(7) Trade secrets, confidential information. - When a subpoena requires disclosure of a trade secret or other confidential research, development, or commercial information, a court may, to protect a person subject to or affected by the subpoena, quash or modify the subpoena, or when the party on whose behalf the subpoena is issued shows a substantial need for the testimony or material that cannot otherwise be met without undue hardship, the court may order a person to make an appearance or produce the materials only on specified conditions stated in the order. Director Division of Water Quality June 30, 2005 Mr. Arlyn Wall 247 Mohican Trail Wilmington, NC 28409 Subject- Cape Lookout RV Park 5tormwater Project No. SW8 020432 Carteret County Dear Mr. Wall: Thank you for your recent inquiries concerning the stor(Myster system a prayed for the Cape Lookout RV Park project. This project was originally permitt ed on Jufy , 2002, for 26 RV spaces, an office & bathhouse, a 16' wide inverted crown road, and 2 infiltration basins, each with a proposed bottom elevation of 8.95 FMSL. On or about February 13, 200$, the Division of Water Quality received a copy of a CAMA Major Permit application for the Cape Lookout RV Park. This application indicated that there were 28 proposed RV spaces, which was 2 more than the Division had permitted, On February 14, 2003, the Division sent Mr. Loftls a letter informing him that a modification to the stormwater permit was required to address this discrepancy. This letter was copied to Ms. Teri Barrett in the Morehead City office of the Division of Coastal Management. On March 12, 2003, the Division received the permit modification package for Cape Lookout RV Park. While the modification is in review, the conditions of the original permit remain in effect In the meantime, CAMA continued its review of the CAMA Major application. It is not unusual for CAMA to issue its permit with conditions that require approvals/permits from all other agencies to be in place before the permitted work can begin, Additionally, only work within 576' of the ORW AEC is covered by the CAMA permit. This may help explain why the construction was contlnuing in other parts of the project while the CAMA Permit was in process. On July 1, 2003. 1 inspected the project. My comments regarding this inspection are included in an email I sent to Mr. McLean on July 2, 2003, copy enclosed, This is the only documentation of this 4nspection. The bottom elevation of Basin #1 was also deepened from 8.95 FMSL to 8.75 FMSL. Calculations submitted by Mr. McLean indicate that the basins are sized to provide sufficient volume to meet the 1.b" design rainfall requirements of infiltration, Cary Beecher's .tune 7, 2005, inspection, copy enclosed, was conducted only a day or two after a 6-8 inch rain, and indicated that the infiltration basins were full. Both basins were dry. The plans were revised to remove the earthen berms and to fill in the low spot. 1 do not recall any of the particulars regarding Mr. Loftis' decision to fill the low spot rather than install a catch basin and pump, however, had a catch basin been proposed, I would have told Mr. Loftis that it would be necessary to increase the size of Basin #2 in order to account for the offsite runoff that would enter the catch basin from any of the adjacent properties. On November 20, 2003, John McLean, P.E., certified to the State that the project had been built within substantial compliance of the permit conditions and the approved plans. Until the re -inspection of the basins occurs after the next 5 rain -free days, the Division is unable to make a determination as to the projects compliance status. The stormwater application for this project indicates that there is no offsite drainage. The plans prepared by Mr. McLean and submitted to the Division show only that a low spot existed on the Loftis property at elevation 7.7. Based on the scant topographic information on the approved plans, it appears that a low area may have straddled both the Wall property and the Loftis property. It also appears that the filling of the low spot on the Loftis property is keeping the runoff generated by the Wall property from draining onto the Loftis property. Flooding is an issue that is not addressed in the stormwater permit, and which the Division has no jurisdiction over. If flooding is to be regulated, it must be done at the local government level. The NC Legislature has neither formulated flood control rules nor charged the Division with the responsibility of reviewing plans to make sure adjacent properties are not being flooded by the development of the permitted property. If any person, firm or corporation shall fell any tree or put any slabs, stumpage, sawdust, shavings, lime, refuse or any other substances in any creek, stream, river or natural or artificial drainage ravine or ditch, or in any other outlet which serves to remove water from any land whatsoever whereby the drainage of said land is impeded, delayed or prevented, the person, firm or corporation so offending shall be guilty of a Class 2 misdemeanor: Provided, however, nothing herein shall prevent the construction of any dam or weir not otherwise prohibited by any valid local or State statute or regulation. In addition to any fine or imprisonment imposed, the court may, in its discretion, order the person, firm, or corporation so offending to remove the obstruction and restore the affected waterway to an undisturbed condition, or allow authorized employees of the enforcing agency to enter upon the property and accomplish the removal of the obstruction and the restoration of the waterway to an undisturbed condition, in which case the costs of the removal and restoration shall be paid to the enforcing agency by the offending party. This section may be enl-orced by marine fisheries inspectors and wildlife protectors. Within the boundaries of any county or municipality this section may also be enforced by any law enforcement officer having territorial jurisdiction, or by the county engineer. This section may also be enforced by specially commissioned forest law -enforcement officers of the Department of Environment and Natural Resources for offenses occurring in woodlands. For purposes of this section, the term "woodlands" means all forested areas, including swamp and timber lands, cutover lands and second -growth stands on previously cultivated sites. I also spoke to the owner, Ron Loftis. You probably need to visit the site yourself because what you show on the plans will not be implemented at the site. The road adjacent the infiltration basins will NOT be sheet -flowing into the basins. There is a 1.5' high earthen berm that is preventing sheet flow from entering. All runoff appears to be directed to the ends of the basin. Additionally, the lot area beside the house, where there was supposed to be about 2' of fill, will be left alone. Mr. Loftin has installed a pump, and wants to construct a catch basin in the low area and pump all the runoff into the infiltration basin. The revised plans you worked on are no longer the proposed condition. Please talk to your client, visit the site, and get everything straight. Given the discrepancies between what is on the ground and what is shown on the plan, a permit will not be forthcoming in time for Mr. Loftis' appearance before whatever board or commission he is appearing before to get a CO. A copy of the follow-up inspection report after the 6/7/2005 site inspection. 2. Documentation of the inspection performed on or around May 21, 2003. 3. A copy. of Laurie Munn's list of problems at the site. 4. 'Documentation of our response to Mr. McLean's concern about the commencement of filling activities on some of the lots partially within the 575' AEC. Attached please find an inspection report dated March 21, 2006. Due to the moderate to severe drought our region finds itself in, the average rainfall in the Beaufort area between September 1, 2005 and February 28, 20b6, was only 4,4". The basins were dry on March 17, 2006. Approximately .88" of rain fell on March 24, 2006, and a re -inspection is planned for Wednesday, March 29, 2006, to see how quickly the basins are drawing down. You will be copied on that inspection report. On June 30, 2005, 1 sent you a letter in which I explained that written documentation of the site inspection I performed on July 1, 2003, does not exist. Please refer to my letter of June 30, 2005, for a summary of that inspection as 1 remembered it. Attached please find a copy of Laurie Munn's request for additional information letter dated May 21, 2001 This letter appears to be the "list of problems" at this site that she was referring to. I am unable to recall any other specific details in regards to those "problems". Mr. McLean's question in his July 7, 2003, email to me, was in regard to being able to fill Lots 18, 19 and 20, prior to receipt of the CAMA Major Permit, which was still in process at the time. I can find no documentation in the file regarding a written response to his question, however, it is not within the Division's authority to grant permission to undertake activities that are covered by another permit issued by a sister agency. My calculations show that Basin 1'does not have sufficient volume to infiltrate the 3" storm. Stormwater Permit Number SW8 020432.Mod issued on July 16, 2003. A summary of the findings and comments were noted under section 4 of his report. Gary's report noted that the inspection was made, both basins have been built, they were both full of water, and that the inspection was performed following a 6-8" rain event (several days before). A follow-up inspection would be performed to determine if both basins are infiltrating as they were designed to do. Marshall it states that an inspection was made by Daniel Sams from the N.C.Division of Water Quality on or about the week prior to June 10, 2005. That Mr. Sams investigated the Stormwater retention ponds within the RV Park and found it held approximately 8" more than the State requires the retention ponds to retain during the last heavy rain storm which was 6-8" several days before. The letter indicates that Mr. Ron Loftis Park Owner and Mr. Daniel Sams met on or about June 10, 2005. 1 have a copy of an inspection that Linda Lewis sent to me where Gary Beecher performed an inspection on June 7 , 2005 that indicates a summary of the findings and comments were noted under section 4 of his report. Gary's report noted that the inspection was made, both basins have been built, they were both full of water and that the inspection was performed following a 6-8" rain event several days before. It was noted on his report that a follow-up inspection would be performed to determine if both basins are infiltrating as they were designed to do. The drainage area for Basin 1 is shown to be 68,411 sq. ft.. The drainage area for Basin 2 is 63,400 sq. ft. The DOT has recently constructed a ditch on the north R/W of SR 1335. It is virtually impossible for the owner to prevent a strip of land about 6 or 8 feet wide to drain into that property. That accounts for the total 3.12 acres of this tract. Easley, Governor William G. Ross Jr., Secretary Thank you for your phone calls to me on June 21 and June 22, 2005 expressing concern about the Cape Lookout RV Park project. Among your concerns was that when you requested to see the file, Dan Sams, Regional Engineer of the Wilmington Regional Office, first told you that the file was closed and might have already been discarded. Upon inspection of the file, you felt you,were not given complete documentation. Although the file had been closed, all information had been retained, and my office has been forwarded all inspection reports. I am enclosing those reports here. I understand that this is the same information previously given to you. I did not find the "blank" inspection reports that you mention in your phone call. The inspection date and time leaving the site were inadvertently omitted on compliance inspection report following the May 20, 2003 inspection. Mr. Sams has since confirmed from another inspection on that same date that the date of this inspection was June 12, 2003. Both the June 12 inspection and the next inspection on September 2, 2003 found the site in compliance. The inspection report dated December 15, 2004 is a notation to the file that the project is completed, and the file can be closed. Given the nature of this project with respect to the Sedimentation Pollution Control Act of 1973, our file appears adequate. From conversations with you and with Dan Sams, I believe that your complaints are primarily about increased stormwater runoff from the adjoining Cape Lookout RV Park. I regret that we are not able to assist you in your problem. But, this kind of problem, while fairly common, is not specifically addressed by the Sedimentation Pollution Control Law of 1973 that we administer. I also spoke to the owner, Ron Loftis. You probably need to visit the site yourself because what you show on the plans will not be implemented at the site. The road adjacent the infiltration basins will NOT be sheet -flowing into the basins. There is a 1.5' high earthen berm that is preventing sheet flow from entering. All runoff appears to be directed to the ends of the basin. Additionally, the lot area beside the house, where there was supposed to be about 2' of fill, will be left alone. Mr. Loftis has installed a pump, and wants to construct a catch basin in the low area and pump all the runoff into the infiltration basin. The revised plans you worked on are no longer the proposed condition. Please talk to your client, visit the site, and get everything straight. Given the discrepancies between what is on the ground and what is shown on the plan, a permit will not be forthcoming in time for Mr. Loftis' appearance before whatever board or commission he is appearing before to get a CO. He told me this morning that he will use the area south of Lot 1 as a "common area" and he plans no improvements there nor any around the house. What help can you give as far as letting us proceed with the original plan on the areas inside the 575' setback area? Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the per nutted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The pennittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stormwater facilities without first applying for and receiving a permit modification. IIl. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of owership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and mayor may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Pennittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The size of the tract of land is 3,12 acres. There is an existing residence on the property which will be used as an office and a bath house for residents. The proposed street system will be one way traffic on a 16 foot wide right-of-way. The proposed street will be constructed in the shape of an inverted crown. The pavement width will be 14 feet. The tract of land is situated on the north side of SR 1335. The water course located to the south is Back Sound, classified as SA-ORW. There is no outlet drainage on this tract. There will be one way traffic on the street. The street system is set at .5% grade, with a high point located at the north quadrant point of the street, set at + 10.5 feet. The adjoining land is higher at this point with spot elevations exceeding +11 on Lots 11 & 12. Lots 7, 8, 9 & 10 require fill, but less than a foot in all places. Fill for the development is available on -site in two areas which will collect the storm water runoff and treat it with infiltration. The street grade will remain at .5% for the entire RV Park. Minor fill (less than a foot) will be necessary on Lots 1 & 2, and Lots 18, 19 & 20. The owner intends to selectively clear all lots in order to leave as many trees as possible so the canopy can be left. The only wholesale clearing will be for the street and the sewer system. The sewer system requires two parcels be cleared and low pressure lines installed. Only those two land masses will be cleared, the remaining will be left undisturbed. See map for clearing notes. Each infiltration basin has been sized to accept the flow of a 3 inch event. The western basin is 30 feet wide and 190 feet long. The eastern basin is 30 feet wide and 200 feet long. The volume for storage is based on equal flow to the basins, and each has a bottom elevation of 8.93 feet. This can vary as required for more or less storage. The bottom elevation is 9 inches lower than the inlet elevation. The overall storage is slightly more than required for the 3 inch event. The bottom of the infiltration basin shall remain with no silt, no topsoil, only native sand. It is imperative that the bottom of each basin be left without sealing from ability to infiltrate. At the entrance of both basins, on both ends of both basins, a temporary sediment basin has been designed to handle 1,800 cf/acre disturbed in the construction. The temporary basins are 25 feet square, 2 feet deep. These temporary sediment traps will eventually be filled when construction is complete and vegetation has been established. This property is a 3.12 acre tract previously occupied by a single residence and mobile home. The site is located on the north side of Island Road (SR 1335) on Harker's Island, Carteret County. Harker's is bound by West/East Mouth Bays on the north side, and Back Sound on the south side. The island is primarily residential in nature, with small family businesses supporting the local economy. The subject property has recently undergone clearing that is statutorily exempt from permitting requirements, That is to say, trees have been cut with minimal ground disturbance. On the south and north sides of the property, the elevations are low, and conducive to ponding. Mr. Mickey Sugg with the US Army Corps of Engineers has made the determination that any wetlands present are isolated and non jurisdictional (on file). The soils on site are sandy, primarily vegetated with pines and oaks. Toward the north end of the property in the area of the isolated wetlands, the vegetation expands to White Bay, Fetterbush, American Holly, and Sassafras. The waters of Back Sound carry a DWQ classification of SA-ORW; the area is open to the taking of shellfish for consumption, and is not designated as Primary Nursery Area. The Carteret County Land Use Plan classifies this area as Limited Transition, with all AEC's classified as Conservation. The proposal at hand is to clear, grade, and develop the infrastructure for an R/V Parlc. Approximately 2.75 acres will be graded, and a loop road installed with asphalt surface. The entrance road will be 25'-30' in width, with a 20' improved travel way. The remainder of the loop will be 14' of improved surface within a 16' right of way. Infiltration basins, 200' in length, are proposed for the east and west sides of the loop road. Road shoulders will slope (1:3) into these features. Two septic treatment facilities will be installed within the area proposed for disturbance in the center of the loop road. Sites are designated for 28 campers, and water will be provided through the municipal water supply. Finished impervious area shown on the submitted plats is approximately 23 % within the 575' AEC. The existing residence is intended to be converted into a park store and bathhouse. 10. ANTICIPATED IMPACTS: The project will require the grading of approximately 2.75 acres of high ground and isolated wetlands for commercial use. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Pennittee for a minimum of ten years from the date of the completion of construction. 12. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property, 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 111. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittce, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permittee until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. I. i5'd5_ • 11 Cape Lookout Harkers Island, NARRATIVE: RV Park North Carolina April 22, 2002 Cape Lookout RV Park is a proposed development planned on SR 1335 (Harkers Island Road). The size of the tract of land is 3.12 acres. There is an existing residence on the property which will be used as an office and a bath house for residents. The proposed street system will be one way traffic on a 16 foot wide right-of-way. The proposed street will be constructed in the shape of an inverted crown. The pavement width will be 14 feet. The tract of land is situated on the north side of SR 1335. The water course located to the south is Back Sound, classified as SA-ORW. There is no outlet drainage on this tract. There will be one way traffic on the street. The street system is set at .5% grade, with a high point located at the north quadrant point of the street, set at + 10.5 feet. The adjoining land is higher at this point with spot elevations exceeding +11 on Lots 11 & 12. Lots 7, 8, 9 & 10 require fill, but less than a foot in all places. Fill for the development is available on -site in two areas which will collect the storm water runoff and treat it with infiltration. The street grade will remain at .5% for the entire RV Park. Minor fill (less than a foot) will be necessary on Lots 1 & 2, and Lots 18, 19 & 20. The owner intends to selectively clear all lots in order to leave as many trees as possible so the canopy can be left. The only wholesale clearing will be for the street and the sewer system. The sewer system requires two parcels be cleared and low pressure lines installed. Only those two land masses will be cleared, the remaining will be left undisturbed. See map for clearing notes. Each infiltration basin has been sized to accept the flow of a 3 inch event. The western basin is 30 feet wide and 190 feet long. The eastern basin is 30 feet wide and 200 feet long. The volume for storage is based on equal flow to the basins, and each has a bottom elevation of 8.95 feet. This can vary as required for more or less storage. The bottom elevation is 9 inches lower than the inlet elevation. The overall storage is slightly more than required for the 3 inch event. The bottom of the infiltration basin shall remain with no silt, no topsoil, only native sand. It is imperative that the bottom of each basin be left without sealing from ability to infiltrate. At the entrance of both basins, on both ends of both basins, a temporary sediment basin has been designed to handle 1,800 cf/acre disturbed in the construction. The temporary basins are 25 feet square, 2 feet deep. These temporary sediment traps will eventually be filled when construction is complete and vegetation has been established. El i ra :7 • 0 SOIL CONDITIONS: 0 The property has been evaluated by Land Management Group, Inc. (Larry Baldwin, CPSS- A copy of his report has been included herein. Soil types Seabrook and Mandrin-dry phase were identified in an area planned for infiltration basin # 1 (West). Mandrin and Leon -dry phase were identified for infiltration basin # 2 (East). The seasonal high water table was identified as being from 35" to 55" below the surface of the ground. Permeability has been set at 2-6 inches per hour. DEVELOPMENT NOTES: The owner intends to obtain Carteret County Planning Board Approval in May. There will be no work done until DENR permits are obtained from Land Quality and Water Quality. The Carteret County Environmental Health Division has evaluated the land for septic permits. There will be two large systems which collect the effluent and dispose of it through low pressure pipe systems. A DOT entrance permit will be obtained for access to SR 1335 across an existing driveway to the existing residence which will be used as an office and bath house. Water supply for the Cape Lookout RV Park is being requested from Harkers Island Water Corporation. The owners plan to selectively clear for RV sites. Although clearing is necessary for the street, the owners plan to save as may oak trees as they can be carefully selecting sites. The septic system requires two active sites and two repair sites. The repair sites will NOT be cleared, but left with a canopy from existing trees as much as possible. Excavation, Filling and Roadway construction. As much as possible, all material to be excavated will be used in areas noted on plans to build up adjoining lots. The owners have been extremely cautious with respect to wholesale clearing. All work will be monitored carefully to ensure no clear cutting is done. The construction of the infiltration basins will be monitored to make certain no topsoil or silt is allowed to be placed in the basins. It is imperative that sandy soil is the medium in the bottom of the basins. 4) 0 a PLANNED SEDIMENTATION & EROSION CONTROL PRACTICES: 1, Construction Entrance See detail on drawing. Clean washed rock will be used in the entrance. 2. Temporary Sediment Retention Basins (4) See details on drawing. There is at least one basin at each corner of each infiltration basin. The Temporary Basins are to be 2 feet deep, 25 feet square. 3. Rock Check Dams Rock check dams are provided at the four corners of the infiltration basins as detailed on the drawings. 4. Silt Fences A silt fence will be used to protect adjoining property. It will be erected as shown on the drawings. S. Driveway pipe; None. The DOT has no roadside ditch along SR 1335. MAINTENANCE MEASURES: The rock check dams require monitoring for sediment accumulation. If evidence of silt is found at the check dam areas it shall be removed. Grass is a critical measure for all sediment control. If grass is found to be (91 ineffective, other temporary measures shall be used to control sediment. These additional temporary measures could be more check dams or additional silt fence. When ground cover is established, the siltation will be controlled. It is equally important to monitor the temporary sediment basins for accumulation of sand/silt. When it becomes obvious that at least 200/c of the temporary basins are filled, they will be excavated and graded to original construction conditions. NAME OF RECEIVING WATERS There is no outlet from this project to adjoining wetlands, marsh, water, streams, etc. TEMPORARY BENCH MARK There shall be a temporary bench mark set in each basin at the north and south e6—d-with the elevation of +9.5 clearly marked. When this elevation is reached, it is time to remove the sediment. NCDEH&NR "Stormwater Runoff Disposal" rules and regulations (NCAC 15-2H-.1000) were used as guidelines in making this evaluation. The proposed project is greater than 1 acre in size, proposes >25% impervious surfaces, drains to Class SA or ORW Waters, and is within 112 mile of class SA-ORW Waters. If the development project is within 1/2 mile of and drains to Class SA-ORW Waters or their unclassified tributaries, then stormwater must be treated by infiltration basins or an equivalent alternative method. The tract has previously been determined to be geographically located within 1/2 mile of Class SA- ORW Waters to the south, thus stormwater is to be treated through infiltration basins. This tract has broad sandy ridgetops, that gently slope (-1-3%) to poorly drained flats. Principle soil and site requirements for an infiltration system are: ---the infiltration system's bottom must be 2 ft or greater from the seasonal high water table; ---must be capable of complete draw - down within 5 days; ---the soil's hydraulic conductivity must be >0.52 inlhr (<115 min/in); ---recent fill (>1977) material is not usable. The enclosed land & soils map shows the various land/soil types found (see map). The following are brief descriptions of these land & soil types for stormwater infiltration usage: The "Yellow" Areas are well to moderately well drained, deep sandy soils. These soils have an estimated seasonal high static water table +45 to 55 inches from the surface, based upon soil wetness indicators. Estimated permeability is <10 - 20 minlin (+3-6 inlhr) to +48" depths. Soils may have a non-restrictive spodic horizon between +30-50" depths. These soil types should be considered as usable for shallow placed infiltration stormwater systems with basin bottoms <2-3 ft into the present ground surface. These usable soil areas should not be significantly excavated or altered. Soil types found are Seabrook and klandsrin-dry phase. Page 2. Cape Lookout RN Tract, Soils & Stormwater Usability The "Brown" Areas are moderately well drained, deep sandy soils. These soils have an estimated seasonal high static water table +35 to 45 inches from the surface, based upon soil wetness indicators. Estimated permeability is <10 - 30 min/in (+2-6 in/hr) to +45" depths, Soils may have a non-contiguous restrictive spodic horizon between +35-55" depths. These soil types should be considered as usable for ultra -shallow placed infiltration stormwater systems with basin bottoms <1.0 - 1.5 ft into the present ground surface and/or with sidewall berms. These usable soil areas should not be significantly excavated or altered. Soil types found are Mandarin and Leon -dry phase. The "Pink" Areas are somewhat poorly to poorly drained sandy soils. These soils have an estimated seasonal high static water table +12 to 25 inches from the surface, based upon soil wetness indicators. Estimated permeability is <20 - 40 min/in (1.5 - 3.0 in/hr). Soils may have a non-contiguous restrictive spodic horizon between +30-50" depths. These soil types should be considered as unsuitable infiltration stormwater systems, unless fill and site improvements can be constructed These natural soil areas should not be significantly excavated or altered. Soil types found are Leon and Lynn -Haven. The tract is relatively uniform within the respective soil groups delineated on the enclosed map. The major variations are depths to seasonal high water table indicators and depths to non- restrictive or restrictive spodic horizons, which are typcially non-contiguous. The better sites for stormwater infiltration system usage are on the higher elevations above—10-10.5 ft elevations, with marginal sites being above --9.5-10 ft elevations. Unsuitable sites are typically found at -r8.5 to <9.5 ft lower elevations. Careful planning and design should be exercised to insure gravity flow to usable soil areas, and that usable soils are reserved for stormwater infiltration treatment in their natural state.
