mailing address.
Failure to provide the requested information, or to respond to this letter with a plan of action,
including a timeline to resolve the identified deficiencies, by May 12, 2019, are considered violations
of the permit. If the requested information is not submitted to this office by the due date, then
DEMLR staff will re -inspect the site and may issue a Notice of Violation. Please also note that any
individual or entity found to be in noncompliance with the provisions of a stormwater management
permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21,
including the assessment of civil penalties of up to $25,000 per day.

Dear Ms. Howard:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for compliance with
the permit.
On March 11, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project, located at Waterfront Road in Onslow County to
determine the status of compliance with the State Stormwater Management Permit Number SW8 980808
issued on November 2, 1998. DEMLR file review and site inspection revealed that the site is not in
compliance with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Onslow Asphalt, Inc is dissolved. Please submit a permit transfer application form.
2. Additional development has occurred within the original limits of the permit. The original permit
accounted for 110 acres. Development on parceled land must be submitted as a revised plan.
3. The asphalt plant has not maintained treatment for the stormwater. The permit application
details sheet flow in the location of the asphalt and rock stockpiles and for vegetative conveyance.
Submit revisions in best management practices.

Please be reminded that it is your responsibility as the permittee of record to submit a completed and
signed Permit. "Transfer Application Form to the Division of Energy, Mineral and Land Resources 30-60
calendar days prior to making any of the below listed changes. This form is available on our website at:

a. An ownership change including the sale or conveyance of the permitted project area in whole or
in part. This does not include the conveyance of subdivided residential lots to individuals which
are made subject to a recorded declaration of covenants and restrictions which contain the
statements required by the stormwatcr permit;
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association, subject to the requirements of Session Law 2011-256;
c. Foreclosure proceedings;
d. Filing for Bankruptcy;
e. Dissolution of the partnership, corporate entity or LLC. Per NCGS 57D-6-07, a dissolved LLC
shall wind up, which may include continuing the business of the LLC for a period of time. The
person charged with winding up the LLC shall collect the LLC's assets [which include the
stormwater management permit], and distribute the assets as provided in NCGS 57D-6-08(2).
f. A name change of the owner / permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
Please be advised that until you submit the required Permit Transfer Application Form to the Division and
receive approval from the Division to transfer the permit, you are required to comply with the terms,
conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina
Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation
and maintenance of the permitted stormwater system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by March 31, 2019, are considered violations of the permit.
If the requested information is not submitted to this office'by the due date, then DEMLR staff will re-
inspect the site and may issue a :Notice of Violation. Please also note that any individual or entity found to
be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is
subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of civil
penalties of up to $25,000 per day.
