Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 020804 dated January 9, 2003, for the construction of Sea Oats Village. This permit shall be effective from the date of issuance until January 9, 2013, and shall be subject to the conditions, and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stonnwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structures, vegetated filter, flow spreader, catch basins and piping. g. Access to the outlet stricture must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of constriction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater controls have been designed to handle the runoff from 36,408 ft2, 19,289 ft2, 5,745 ft2 and 10,973 ft2, respectively, of impervious area. 3. The overflow from the infiltration trenches must be directed into a 50' vegetated filter prior to release into waters of the State. 4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the permitted built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The pennittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The pennittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stonnwater facilities without first applying for and receiving a permit modification. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Penmittee, a formal permit transfer request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittec to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stonmwater management systems. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 5 State Stormwater Management Systems Permit No. SW8 020804 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. After every runoff producing rainfall event and at least monthly inspect the bypass/overflow structure for blockage and deterioration and the infiltration system for erosion, trash accumulation, grass cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash and blockages as needed to maintain system performance.- 3. Remove accumulated sediment annually or when depth is reduced to 75% of the original design depth. Restore depth to original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. 4. The water level in any monitoring wells will be recorded after a I inch rainfal l event and at least once a month. Chronic high water table elevations (within I foot of the bottom of the system for a period of three months) shall be reported to DWQ immediately. 5. If DWQ determines that the system is failing, the system will immediately be repaired or replaced to original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 2H . 1000 must be designed, approved and constructed. b. Remove accumulated sediment from the infiltration system annually or when depth in the unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over - excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). UNDERGROUND INFILTRATION TRENCH OPERATION AND MAINTENANCE AGREEMENT 1. After every runoff producing rainfall event and at least monthly inspect the bypass/overflow structure for blockage and deterioration and the infiltration system for erosion, trash accumulation, grass cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash and blockages as needed to maintain system performance. 3. Remove accumulated sediment annually or when depth is reduced to 75% of the original design depth. Restore depth to original design depth without,over-excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. 4. The water level in any monitoring wells will be recorded after a 1 inch rainfall event and at least once a month. Chronic high water table elevations (within I foot of the bottom of the system for a period of three months) shall be reported to DWQ immediately. 5. If DWQ determines that the system is failing, the system will immediately be repaired or replaced to original design specifications. If the system cannot be repaired to perform its esign function, other stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed. 6. Remove accumulated sediment from the infiltration system annually or when depth in the unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over - excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water duality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the infiltration system. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. 4 When the depth at the benchmark reads '�" t� , the accumulated sediment shall be removed from the system. Please provide 4 original signature pages for each of the four infiltration supplements. Photocopying the signature page is not allowed, per the Attorney General's Office. 3. Please provide consistent design calculations, i.e., the same for each trench, which indicate all the steps leading up to the required volume calculation. For example, the required storage volume on sheets 2/5 and 3/5 is simply stated as " cubic feet", whereas on sheets 4/5 and 5/5, an actual calculation is provided. 4. Please either provide a bypass for the excess design storm, or provide storage for the runoff from a 4.5" event. The rules require infiltration systems to be offline, i.e., the bypass of the excess design storm must occur prior to the runoff entering the infiltration system. In this case, a separate overflow pipe from the oil separator set at the top elevation of the trench to a 50' vegetated filter will meet the regulations. 5. Please provide a 50' vegetated filter for the overflow from all infiltration systems. Show and specify the flow spreader mechanism, inverts, slopes and the grass type to be planted in the filter. 6. The design volume reported on the State's application should correspond to the calculated State's minimum 1.5" runoff volume, not the 2" storm. You need not demonstrate compliance with Emerald Isle's stormwater ordinances to DWQ. The provided volume shown on page 2 of the supplement is sufficient to demonstrate that you are providing more volume than is required under State regulations. 12. Please revise the pipe lengths for Trenches 1, 2, and 4 on the supplements. In Trench #1, for example, there are 3 sets of 125' long infiltration piping. Therefore, the length of 36" pipe provided is 3 x 125 or 375', not 125'. You can note on the supplement out to the side of the pipe length that there are 3 lengths of 125' each. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to November 2, 2002, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. On 5/23/02 a soil evaluation was performed on the above referenced site, as shown on the map entitled Survey For William U Farrington by Pate Phillips and Associates PA, last revision dated 615102. The site inspection evaluation was for the purpose of determining the soil limitations for design and installation of stormwater management infiltration systems conforming to NCAC TISA : 02H .1000. I offer the following observations and recommendations for your consideration. No wetlands per se were found on the subject parcel but the ordinary high water mark of Piney Creek does qualify as "waters of the US". It is obvious that this water body was at least partially dredged at one time and that the spoil materials were placed in the present buffer area at a time substantially predating the Clean Water Act. If no activities are proposed in or near the water body or the mandated 50' buffer, there will be no permit requirements under the regulatory jurisdiction of the Army Corps of Engineers. Soil sampling was performed along a transect west to east in the interdunal trough that offered the lowest elevations on the parcel outside of the Piney Creek buffer area. Other than identifying wetland characteristics, no soil sampling was performed in the 50' buffer assuming that no activities will occur in that area. The elevations of the profile sampling started at or near 9'f MSL, 10'± MSL and proceeded up to 16'± MSL on the Holly Street end of the parcel. Except for the first sample at the topo grid cut 50' from Bogue Inlet Drive, all of the soils were found to be various depths (I' to 8'+) of wind deposited sand most similar to the Newhan soil series over older dune geomorphology most similar to the Carteret County variant of the Fripp soil series. As in most of the cases where I can identify profiles that conform to MRCS standard descriptions, I use the MRCS data at the lowest Ksat values of that series to take into account the potential long term clogging of the infiltration surface. I therefore recommend that the design infiltration rate not exceed 6.0"/hour. When the soil wetness colors in the trough transect were plotted and converted to elevations in mean sea level (MSL) (i.e 4.8'+_ MSL @ 50' from Bogue Inlet Drive, 5.6'f MSL @ 150' from Bogue inlet Drive, 7.5'f MSL@ the western limits midway on the left boundary of the Hwy 58 frontage etc), the elevations had a very consistent slope of 0.8 to 09 percent and then leveled off on the Holly Street end of the tract. To assure the minimum 24" separation from the infiltration system invert to soil wetness colors and to optimize design alternatives for your adjustment to zoning design and other regulatory requirements, I offer the following recommendations on the minimum invert and horizontal locations for the stormwater management infiltration systems. It is may understanding that the on -site sewage treatment and disposal system is proposed north of the NIF Lee Van Winkle lot and west of the Bogue Banks Water Corporation well site. All stormwater infiltration systems should be kept at least 50' from any part of that system to assure minimal impacts during potential mounding after storm water precipitation events. When that area is omitted from consideration for stormwater infiltration systems, all of the remaining parcel to the west to Bogue Inlet Drive can easily provide the minimum 24" separation if the stormwater infiltration invert is placed at or above 7.6' MSL. All of the remaining parcel to the east to Holly Street can easily maintain the 24" separation if the stormwater infiltration invert is placed at 9.6' MSL. It is fine sand or sand, 0 page 4 of 4 0 0 • • U July 31, 2002 SPECIFICATIONS Sea Oats Village - Storm Water Plan The property is north of NC 58 and; east of Bogue Inlet Drive on Emerald Isle in Carteret County. Most of the tract is wooded. Piney Creek and Bogue Banks Water Corporation border the project on the north side, Bogue Inlet Drive on the West side, NC 58 on the South side and Holly Street on the East side. The tract contains 2.902 acres. The Town of Emerald Isle requires storage (infiltration devices) for the two (2) inch event. The Town has also required a thirty-five (35) foot buffer south of Piney Creek. There will be no land occupied within the 35 foot buffer. There is a very small portion of the property identif led as 404 Wetlands (Corps of Engineers jurisdiction) which will be left undisturbed. The wetlands are located along the banks of Piney Creek. See attached map (370047-0002-D) dated August 17, 1998 (Town of Emerald Isle, North Carolina, Carteret County) TREATMENT OF STORMWATER RUNOFF The development plan includes the construction of two buildings a connector driveway between the buildings and associated adjacent parking lots. This is a new project. Development is planned in two different areas of the same parcel. The project along NC 58 is identified as a 65 foot wide by 150 foot long building which will contain a proposed restaurant, three offices and three retail stores. ..f This plan provides for collecting runoff from different areas of the property numbered I through IV. Entry to all devices will be from standard 2 x 2 frame and grates which will be mounted in the parking lots in all locations. All impervious areas on the NC 58 building will be retained on site. There are no additional areas which drain on to this property. This plan also provides for collecting the runoff from a 2 inch event for the area on the south side of the Rogue Inlet Building as well as for collecting the runoff from a 2 inch event for the area on the west side of the Bogue Inlet Building. This collection device is a one barrel assembly which requires an entry pipe of smaller diameter in the flow line. The plan also provides for collecting the runoff from a 2 inch event for the area on the north side of the Bogue Inlet Building. This collection device located on the north side as shown on Sheet 5 of 5. All devices are located either within or close to the center of the parking/drive areas. All devices can overflow downstream from the initial collector to the final collector. If all devices fill, the overflow will be directed northward to the adjacent 404 wetlands (Piney Creek) which is shown on several sheets of the plans. There is a vegetated buffer located near the overflow of device # IV as shown on the plans. Erosion Control measures include Construction Entrances (2), Temporary Sediment Retention Basins and an overflow for all devices constructed of sod (Bermuda or Centipede). Calculations: See plans 2 of 5 through 5 of 5 for calculations and seal of engineer. U .I 0 SAFETY IN THE WORK PLACE Personnel safety is of paramount importance in all cases. The contractor shall call U-LOCO or NO -CUTS prior to beginning work. The contractor shall erect appropriate signs, issue personnel traffic vests, flags and ensure safety in all operations, especially around NC 58 and Bogue Inlet Drive with regard to vehicular traffic. All operations related to excavation, backf ill, lifting, erecting, transporting materials, searches for,utility lines, unloading materials and all work pertaining to construction operations shall be carefully conducted within safety guidelines of all local, state and national safety standards. The contractor shall be directly responsible for these safety measures. CONSTRUCTION (Storm Water Devices) Pipes which are detailed on the sheets shall be carefully manufactured and assembled off -site, coated with galvanization (paint bulkheads to meed DOT minimum standards), equipped with galvanized hugger bands, and galvanized connector bolts, washers and nuts. The pipe shall be carefully unloaded on the job site to prevent damage to shape or coatings. Lifting straps shall be only those of accepted industry standard. No damaged lifting straps or cables shall be allowed on the job site. Excavation shall be carefully completed, making certain to observe surrounding materials or equipment. The contractor shall clear the site prior to installation and will be responsible for maintaining a safe work place. As soon as the holes are excavated, geo-textile fabric shall be placed to ensure the cross-section in properly installed. Aggregate shall be filled, pipe installed and backfilled and the geo-textile fabric wrapped complete around all corners. The geo-textile fabric shall be overlapped in all instances (24" minimum overlap) and care shall be exercised to ensure tightly bound connections at risers. In all instances of these storm water infiltration pipes, grades are very important. The pipes shall all be installed level. When covering the entire apparatus, there shall be another level of geo-textile installed to ensure proper driveway and parking bearing. This is important and is herein re -stated. There shall be a final layer of geotextile covering (industry recommended) placed on top of every apparatus as a • measure of protecting the installation from crushing or settling as a result of 16 future traffic. If there are questions pertaining to this installation, the contractor shall request assistance from the Engineer. Maintenance Concerns: Therefore the following steps will be recommended for a maintenance plan. a. Remove silt within 48 hours after each 2" event. b. This silt shall be raked or shoveled and discarded as needed, but not discarded in an infiltration basins. C. Leaf and organic debris contributes sealing problems and must also be removed on the same schedule as the runoff siltation from the parking lot. Benchmarks: Provisions shall be made by the owner to set a bench mark for all devices.
