We also have the responsibility to the public to safeguard these records and to carry out our day-to-day program obligations. Please read carefully the following guidelines signing the form: 1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule an appointment to review the files. Appointments will be scheduled between 9:00am and 3:00om. Viewing time ends at 4:45pm. Anyone arriving without an appointment may view the files to the extent that time and staff supervision is available. 2. You must specify files you want to review by facility name. The number of files that you may review at one time will be limited to five. 3. 4. You may make copies of a file when the copier is not in use by the staff and if time permits. Cost per copy is $.05 cents. Payment may be made by check, money order, or cash at the reception desk. 5. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be taken from the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can be fined up to $500.00. The Phase 1A lots were sold individually but were brought into the development later. The BUA on the eleven Phase 1A lots is limited to 30% of their area. The 22 lots in Phase 1 were limited to 1686 sf per lot. I think these 2 permits should be combined into one under 890508 and we can use 890519 to cover the Phase II and Phase III lots, and then transfer those permits to the HOA (if one exists). If not, the Town can require adherence to the 1686 sf maximum. 2. There is no permit for the Phase II lots (45-78) or the Phase III lots (79-91) in Kure by the Sea, although the plans submitted for Phase I and Phase IA show the lots in Phase II and III. Based on recorded deed restrictions, the Phase II lots were also limited to 1686 sf, although there is no permit or supporting calculations. 3. There were at least 7 lots that exceeded the 1686 sf maximum BUA limit in the early 1990's. All of the discrepancies were resolved by a combination of eliminating the 30% BUA for Lot 18 in Phase 1A and reallocating, and individual removal of BUA. But, the BUA limit for those lots has changed. Once I find those final figures, I'll let you know. 4. A portion of the project area for Phase II and III ended up being incorporated into the Kure Estates III Permit under SW8 990413. This includes the 24 lots on the west side of Bluefish Lane. The BUA on all of the Kure Estates lots is limited to 3,000 sf. I dug up the file and discovered there are 2 active permits for the same project. SW8. 890508 also covers Kure By the Sea. I think one may have been intended to be Phase 1 & 1A and the other may have been for Phase II, but I need some time to investigate. It looks like the engineer submitted the same application and calculations for each Phase, but meant them to be separate permits. It does appear that the BUA on Lot 18 in Phase 1A (on the Oceanside) was reduced to zero. That BUA was then distributed to other lots in order to make up for the overages that occurred in 1992. In the meantime, 1 have attached the SW8 890519 permit and some supporting information to this email. Please don't take it as the final permit, however, pending the outcome of the investigation. The permit is the "Certification of Compliance". There wasn't much to the permits back then. They were hidden in a stack near your door. @ Anyway, I had a random call from Xavier Tondour who lives in the subdivision and was interested in getting a copy of the permit for his HOA because they don't have it already. I explained to him that it looks like there is some work to be done to work through some issues but that we would be back in touch with him when this eventually gets resolved.
