Coast Harley Davidson. Per the requirements of the permit, a copy of the
Engineer/Designers certificate for the stormwater pond must be forwarded to our office
upon completion of the site. A Certification Request letter was sent to you on June 24,
2004. A review of our files indicates that we have not received a copy of the certificate
yet.

Hi Linda,
Our crews are scheduled to collect the field data necessary to complete
the requested Designer's Certification sometime this week.
We should be able to submit the certification shortly there after.
The training course is continuously and erroneously being referred to as a "parking lot".
For the record please correct this misnomer, as the proposed site is to be used for
rider safety and education purposes only and not as a parking lot and has never been indicated
as such.

You also referred to me as a PE, as flattering as it sounded (I think)
please let me assure you that this is not the case. (I played one
on TV once, but that was about it.)
At this point in my career I have about zero desire to become a PE
nor would I want to wish it on anyone else.

Dear Mr. Noyes:
On June 24, 2004, and again on December 14, 2004, the Division sent you letters requesting
that you submit a copy of the Designer's Certification for this project. On March 8, 2006, the
Division received a plan revision regarding the construction of a parking lot on one of the future
development tracts identified as FDA-1. On March 20, 2006, the Division received an email
from your consultant, David Brown, P.E., with Hanover Design Services, indicating that the
necessary Designer's Certification would be submitted as soon as possible. On May 18, 2006,
the Division reviewed the plans submitted and again requested that the Designer's Certification
be submitted. To date, the required Designer's Certification has not been provided.
Prior to approving the plan revision, the permitted pond must be certified by an appropriate
designer. Please submit the required Designer's Certification as required by Section 11.7 of
your permit prior to July 7, 2006. The construction of the new parking lot on FDA-1 may not
commence until the Designer's Certification is received and the plan revision has been
approved.
Failure to submit the requested information by July 7, 2006, may result in the initiation of
enforcement action, to include potential fines and revocation of the permit, resulting in
construction delays. By copy of this letter to the Onslow County Building Inspector, the Division
is informing them of the deficiency at this site, located at the intersection of Onslow Pines
Road (SR1116) and US 17, and requesting that they consider withholding the certificate of
occupancy for this project until the necessary information is provided. If you have any

a modification to the 5W8 030508 permit, and Mr. Noyes owns the Future Development
Area No. 1 (FDA -a) , then an offsite supplement is not necessary, unless he is
planning on conveying the ownership of that area in the near future.
If Mr. Noyes will not be conveying ownership of FDA-1, then only a plan revision to
show the specific development of that area is needed.
If Mr. Noyes plans to sell FDA-1, then this will be a new permit, not be a
modification to SW8030508. FDA-1 will receive it's own offsite permit and permit
number. Having a separate permit facilitates the transfer of ownership of the
individual parcels.
In either case above, the required designer's certification has not been submitted.
This certification must be submitted prior to approving a plan revision or issuing
an offsite permit.
Please advise ASAP.

NARRATIVE
NOTE: To be reviewed in conjunction with " Erosion & Sediment Control and Water Quality Plan
for Carolina Coast Harley Davidson," Hanover Design Services, P.A., Drawing No. 104025ecpTC
Sheets 1-3.
PROJECT DESCRIPTION -
The purpose of this project is the addition of a Training Course Area, along with
additional site grading to a previously approved Harley Davidson dealership. The Water
Quality Plan is to identify measures to treat Storm Water previously approved and the
delineation of this project's additional impervious.
The site is located at the intersection of U.S. Highway 17 and Onslow Pines Road (SR 1116), on the
northwestern corner. The total site area is 8.79 acres in sire, 3.7 acres of which are proposed to be
disturbed for this phase of development. The site is mostly flat, slightly sloping topography towards
the north along the northern part of the site. It is bordered on the south by Onslow Pines Road (SR
1116), on the east by US Hwy 17, on the west by a single family residence and some vacant land,
and on the north by single family residences as shown on drawing 9 104025ecpTC Sheets 1-3.

Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as attached
and on file with and approved by the Division of Water Quality and considered a part of this
permit.
This permit shall be effective from the date of issuance until August 1, 2013, and shall be subject
to the following specified conditions and limitations:
1. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. The stormwater control has
been designed to handle the runoff from 325,708 square feet of impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans. The built -upon area for the future development is limited
to 214,780 square feet.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system. A permit modification must be
submitted and approved prior to the construction of additional built -upon area from
outside of the approved drainage area.

I1. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to the issuance of a Certificate of Occupancy for
any facilities on this tract, including existing facilities, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the
system installed certifying that the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other supporting documentation.
Any deviations from the approved plans and specifications must be noted on the
Certification. A modification may be required for those deviations.
8. No Certificate of Occupancy shall be issued for any facility on the tract, including
existing facilities, prior to the completion of construction and certification of the
stormwater system.
9. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
10. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage
area.

C. Further subdivision, acquisition, or sale of all or part of the project area. The
project area is defined as all property owned by the pennittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
11. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the amount permitted under this permit, a modification to the permit must be submitted
and approved prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
13. At least 30 days prior to the sale or lease of any portion of the property, the permittee
shall notify DWQ and provide the name, mailing address and phone number of the
purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee if access to the stormwater facilities will be restricted by
the sale or lease of any portion of the property.
14. The permittee must maintain compliance with the proposed built -upon area and ensure
that the runoff from all the built -upon is directed into the permitted system.
15. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
16. The permittee must maintain the current permitted drainage area. No additional runoff
from outside of the permitted drainage area boundary may enter the permitted stormwater
facilities without first applying for and receiving a permit modification.
111. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director. In the
event of a change of owership, or a name change, the permittee must submit a formal
pen -nit transfer request to the Division of Water Quality, accompanied by a completed
name/ownership change form, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved. The permittee is responsible
for compliance with all permit conditions until such time as the Division approves the
transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stonmwater management systems.

The permittee grants DENR Staff permission to enter the property during normal business
hours for the purpose of inspecting all components of the permitted Stormwater
management facility.
6. The permit maybe modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and rcissuance or termination does not
stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address changes
within 30 days.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted acreage

3. All the built -upon area associated with the project is graded such that the runoff
drains to the system.
4. The outlet/bypass structure elevations are per the approved plan.
5. The outlet structure is located per the approved plans.

8. Vegetated slopes are no steeper than 3:1.

Dear Mr. Noyes:
The Wilmington Regional Office received a Stormwater Management Permit Application for
Carolina Coast Harley Davidson on May 6, 2003. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue the
stormwater review:
Please provide a legend on the plans.
2. Please provide dimensions and bearings for all property lines. The bearings and
dimensions for the northern portion of the property have been omitted.
3. Please dimension the buildings, sidewalks, and driveways.
4. Please label the permanent pool and temporary pool elevations on the pond detail.
5. Please add the elevation of the top of the drop inlets.
6. The total drainage area and amount impervious should be delineated for the area draining
to each forebay. The forebay should be sized with this information to ensure that each
forebay contains adequate volume for the area draining to it. For example, if one forebay
receives 70% of the runoff and another receives 30%, the forebays will require different
volumes based on the amount of storage needed to treat the runoff. Please provide your
calculations.
7. Please divide the future impervious square footage for each future development lot. The
area adjacent to Pines Road should be separated because this area drains to a different
forebay.
8. If the owner plans to sell the future development, please label the tracts. This will make
future permitting easier.

The requested information should be received by this Office prior to July 25, 2003, or the application will
be retumed as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee.
If you need additional time to submit the information; please mail or fax -your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90
days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to
enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original
documents that need to be revised have been sent to the engineer or agent. All original documents must be
returned or new originals must be provided. Copies are not acceptable. If you have any questions

I inspected Coastal Carolina Harley Davidson on July 22, 2003. At this time, the
disturbance is approximately 0.75 acres. Portions of the parking lot have been
paved and the building is being constructed. According to Onslow County
records, the property was sold to Mr. Noyes on 11/27/2002. The entire tract of
9.53 acres was sold to him at one time along with an additional acre across Piner
Road. I have revised the permit to reflect today's date. Please let me know how
you want me to proceed.

NARRATIVE
NOTE. To be reviewed in conjunction with " Erosion & Sediment Control and Water Quality Plan
for Carolina Coast Harley Davidson," Hanover Design Services, P.A., Drawing No. 104025ecpHSR.
PROJECT DESCRIPTION -
The purpose of this project is construction of a Harley Davidson Dealership building,
parking lot, and access roads to serve the site. The Erosion and Sediment Control Plan is to
identify measures to be implemented to control erosion during construction of the private
roads, utilities, and land grading associated with this development
The site is located at the intersection of U.S. Highway 17 and Onslow Pines Road
(SR 1116), on the northwestern corner. The total site area is 8.79 acres in size, 5.5 acres of
which are proposed to be disturbed for this phase of development. The site is wooded,
mostly flat, slightly sloping topography towards the north along the northern part of the site.
It is bordered on the south by Onslow Pines Road (SR 1116), on the east by US Hwy 17, on
the west by a single family residence and some vacant land, and on the north by single family
residences as shown on drawing # 10402ecp 1 HSR.
SOILS -
The soils in the project area are Baymeade fine sand (BaB), well drained soils to
somewhat poor drained soils with a hydrologic classification of"A" and Onslow loamy fine
sand (On), moderately well drained soils with a hydrologic classification of "B," The
primary means of stormwater transport in all areas around the site, all proposed site
improvements, and impervious areas will be directed to the storm water pond via conduit.
Erosion "K" factors of the onsite soils are mostly 0.1, slight erodibility. Inlet
protection, silt fencing, and direction of all stormwater to the sediment basin will be the
primary means of sedimentation control.

PLANNED EROSION AND SEDIMENT CONTROL PRACTICES -
I. TEMPORARY GRAVEL CONSTRUCTION ENTRANCE
Practice 6.06
Shall be installed at the entrance of the project from U.S.Hwy 17. Drainage is away
from the road and sedimentation will be controlled with downstream practices. During wet
weather it may be necessary to wash truck tires at this location.
2. LAND GRADING
Practice 6.02
Grading should be limited to areas as shown on the plans. Cut and fill slopes shall be
3:1 or flatter except where specifically indicated.
3. SEDIMENT FENCE
Practice 6.62
Sediment fencing should be installed as shown on the Plan, and around any temporary
stockpile areas as necessary to prevent any graded interior areas from eroding onto adjacent
areas.
4. CONSTRUCTION ROAD STABILIZATION
Practice 6.80
Upon reaching final grade and after utilities have been installed, road areas are to be
stabilized by placing sub -base course of approved stone, to reduce erosion and dust during
the remainder of building construction.
INLET PROTECTION
Practice 6.52
Storm sewer inlet barriers of silt fencing or block and gravel inlet protection are to be
constructed to help prevent sediment from entering the storm sewer system.
6. SEDIMENT BASIN
Practice 6.61
The Sediment Basin is to be constructed first (see Construction Schedule) and is the
primary Practice to prevent sediment from leaving the site. Detailed design and spillway
configurations are specified in the CALCULATIONS section following.

l . Obtain approval of Plan and any necessary permits, and hold a pre -construction conference
prior to commencing any work.
2. Flag work limits and stake -out roadway and Sediment Basin for preliminary grading.
3. Install Gravel Construction Entrance.
4, Install Sediment Basin as shown on Plan prior to clearing and grubbing site.
S. Construct other sediment control Practices shown, prior to rough grading site, stockpiling
topsoil as necessary.
6. Establish final grades and stabilize roadway areas with stone base course.
7. Final grade building sites, install public and non -municipal utilities as needed, and
vegetatively stabilize areas where building construction is not imminent.
8. All erosion and sediment control Practices are to be inspected weekly and after any rainfall,
and repaired as necessary.
9. Upon completion of building construction, the roadway areas are to be paved and all areas
permanently vegetatively stabilized. After site stabilization, temporary measures are to be
removed and the Sediment Basin cleaned to its original design contours, if necessary, and
riser structures orifices opened, so as to function as a stormwater management / water quality
retention pond.

Indicated on plan
All measures to be inspected weekly and after any rainfall event and needed repairs made
immediately.
2. Sediment Basin to be cleaned out when the level of sediment reaches 5.5' below orifice
opening. Riser structure to be cleaned if excess water above design surface no longer drains
properly.
3. Sediment to be removed from behind the Silt Fence when it becomes 0.5' deep. Fencing to be
repaired as needed to maintain a barrier.
4. All seeded areas shall be fertilized, mulched, and re -seeded as necessary, according to
specifications provided, to maintain a suitable vegetative cover.
5. Construction entrance to be maintained in such a manner as to prevent mud or sediment from
leaving the construction site. Periodic topdressing with 2-inch stone may be required.
Inspect after each rainfall and immediately remove all objectionable materials spilled,
washed, or tracked onto public roadways.

The overland flow portion of flow time may be determined from Figure 8.03a.
The flow time (in minutes) in the channel can be estimated by calculating the
average velocity in feet per minute and dividing the length (in feet) by the
average velocity.
Step 4. Determine the rainfall intensity, frequency, and duration (Figures 8.03b
through 8.03g—source: North Carolina State Highway Commission; Jan.
1973). Select the chart for the locality closest to your location. Enter the
"duration" axis of the chart with the calculated time of concentration, Tc. Move
vertically until you intersect the curve of the appropriate design storm, then
move horizontally to read the rainfall intensity factor,1, in inches per hour.
Step 5. Determine peak discharge, 0 (ft /sec), by multiplying the previously
determined factors using the rational formula (Sample Problem 8.03a).

DECLARATION OF RESTRICTIONS
COUNTY OF ONSLOW
THIS DECLARATION made the day of , 2003, by RICK
NOYES ("Owner"), owner of that certain tract of land in the City of Jacksonville, Onslow
County, North Carolina, containing 8.79 acres and more particularly described in deed
recorded in Book 1859, Page 891, of the Onslow County Registry (the "Property");
WITNESSETH:
WHEREAS, Owner is constructing certain improvements on the Property; and
WHEREAS, Owner has secured from the Division of Water Quality, North
Carolina Department of Environment and Natural Resources, State Stormwater
Management Permit # , issued under Title 15 of NCAC 2H.1000; and
WHEREAS, Title 15 NCAC 2H.1000 requires that the following deed
restrictionstprotective covenants be placed against the Property.
NOW, THEREFORE, Owner declares that the Property described above shall be
held, sold and conveyed subject to the following covenants and restrictions:
1. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number , as issued by the
Division of Water Quality under NCAC 21-1.1000.
2. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the stormwater management permit.
3. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
4. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division of Water
Quality.
5. Alteration of the drainage as shown on the approved plan may not take
place without the concurrence of the Division of Water Quality.
6. The built -upon area for the initial improvements shown on the approved
plans is 78,198 square feet and the maximum built -upon area for outparcel(s) and future
areas shown on the approved plans is 214,780 square feet (resulting in a total
impervious area for the entire Property of 325,708 square feet).
These allotted amounts include any built -upon area constructed within the
property boundaries, and that portion of the right-of-way between the lot lines and the
edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt,
concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include
raised, open wood decking, or the water surface of swimming pools.
7. The runoff from all built -upon area on the outparcel or future area must be
directed into the permitted stormwater control system.
8. Built -upon area in excess of the permitted amount will require a permit
modification.
9. The connection from the outparcel's collection system into the stormwater
control shall be made such that short-circuiting of the system does not occur.
10. Each outparcel or future development tract whose ownership is not
retained by the permittee, shall submit a separate offsite stormwater permit application
to the Division of Water Quality and receive a permit prior to construction.
