Dear Mr. Cheatham:
On October 1, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected Olsen Park in New Hanover County to determine the status of compliance with the State
Stormwater Management Permit Number SW8 090217 issued most recently on January 12, 2012. DEMLR file
review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please
find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes
the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Please submit a certification per Section II(9) of your permit which reads, "Within 30 days of completion of
the project, the permittee must certify in writing that the projects stormwater controls, and impervious
surfaces have been constructed within substantial intent of the approved plans and specifications. Any
deviation from the approved plans must be noted on the Certification.'.
Please inform this Office in writing before Date, of the specific actions that will be undertaken and the time frame that
will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by
the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If
a written plan of action is not submitted to this office by Date then DEMLR staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.
Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater
Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General
Statute 143-214.7, including operation and maintenance of your permitted stormwater system. Violations of your
Stormwater Management Permit may be subject to the assessment of civil penalties of up to $25,000 per day per
violation. If the project has changed its name, ownership, or mailing address, it is your responsibility to submit a
completed and signed Name/Ownership Change form to DEMLR at least 30 calendar days prior to making the
changes. Please include the name, mailing address and phone number of the person or entity that is now
responsible for this permit on the Name/Ownership Change form. If you have any questions, please contact David

appropriate. The number of files that you may review at one appointment will be limited to
five.

There is no charge for 25 or less copies.: cost per copy after the initial 25 is 2.5 per copy.
Payment is to be made by check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received'them. Files may. not be taken from the office.
No briefcases, large totes, etc. are permitted in the file review area. To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00.
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo ID, sign -in, and receive a visitor sticker prior to
reviewing files.

We had recently (March -Apr 2011) modified a pond at Legion Stadium and then re -permitted all the ponds under one
permit. I did not see a recent permit on that list for this site.
Also, we have maintenance responsibilities on the BMPs out at Olsen Park in the County. I see a sewer permit but not a
stormwater.

I have scheduled you for Tuesday, June 10 at 9AM. I've allowed you until noon which should hopefully give you a good
amount of time to go through what I am pulling together for you.
Certainly we can talk about the other projects that we haven't identified as yet, but honestly, the only way I can search
for the files that are in question is my owner name or facility name — from there I get the permit number, which is how
we file our tiles. I did have an idea however that may help you identify the ones in question — I took screenshots from
our data base of all the permits with the City of Wilmington as owner — this is attached. Perhaps if you reviewed this list,
it may help you identify the ones we can't locate with the info you have given me thusfar.

I talked to you several weeks ago regarding pulling the files for our City BMPs. We are looking to update our files (or
make sure they are current) so I was hoping to get copies of the original DWQ permits and the associated O&M
agreements, engineer certifications, etc.
We use the site name of the facility when identifying the various locations so I'm hoping the permit is listed as the same.

A couple problems however (nothing is ever simple, is it?):
I don't have a facility called Fire Station #10 (or any indication of Bagley Ave). I broadened the search to all of the fire
stations for the City and this is what I have: Fire Station HO, Eastwood Fire Station, Fire Station 2 Empie Park, Military
Cutoff Fire Station, and Pine Valley Fire Station. Any of those the one you are looking for? I'll check on this one.
I do not have a facility called Halyburton Park but 1 do have one for the City called "South 17t' Street Neighborhood
Park." Common sense tells me this has to be Halyburton — agree? Agree
I do not have a facility called Pine Valley Golf Course with the City as the owner but I do have: Pine Valley Club Stream
Restoration and Pine Valley Sidewalk. Either of these? This was part of the Pine Valley Drainage Improvement project
for the streets. I don't know of it may be listed under that.
1 do not have Randall Pond but I do have a (new-2010) project owned by the city called Randall Pond Parkway
Improvements. Want to see that? No, I'm almost certain there was no permit for this one.
Do not have: Sterling Place, Stonegate, or Victoria Place. Any chance these are pre-1988 (before state stormwater)?
They might be. The only one the I feel was not is Sterling Place. I'll try to see if I can get more info. on that.
