Morris First Citizens Bank Swansboro Onslow County FOR THE construction, operation and maintenance of an infiltration basin in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules"} and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until February 28, 2013, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS l . This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The infiltration basin has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 24,272 square feet of impervious area. The infiltration basin is designed to store and infiltrate the runoff from 3" of rain, therefore a vegetated filter is not required. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every G months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. G. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. Any additional runoff from outside of the approved drainage area (either onsite or offsitc) into the permitted system. 4 State Stormwater Management Systems Permit No. SW8 020821 9. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 11. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee.'An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 12. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II1. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Pennittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Pennittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 5 State Stormwater Management Systems -Permit No. SW8 020821 Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. Permit issued this the 28th day of February, 2003. The existing site prior to redevelopment consisted of a First Citizens Bank building, a vacant two-story building, asphalt parking areas and drives. Kirnley-Horn and Associates requested that we estimate the depth to the seasonal high water table (SHWT) and estimate the hydraulic conductivity (K, in two locations ors the site. The information is needed for stormwater ' management facility design. Two hand auger borings were made to observe soil conditions for the purpose of estimating the depth to the SHWT and to estimate the soil permeability. The borings were made to a depth of 108 inches at both locations. The estimate of the hydraulic conductivity was made based on the observed soil textwe and other soil eondirions. Burin Several borings were attempted near the center of this location, but met refusal at less than 24 inches depth because of gravel and concrete fragrents. A final hand auger boring was made to a depth of 108 inches in the approximate location depicted on the attached figure. The soil at this location resembled the Marvyn series. Based on the site maps provided by Kitnley-Horn, the elevation of this boring location is estimated to be about 13 feet. ' The soil from 0 to 18 inches appeared to, be fill or disturbed natural soil containing gravel and concrete fragments. Its texture was fine sandy loam, From 18 to 36 inches, the soil was yellowish brown fine sandy loam. From 36 to 52 inches, the soil was massive, strong ' brown clay and sandy clay. Gray mottles were observed at a depth of about 42 inches. From 52 to 96 inches, the soil was Eight yellowish brown sand with lumps of gray sandy ' loam. From 96 to 108 inches, the soil was white sand. The soil was water saturated beginning at a depth of 52 inches, at the interface of the clay arid sand soil layers. The depth to the water table was measured at a depth of 52 inches below the ground surface, approximately one hour after the boring was completed. The hydraulic conductivity of the fine sandy loam soil (0 to 36 inches) is estimated to be 2 to 4 Whr. The permeability of the massive clay layers (36 to 52 inches) is estimated to be much less than the 0.52 in/hr required for infiltration basins. The permeability of the sand layers beneath the clay (52 to 108 inches) is estimated to be about 6 in/hr. Boring Vocation 2 A hand auger boring was made to a depth of 108 inches at this location. The soil at this ' location resembled the Marvyn series. Based on the site maps provided by Kimley-Horn, the elevation of this boring location is estimated to be about 15 feet. The soil from 0 to 18 inches appeared to be disturbed natural soil_ Its texture was fine sandy loam. From 18 to 48 inches, the soil was yellowish brown fine sandy loam_ From 48 to 71 inches, the soil was massive, strong brown clay and sandy clay. Gray mottles ' were observed at a depth of about 52 inches. Front 71 to 96 inches, the soil was light yellowish brown sand with lurnps of gray sandy loam. The permeability of the sand p ty layers (71 to 108 inches) is estimated to be about 6 in/hr_ ' Conclusions The depth to the water table corresponds with the bottom of the clay layers encountered ' in the soils at both boring locations. Because the project site is located in a midslope position above the White Oak River, it is likely that the permanent water table is confined beneath the clay layers, draining toward the river through the sand layers beneath the clay. It is also likely that water drains along the top of the clay layers during periods of rainfall. The slope of the site makes it unlikely that the water perches on the clay layers for very long, therefore the permanent water table is likely that beneath the clay layers. The ' difference in the depth of the water table beneath -the soil surface at the two locations is likely due to the elevations of the boring positions. We estimate the elevation of the water ' table, therefore, to be about 9 feet. If permission can be. obtained from the NC-DWQ, it may be possible to construct an infiltration basin in the area of bong location 1 by excavating the soil to the bottom t elevation of the clay layers, placing a suitable sand fill to a depth of about 2 feet above the water table, and obtaining any additional volume by building a soil berm around the basin (if necessary). We understand that the excavation of unsuitable soil material and replacing it with fill is considered by the NC-DWQ on a case -by -case basis. Unless there are other utilities besides the sanitary sewer line and the transformer pad, it would appear that a retaining wall could be built which would provide significantly more storage. If the only thing in the way of the retaining wall and additional storage is a minor relocation of the utilities, I think that it would be considered "maximum extent practicable" and a fair tradeoff to gain additional storage. As you may be aware, the rules require a bypass and vegetated filter for the excess volume from all infiltration systems. The standard design volume is 1" for non -SA waters and 1.5" for SA waters. A few years back we started running across projects that, for various reasons, could not provide the required bypass and 50, vegetated filter. Jeanette, Bradley, and I agreed that in lieu of the bypass and filter, we would require additional storage. The exact amount of storage is based on the distance to the receiving waters, the infiltration capacity of the soils, and the depth to the seasonal high water table. The design volume for a project far.away from SA'waters (1/2 mile), with good infiltration and a deep SHWT, would be required to do twice the design storm. Projects adjacent SA waters, with marginal soils (<I" per hour) and shallow SHWT (right at 21) would be required to provide 3 times the minimum volume. Projects in-between are subject to a design volume somewhere in-between. Based on what I see on the plans, a retaining wall placed around the entire interior perimeter of the curbing (staying 5' away from the transformer pad) would provide storage for close to a 3.5" volume. Certain areas would have a 6-7 foot retaining wall, therefore, per the "maximum extent practicable" requirement under the redevelopment rules, I am able to consider a retaining wall and/or 2:1 slope (or combination of the two) to provide 3" of volume. Stabilization of a 2:1 slope is a concern, so it will need to be either rip -rap or sod. In a separate matter, I reviewed the drainage area plan received on October 7, 2002. The offsite drainage area is still a concern. What is happening to the runoff that collects along the northeastern curbing on Main Street? There is no catch basin to pick up this runoff on the plans, so I have to assume that, unless Elm Street does not have a normal crown section, it turns the corner and heads northeast along the curb down Elm Street to be eventually collected into the infiltration basin. There isn't enough existing contour information for Elm Street to definitively conclude what is happening with the runoff. I calculate about 6,900 sq. ft. of offsite built -upon area, as opposed to the 2,144 now reported on the application. Please either account for this additional runoff or provide enough contour information for Elm Street on the plans to show how this drainage bypasses the proposed infiltration basin. The current application shows that the basin will hold 3,888 cubic feet of volume up to elevation 12.17. The total 3" volume required is 7,032 cubic feet (including the additional potential offsite area from above). The contours in the basin are already shown at a 2:1 interval, so I assume that a retaining wall of some sort will be needed in places to gain the additional required volume. Please submit revised plans, application and calculations for a 3" design volume. I am faxing you two sketches showing the offsite drainage area and possible retaining wall locations. The pre-existing impervious area totaled 28, 400 square feet and the post construction impervious area totals 25, 369 square feet. This represents approximately a 11 percent reduction in impervious area. Therefore, we believe that this project is a redevelopment project as defined in NCAC 2B. 1002(14), because we have decreased the impervious area. Under NCAC 213.1003 (3) (13), development may also be permitted on a case -by case basis if the project is redevelopment which meets the requirements of the rule to the maximum extent practicable. The only requirement that we cannot meet with the project as designed is the 50-foot vegetative filter strip before the runoff enters surface waters. To compensate for this inability, we can capture and infiltrate runoff from a two-inch rainfall event. We believe this increased capture rate should compensate for the loss of vegetative filter and in light of this being redevelopment, the plan meets the requirements of the rule to the maximum extent practicable. Enclosed are two (2) sets of the revised plans addressing the comments as described below. Also enclosed are copies of the revised stormwater applications and a Drainage Area plan with proposed drainage areas "DA-l" and "DA-22" delineated. Comments 1. Please either delineate all wetlands on site, disturbed or undisturbed, or note on the plans that none exist. A note has been added to the plans (Sheet C4) that no wetland exists on the site. 2. This project is proposing an infiltration basin, which is not considered an alternative design. However, I am able to give consideration regarding the untreated runoff. I consider the fact that the site used to contain over 28'000ft2 of impervious area that received no treatment, and which now contains under 3,000 ft2 of untreated imperious area a fair trade-off under the redevelopment guidelines. So noted. 3. No Comment. 4. Please either find a way to provide the required 50' vegetated filter, or provide additional storage in the infiltration basin for the runoff from a 4. 5" design storm (a little over 8,100 cubic feet). Because there are no specific rules to follow when a required element is not provided, we must use our best judgement on a case -by -case basis. I cannot allow this element of the system to be deleted without getting something else in return. Due to the proximity of this site to SA waters, a 4.5" design storm is justified. The use of retaining walls in the area of the infiltration basin will enlarge the basin and may free up enough space so that additional storage for the runoff is crated. Unlike wet detention ponds, infiltration basins are storage areas and are not required to have vegetated side slopes if something else will do a better job. Kimley-Horn and Associates, Inc. Based on the site design restrictions, the proposed First Citizens Bank site stormwater runoff has been captured and treated to the maximum extent practicable by the proposed infiltration basin and cannot incorporate a 50' vegetated filter. However, the proposed infiltration basin has been redesigned to capture a 2" design storm. The infiltration basin cannot be designed for the 4.5" design storm even with an expensive retaining wall constructed the entire perimeter of the basin. 5. The basin detail shows a now spreader, but it does not show what it is or how it will work. Please explain and provide additional details to ensure that the entire basin gets used for infiltration, instead of just the area immediately around the bypass structure. The flow spreader will be constructed of compacted clay in the vicinity of the emergency bypass control box to aid runoff entering the basin to be evenly dispersed throughout the basin. A plan view of the proposed flow spreader location has been added to Sheet C4 and the detail has been revised on Sheet C6. 6. It appears that offsite drainage from both Elm Street and Main Street may be entering the site at the driveways, however, on offsite area has been accounted for on the application. No existing catch basins or piping is shown in either Elm Street or Main Street to collect the runoff. Please show how this runoff will be blocked from entering the bank site. Due to the existing crown roadway sections of Elm and Main Street, there is some off -site water entering the site drainage system. We have accounted for this additional drainage in the application, in the calculations and these areas are shown' on the Drainage Area Plan. 7. Rather than show the confusing phased grading in the area of the drive-thru lane and retaining wall, please just show the final grading when all is done. The contours in this area overlap and make no sense. The enclosed plans have been revised to show the final grading without any overlapping grades due to Phase I and Phase 2 construction. 8. Please provide dimensions for the building, concrete areas, parking and drives. Dimensions for the requested areas have been added to Sheet C3. 4. Please label the drainage areas on the highlighted plan. As you are aware, the one -acre land disturbed area threshold has triggered the need to obtain a stormwater permit. To assist you in helping to resolve the permit issue, the following information may be helpful to understand the situation. The bank site was previously the location of three different land parcels. On one parcel located in the north east quadrant, a single family home previously existed. First Citizens Bank's building occupied the southern corner and a two-story office building was located on the western end of this triangular city block. Each parcel had rooftops, driveway and other impervious surfaces. This particular block is unique in that the surface experiences approximately 17 feet of elevation difference over a distance of approximately 300 feet. I'm sure that you have noticed this elevation change in your travels through Swansboro. Our client decided to construct a new bank in Swansboro and after significant discussions with the Town, they decided to undertake construction of a new branch office at the same general location. Prior to the bank construction, the NC DOT began the construction of an upgrade to US 24. The design for the bank was to be phased development with the initial phase not to exceed one -acre. Land disturbance crossed the one -acre threshold and it appears that a stormwater permit is required for the site. Our client has received a notice of violation from the Land Quality Section and the required erosion control plan has been submitted for approval. Our client has also received your office's Request for Stormwater Management Permit Application and the Notice of Recommendation for Enforcement on July 26 and July 29, 2002, respectfully. On August 2, 2002 Kimley-Horn staff met with Ms. Noelle Lutheran to discuss the site and the requirements for complying with the State rules. Subsequent to that meeting Kimley-Horn staff requested the assistance of Eastern Soils Limited to conduct a soils investigation of the site in anticipation of developing a stormwater management plan to meet the requirements of the State rules (report included with application). Two borings were conducted on the site to estimate the seasonal high water table and the hydraulic conductivity of the soils. The soils investigation concluded that the depth to the water table corresponds with the bottom of a clay layer located at approximately elevation 9.0. Further, because the site is located in a midslope position above the White Oak River, the investigator believes that it is likely that the permanent water table is confined beneath the clay layer, draining towards the river through sand layers beneath the clay. He also believes that water drains along the top of the clay layers during periods of rainfall and it is unlikely that water perches on the clay layers for very long. Given the location of the site, soil conditions, water table, and state of construction the following design considerations were included in the design of a stormwater management plan for the subject site. The pre-existing site contained approximately 28,400 square feet of impervious areas. The new site contains approximately 25, 368 square feet of impervious area which means that the new site has reduced the amount of impervious area by 3,032 square feet or by approximately 10.5 percent. The first option that was evaluated was to see if the site drainage could be re- designed to provide for infiltration runoff from the first one and one-half inch of rainfall from all impervious areas. Because the site has been completely graded with curb and gutter, asphalt, and roof drain system constructed it is apparent that there is a small area, approximately 3896 square feet that can not be captured and treated by an infiltration facility. In investigating the possibility of an infiltration facility, the soils report indicated that with the confining clay layer located at the ground water elevation that it would not be possible to construct a conventional infiltration facility. We believe this to be correct because there appears to be no available elevation difference between the bottom of the clay layer and the water table. Clearly there is not enough space on the site to construct a wet pond and I believe that an alternative EMPI Kimley-Horn = and Associates, Inc. stormwater facility is warranted. Therefore, the following stormwater design plan is being submitted for approval. Stormwater runoff from impervious areas will be collected and directed to an infiltration facility located between the driveways connecting to Elm Street with the exception of runoff from approximately 3900 square feet of driveway. This small area is located at an elevation too low to allow drainage to the facility. A bypass structure has been designed to bypass all runoff above the design storm consistent with the Division's BMP criteria. The infiltration device will require excavation of the clay layer down to the top of the permanent ground water table and then back fill with a minimum of two feet of select sand material to form the bottom of the facility. We believe that this will provide removal of 85 percent of the total suspended solids. It is not possible to capture the discharge at the bottom of the filter due to surrounding streets and drainage system elevations. The proposed design captures and treats runoff from approximately 21, 472 square feet compared to no treatment from approximately 28, 400 square feet that previously existed. We are not able to capture 100 percent of the new impervious areas but it appears that we are significantly increasing the treatment of runoff from the site compared to the pre-existing conditions. 15A-NCAC 2H 1003 (d)(3)(B) provides development may also be permitted on a case -by -case basis if the project "is redevelopment which meets the requirements of this Section to the maximum extent practicable". 2H.1002 (14) states "Redevelopment means any rebuilding activity which has no net increase in built -upon area or which provides equal or greater stormwater control than the previous development (stormwater controls shall not be allowed where otherwise prohibited)". The site imperviousness has been reduced, stormwater management is being proposed and the plan meets the intent of maximum extent practicable as called for in the rules and that water quality will be improved by the proposed plan. Therefore, under the provisions of the rules we are requesting approval of our stormwater plan as a redevelopment site and as an alternative design. The construction of the bank is nearing completion and all consideration to a quick review of the application is requested. I appreciate the situation that exists and understand the stormwater issues are our responsibility, however, it is our request that this issue be resolved as quickly as possible and before early October 2002.
