Please find attached a copy of the completed form entitled "Stormwater Compliance
Inspection Report". The report summarizes the findings of a recent inspection of the
project's stormwater controls conducted on February 2, 2006 to determine compliance
with Stormwater Permit Number SW8 981116.mod issued on April 7, 2000.
A summary of the findings and comments are noted under Section 4 of the report.
Please inform this Office in writing before March 7, 2006 of the specific actions that will
be undertaken and the time frame required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action. If you have

2. Inspection Date: February 2, 2006
Weather Conditions: Cool 8r Dry (50's)
3. Compliance Issues:
(a) Many of the swales on -site are still bare and require more vegetation.
(b) Several of the sediment traps are still missing from the swales.
(c) Sediment is leaving the site from the outlet structure located by lot #64 in the
NW corner of the site. This sediment has begun to accumulate in the DOT ditch
along state ,road 1343.
4. Required Actions: (Explain each deficiency and what needs to be done to bring
the system back into compliance)
(a) Grass or sod must be placed on the Swale slopes and inside the swales. The
grass must be accompanied with mulch and fertilizer to ensure adequate
growth.
(b) install and repair the sediment traps that are on the permitted plans for this
site.
{0 Sediment cannot leave this site. The sediment that has accumulated within the
DOT ditch along SR 1343 must be removed. More silt fencing or riplrap must
be installed by the outlet structure to contain as much sediment or -site as
possible.

I received a copy of your letter by fax from Mr. Chris Stephens, President of Landmark
Companies, Inc. on Monday October 31, 2005. An assignment from Landmark to Teal Briar Properties, LLC
of all permits and other controlling interests were completed in 2001 as part of the sale of this property to
Teal Briar Properties, LLC.
Acting as an agent for Teal Briar Properties, LLC, I am responding to the summary of findings and
comments enclosed in your letter dated October 26, 2005 regarding the notice of inspection in the Teal Briar
development
I have a copy of the modified site plan from Tripp Engineering that were sent to state storm water but were
not copied to you or your depadment The modification is the location of a drainage swale in one of the cul
de sacs due to the sewer main being shallow and Laving to redirect the water to another point on the
opposite side of the pavement. I phoned Tripp Engineering and requested a copy for your use. I will have
this plan, and copies in my possession on Wednesday November Vd.
At this time, all the swales have been seeded, erosion control matted and rip rap placed at the ends of each
swale. Grass approximately 3° in length already appears in areas of each of the swales. Given the wet
weather this growth should continue. Without irrigation on the yet to be developed lots it may grey up in
some areas in the future. Overall, given the poor quality of the existing soils ( clay ) indigenous grass seems
to reestablish itself over time and seem to remain healthy if left undisturbed_
I noticed a note for silt fencing in the required actions section of your letter. We will be happy to meet on site
and have you ( or your representative ) show us where to install these areas of fencing since it is not shown
on the site plans for the development. Our goal is to address DENR's and the Town of Burgaw's
requirements as directed.
Please contact me as to when we can meet on site to let you view the installations we have already in place

Weather Conditions: Warm & Dry (70's)
3. Compliance Issues:
(a) The as built site appears different from the permitted state stormwater plans.
(b) Many of the swales are bare and require more vegetation.
(c) Riplrap and sediment traps appear to be missing from several of the 5:1
swa les.
(d) Sediment must be contained on -site. Silt fencing and rip/rap must be used to
help control sediment runoff.
4. Required Actions: (Explain each deficiency and what needs to be done to bring
the system back into compliance)
(a) Please send us a copy of the as -built plans.
(b) More grass seed or sod must be placed on the swale slopes and within the
swales. The grass must be mulched and fertilized to help it survive and grow.
(c) Place sediment traps with rip/rap in all designated areas. The permitted
stormwater plans clearly show where these traps are to be placed,
(d) Install silt fences and rip/rap to help control sediment runoff Thank You

Subject: Tealbriar drainage ditches
Leon,
Hope you are doing well and that your work hasn't been affected too badly by all this rain we have had. I received a call from a
resident of Tealbriar who felt the drainage ditches in the subdivision aren't being maintained properly(trimmed and free of
debris). I spoke about this to Doug (P.W. Director) and he told me that he thought Cape Fear Paving was responsible for the
ditch upkeep.
Is this Cape Fear Paving responsibility?
and if so,
Do you think the ditches are in sound functioning condition?
if not
Does Cape Fear Paving have any plans in the near future to clean the ditches?
Please let me know what you find out so I can pass the information on the resident.

My opinion is that most of the retention of water on site is an engineering item. In a sandy soil condition the existing ditches
would allow for some of the water to percolate into the soil. With the clay soil this doesn't occur. In a perfect world provisions
should have been made by the engineer to allow for complete run off into the state ditches. The problem that he would
encounter would be getting it passed by the state storm water ( DENR ). What he designed is an acceptable system 99% of the
time, the soils on site are the real problem. As far as vegetation, the thicker the better. This removes any suspended particles in
moving water and allows for settlement IN THE DITCHES and does not allow for movement into the lower lying areas. The
growth of cattails allow for absorption of heavy metals and contaminates that may run off into the ditch so this is a positive thing.
Unfortunately, people do not like their looks.

Leon,
Thanks for getting back with me. Last week I spoke with Louis and Doug about the concerns of the lady who contacted
me. They both said the retention ditches were functioning properly and as designed. Also, I made several trips out
there and walked around the area in question. The ditch located immediately adjacent to her property had no standing
water in it just some vegetation. She was concerned about the veg. and in conversations with her last week Doug and
myself assured her that there was supposed to some veg. in the ditch for the purposes of sedimentation control. I don't
think she quite understood. Anyway, if Doug and Louis feel the ditches are functioning properly then I am satisfied. As
for the residents concerns, please keep me updated if and when Cape Fear cleans out the state ditches.
In your opinion are these problems due to maintenance (cleaning out the veg. and debris in the ditches) or due to an
engineering factor. ----Just curious.

I was out last week so I apologize for the slow response. I too have looked at the ditches in the past months and
Cape Fear recently cleaned out and repaired a lot of the Phase 2 section ditches. ( This was before you came on
board with the Town ). I have also been in contact with the state ( Glen Crews ) to ask if Cape Fear could clean out
their state ditches, they had no problem with this as long as we gave them engineered plans, existing elevations of all
pipes and did not take the ditches below the natural flow lines of all of the driveway pipe crossings along all roads
around the subdivision. These state ditches are very overgrown but the real problem is that the water has no close
outfall. The water simply sits in the ditches after rains due to clay soil conditions. It has to drain up (evaporation)
instead of down. We have looked at the weir at the rear of the property and the past owners ( Landmark) by all

indications have installed the weir and concrete at the original proposed plan elevations. The storm water from the site
backs up into the subdivision and again has to evaporate or wait for the state ditches to drop before it releases to a
lower elevation.
The water on the Hwy. 53 side has no where to go since the ditch is grown up approximately 700 feet to the east
where the outfall pipe stubs out beside a manhole.
I have been down this road before on this drainage issue and would be happy to discuss any workable options with
anyone who has a workable solution.
