Skvarla, III Secretary The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Deer Crossing on May 20, 2013. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000, effective September 1,1995. We are forwarding Permit No. SW8 000245, dated June 17, 2013, for the construction of the built -upon area associated with the subject project. Modifications Include: Reallocating impervious area as specified in Table A. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, and transferring the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, or to transfer the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. Each of the 139 lots is limited to a maximum amount of built -upon area (BUA) as indicated in Section 11.10 of this permit. 2. The overall tract built -upon area percentage for the project is limited to a maximum of 30% per the requirements of the stormwater rules. This permit covers the construction of a total of 808,909 square feet of built -upon area, which includes 543,458 square feet of proposed BUA, and 265,451 square feet of future BUA allocation per Table A, which is attached as the last page of this permit. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. Projects covered by this permit will maintain a minimum 50-foot-wide vegetated buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers, and the mean high water line of tidal waters. 5. All runoff directed into and through the vegetative buffer must flow through the buffer in a diffuse manner. All runoff directed into wetlands shall flow Into and through the wetlands at a non -erosive velocity of 2 feet per second or less. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. II. SCHEDULE OF COMPLIANCE Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. The permittee shall at all times provide and perform the necessary operation and maintenance procedures as specified in the signed Operation and Maintenance Agreement, such that the permitted stormwater management system functions as designed and permitted. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any of the items shown on the approved plans, including the stormwater management system, design concept, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further subdivision, acquisition, or sale of the project area in whole or in part. d. Filling in, altering or piping any vegetative conveyance shown on the approved plan. e. Construction of any future development area on the plan with a BUA allocation. 5. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 6. No piping shall be allowed except that minimum amount necessary to direct runoff beneath an impervious surface such as a road and that minimum amount needed under driveways to provide access to lots. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built - upon area. Once the lot transfer is complete, the maximum allocated built -upon area for the lot may not be revised without approval from the Division of Water Quality. If the allocated maximum built -upon area on the lot is exceeded, the permittee shall notify the lot owner in writing and shall require remediation within a reasonable time frame. If the situation is not remediated, both the permittee and the lot owner are subject to enforcement action by the Division of Water Quality. 8. Within 30 days of completion of the project, the permittee must certify in writing that the projects stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. 9. If the permittee sets up an Architectural Review Committee or Board to review new lot plans and subsequent modifications for compliance with the provisions of this permit and the restrictive covenants, the plans reviewed must include all built -upon area (BUA) and piping. Any approvals given by the Committee or Board on behalf of the permittee do not relieve the lot owner or the permittee of the responsibility to maintain compliance with the permitted lot BUA limit. 10. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the Register of Deeds prior to the sale of any lot. Recorded deed restrictions must include, as a minimum, the following statements related to stormwater management: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 000245, as issued by the Division of Water Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. f. The maximum built -upon area per lot is as specified in Table A. This allotted amount includes any built - upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the water surface of swimming pools. g. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. h. For those lots adjacent to surface waters, each lot will maintain a minimum 50 foot wide vegetated buffer adjacent surface waters. i. All roof drains shall terminate at least 50 feet from surface waters. Page 3 of 6 State Stormwater Management Systems Permit No.SW8 000245 Any individual or entity found to be in noncompliance with the provisions of the stormwater management permit or the requirements of the stormwater rules found in 15A NCAC 02H.1000 and Session Law 2008-211, is subject to enforcement procedures as set forth in N.C.G.S.143, Article 21. 11. The permittee shall submit a copy of the recorded deed restrictions, which contain all of the above statements, within 30 days of the date of recording. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. All stormwater conveyances will be located in either a dedicated right-of-way (public or private), recorded common areas or recorded drainage easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. III. GENERAL CONDITIONS Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. The permit issued shall continue in force and effect until modified, revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143- 215.1 et. al. 5. The permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and re -issuance of the permit to change the name and incorporate such other requirements as may be necessary. At least 30 days prior to a change of ownership, or a name change of the permittee or of the project, or a mailing address change, the permittee shall submit a completed and signed Name/Ownership Change Form to the Division of Water Quality accompanied by the supporting documentation as listed on the form. The approval of this request will be considered on its merits, and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the permit transfer request. Neither the sale of the project nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state and federal), which have jurisdiction. If any of those permits result in revisions to the plans, a permit modification must be submitted. 8. The permittee grants permission to DENR Staff to enter the property during business hours for the purposes of inspecting the stormwater management system and its components. 9. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. Grass height will not exceed six inches at any time; and grass will not be mowed too close to the ground or "scalped". 2. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up, erosion, and trash accumulation. 3. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded following sediment removal. 4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope. 5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every significant runoff producing rainfall event. Skvarla, III Secretary The Wilmington Regional Office received and accepted a modified State Stormwater Management Permit Application for Deer Crossing on My 3, 2013. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Permitted Areas on the Plans: The current permit issued in January 2013 has various pieces labeled as drainage areas (DAs), which was done in order to be consistent with the 2007 permit terminology. The three DAs are DA1 (Enchanted Oaks, Formedy Townhomes), DA2 (Other Single Family), and Conservation Area. However, after reviewing Phase 3 plans from the county it is clear that the DAs need to be shown and labeled on the plans so that the various areas referred to in the permit text can be easily referenced on the plans because the DA lines to not appear to line up with the phase lines. For instance, Phase III is shown to be 7.41 ac on the plans submitted but this area is not equal to the area of any of the phases submitted. When I received the county's plans earlier this month, I went through the New Hanover County GIS data to pull the parcel sizes for the various DAs (enclosed). The county data is slightly different from the permitted data. Generally when this happens, the plans are more accurate because they are based on survey. We need to show the various DAs on the plans with their respective areas in order to more clearly document what is permitted. This will more accurately show the project area and impervious area that is allowed for future phases of this development. 2. Project Area: The total project area is shown on the application and the plans to be 61.9ac (which is consistent with the January 2013 and the August 2007 permits), but the individual drainage areas (1,679,673 +204,296 +1,475,377sf=3,359,346sf=77.12ac). This same error was discovered after the permit was issued on January 14, 2013, a permit correction was issued on January 22, 2013 correcting the issue. The data from the correction is summarized in the enclosed table. Why is the project area again shown to be 77.12ac rather than 61.9ac? (On a related note, the project area from the original permit in 2000 was 63.77ac. The project narrative received on 5/3/13 also shows 63.77ac. Maximum Percent Impervious: The current permit from January 2013 and the 2007 permit both limit the overall imperious area to 30%. (As discussed in the impervious area summary, the 30 % was actually done in error in 2007 because the project is within a half mile of and draining to SA waters and so it should have been limited to 25% overall.) This permit is written under the 1995 rules, which allowed for pockets of high density (POND) up to 10% over the allowed maximum. The allowed percentages are summarized in the enclosed table. The current permit application is in excess of the allowed amounts. Each drainage area must stay within 35% in order not to trigger a POHD and therefore not need a structural stormwater BMP. Additionally, the total imperious area percentage must stay within 30% imperious in order to remain low density. 4. Imperious Area: a. Total: Please see the enclosed table. The imperious area proposed appears to be in excess of the imperious amount allowed under a low density permit. b. 1,475,377sf DA: 315,350sf of buildings are shown to be allocated in this DA but it does not appear that deed restrictions have been submitted for those buildings/lots. If this is a "place -holder" number for which you do not yet want to propose the exact lots (assuming that those lots are not shown on the plan as discussed in #1 above), then that number can remain in the total. But, if you later decide to deed restrict lots to total to 315,350sf then that will be a permit modification. It is your choice to do that either with this permit or at a later date. c. Low Density Supplement Calculations: These calculations do not include the area claimed as "future" on the application. Additionally, the "conservation area" is not shown in this data. 5. Plans: a. A drainage area map is enclosed. DA1 is Phase 2 (20 lots, formerly Townhomes), DA2 is Phase 1 (119 lots) and DA3 is the conservation area. Phase 3 (Midway Mobile Home Park) is not included in this stormwater permit. 2. The project area breakdown on page 3 of the application of our previous submittal showed columns containing DA1, DA2 and an overall column (DAO) which was DA1+DA2. The conservation area was not represented in the table. This is what has caused the confusion in the total project area. I have redone the table to match your spreadsheet. 3. Impervious percentages have been adjusted not to exceed maximum allowable amounts. 4. Impervious areas: a. Total: The table you enclosed does not reflect to proposed totals. Again, the first column on the table previously submitted did not reflect the conservation area and should not have been included in your overall calculation. The table on the application has been revised to match your columns to prevent further confusion. b. Phase 1 of the subdivision (DA2) is built. Attached is a copy of the recorded deed restrictions showing 2,650 sf BUA allowable per lot (119 lots x 2650 sf-- 315,350 sf). c. Low density calculations now include future areas and the conservation area. 5. North arrow and scale have been added to the plans. 6. Phase 3 may be next week or next year, not sure just yet. We will work out the particulars with you guys whenever the time comes. A heads up, we are preparing a revision to the recently issued modification. The recent modification for 2125 sf allowable built upon area for Lot Nos. 120-139 (Phase 2) was unacceptable to the developer and the buyer. To increase the built upon area per lot we are now including the impervious area for sidewalks as part of the allowable impervious for the lots that are immediately adjacent. In other words those lots adjacent to a sidewalk will account for the sidewalk impervious as a portion of the allowable built upon area for that lot. In addition the remaining portions of sidewalk not adjacent to a lot will be constructed of pervious concrete, applying for a 75% reduction in impervious area. I went through the NH County GIS data to pull the parcel sizes for the various pieces (in the pdf), and so hopefully this will help clarify things when this comes back in. But, I don't know the size of Phase 1, the conservation area on the GIS is slightly different than on the plans (but if the plans are done from survey they are more accurate), and since there was a turn lane next to Phase 2 this all gets complicated with the GIS data. I think that Phase 3 is in SW8 000245 completely, but I wish I had asked him to put the outlines of the DAs on the plans to more clearly show that. So anyway, if I am out of the office when you all try to figure this out hopefully this will help speed things along.
