Thank you for bringing this to our attention. Building ponds differently than the plans can often lead to issues. But,
since this pond is built to be 7.5ft deep and was permitted at 3.5ft deep that could actually be a good thing. It gives you
more room for sediment to accumulate in the pond before it has to be cleaned out. And, it isn't too deep such that it
causes temperature issues affecting how sediment deposits. I think you will be OK. When your engineer certifies the
pond (if he/she hasn't already) he/she can call this out as a discrepancy but it won't be a problem.

Hi Lisa Marie.
It is likely fine if it only exceeds the permitted depth by that much, although it can cause problems when ponds are
MUCH deeper than permitted due to potential thermal inversions and sediment disturbance related to that. I am
copying Kelly Johnson in our Stormwater technical review group in case I am missing details that are of concern and
have given her the file.

construction, operation and maintenance of 2 wet detention ponds in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as attached
and on file with and approved by the Division of Water Quality and considered a part of this
permit.
This permit shall be effective from the date of issuance until January 22, 2014, and shall be
subject to the following specified conditions and limitations:
1. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. The stonrwater control has
been designed to handle the runoff from 37,187 square feet of impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system. A permit modification must be
submitted and approved prior to the construction of additional built -upon area from
outside of the approved drainage area.

H. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
C. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
Decorative spray fountains will be allowed in the stormwater treatment system, subject to
the following criteria:
a. The fountain draws its water from less than 2' below the permanent pool surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing, may
be used only if they draw water from the surface in the deepest part of the pond.
C. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for the fountain's pump is based on the permanent
pool volume. The maximum pump power for a fountain in Pond I is 1/8
horsepower and in Pond 2 is 1/8 horsepower.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this pennit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications
must be noted on the Certification. A modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. The pennittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:

a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage
area.
e. Further subdivision, acquisition, or sale of all or part of the project area. The
project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
10. The penmittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the amount permitted under this permit, a modification to the permit must be submitted
and approved prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
12. At least 30 days prior to the sale or lease of any portion of the property, the permittee
shall notify DWQ and provide the name, mailing address and phone number of the
purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee if access to the stormwater facilities will be restricted by
the sale or lease of any portion of the property.
13. The permittee must maintain compliance with the proposed built -upon area and ensure
that the runoff from all the built -upon is directed into the permitted system.
14. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
15. The permittee must maintain the current permitted drainage area. No additional runoff
from outside of the permitted drainage area boundary may enter the permitted stormwater
facilities without first applying for and receiving a permit modification.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In the
event of a change of ownership, or a name change, the permittee must submit a formal
permit transfer request to the Division of Water Quality, accompanied by a completed
name/ownership change form, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved. The permittee is responsible
for compliance with all permit conditions until such time as the Division approves the
transfer request.
Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business
hours for the purpose of inspecting all components of the permitted stormwater
management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance or termination does not
stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
9. The pennittee shall notify the Division any name, ownership or mailing address changes
within 30 days.

On behalf of Bluegreen Carolina Land, LLC, we are submitting for your
review and approval two (2) copies each of the revised stormwater plan, revised
stormwater pond calculations, and the revised stormwater application and
supplement sheets. This submittal is in response to the letter you sent via fax,
dated January 8, 2004. Each of your concerns are addressed below.
1. On January 13, 2004, 1 spoke to you about the cart path you were
concerned with. You suggested that we extend the swale that runs
into the forebay of Stormwater Pond # 1 to the existing fence. That
swale has been extended. It now collects more of the runoff from the
existing cart path. Two (2) copies of the revised Sheet 1 are enclosed.
2. We received a letter from Mr. David Edwards, that shows him to be
the Vice President of the Bluegreen Carolina Land Corporation. Two
(2) copies of this letter are enclosed.
In addition to the above, sheet 2 of the application and sheet 1 of both
pond supplements were revised slightly. The revised application and
supplement sheets were necessary because the drainage basins were changed
slightly. Also, the Stormwater Pond calculations were revised for the same
reason. Two (2) copies of the revised application sheets and calculations are
enclosed. Can you please replace the application sheets you have with the
revised sheets that are enclosed?

Dear Ms. Munn:
On behalf of Bluegreen Carolina Land, LLC, we are submitting for your
review and approval two (2) copies each of the revised stormwater plans,
revised stormwater pond calculations, and the revised stormwater applications
and supplements. This submittal is in response to your letter requesting
additional information dated November 13, 2003. Each of your comments are
addressed below.
1. A legend has been added to Sheet 1. Two (2) copies of Sheet 1 are
enclosed.
2. Both dimensions and bearings have been added to the project
boundary on Sheet 1.
3. A note stating, "All roof drains must be directed to and collected in a
Stormwater Pond", has been added to Sheet 1 of the plans.
4. The forebay berm of Stormwater Pond #2 was raised and extended
away from the swale entrance point. The extension of the forebay
increases the flow path. A baffle has also been added to Stormwater
Pond #2 to increase the flow path and achieve the required 3:1 length
to width ratio. See Stormwater Pond #2 grading and detail.
Stormwater Pond # 1 is existing and therefore it isn't possible to
extend the swale to the northern end of the forebay. The existing
length to width ratio is greater than the required 3:1.
5. The gravel areas, driveways, and concrete pads have all been
dimensioned on Sheet 1.
6. Existing spot elevations and roof drain down spouts are now shown
on Sheet 1.

7. The grading details for both stormwater ponds are shown on Sheet 1.
Two (2) cross sections each are also shown on Sheet 1. All pond side
slopes and shelfs are shown and labeled.
S. A table has been added to the outlet structure detail on Sheet 2. The
table has the specifics for each stormwater pond. Two (2) copies of
Sheet 2 are enclosed. Also, the outlet structure detail shows that the
trash guard is to be extended at least 8 inches below the bottom of
the orifice to prevent the orifice from clogging.
9. It is our understanding that Mr. David Edward's has provided the
necessary documentation.
In addition to all of the above there are revised applications and
supplements and revised calculations for each of the stormwater ponds. The
new applications, supplements, and calculations were necessary because the
drainage basins changed slightly due to actual spot elevations.

15A NCAC 2C .0107(d)(4)(B), .0107(e)(1)(A), and 2C .0116 provide for the ability to construct a well to a depth of less than 20 feet where the best
source of water exists between a depth of ten and twenty feet below the surface of the land. Because additional minimum construction requirements
necessitate that: 1) casing extend to a depth greater than 20 feet below land surface; and 2) grout extend to the first significant clay laver greater than
20 feet below land surface or to the source aquifer, a variance to horizontal separation distances for shallow wells cased to less than 20 feet is not feasible.
Well construction information should be provided with the Application for Permit for Variance detailing how minimum additional construction
requirements will he satisfied.

Dear Mr. Edwards:
The Wiiinington Regional Office received a Stormwater Management Permit Application for
Maintenance Facility at Winding River Plantation on October 6, 2003. A preliminary review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. Please add a legend to the plans. On the legend, please include the wetlands delineation
line and the drainage area delineation line in addition to other site features.
2. Please provide dimensions and bearings for the project boundary.
3. Please note on the plans that all roof drains must be directed so as to be picked up by the
pond.
4. Please provide a 3:1 L:W flow path ratio in pond 92. It may be necessary to add baffles
to achieve the required ratio. Also, please extend the swale to enter the forebay at the
northern area of the forebay on pond 91 to maximize the length to width ratio.
Please dimension the gravel area, driveways, and concrete pads.
6. Please provide spot elevations in the parking lot and driveways to show that the runoff is
directed to the forebay. Also, please show the location of the roof drains to verify that
this area drains to the forebay. All runoff from impervious surfaces must enter the
forebay.
Please add a detail of the detention ponds or modify the sections to show the slopes of the
pond banks.
Please modify the structure detail to call out the specifics for each outlet structure. You
may add a table to the detail with the required design criteria for each structure. Also,
please provide protection over the orifice to prevent clogging.
Based on the last Annual Report for the fiscal year ending 12/31/2002, the Vice -President
of bluegreen Carolina Lands, LLC was Terrell Jones. Please provide documentation that
you are the Vice -President of bluegreen Carolina Lands, LLC.

The requested information should be received by this Office prior to December 13, 2003, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of all
required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90
days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to
enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original
documents that need to be revised have been sent to the engineer or agent. All original documents must be
returned or new originals must be provided. Copies are not acceptable. If you have any questions

Stormwater Pond # 1 is shown in its existing location with minor level changes.
However, it isn't possible to convey all runoff from the projects impervious
areas into Stormwater Porid # 1. A vegetative swale is proposed to convey the
stormwater runoff from Basin #1 (the southern project area) into the existing
Stormwater Pond # 1.
Stormwater Pond #2 is proposed to treat the runoff from the projects
remaining impervious areas. A vegetative swale is proposed to convey the
stormwater runoff from Basin #2 into Stormwater Pond #2.

LIMITED LIABILITY COMPANY AGREEMENT
This Limited Liability Company Agreement, dated as of August- 10, 1999
(this "Agreement"), is by and between Bluegreen Corporation (the "Member" and,
collectively, with any additional or successor members of the Company from time to
time, the "Members^) and Bluegreen Corporation (the "Manager")_
Introduction
Bluegreen Carolina Lands LLC Has been formed as a limited liability company
by the filing on August 10, 1999 of a Certificate of Formation (as amended from
time to time the "Certificatel in accordance with the Delaware Limited Liability
Company Act (G Del. C. 918-101, ems, 2gq.), as amended from time to time (the
"Act"). As of the execution of this Agreement, Bluegreen Corporation is the sole
equity -holder and member of Bluegreen Carolina Lands LLC,
NOW THEREFORE, In consideration of the mutual covenants herein
expressed, the parties hereto hereby agree as follows:
' ARTICLE I.
Name,,rpose,_and Officers and Member
1. Name, The name of the limited liability company (the "Company") is
Bluegreen Carolina Lands LLC. The Company is a limited liability company organized
under the laws of the State of Delaware, The name of the company may be
changed at any time and from time to time with the approval of the Board of
Managers (as defined below) and the written consent or approval of more than 50%
in interest of the Members (~Consent^).
12, EgMosg. The Company.is formed for the object and purpose of, and
the nature of the business to be conducted and promoted by the Company is,
engaging in any lawful act or activity for which limited liability companies may be
formed under the Act and engaging in any and all activities necessary or incidental
to the foregoing,
§3. Registered Office: Register__ dd Agent. The name of the registered
Agent and the address of the registered office of the Company in the State of
Delaware is, Corporation Service Company, 1013 Centre Road, Wilmington,
Delaware 19805. The Board of Managers may cause the Company to change from
time to time Its registered office and registered agent. The Board of Managers or
officers of the Company shall cause to be filed such certificates and documents as
may be necessary or appropriate to comply with the Act and any other applicable
requirements for the operation of a limited liability company in accordance with the

laws of the State of Delaware and any other jurisdictions in which the Company
shall conduct business.
§4 Member, The name and the business, residence or rnailing-.addresses
of the initial Member are set forth on ExhihiL6 hereto. Additional Members may be
admitted to the Company with the Consent of the then -existing Memberls), which
approval shall set forth the capital contribution, economic interest and any other
rights or obligations of such additional Member. In connection with any such
admission, this Agreement (including bit A) shall be amended to reflect the
additional Member, its capital contribution, if any, and any other rights or obligations
of the additional Member.
Article Il.
Manasernent
R 1.Mana-Qement of the COEnpany. The business and affairs of the
Company shall be managed by or under the direction of a board of Managers the
'Board of Wnagers"), who may exercise all of the powers of the Company except
as otherwise provided by law or this Agreement (including without limitation, R of
this Article It below). In the event of a vacancy In the Board of Managers, the
remaining Managers, except as otherwise provided by law, may exercise the powers
of the full Board until the vacancy is filled.
'-ON All management and other responsibilities not specifically reserved to the
Members in this Agreement shall be vested in the Board of Managers, and the
Members shall have no voting rights except as specifically provided in this
Agreement. Each Manager shall devote such time to the affairs of the Company as
may- be reasonably necessary for performance by the Manager of his, her or its
duties hereunder, provided such Persons shall not be required to devote full time to
such affairs.

Specifically, but not by way of limitation, but subject to the provisions of §7
of this Article II, the Board of Managers shalt be authorized in the name and on
behalf of the Company, to cause the Company to do all things necessary or
appropriate to carry on the business and purposes of the Company, including
without limitation the following:
(1) to acquire by purchase, lease, exchange or otherwise, and
to sell, finance, refinance, encumber and. otherwise deal with, any real
or personal property;
Pi) to borrow money and issue evidence of indebtedness or to
guarantee loans and to secure the same by mortgage, deed of trust,
pledge or other lien an any assets or property of the Company and to
pay, prepay, extend, amend or otherwise modify the terms of any
such borrowings;

(iii) to employ executive, administrative and support personnel
in connection with the business of the Company, to pay salaries,
expense relm amen , employee ene its, fringe benefits, bonuses
and any other form of compensation or employee benefit to such
persons and entities, at such times and in such amounts as may be
determined by the Board of Managers, in order to provide executive,
administrative and support; services in connection with the business of
the Company;
(iv) to hire or employ such agents, employees, 'managers,
accountants, attorneys, consultants and other persons necessary or
appropriate to carry out the business and operations of the -Company,
and to pay fees, expenses, salaries, wages and other compensation to
such persons;
(v) to pay, extend, renew, modify, adjust, submit to
arbitration, prosecute, defend or compromise, upon such terms as it
may determine and upon such evidence as it may deem sufficient, any
obligation, suit. liability, cause of action or claim, including taxes,
either in favor of or against the Company;
(vi) to determine the appropriate accounting method or
methods to be used by the Company;
(vii) to cause the Company to make or revoke any of the
elections referred to in the internal Revenue Code of 1986, as
amended from time to time (the "Code");
(vial) to establish and maintain reserves for such purposes and
in such armejunts as it deems appropriate from time to time; .
Ox) to pay all organizational expenses and general and
administrative expenses of the Company;
(x) to deal with, or otherwise engage in business with, or
provide services to and receive compensation therefor' from any
person who has provided or may in the future provide any services to,
lend money to, sell property to, or purchase property from the
Company, including without limitation, any Member or Manager;
(xi) to engage in any kind of activity and to perform and carry
out contracts of any kind necessary to, or in connection with, or
incidental to the accomplishment of the purposes of the Company;
Will to pay any and all fees and to make any and all
expenditures which it deems necessary or appropriate in connection
with the organization of the Company, the management of the affairs

fees, reimbursements and expenditures payable to a Member or
Manager;
(xiii) to exercise all powers and authority granted by. the Act to
managers, except as otherwise provided in this Agreement;,
(xiv) to cause the Company and its properties and assets to be
maintained and operated in such manner as the Board of Managers
may determine subject, however, to obligations imposed by applicable
laws or by any mortgage or security interest encumbering the
Company and such properties and assets from time to time, and by
any lease, rental agreement or other agreement pertaining thereto;
(xv) -to muse to be obtained and continued in force all policies
of insurance required by any mortgage, lease or other agreement
relating to the Company's business or any part thereof, or determined
by the Board of Managers to be in the best interest of the Company,,
(xvi) to cause to be paid any and all taxes, charges and
assessments that may be levied, assessed or imposed upon any of the
assets of the Company, unless the same are contested by the
Company; and
(xvii) to perform any other act: which the Board of., Managers
may deem necessary, convenient or desirable for the Company or its
business.
§2.,_Managers.
(a) Number; Eleatio?p and Qualification. The number of Managers
which shall constitute the whole Board of Managers shall be three (3), unless
otherwise determined by resolution of the Members or the Board of Managers,
Subject to the preceding sentence, the number of Managers may be decreased at
any time and from time to time either by the Members or by a majority of the
Managers then in office, but only to eliminate vacancies existing by reason of the
death, resignation, removal or expiration of the term of one or more Managers. The
Managers shall be elected at an annual meeting of Members by such Members as
have the right to vote at such election. Managers need not be Members of the
Company.
The number of members of the Board of Managers is hereby initially
fixed at three, and the persons named on Schedule A hereto are the initial
Managers.
Each person elected to serve as a Manager of the Company shall sign
this Agreement, or a counterpart hereof or amendment hereto, or other writing
pursuant to which such person (i) acknowledges receipt of a copy of 'this
Agreement, as amended and in effect as of the date of such writing. (ii) agrees that
he, she or it is a party to and bound by this Agreement, (iii} agrees to perform the

duties of a Manager hereunder, and {iv) agrees to execute and deliver such
additional agreements, instruments, certificates and documents, including without
Hinitation an wnich may be necessary, appropriate or
convenient to reflect the foregoing matters and the election of such person or entity
as a Manager of the Company. -
Upon the death, resignation, removal or expiration of the term of any
Manager (a "Terminal Mann er"), (i) such Terminated Manager shall have no
further authority under this Agreement, (ii) such Terminated Manager shall have no
further obligations or rights under this Agreement (except for liabilities and rights
accruing prior to the date of death, resignation, removal or expiration of his term,
such as, for example, rights to Indemnification under L 10 of this Article 11 below,
which related to actions or omissions occurring during such person's service as a
Manager), and (ill) no writing or instrument shall be required to be executed by the
Company or the Terminated Manager to reflect such cessation of service, except
that the Terminated Managar (or its legal representative or attorney -in -fact, as
provided in the following paragraph) shall execute and deliver any agreement,
instrument, certificate or document, including an amendment to the Certificate
which may be reasonably required to reflect that the Terminated Manager is no
longer a Manager of the Company.
Each person now or hereafter serving as a Manager of the Company
by execution of this Agreement, an amendment hereto, or an instrument
acknowledging that it is bound hereby, hereby constitutes and appoints each other
person who may from time to time be serving as a Manager, and each of them
acting singly, such Manager's agent and attorney -in -fact for the purpose of
executing and delivering any and all agreements, instruments and other documents
(including without limitation, an amendment to the Certificate) as are necessary or
appropriate to reflect that he, she or it is no longer a Manager of the Company
following the death, resignation, removal or expiration of -the term of such Manager,
which power of attorney, is hereby agreed and acknowledged to be coupled with an
Interest and irrevocable, and shall survive the death, dissolution, bankruptcy or
incapacity of any Manager until such time as the withdrawal of such Manager from
the Company has been reflected by all necessary or appropriate agreements,
instruments and other documents,
(b) Enlar-gement of the -Board. Subject to §2(a) above, the nurinber
of Managers be increased at any time and frorn time to time by the Members or by a
majority of the Managers then In office.
(c) Tpnure. Each Manager shall hold office until the next annual
meeting of Members and until his successor is duly elected and qualified, or until his
earlier death, resignation or removal.
(dl vacancies. unless and until filled by the Members, any
vacancy in the Board of Managers, however occurring, including a vacancy resulting
from an enlargement of the Board, may be filled by vote of a majority of the
Managers then in office, although less than a quorum, or by a sole rem-aining
Manager. A Manager elected to fill a vacancy shag be elected for the unexpired

term of his predecessor in office, and a Manager chosen to fill a position resulting
from an increase in the number of Managers shall hold office until the next annual
meeting of Members and until his successor is duly elected and qualified, or until his
earlier death, resignation or removal.-
(e) flesignation, Any Manager may resign by delivering his written
resignation to the Company at its principal office or to the President or. Secretary.
Such resignation shall be effective upon receipt unless It is specified to,be effective
at some other time or upon the: happening of some other event.
(f) Regular M_eptinos. Regular meetings of the Board of Managers
may be held without notice at such time and place, either within or without the
State of Delaware, as shall be determined from time to time by the Board of
Managers. A regular meeting of the Board of Managers may be held without notice
immediately after and at the same place as the annual meeting of Members.
(g) Special Meeting. Special meetings of the Board of Managers
may be held at any time and place, within or without the State of Delaware,
designated in a call by the President, two or more Managers, or by one Manager in
the event that there is only a single Manager in office.
(h) Notice of_Sp2gllal Meetings, Notice of any special meeting of
Managers shall be given to each Manager by the Secretary -or by the officer'or one
of the Managers calling the meeting. Notice shall be duly given to each Manager (i).
by giving notice to such Manager In person or by telephone at least 24 hours in
advance of the meeting, (ii) by sending a telegram or telex,. or delivering written
notice by hand, to his last known business or home address at least 24 hours in
advance of the meeting, or (iii)-fay mailing written notice to his last known business
or home address at least 72 hours in advance of the meeting. A notice or waiver of
notice of a meeting of the Board of Managers need not specify the purposes of the
meeting.
(i) Meetiqq by Telephone Conference Calls. Managers or any
members of any committee designated by the Managers may participate in a
meeting of the Board of Managers or such committee by means of conference
telephone or similar communications equipment by means of which all persons
participating In the meeting can Rear each other, and participation by such means
shall constitute presence in person at such meeting.
(j) Quorum. A majority of the total number of the whole Board of
Managers shall constitute a quorum at all meetings of the Board of Managers. in
the event one or more of the Managers shall be disqualified to vote at any meeting,
then the required quorum shall be reduced by one for each such Manager so
disqualified; ofovidd however, that in no case shall less than one-third 0 /3) of the
number so fixed constitute a quorum. In the absence of a quorum at any such
meeting, a majority of the Managers present may adjourn the meeting from time to
time without further notice other than announcement at the meeting, until a quorum

(k) Action at Meeting. At any meeting of the Board of Managers
at which a quorum is present, the vote of a majority of those present shall be

(1) Action y—Lposent. - Any 'action required or permitted to be
Taken at any meeting of the Board of Managers or of any committee of the Board of
Managers may be taken without a meeting, if all members of the Board or
committee, as the case may be, consent to the action in writing, 04 the written
consents are filed with the minutes of proceedings of the Board or committee.
(m) Removal. Except as otherwise provided by the Act, any one or
more or all of the Managers may be removed, with or without cause, by Members
holding a majority of the economic interests then held by all Members, except that
the Managers elected by the holders of a particular class or series of Members may
be removed without cause only by vote of Members holding a majority in economic
interest of such class or series.
(n) QOmmittees. The Board of Managers may, by resolution
passed by a majority of the whole Board, designate one or more committees, each
committee to consist of one or more of the Managers of the Company, The Board
may designate one or more Managers as alternate members of any committee, who
may replace any absent or disqualified member at any meeting of the committee, in
the absence or disqualification of a member of a committee, the member or
members of the committee present at any meeting and not disqualified from voting,
whether or not he or they constitute a quorum, may unanimously appoint another
member of the Board of Managers to act at the meeting in the place of any such
absent or disqualified member. Any such committee, to the extent provided in the
resolution of the Board of Managers and subject to the provisions of the Act, shall
have and may exercise all the powers and authority of the Board of Managers in the
management of the business and affairs of the Company. Each such committee
shall keep minutes and make such reports as the Board of Managers may from time
to time request. Except as the Board of Managers may otherwise determine, any
committee may mace rules for the conduct of its business, but unless otherwise
provided by the Managers or in such rules, its business shall be conducted as nearly
as possible in the same manner as is provided in this Agreement for the Board of
Managers. : .
(4) COmAensation of Managers. Managers may be paid such
compensation for their services and such reimbursement for expenses of attendance
at meetings as the Board of Managers may from time to time determine. No such
payment shall preclude any Manager from serving the Company or any of its parent
or subsidiary entities in any other capacity and receiving compensation for such
service.
§3. Members.
(a) All meetings of Members shall be held at such place within or
without the State of Delaware as may be designated from time to time by the Board

Company-
(b) AnnUgi Meeting. There shall be held art annual meeting of
Members for the election of Managers and for the transaction of such other
business as may properly be brought before the meeting. Such annual meeting shall
be held on a date to be fixed by the Board of Managers or the President (which date
shall not be a legal holiday In the place where the meeting is to be held) -at the time
and place to be fixed by the Board of Managers or the President and stated in the
notice of the meeting. If no annual meeting is held in accordance with the foregoing
provisions, a special meeting may be held in lieu of the annual meeting, and any
action taken at that special meeting shall have the same effect as if it had been
taken at the annual meeting, and in such case all references in this Agreement to
the annual meeting -of the Members shall be deemed to refer to such special
meeting.
(c) Special Me2t4aS. Special meetings of Members may be called
at any time by the President or by the Board of Managers. Business transacted at
any special meeting of Members shall be limited to matters relating to the purpose
or purposes stated in the notice of meeting.
(d) Notice of Meetings. Except as otherwise provided by law,
written notice of each meeting of Members, whether annual or special, :,hall be
given not less than 10 nor more than 60 days before the date of the meeting to
each Member entitled to vote at such meeting. The notices of all meetings shall
state the place, date and hour of the meeting. The notice of a special meeting shall
state, in addition, the purpose or purposes for which the meeting is called. If
mailed, notice is given when deposited in the United States mail, postage prepaid,
directed to the Member at his address as it appears on the records of the Company.
(e) Volute_ List. The officer who has charge of the membership
ledger of the Company shall prepare, at least 2 days before every meeting of
Members, a complete fist of the Members entitled to vote at the meeting, arranged
in alphabetical order, and showing the address of each Member and such. Member's
economic interest in the Company (his "Percents Interest"). Such list shall be
open to the examination of any Member, for any purpose germane to the meeting,
during ordinary business hours, for a period of at least 2 days prior to the meeting,
at a place within the city where the meeting is to be hold. The list shalt also be
produced and kept at the time and place of the meeting during the whole time of the
meeting, and may be inspected by any Member who is present-
(f) Quorum. Except as otherwise provided by law, the Certificate
or this Agreement, the holders of a majority of the percentage Interests of the
Company and entitled to vote at the meeting, present in parson or represented by
proxy, shall constitute a quorum for the transaction of business.
(g) Adiournmentri, Any meeting of Members may be adjourned to
any other time and to any other place at which a meeting of Members may be held
under this Agreement by the Members present or represented at the meeting and

vote at a meeting of Members, or to express consent or dissent to Company action
in writing without a meeting. A Member may vote or express such consent or
dissent in person or may authorize another person or persons to vote or act for him
by written proxy executed by the Member or his authorized agent and delivered to
any Officer of the Company. No such proxy shall be voted or acted upon after three
years from the date of its execution, unless the proxy expressly provides for a
longer period.
6) Action at etin . When a quorum is present at any meeting,
the Members representing a majority of the total economic Interests of all members
entitled to vote tot' if there are two or more classes of Members entitled ,to vote as
separate classes, then in the case of each such class, the holders of a majority of
the total Percentage interests of that class entitled to vote on such matter) shall
decide any matter to be voted upon by the Members at such meeting, except when

be taken at any annual or special meeting of Members of the Company may be
taken without a meeting, without prior notice and without a vote, if a consent in
writing, setting forth the action so taken, is signed by the Members having not less
than the minimum aggregate economic Interests that would be necessary to
authorize or take such action at a meeting at which all Members to vote on such
action were present and voted. Prompt notice of the taking of an action without a
meeting by less than unanimous written consent shall be given to those Members
who have not consented in writing.
ik) Record Cate. The Board of Managers may fix in advance a
date as a record data for the determination of the Members entitled to notice of or
to vote at any meet€ng of Members or to express consent (or dissent) to Company
action in writing without a meeting, or entitled to receive payment of any
distribution or allotment of any rights in respect of any change, conversion or
exchange of Interests, or for the purpose of any other lawful action. Such record
date shall not be more than 60 nor less than 10 days before the date of such
meeting, nor more than 10 days after the date of adoption of a record date for a
written consent without a meeting, nor more than 60 days prior to any other action
to which such record date relates.

94. Offers.
(a) Enumeration, The officers of the Company shall consist of a
President, a Treasurer, a Secretary and such other officers with such other titles as
the Board of Managers shall determine, including a Chairman of the Board, a Vice -
Chairman of the Board, and one or more Vice Presidents, Assistant Treasurers, and
Assistant Secretaries. The Board of Managers may appoint such other officers as it
may deem appropriate. The initial officers of the Company are set forth- on Exhibit
A_ hereto.
(b) Election. The President, Treasurer and Secretary shall be
elected annually by the Board of Managers at its first meeting following the annual
meeting of Members. Other officers may be appointed by the Board of Managers at
such meeting or at any other meeting.
(c) Qualification. No officer need be a Member or a Manager.
Any two or more offices may be held by the same person.
(d) Tenure, Except as otherwise provided by law, by the
Certificate or by this Agreement, each officer shall hold office until his successor is
elected and qualified, unless a different term is specified In the vote choosing or
appointing him, or until his earlier death, resignation or removal.
(e) Resignation gnd Rernnyai. Any officer may resign by delivering
his written resignation to the Company at its principal office or to the President,
Secretary or any Manager. Such resignation shall be effective upon receipt unless it
Is specified to be effective at some other time or upon the happening of some other
event.
Any officer may be removed at any time, with or without cause, by
vote of a majority of the Managers then in office (which number shall be determined
exclusive of any officer who is the subject of the proposed removal).
Except as the Board of Managers may otherwise determine, no officer
who resigns or is removed shall have any right to any compensation as are officer for

(f) Vacancies, The Board of Managers. may fill any vacancy
occurring in any office for any reason and may, in its discretion, leave unfilled for

for the unexpired term of his predecessor and until his successor is elected and
qualified, or until his earlier death, resignation or removal.
ig) Chairman of the Board and Vice -Chairman -of ,the Board, The
Board of Managers may appoint a Chairman of the Board. If the Board of Managers
appoints a Chairman of the Board, he shall perform such duties and possess such
powers as are assigned to him by the Board of Managers. If the Board of Managers
appoints a Vice -Chairman of the Board, he shall, in the absence or disability of the
Chairman of the Board, perform the duties and exercise the powers of the Chairman
of the Board and shall perform such other duties and possess such other powers as
may from time to time be vested in him by the Board of Managers.
(h) Pre ' . The President shall, subject to the direction- of the
Board of Managers, have general charge and supervision of the business of the
Company. Unless otherwise provided by the Board of Managers, he shall preside at
all meetings of the Members and, if he is a Manager, at all meetings of the Board of
Managers. Unless the Board of Managers has designated the Chairman of the Board
or another Officer as Chief Executive Officer, the President shall be the Chief
Executiva officer of the Company. The President shall perform such other duties
and shall .have such other powers as the Board of Managers may from time to time
prescribe.
(i) Vice Presidents. Any Vice President shall perform such duties
and possess such powers as the Hoard of Managers or the President may from time
to time prescribe. In the event of the absence, inability or refusal to act; of the
President, the Vice President for if there shall be more than one, the Vice Presidents
in the order determined by the Board of Managers) shall perform the duties of the
President and when so performing shall have all the powers of and be subject to all
the restrictions upon the President. The Board of Managers may assign to any Vice
President the title of Executive Vice President, Senior Vice President or any other
title selected by the Board of Managers.
ii) Secretary and Assistant Secretaries. The Secretary shall
perform such duties and shall have such powers as the )Board of Managers or the
President may from time to time prescribe. In addition, the Secretary shall perform
such duties and have such powers as are incident to the office of the Secretary,
including without limitation the duty and power to give notices of all meetings of
members and special meetings of the Board of Managers, to attend all meetings of
Members and the Board of Managers and keep a record of the proceedings, to

Secretary, the Assistant Secretary. for if there shall be more than one, the Assistant
Secretaries in the order determined by the Board of Managers) shall; perform the
duties and exercise the powers of the Secretary.
In the absence of the Secretary or any Assistant Secretary at any meeting of
Members of Managers, the person presiding at the meeting shall designate a
temporary secretary to keep a record of the meeting.
(k) Treasurer and _Assistant -Treasurer s. The Treasurer shall
perform such duties and shall have such powers as may from time to time be
assigned to him by the Board of Managers or the President. In addition, the
Treasurer shall parform such duties and have such powers as are incident to the
office of treasurer, including without limitation the duty and power to keep and be
responsible for all funds and securities of the Company, to deposit funds of the
Company in depositories selected in accordance with these By -Laws, to disburse
such funds as ordered by the Board of Managers, to make proper accounts of such
funds, and to render as required by the Board of Managers statements of all such
transactions and of the financial condition of the Company.
The Assistant Treasurers shall perform such duties and possess such
powers as the Board of Managers, the President or the Treasurer may from time to
time prescribe. In the event of the absence, inability or refusal to act of the
Treasurer, the Assistant Treasurer (or if there shall be more than one, the Assistant
Treasurers in the order determined by the Board of Managers) shall perform the
duties and exercise the powers of the Treasurer.
. (1) Salaries. Officers of the Company shall be entitled to such
salaries, compensation or reimbursement, if any, as shall be fixed or allowed from
time to time by the Board of Managers.
45. Intgrpretation of Rights and Dutipg of ManagerManagerg and Members. To the
fullest extent permitted by the Act and other applicable law, and to the extent not
inconsistent with the specific provisions of this Agreement or the Certificate, it is
the intention of the parties that;
0) the Board of Managers shall have the power to do any and
all acts, statutory and otherwise, with respect to the Company which
the board of directors. of a Delaware corporation would have with
respect to such Delaware corporation, and
(R) the Members shall have no power or authority whatsoever
with respect 'to the management of the business and affairs of the
Company.

the prior written Consent of the- Members,. the -Board.of_.Managers shall not cause
the Company to (and the Company shall not) take any of the following actions:

arrangement with any of the Managers or any of their respective
Affiliates pursuant to which any Manager or any of such Affiliates is
to receive compensation of any kind; or

§7, Binding the Company. Except as the Board of Managers may
generally or in any particular case or cases otherwise authorize, and subject to the
other provisions of this Agreement and the Certificate, all deeds, leases, contracts,
bonds, notes, checks, drafts or other obligations made, accepted or endorsed by the
Company shall be signed by the Chairman of the Board, if any, the President, any
Vice President and the Treasurer, or any of them acting singly,
§ Q. Contracts with Members, With the approval of a majority ,in number
of disinterested Managers in each case, the Company may engage in business with,
or enter into one or more agreements, leases, contracts or other arrangements for
the furnishing to or by the Company of goods, services or space with any Member
or Affiliate of a Member, and may pay compensation in connection with such
business, goods, services or space, pravitlP in each case the amounts payable
thereunder are reasonably comparable to those which would be payable to
unaffiliated Persons under similar agreements, and if the determination of such
amounts is made in goad faith it shall ba conclusive absent manifest error.
_§_9, Indemnification and-gglpation. No Manager, or its Affiliates (as that
term is defined in the regulations adopted under the Securities Act of 1933, as
amended), shall have any liability to the Company or to any Member for any loss
suffered by the Company which arises out of any action or inaction of any Manager
or its Affiliates if such Manager or Its Affiliates, as the case may be, in good faith,
determined that such course of conduct was in the best interests of the Company
and such course of conduct did not constitute gross negligence of willful
misconduct of such Manager or its Affiliates. Each Manager and its Affiliates shall
be indemnified by the Company against any lases, judgments, liabilities, expenses
and amounts paid in settlement of any claims sustained by it with respect to actions
taken by such Manager or its Affiliates on behalf of the Company, ravidgg that no
indemnification shall be provided for any person with respect to any matter as to
which he shall have been adjudicated in any proceedings not to have acted in good
faith in reasonable belief that his action was in the best interest of the. Company.
Without limiting the foregoing, such indemnification may with the approval of the
Member include payment by the Company of expenses incurred In defending a civil

or criminal action or proceeding in advance of the final disposition of such action or
proceeding, upon receipt of an undertaking by the person indemnified to repay such

such person to make repayment.- Any indemnification to be provided hereunder may
be provided although the person to be indemnified is no longer a Manager or an

Notwithstanding the foregoing, no Manager, nor its respective Affiliates, nor
any person acting as a broker -dealer, shall be indemnified for any losses, liabilities or
expenses arising from or out of a violation of federal or state securities laws or any
other intentional or criminal wrongdoing. Any indemnity under this 9 shall be paid
from, and only to the extent of, the Company's assets, and no Member shall have
any personal liability on account thereof.
§ 10. Other Activities,
(a) Except as provided in §10(b) below, the Members, Managers
and any Affiliates of any of them, may engage in and possess interests in other
business ventures and investment opportunities of every kind and description,
Independently or with others, including serving as directors, officers, stockholders,
managers, members and general or limited partners of corporations, partnerships or
other iirnited liability companies with purposes similar to those of the -Company.
.„, Neither the Company nor any other Member or Massager shall have any rights in or
to such ventures or opportunities or the income or profits therefrom.

(b) No Manager shall, without the prior Consent of the Membors,
conduct any timeshare or other real estate business (as a developer, investor or
lender) which competes with the business of the Company or any of its direct or
Indirect parents or subsidiaries or any portion thereof. Northing contained in this § 10
shall entitle any Manager to compete with Bluegreen Corporation or any of its
subsidiaries or Affiliates or solicit, or hire away any of their respective employees or
customers to the extent such competition or other activities are otherwise prohibited
by applicable law, contract or otherwise.

_ 91. Capital Contribution. The Member has contributed the amount Set
fortis opposite such Member's name on Exhibit.Al hereto. No interest shall accrua on
any.coritributions to the Company, and the Member shall not have the right to
withdraw or to be repaid any capital contributed by it or to receive any other
payment in respect of its interest in the Company, including, without limitation, as a
result of the withdrawal of such Member from the Company, except as specifically
provided in this Agreement.
52 Additional -pritributions The Member is not required to make any
additional capital contribution To the Company. Additional capital contributions may
be made by the Member at the Member's discretion and shall be reflected on Exhibit
A hereto.
§3. Capital Accountg. A separate Capital Account shall be established for
the Member, and shall be maintained in accordance with applicable regulations
under the Internal Revenue Code, as amended. To the extent consistent with such
regulations, there shall be credited to the Member's Capital Account the amount of
any contribution of capital made by the Member to the Company, and the Member's
share of the net profits of the Company, and there shall be charged against the
Member's Capital Account the amount of all distributions to the Member, and the
Member's share of the net losses of the Company.
Article-V.
General Provisions
U . B_noks and- Records. The Manager shall cause the Company to keep
just and true books of account with respect to the operations of the Company.
Such books shall be maintained at the principal place of business of the Company,
and the Member, and its duly authorized representatives, shall at all .reasonable
times have access to such books. Such books shall be closed and balanced as of
the close of the Company's fiscal year in each year. The same method of
accounting shall be used for both accounting and tax purposes. The fiscal year of
the Company shall be the Sunday closest To March 31 each year.
92. ©is 'butions. To the extent permitted by the Act, distributions shall
be made to the Member at the times and in the aggregate amounts determined by
the Board of Managers or the Member.
§3. Resignatpri. The Member may resign from the Company at any time,

and understanding with respect to the subject matter hereof and supersedes all prior
agreements and understandings relating to such subject matter.

The Wilmington Regional Office received the Stormwater Management Permit Application for the Winding River Plantation
Maintenance Facility on May 14, 1997, with final information on August 4, 1997. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title
15A NCAC 2H.1000. We are forwarding Permit No. SW8 970526 dated August 4, 1997, for the construction of Winding
River Plantation Maintenance Facility.
This permit shall be effective from the date of issuance until August 4, 2007, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained .in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the

T. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and

4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved
plans.
5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -
upon area.
6. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification to the
permit.
7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the .stormwater
management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's
intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
, 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.

5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
III. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and may or may not be approved.
Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality; in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components
of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

Bluegreen Carolina Land, LLC is in receipt of the subject Notice of
Violation (NOV) and has requested that I respond with the required Plan of
Action. We received the letter of violation on June 11, 2003. The Plan of
Action is detailed below with the expected completion date in parentheses.
Plan of Action
(1) Clean existing pond of debris, cut overgrown vegetation, and stabilize
existing stormwater pond. (July 11)
(2) Retain a land surveyor to perform an as -built survey of the site
including all impervious surfaces and stormwater structural controls.
(July 31)
(3) Educate existing staff to the requirements of the stormwater
regulations and perform interim necessary inspections and
maintenance. (July 31)
(4) Evaluate the impervious surface from the as -built survey in (2) above,
make necessary corrections to the stormwater calculations , and modify
the existing stormwater plan to capture all runoff. (August 22)
(5) Submit new calculations and plans to DENR for review. (September 12)
(6) Construct improvements in accordance with plan (October 31)
(7) Submit designer's certification following any construction. (November 14)

1. Monthly, or after every runoff producing rainfall event, whichever comes first:
A. Inspect trash racks, remove accumulated debris, repair/replace if not functioning
properly.
B. Inspect and clear orifice of any obstructions.
C. Inspect the pond side slopes; remove trash, and repair eroded areas before the next
rainfall event.
1I. Quarterly:
A. Inspect grassed swales and ditches for accumulation of debris and erosion.
Accumulated debris shall be cleared and any eroding slopes restabilized.
B. fond outlet structure shall be checked for undercutting. if undercutting is evident, rip
rap or other energy dissipation means shall be installed.
1I1. Semi-annually:
A. Accumulated sediment from the bottom of the outlet structures shall be removed.
B. Grassed swales shall be reseeded twice a year as necessary.
IV. Annually:
Stormwater detention pond depth shall be checked at various points. Sediment shall be
removed to the depth 4 feet below normal pool (orifice elevation).
V. General:
A. Mowing of the side slopes shall be accomplished according to the season. Maximum
grass height shall be 6".
B. Cattails are encouraged along the pond perimeter, however, they shall be removed when
they cover more than 1/2 the surface area of the pond. The best time to cut them is at
the end of the growing season, in November. Environmentally sensitive chemicals for
use in killing cattails can also be used. Contact the Agricultural Extension Service.
C. The orifices is (are) designed to draw down the pond in 2 to 5 days. If draw -down is not
accomplished in that time, the orifice shall be replaced with a larger or smaller orifice,
as required. Slow draw down may be attributed to a clogged system. The source of the
clogging shall be found and eliminated.

D. All components of the detention pond system shall be kept in good working order.
Repair or replacement components shall meet the original design specifications as per
the approved stormwater plan. If previously approved components are determined to be
ineffective, the component shall be redesigned and/or replaced.

Dear Mr. Houston:
The Wilmington Regional Office received a Stormwater Management Permit Application for
Maintenance Facility at Winding River on May 14, 1997. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue the
stormwater review:
The "littoral zone" detail should be modified so that it is shown as being a perimeter item,
ie., on both sides of the pond. The'detail as currently shown indicates that the shelf is only
located within the forebay, and only on one side of it. The shelf area is not to be located
within the forebay, only in the pond. Additionally, the slope of the shelf area, (6:1
minimum), and the begin and end elevations of the shelf must be indicated on the detail.
2. The weir elevation between the forebay and the main pond must be z the permanent pool, and
<_ the design pool elevations. '
3. Please add the permanent pool dimensions to the pond, or on a separate detail.
4. Dimension the building, parking and sidewalks.

5. Is the .28 acres of existing BUA supposed to represent Zion Hill Road? I scaled 425' x 36'
for a total of .35 acres. The drainage area map you provided shows .422 acres for Zion Hill
Road. The building scales 100' x 110', yet you account for over 2,000 square feet more on
the application. Our parking and walks are very close. Please clarify.
6. Please locate the curb inlets and piping from Zion Hill Road into the pond.
7. Please delineate and label the 38.9 contour in the pond.
8. Is David Dickey both a Regional Manager and a Vice -President in bluegreen Corporation?
The application form uses both.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to July 6, 1997, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.

Revised Stormwater Plan Submittal
Dear Ms. Lewis:
We have revised the subject stormwater plan in response to the
comments presented in your June 6, 1997 letter to us. The following items
summarize the revisions as they relate to your numbered comments:
L We have revised the "Wet Pond Section" to illustrate the littoral zone
in the main pond area only. Additionally the slope of the shelf and the
beginning and ending elevations are now shown on the detail.
2. The "Wet Pond Section" has been revised to show the elevation of the
top of the containment berm at 38.30'. This elevation is higher than
the permanent pool but lower than the storage pool.
3. The permanent pool dimensions have been added to the plan view of
the pond.
4. Dimensions of the building, parking, and sidewalks have been added to
the plan view.
5. Our client has decided not to improve Zion Hill Road as shown on our
previous plans. Runoff from Zion Hill Road therefore, will be handled
by NCDOT within roadside swales. We have added a driveway culvert
to our plans to "bypass" Zion Hill Road runoff. The total area and BUA
served by the stormwater detention pond has therefore been reduced.
The calculations, tables, and stormwater form have been revised to
account for this change.
The additional 2000 SF for building BUA shown on the application is
attributed to a small (25" x 30') concrete block storage building
adjacent to the concrete apron and to a small "reserve" in the event
the owner decides that additional BUA is needed for future
maintenance activities.

6. We no longer plan to serve Zion Hill Road with this project. (See Item
5 above.)
7. The storage pool elevation has been reduced from 38.9' to 38.7' due to
the elimination of service for Zion Hill Road. The plan view of the
pond illustrates (by stippled shading) the area within the 38.7'
contour.
8. Dave Dickey is Regional Manager.
Enclosed for your review and approval are two copies each of the
revised plans, calculations, and stormwater form.

Stormwater Plan Submittal
Dear Ms. Lewis:
The stormwater drainage plans for the Maintenance Facility at
Winding River Plantation have been completed. Enclosed for your review
and approval are two copies each of the following documents:
1) Stormwater and erosion control plans;
2) Hydrologic and hydraulic calculations;
3) DWQ Stormwater submittal form;
4) Maintenance Requirements form; and,
5) Check in the amount of $385 to cover the application fee.
The Maintenance Facility is part of the "overall" project submitted to
your office as Carolina National at Winding River Plantation. A current
stormwater permit exists for the overall project under DWQ Permit Number
SW8 961109. Our most recent submittal for the overall project allocates a
BUA value of 2.7 acres to the Maintenance Facility Tract. Our current
detailed submittal significantly reduces the BUA proposed to 1.45 acres. We
will soon be making submittal for the next Phase (1 B) of "overall"
development, and the stormwater documents will reflect the detailed
Maintenance Facility data.
