Building ponds differently than the plans can often lead to issues. But, since this pond is built to be 7.5ft deep and was permitted at 3.5ft deep that could actually be a good thing. It gives you more room for sediment to accumulate in the pond before it has to be cleaned out. And, it isn't too deep such that it causes temperature issues affecting how sediment deposits. I think you will be OK. When your engineer certifies the pond (if he/she hasn't already) he/she can call this out as a discrepancy but it won't be a problem. It is likely fine if it only exceeds the permitted depth by that much, although it can cause problems when ponds are MUCH deeper than permitted due to potential thermal inversions and sediment disturbance related to that. I am copying Kelly Johnson in our Stormwater technical review group in case I am missing details that are of concern and have given her the file. Let me know how else I may assist. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. C. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain draws its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. C. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in Pond I is 1/8 horsepower and in Pond 2 is 1/8 horsepower. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this pennit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The pennittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: 4 State Stormwater Management Systems Permit No. SW8 970526 Modification a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The penmittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. At least 30 days prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stormwater facilities without first applying for and receiving a permit modification. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. Two (2) copies of Sheet 1 are enclosed. 2. Both dimensions and bearings have been added to the project boundary on Sheet 1. 3. A note stating, "All roof drains must be directed to and collected in a Stormwater Pond", has been added to Sheet 1 of the plans. 4. The forebay berm of Stormwater Pond #2 was raised and extended away from the swale entrance point. The extension of the forebay increases the flow path. A baffle has also been added to Stormwater Pond #2 to increase the flow path and achieve the required 3:1 length to width ratio. See Stormwater Pond #2 grading and detail. Stormwater Pond # 1 is existing and therefore it isn't possible to extend the swale to the northern end of the forebay. The existing length to width ratio is greater than the required 3:1. 5. The gravel areas, driveways, and concrete pads have all been dimensioned on Sheet 1. 6. Existing spot elevations and roof drain down spouts are now shown on Sheet 1. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please add a legend to the plans. On the legend, please include the wetlands delineation line and the drainage area delineation line in addition to other site features. 2. Please provide dimensions and bearings for the project boundary. 3. Please note on the plans that all roof drains must be directed so as to be picked up by the pond. 4. Please provide a 3:1 L:W flow path ratio in pond 92. It may be necessary to add baffles to achieve the required ratio. Also, please extend the swale to enter the forebay at the northern area of the forebay on pond 91 to maximize the length to width ratio. Please dimension the gravel area, driveways, and concrete pads. 6. Please provide spot elevations in the parking lot and driveways to show that the runoff is directed to the forebay. Also, please show the location of the roof drains to verify that this area drains to the forebay. All runoff from impervious surfaces must enter the forebay. (a) Number; Eleatio?p and Qualification. The number of Managers which shall constitute the whole Board of Managers shall be three (3), unless otherwise determined by resolution of the Members or the Board of Managers, Subject to the preceding sentence, the number of Managers may be decreased at any time and from time to time either by the Members or by a majority of the Managers then in office, but only to eliminate vacancies existing by reason of the death, resignation, removal or expiration of the term of one or more Managers. The Managers shall be elected at an annual meeting of Members by such Members as have the right to vote at such election. Managers need not be Members of the Company. The number of members of the Board of Managers is hereby initially fixed at three, and the persons named on Schedule A hereto are the initial Managers. Each person elected to serve as a Manager of the Company shall sign this Agreement, or a counterpart hereof or amendment hereto, or other writing pursuant to which such person (i) acknowledges receipt of a copy of 'this Agreement, as amended and in effect as of the date of such writing. Each person now or hereafter serving as a Manager of the Company by execution of this Agreement, an amendment hereto, or an instrument acknowledging that it is bound hereby, hereby constitutes and appoints each other person who may from time to time be serving as a Manager, and each of them acting singly, such Manager's agent and attorney -in -fact for the purpose of executing and delivering any and all agreements, instruments and other documents (including without limitation, an amendment to the Certificate) as are necessary or appropriate to reflect that he, she or it is no longer a Manager of the Company following the death, resignation, removal or expiration of -the term of such Manager, which power of attorney, is hereby agreed and acknowledged to be coupled with an Interest and irrevocable, and shall survive the death, dissolution, bankruptcy or incapacity of any Manager until such time as the withdrawal of such Manager from the Company has been reflected by all necessary or appropriate agreements, instruments and other documents, (b) Enlar-gement of the -Board. Special meetings of the Board of Managers may be held at any time and place, within or without the State of Delaware, designated in a call by the President, two or more Managers, or by one Manager in the event that there is only a single Manager in office. (h) Notice of_Sp2gllal Meetings, Notice of any special meeting of Managers shall be given to each Manager by the Secretary -or by the officer'or one of the Managers calling the meeting. Notice shall be duly given to each Manager (i). by giving notice to such Manager In person or by telephone at least 24 hours in advance of the meeting, (ii) by sending a telegram or telex,. or delivering written notice by hand, to his last known business or home address at least 24 hours in advance of the meeting, or (iii)-fay mailing written notice to his last known business or home address at least 72 hours in advance of the meeting. A notice or waiver of notice of a meeting of the Board of Managers need not specify the purposes of the meeting. (i) Meetiqq by Telephone Conference Calls. Managers or any members of any committee designated by the Managers may participate in a meeting of the Board of Managers or such committee by means of conference telephone or similar communications equipment by means of which all persons participating In the meeting can Rear each other, and participation by such means shall constitute presence in person at such meeting. (j) Quorum. Any such committee, to the extent provided in the resolution of the Board of Managers and subject to the provisions of the Act, shall have and may exercise all the powers and authority of the Board of Managers in the management of the business and affairs of the Company. Each such committee shall keep minutes and make such reports as the Board of Managers may from time to time request. If mailed, notice is given when deposited in the United States mail, postage prepaid, directed to the Member at his address as it appears on the records of the Company. (e) Volute_ List. The officer who has charge of the membership ledger of the Company shall prepare, at least 2 days before every meeting of Members, a complete fist of the Members entitled to vote at the meeting, arranged in alphabetical order, and showing the address of each Member and such. Member's economic interest in the Company (his "Percents Interest"). Such list shall be open to the examination of any Member, for any purpose germane to the meeting, during ordinary business hours, for a period of at least 2 days prior to the meeting, at a place within the city where the meeting is to be hold. Mowing of the side slopes shall be accomplished according to the season. Maximum grass height shall be 6". B. Cattails are encouraged along the pond perimeter, however, they shall be removed when they cover more than 1/2 the surface area of the pond. The best time to cut them is at the end of the growing season, in November. Environmentally sensitive chemicals for use in killing cattails can also be used. Contact the Agricultural Extension Service. C. The orifices is (are) designed to draw down the pond in 2 to 5 days. If draw -down is not accomplished in that time, the orifice shall be replaced with a larger or smaller orifice, as required. Slow draw down may be attributed to a clogged system. The source of the clogging shall be found and eliminated. Pond Maintenance Requirements Page 2 D. All components of the detention pond system shall be kept in good working order. Repair or replacement components shall meet the original design specifications as per the approved stormwater plan. If previously approved components are determined to be ineffective, the component shall be redesigned and/or replaced. The following information is needed to continue the stormwater review: The "littoral zone" detail should be modified so that it is shown as being a perimeter item, ie., on both sides of the pond. The'detail as currently shown indicates that the shelf is only located within the forebay, and only on one side of it. The shelf area is not to be located within the forebay, only in the pond. Additionally, the slope of the shelf area, (6:1 minimum), and the begin and end elevations of the shelf must be indicated on the detail. 2. The following items summarize the revisions as they relate to your numbered comments: L We have revised the "Wet Pond Section" to illustrate the littoral zone in the main pond area only. Additionally the slope of the shelf and the beginning and ending elevations are now shown on the detail. 2. The "Wet Pond Section" has been revised to show the elevation of the top of the containment berm at 38.30'. This elevation is higher than the permanent pool but lower than the storage pool. 3. The permanent pool dimensions have been added to the plan view of the pond. 4. Dimensions of the building, parking, and sidewalks have been added to the plan view. 5. Our client has decided not to improve Zion Hill Road as shown on our previous plans. Runoff from Zion Hill Road therefore, will be handled by NCDOT within roadside swales. We have added a driveway culvert to our plans to "bypass" Zion Hill Road runoff. The total area and BUA served by the stormwater detention pond has therefore been reduced. The calculations, tables, and stormwater form have been revised to account for this change. The additional 2000 SF for building BUA shown on the application is attributed to a small (25" x 30') concrete block storage building adjacent to the concrete apron and to a small "reserve" in the event the owner decides that additional BUA is needed for future maintenance activities. The storage pool elevation has been reduced from 38.9' to 38.7' due to the elimination of service for Zion Hill Road. Enclosed for your review and approval are two copies each of the following documents: 1) Stormwater and erosion control plans; 2) Hydrologic and hydraulic calculations; 3) DWQ Stormwater submittal form; 4) Maintenance Requirements form; and, 5) Check in the amount of $385 to cover the application fee. The Maintenance Facility is part of the "overall" project submitted to your office as Carolina National at Winding River Plantation. A current stormwater permit exists for the overall project under DWQ Permit Number SW8 961109. Our most recent submittal for the overall project allocates a BUA value of 2.7 acres to the Maintenance Facility Tract. Our current detailed submittal significantly reduces the BUA proposed to 1.45 acres. We will soon be making submittal for the next Phase (1 B) of "overall" development, and the stormwater documents will reflect the detailed Maintenance Facility data.
