The Wilmington Regional Office,received a complete Stormwater Management Permit Application for
New Beginning Christian Church on May 17, 2013 with additional information submitted on June 6, 2013.
Staff review of the plans and specifications has determined that the project, as proposed, will comply with
the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are
forwarding Permit No. SW8 130208 dated June 11, 2013, for the construction, operation and
maintenance of the BMP's and built -upon areas associated with the subject project.
This permit shall be effective from the date of issuance until June 11, 2021, and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the conditions listed in this
permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions,
procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management system, to
record deed restrictions, to transfer -the permit, or to renew the permit, will result in future compliance
problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conforms to Chapter 150B of the North Carolina General Statutes, and
per NCGS 143-215(e), must be filed with the OAH within thirty (30) days of receipt of this permit. You
should contact the OAH with all questions regarding the filing fee (if a filing fee is required) and/or the
details of the filing process at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at
919-431-3000, or visit their website at www.NCOAH.com. Unless such demands are made this permit

Carolina as amended, and other applicable Laws, Rules, and Regulations

FOR THE
construction, operation, and maintenance of an overall 24% low density development with
one (1) wet detention pond to treat a new high density parking lot, in compliance with the
provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter collectively referred
to as the "stormwater rules') the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until June 11, 2021, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data. The site area is described as
Tract 2 of the Recombination of Tracts for New Beginning Christian Church, recorded
with New Hanover County, signed and dated April 22, 2013. Tract 1 built -upon area
was originally constructed before 1988, when State Stormwater rules took effect, and
is therefore excluded from this permit.
2. The overall tract built -upon area percentage for the project must be maintained at or
below 24% per the requirements of Section .1005 of the stormwater rules. This
project is permitted for a maximum of 59,931 square feet of BUA, which is comprised
of 39,148 square feet in the pocket of high density, and 20,783 square feet in the low
density section. The amount of BUA remaining for future development is 127,621
square feet in keeping with the rules for this overall !ow density pen -nit.
3. The stormwater systems proposed to treat the runoff generated by the designated
high density areas have been approved for the management of stormwater runoff as
described in Section 1.7 on page 3 of this permit. The stormwater control has been
designed to handle the runoff from 39,148 square feet of impervious area.
4. The project shall maintain a 50' wide vegetative buffer adjacent to surface waters,
measured horizontally from and perpendicular to the normal pool of impounded
structures, the top of bank of both sides of streams and rivers and the mean high
water line of tidal waters.

5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
6. Within the low density portions of the permitted project, the only runoff conveyance
systems allowed will be vegetated conveyances such as swales with minimum side
slopes of 3:1 (H:V) as defined in the stormwater rules and as shown on the approved
plan.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. Nobody shall fill in, alter, or pipe any drainage feature (such as swales) shown on the
approved plans as part of the stormwater management system without submitting a
revision to the permit and receiving approval from the Division.
4. The permittee is responsible for verifying that the proposed built -upon area for the
project does not exceed the maximum allowed by this permit.
5. The permittee shall, at all times, provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The signed
and approved Operation and Maintenance Agreement must be followed in its entirety
and maintenance must occur at the scheduled intervals.
6. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
6. Decorative spray fountains will not be allowed in the wet detention pond.

7. The runoff from all built -upon area within the drainage area of the area of higher
density must be directed into the permitted stormwater control system.
8. Within the low density area, all roof drains shall terminate at least 50 feet from the
mean high water mark of surface waters.
9. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
11. If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
12. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.
13. The permittee shall submit to the Director and shall have received approval for
revised plans, Specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The protect area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
14. Prior to the construction of any permitted future areas shown on the approved plans,
the permittee shall submit final site layout and grading plans to the Division for
approval.
15. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
16. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit. A copy of the approved plans and specifications
shall be maintained on file by the Permittee at all times.
17. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel. The facility must be in compliance with all permit conditions. Any items not
in compliance must be repaired or replaced to design condition prior to the transfer.
Records of maintenance activities performed to date may be required.

III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Water Quality at least 60 days prior to any one or
more of the following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part;
b. Bankruptcy;
c. Foreclosure;
d. Dissolution of the partnership or corporate entity;
e. A name change of the current permittee;
f. A name change of the project;
g. A mailing address change of the permittee;
2. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request.
3. Any individual or entity found to be in noncompliance with the provisions of this
storrmwater management permit or the requirements of the Stormwater rules is
subject to enforcement procedures as set forth in G.S. 143 Article 21.
4. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, ruies, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or renewed.
The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and re -issuance or termination does
not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

Thank you for your call today. Per our conversation this is the timeline which we have been able to
obtain for the existing Church Site.
• The site was in the 6o's Wrightsboro Academy. At some Point between the 6o's and early 7o's
the site was occupied by Wrightsboro Private Schools, Inc.
• In July of 1974 Wrightsboro Private Schools, Inc. sold the site to the Wilminton Jaycees, Inc.
• The Jaycees kept the site until November of 83 in which they sold it to the Hendersons.
• The Henderson family sold the site to the Rock Church in October of go.
This is the timeline of what we were able to find up to now proven by deeds. The site acted as a school
in the 6o's up into mid 70's. This school would have had parking and access as necessary. The site
continue to be used by the Jaycees from 74-83. The Jaycees are known for gatherings and meetings
and therefore would also have needed parldug accordingly. The Jaycees sold to the Henderson family
and eventually the Henderson Family sold to the Rock Church in i99o. From the NBCC Pastor
Campbell's discussions with the previous Rock Church personnel, the Rock Church occupied the old
school building and renovated the existing building to be used for their services.
I feel like there is some solid evidence that the existing Church Site should be considered as it's own
site and not part of the proposed permit.

Please be advised that a copy of the approved soil erosion plan and a copy of the issued grading permit
must be available at all times at the site.
New Hanover County's Erosion and Sedimentation Control Program is performance oriented requiring
protection of the natural resources and adjoining properties. If following the commencement of the project, it is
determined that the plan is inadequate to meet the requirements of the New Hanover County's Erosion and
Sedimentation Control Ordinance, this office may require revisions in the plan and its implementation to insure
compliance with the ordinance.

Hopefully, the letter from New Hanover County authorizing the reconstruction will help to tie it to the pre-88 original
construction. This may be all we need in order to permit the project as is. If you can find other information such as a

In the February letter it was my assumption that it was built prior to 88. I will do my best to find out
the exact date that it was built. Please know the original site was built by a different owner and had
nothing to do with the site we are proposing at this time. The original church burned down and the
current owner did rebuild the church in a similar footprint as to the original as authorized by NH
County.
I can obtain a letter which authorized the Church to be reconstructed in the original footprint.
Please give me till Tuesday to obtain this information.

Charlie,
In your response received May 17, you stated that the existing church and parking area were an offsite parcel built in the
early 90's, not part of our requested permit. Earlier, on Feb. 5, you stated that the original church was built prior to
1988 and that it's reconstruction was reviewed and accepted by New Hanover County.
It seems to me that the existing church and the new parking and drive are now a common plan of development.
However, if the old church / parking was built prior to 1988, then it can be ignored unless it drains to the new pond,
which it doesn't. So, please verify when the old church was built and/or provide a notice from the County about its
approval of the reconstruction.

The Wilmington Regional Office received and accepted a State Stormwater
Management Permit Application for New Beginning Christian Church on February 25,
2013. A preliminary in-depth review of that information has determined that the
application is not complete. The following information is needed to continue the
stormwater review:
Currently, the New Hanover County website shows this property (R3308-
002-009-000) to be 11.67 acres. Your drawings show that a large part of
another tract is included with this tract. The other tract (parcel # RI3300-
003-001-000) is 51.69 acres according to the County records. Please
submit a copy of the deed for the 17.94 ac tract, developed with the help
of the surveyor. As you stated, the applicant is purchasing a portion of the
51.69 acres. This portion will be recombined with part of the 11.67 ac
tract to create a parcel with a total of 17.94 ac as shown on our plan. This
was under contract prior to us submitting the plans and it is scheduled to
close on April 1, 2011
2. Please submit a copy of the swale velocity calculations for all swales on
this project.
Please remember that a change to one number may have a domino effect on other
numbers. Please check all plans, calculations and forms to ensure that the numbers are
consistent throughout.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to April 30,
2013, or the application will be returned as incomplete. The return of a project will
necessitate resubmission of all required items, including the application fee.

New Beginning Christian Church is a proposed 17.94 acre tract located in New
Hanover County, NC. The tract is currently vacant and used for agriculture. The site is
bordered by Alex Trask Drive to the West, Blue Clay Road to the Bast, Residential to the
North, and farm land to the South. The site proposes a parking lot of ioo spaces and 20'
asphalt drive for access to Blue Clay Road. The parking lot is being viewed as a pocket of
high density and therefore provided a Wet Pond for stormwater treatment. The site has
anexisting impervious surface of o s.f nd propose 59,931 s.f. f impervious surface for
the parking and drive. The proposed percent impervious for the site is 7.67%. l.;A.wk A4,e J
Runoff will be directed to a wet detention pond by means of 3:1 grassed swales.
The majority of the runoff from the proposed parlcng lot •r'lill be directed by sheet flow
to curb cuts located along the western parking bay. The curb cuts will direct runoff into
the 3:1 grassed swales, which direct the stormwater to the wet pond. The wet pond has
been designed to treat the 1.5" runoff and 25Yr 24hr pre -post requirements. Runoff
from the site is discharged to Ness Creek QSW Index#18-74-62.

the above referenced project. We are addressing your comments from your letter dated
February 8th, 2013 regarding application return.
1. Existing Church: In your resubmittal please include a discussion regarding why
the existing church was not included in the project area for this submittal.
Google Earth shows that there was a building on the tract in 1998, that the
building was torn down by 2002 leaving the parking lot in -tact, and that a new
building has been built on the track since 2010. It is unclear when the original
building was built. Was the church built prior to 1988 such that it was not
subject to permitting, or was it built in such a way since 1988 that it did not
require a pennit? If there was a building in place on the tract prior to 1988, how
does the pre-1988 impervious area and drainage pattern compare to the
proposed impervious area and drainage pattern? If there was no increase in
impervious area on a tract constructed prior to 1988 and if the stormwater
treatment is equal or better than the pre-1988 conditions, then the church tract
with the original parking lot could qualify for a redevelopment exclusion. If the
church tract does not qualify for a redevelopment exclusion, the please contact
our office to determine how to proceed. Some impervious area will likely have to
be treated if that is the case.
• The original building was constructed ujior to 1 88. The original building
was lost due to a fire. The current building was constructed back with a
similar footprint. This building and parking area are on a separate lot and

requested to remain. These items were reviewed and accepted by New
Hanover County prior to the building being built back.
2. Stream: If there is a stream on the property please label the stream with the tops
of bank, and provide the appropriate buffers.
• No stream on site per SEGI (Southern Environmental Group, Inc.)
3. Wet Pond: I understand that the wet pond will be installed on this overall low
density project because the project collects the parking lot with curb and gutter
and because the proposed development does not locate the impervious areas in
upland areas and away from surface waters and drainageways per 2oo8-211,
Section 2(b), (3)(a)(1). Please locate the permanent pool within six inches of the
SHWT. Please see page 10-2, # 19 of the BMP Manual for further details.
• The pond has been revised to meet SHWT 6" separation. Please find

Drive, near Wrightsboro, New Hanover County, North Carolina. There is an existing church building
located at the northwestern end of the proposed project.
Our firm visited the site in order to estimate the seasonal high water table level at the site of a proposed
stormwater pond (see attachment).
The proposed pond location is currently a cultivated farm field. A hole was dug at one location within the
location of the proposed pond to a depth of 50 inches. The soil colors were measured using a Munsell
Soil Color Chart. From the. soil surface down to 20 inches the soil consisted of black sandy loam. From
20 to 34 inches, the soil consisted of very dark gray sandy loam. At 34 inches, the soil changed to gray
sandy clay loam, with common yellowish brown mottles. After 15 minutes, the depth to standing water
in the hole was measured at 36 inches below the ground surface.

On February 1, 2013, the Division received an incomplete State Stormwater Management Application for the project
listed above. The application and check number 10243, in the amount of $505 are being returned because the
application package lacked the necessary elements to accept it for review. Please provide the following information
upon the next submittal of this application package:
Existing Church: In your resubmittal please include a discussion regarding why the existing church was not
included in the project area for this submittal. Google Earth shows that there was a building on the tract in
1998, that the building was tom down by 2002 leaving the parking lot in -tact, and that a new building has
been built on the tract since 2010. It is unclear when the original building was built. Was the church built
prior to 1988 such that it was not subject to permitting, or was it built in such a way since 1988 that it did not
require a permit? If there was a building in place on the tract prior to 1988, how does the pre-1988
impervious area and drainage pattern compare to the proposed impervious area and drainage pattern? If
there was no increase in impervious area on a tract constructed prior to 1988 and if the stormwater
treatment is equal or better than the pre-1988 conditions, then the church tract with the original parking lot
could qualify for a redevelopment exclusion. If the church tract does not qualify for a redevelopment
exclusion, then please contact our office to determine how to proceed. Some impervious area will likely
have to be treated if that is the case.
2. Stream: If there is a stream on the property please label the stream with the tops of bank, and provide the
appropriate buffers.
3. Wet Pond: I understand that the wet pond will be installed on this overall low density project because the
project collects the parking lot with curb and gutter and because the proposed development does not locate
the impervious areas in upland areas and away from surface waters and drainageways per 2008-211,
Section 2(b), (3)(a)(1). Please locate the permanent pool within six inches of the SHWT. Please see page
10-2, #19 of the BMP Manual for further details.

application package should be submitted to the appropriate DWQ Office. (The appropriate office may be

BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and

Wet Detention Basin Operation and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record. will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.

V. -SWALE SYSTEM MAINTENANCE REQUIREMENTS
1. Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time; and grass will not be mowed too close to the ground or "scalped".
2. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up,
erosion, and trash accumulation.
3. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded
following sediment removal.
4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a
timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope.
5. Catch basins, curb cuts, velocity reduction devices, 'and piping will be inspected monthly or after every
significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts,
velocity reduction devices and piping.
6. Swales will not be altered, piped, or filled in without approval from NCDENR Division of Water Quality.

showing the SHWT? I did not see that in the package. The PP is at 30.25msi, but the SHWT is at 30.95msi (more than 6in
apart)? Also, have you already been working with someone here about putting the development "in upland areas away
from drainageways...etc" such that the pond is being installed? If not, that is fine, I just wanted to make a note on my

New Beginning Christian Church is a proposed 17.94 acre tract located in New
Hanover County, NC. The tract is currently vacant and used for agriculture. The site is
bordered by Alex Trask Drive to the West, Blue Clay Road to the Bast, Residential to the
North, and farm land to the South. The site proposes a parking lot of 10o spaces and 20'
asphalt drive for access to Blue Clay Road. The parking lot is being viewed as a pocket of
high density and therefore provided a Wet Pond for stormwater treatment. The site has
an existing impervious surface of o s..f and proposes 59,931 s.f. of impervious surface for
the parking and drive. The proposed percent impervious for the site is 7.67%.
Runoff will be directed to a wet detention pond by means of 3:1 grassed swales.
The majatity of the ranoff f-Lom the proposed parking lot will be directed by sheei low
to curb cuts located along the western parking bay. The curb cuts will direct runoff into
the 3:1 grassed swales, which direct the stormwater to the wet pond. The wet pond has
been designed to treat the 1.5" runoff and 25Yr 24hr pre -post requirements. Runoff
from the site is discharged to Ness Creek C;SW Index#18-74-62-.
