This permit expires on May 8, 2011, Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall ,be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is be set at $505.00. If this is still an active project please complete and submit the enclosed renewal application prior to November 8, 2010, If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should be completed and submitted along with your renewal application. You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construCion, erosion shall be kept to a minimum and any eroded areas ofthe system will be repaired immediately. The permittec shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. At least once a year, inspect the filter after a 1" design storm event to see if the filter is passing the runoff as expected. When storms of 1 " are not passing through the filter within 24 hours, remove the first 2"-4"of discolored sand and replace with new sand. Dewater the removed sand and properly dispose of C. Sediment removal in the collection system. d. Mowing and revegetation of side slopes. C. Immediate repair of eroded areas. f Maintenance of side slopes in accordance with approved plans and specifications. g. Debris removal and unclogging of weir structure, orifices, catch basins and piping. h. Access to each chamber must be available and sufficient for all maintenance activities. i. Pump out the sediment chamber and maintain it at the same time as the sand filter. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of`DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data.. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. 1 f the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. A modification must be permitted prior to any construction. The following items will require a modification to the permit. The Director may determine that other revisions to the project should require a modification to the permit: a. Any revision to the approved plans, regardless of sire. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area, or the drainage area. C. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 4 State Stormwater Management Systems Permit No. SW8 010108 10. A copy ofthe approved plans and specifications shall be maintained on file by the Permittee for a minimum often years from the date of the completion of construction. 11, Prior to the sale of any portion of the property, an accesslmaintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale orally portion of the property. 12. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 13 The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements ofthe permit. Within tlic time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 14. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days. 111. GENERAL CONDITIONS 1. "I'his permit is not trartsferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. r , In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. `rile filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Please delineate all wetlands on site; disturbed or undisturbed, or note on the plans that none exist. 2. Please submit an original signature on page 4 of the' application. Photocopies are not acceptable. 5. The sediment chamber should sheet flow into the sand filter over the weir, not through the 2" pipes at the bottom of the chamber. Please delete the 2" pipes. 4. The entire sand filter and sediment chamber must be lined with an impervious liner. If the soils are not suitable for infiltration, then the BMP sand filter design criteria must be adhered to. Based on information from the Central Office, the intent of the sand filter design is to provide an impervious barrier between the unsuitable soils and SHWT, to maintain a permanent pool of water in the sediment chamber, to prevent the resuspension of sediment, and to ensure that all runoff is directed into the sand chamber. If the entire filter and sediment chamber are not lined; the system must be redesigned under the infiltration basin design criteria. 5.- In keeping with the BMP design, and to encourage sheet flow across the filter, please provide additional weir cuts. A single weir will concentrate the runoff at a single point in the filter, whereas a number of smaller width weirs will encourage the runoff to sheet flow over a larger area of the filter. Please provide dimensions for the existing and proposed buildings, parking, streets, drives, walks, etc., that will drain into the filter. Please list both the owner's name and title (.terry Bittner / Title?) and the si(Tiling official's name and title (Michael Faye 1 General Manager) on page l of the application. What is Mr. Bittner's title? The signature authorization only says "Board of Directors". The Impervious Surface Area chart in Section 111, Part 6, indicates that the total impervious area draining to this filter is 2.39 acres. Is this correct? From the drainage area provided on sheet C-6A, the drainage area is 2.39 acres, and not all of the 2.39 acres appears to be impervious. Please list only the impervious (i.e., built -upon) area in that section. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to March 15, 2001, or the application will be returned as incomplete_ The return ofa project will necessitate resubmittal of all required items, including the application fee. If you need additional time to submit the information, please mail or fax your request for a time extension to the Division at the address and fax number at the bottom of this letter. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. Dear Ms. Lewis: F C IVED E$ 2 7 Zoal We have reviewed DWQ staffs comments for the above referenced project and our response is as follows: There are no wetlands deleniated on our plans. Within the 8.83 acres designated for the project impact area, and more importantly the areas immediately adjacent to the 1.70 acre project built - upon area, there are no known wetland areas. The zero -flow creek adjacent to the sand filter is a dry creek bed, except during rainfall events. 2. Our submittal should have had Mr. Faye's original signature. We will forward the copy returned to our office to Mr. Faye and ask him to re-sign and re -submit the form to your office. See also Response No. 7. Did staff review our Design Methodology for the proposed filter? if they had, one would have understood that the 16.0' weir is the flow spreader and the concrete/rip rap splash pad on the filter side of the weir wall acts to further disipate the flow velocity and spread the flow across the end of the sand filter cell. The 2-inch pipes are only underdrains for the fore bay section to prevent stagnated water and vector problem potentials. The desire of the Club is to make this stormwater facility one of the fairway hazards, but not to create a manmade wetland. The fore bay will function as required, with or without standing water. We do not want to delete all of the 2-inch pipes, but will do so if required by DENR staff. We would want the deletion requested and signed by Rick Shiver. 4. We disagree with DENR's request for a liner. It is not required in the Manual of Practice, and certainly has no justifiable benefit for this project application. We specifically provided our written justification for excluding the liner. We have provided considerable back-up data on this issue, and we recommend that DENR not require the use of a liner, in this specific case. The whole weir wall is the weir 16' — 0". Again, we feel that staff has not understood the design intent before issuing these comments. We provided a full set of Plans. We have shown the drainage area assessment calculations (sce Sheet C-6A & C-613). The information you request has been provided. 7. Mr. Bittner is a member of the Board of Directors for the Jacksonville County Club Corporation and is in charge of Audit & Administration of the Corporation. He is a Corporate officer. We have added his name as requested to page 1 of the Application. If the DENR staff is still not satisfied, please contact the Country Club directly to resolve this issue. We have addressed Sect. III, Part 6. Please understand that the 8.83 acres is the designated project area within the 180 acre golf course. Initially this was chosen arbitrarily to comply with LOW DENSITY impervious limits, which no longer apply to this project. 9. For design criteria and filter sizing purposes, we included everything within the 2.39 acres as impervious. Once traffic crossover during demolition and construction has finished, grassed areas will be well compacted. Please understand that we have purposely provided more filter capacity than the as -built conditions will need. Therefore, use 2.39 acres, the filter design will handle this size area. The staff review comments of 2/15/01, in our opinion, do not warrant an additional 90 days review by staff. Regarding Comment #4, we will require a design consultative session with DENR staff prior to amending our design to include a liner. We strongly disagree with the cost -benefit and regulatory need for a liner in this specific BMP application. Groundwater contamination by the filter is not an issue for this project. Due to the increase in impervious surface parking, the new facility will exceed 1.0 acres of disturbance. Furthermore, although the project area represents less than 30 percent of the built -upon area, the clustered development nature of the proposed construction and the need to install a storm sewer system classifies this project as HIGH DENSITY development. The site location, Country Club design and soil morphology within the golf course are such that neither (1) Wet Detention Ponds nor (2) Infiltration Basins are possible. Therefore, the Design Intent is as follows: 1. Where possible, parking lot runoff is directed to the golf course fairways. 2. Runoff from undisturbed areas, pervious and impervious will be allowed to drain, untreated to the Creek by means of existing surface drainage channels. 3. A significant area of undisturbed asphalt will be incorporated into the new stormwater management system. 4. Stormwater runoff from impervious surfaces will be collected in a series of drop inlet catch basins and conveyed to a key manhole structure near the access road culvert at the creek. 5. The KEY manhole will be designed with an overflow weir, set at a design height which will allow runoff in excess of the first flush (1-inch) to bypass the stormwater filtration system and discharge directly to the creek. 6. The stormwater filter shall have (1) a sediment chamber, (2) CMU overflow weir and (3) a surface sand filter with underdrain discharge to the Creek. The filter design shall be in accordance with NCDENR's Stormwater Best Management Practices Manual, latest edition. 7. The Sand Filter System design criteria, attached hereto, identifies State minimum standards and the actual design intent, which equals or exceeds State criteria. 8. Consequently, it is being designed to also serve as a hazard area for golf play. It is, therefore, reasonable to expect that the grounds keeping crew will maintain the sand filter in much the same way and frequency as the many sand traps around the course. Regular maintenance should occur on a daily/weekly basis. Raking, debris removal and sand replenishment, as needed, will occur daily, whether or not there was a storm/rainfall event. When it is observed that standing water remains in the filter for more than 24 hours, maintenance attention would involve the removal of the first 2-3 inches of discolored sand, and replacement with new sand. The forebay sediment chamber should also be regularly maintained. The forebay is designed to drain to the filter gallery through 2-inch drain pipes located along the base of the center weir wall. Pea -gravel covers the inlet side of the wall drains. From time to time the pea -gravel will have to be removed and replaced. AIso, the buildup of silt should be removed unless it is the desire to create a man-made wetland in the forebay gallery. Due to the suspended solids content of the stormwater, it is only fair to assume that a "silt mat" will build up in the top 1-2 inches of sand. This mat will reduce the natural permeability of the sand. The creek bottom is sufficiently lower than the filter underdrain to assure that the seasonal high groundwater table will not infiltrate the filter bed and adversely impact filter operations. The design intent is to completely drain the forebay and filter within 24 hours of a storm event. Since the filter is to be incorporated into the hazard configuration of the No. 10 fairway, daily maintenance and grooming is to be expected. ❑ KEY POINTS: 1. A lined forebay gallery provides no benefit to BMP operations. Sedimentation occurs equally whether the forebay is dry or wet. 2. They can be used on small, urban sites that would not normally support the hydrology of a wet detention pond and where the soils would not support an infiltration device. The design procedure described below is based on the experience and equations that were developed by the City of Austin, Texas, the State of Maryland, and the State of Delaware. Much appreciation is extended to Earl Shaver of the Delaware Department of Natural Resources for the use of his design guidance. While sand filters are new in the area of stormwater treatment, they have been used for many years to treat wastewater and as part of the process of purifying drinking water. In most cases, monitoring results suggest that sand filters used to treat stormwater behave similarly to sand filters used in wastewater treatment. They have been demonstrated to be effective in removing many of the common pollutants found in urban stormwater runoff, especially those found in particulate form. They have also been shown to have at least a moderate level of bacterial removal. They have not been effective at removing total dissolved solids and nitrate -nitrogen and, for this reason, would best be used upstream of a vegetated filter. There are two basic components of a sand filter design: the sediment chamber and the sand chamber. They are both important parts of the design, and neither can be omitted. The purpose of the sediment chamber is to reduce the amount of sediment that reaches the sand chamber and to help ensure that stormwater reaches the sand chamber as sheet flow. The purpose of the sand chamber is to trap the finer sediment and sediment bound pollutants, and to provide a media for microbial removal of bacteria. Sand filters work by receiving the first flush of runoff and settling out the heavier sediment in the sediment chamber. Water then flows to, and is spread over the sand bed where pollutants are either trapped or strained out. Sand filters are to be used only for drainage areas that have been stabilized. Sediment suspended in runoff during construction could quickly clog the sand filter and render it useless. By excluding disturbed areas from draining to the sand filter, the actual pollutant loadings that must be treated by the sand filter are those generated by the land use activity for which it is designed. Drainage areas directed to each sand filter should be kept below 5 acres in size. Larger drainage areas are less likely to be entirely impervious, and it is more difficult to distribute the flow of runoff across the sand bed. Sand filters systems can be used on large parking areas and other sites larger than 5 acres if the site is divided into smaller drainage areas that feed individual sand filters. Sand filters are intended primarily for water quality enhancement and must be designed to handle the runoff from frequent storm events. They must be designed to accommodate all the runoff which drains to them, so the drainage area must be determined for actual design. For -the State of North Carolina, water quality controls must be designed for 85% removal of Total Suspended Solids. Design for this level of treatment requires the bulk of TSS removal occur on the frequent, smaller volume storms. Sand filter systems designed according to the requirements outlined here for control of the runoff from the first inch 23 f of rainfall are considered to meet the 85% TSS removal requirement. In most of North Carolina, this represents the runoff of over 90% of all storm events. 3.2 Design Requirements Sediment Chamber: • Volume = 540 ft3 per acre of drainage area • At least 18 inches deep • A surface area of at least 360 ft2/acre • Positive drainage to this chamber either in conduit or surface drainage • No outlet except to sand chamber • Outlet to the sand chamber to result in sheet flow Sand Filter Chamber: • Volume = 540 ft3 per acre of drainage area • At least 18 inches of sand particles less than 2 mm average diameter • A surface area of at least 360 ft2/acre An outlet positioned and sized such that the sand chamber will drain completely in 24 hours No single outlet pipe sized greater than 6 inches, in order to provide a minimum of 12 inches of sand above pipe General: Access to both chambers must be sufficient for all maintenance activities. Because the sediment from at least the first chamber will be somewhat wet when maintenance occurs, heavy equipment access should be provided. The filter must be designed to structurally withstand any load that is expected to occur (water quantity, sediment quantity and surface loading). The design parameters above assume an average filtration rate of 0.04 gal/min/ft2 with one foot of head on the sand surface. This rate is needed in order to allow the runoff from the first inch of rainfall to pass through the filter within a period of 24 hours. The effect of this is that each square foot of sand must transmit approximately 62 gallons of water over a period of 24 hours. This design assumes that drainage through the sand chamber will be occurring throughout the duration of runoff. Storms that exceed one inch of runoff, depending on their intensity and duration, may overflow the sand filter. In these situations, runoff may not receive the same level of treatment as runoff from smaller storms. Where stormwater quantity control is required, runoff that will flow over the sand filter must be considered in addition to the water flowing from the normal outlet from the sand filter. Two examples of sand filters are shown below. The first example, Figures 4 and 5, is one that might be used in an area where land values are very high, or where there are severe physical limitations in siting a BMP. This design uses a concrete structure and can be located or constructed in such a way as to occupy no developable land. The second example, Figure 6, is a sand filter that might be used on a project where spatial limitations are present, but there is some land available for stormwater management. This design does not use the same precast -concrete structure that is used above, and would be less expensive to construct, but would take more land area than the first example presented. 24 3.3 Maintenance Regular maintenance is essential to the long-term performance and durability of the sandfilter, as it is with all stormwater BMPs. At least once a year each filter must be inspected after a storm to determine if the filter bed is passing the runoff as expected. Depending mostly on the activities occurring in the drainage area, most filters will show some decreased capacity for filtration after a few years. Maintenance operations must be performed when storms of approximately one inch are not passing through the filter within 24 hours. Maintenance for sand filters consists of removing the first two or three inches of discolored sand, and replacing this with new sand. The sand that has been removed would then be dewatered, if necessary, and then landfilled. At the same time that maintenance is performed on the sand chamber, the sediment chamber should also be pumped and cleaned. It is most likely that the sediment removed from the first chamber will need to be dewatered before it will be accepted at a landfill. Due to the increase in impervious surface parking, the new facility will exceed 1.0 acres of disturbance. Furthermore, although the project area represents less than 30 percent of the built -upon area, the clustered development nature of the proposed construction and the need to install a storm sewer system classifies this project as HIGH DENSITY development. The site location, Country Club design and soil morphology within the golf course are such that neither (1) Wet Detention Ponds nor (2) Infiltration Basins are possible. Therefore, the Design Intent is as follows: Where possible, parking lot runoff is directed to the golf course fairways. 2. Runoff from undisturbed areas, pervious and impervious will be allowed to drain, untreated to the Creek by means of existing surface drainage channels. A significant area of undisturbed asphalt will be incorporated into the new stormwater management system. 4. Stormwater runoff from impervious surfaces will be collected in a series of drop inlet catch basins and conveyed to a key manhole structure near the access road culvert at the creels. 5. The KEY manhole will be designed with an overflow weir, set at a design height which will allow runoff in excess of the first flush (1-inch) to bypass the stormwater filtration system and discharge directly to the creek. 6. The stormwater filter shall have (1) a sediment chamber, (2) CMU overflow weir and (3) a surface sand filter with underdrain discharge to the Creek. The filter design shall be in accordance with NCDENR's Stormwater Best Management Practices Manual, latest edition. The Sand Filter System design criteria, attached hereto, identifies State minimum standards and the actual design intent, which equals or exceeds State criteria. 8. I checked with the Central Office staff and although the impervious liner requirement was not specifically mentioned in the BMP document, it was the intent of the original writer- the State of Delaware, and the Division, to require a liner. As specified in the introduction of Chapter 3, sand filters can be used on "small, urban sites that would not normally support the hydrology of a wet detention pond and where the soils would not support an infiltration device." Without the liner, this structure becomes an infiltration basin, and must be designed per those requirements. In accordance with the opinion of Central Office staff, an impervious liner is required for all sand filter systems, including the sediment chamber. Please contact.leanette Powell at 919-733-5083 if you have further questions concerning this requirement. That being said, on April 16, 2001, the Division met the Regional Soil Scientist at the Jacksonville Country Club site and had him do some shallow soil borings in the proposed location of the sand filter. One boring was done to a depth of 4', and the other to a depth of 2'. The 2' boring; adjacent the small creek, showed some clay, and evidence of water, while the 4' boring, approximately 20' upsiope from the 2' boring, showed a layer of hard clay at least 4' thick and also some water. This hard clay will suffice as the impervious liner required for sand filters by the BMII document. Since the T boring did not have as much clay, the permit will require that a minimum 8" layer of that. onsite native clay be placed on the bottom of the entire flier, with the geotextile fabric and 18" sand layer on top of that. This may mean that some clay will need to be added to the filter closest to the creek. The Division received the requested additional information on February 27, 2001. The following information is needed to continue the review: As previously requested, if there are no wetlands on the site, please place a note on the plans to that effect. 2. I will accept your design of a single 16' weir at this time. If erosion becomes a problem, the permit will require that multiple weir cuts be added to provide better flow distribution and lessen the erosive potential. It is the intent of sand filter design that some runoff will remain standing in the sediment chamber until pushed over the weir by the next storm. As proposed, the runoff will fill the sediment chamber and will go through those 2" weepholes, not over the weir. In accordance with the intent of sand filter design, you can either delete the weepholes entirely and let the weir act as the sole spreader mechanism, or relocate them so that their invert creates a rninimurn sediment chamber depth of 18", and is at or above the sand elevation. You can also elect to convert the design to a wet detention pond, which would make an excellent water trap for the golf course. Please revise the details, as needed. ]'lease note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to May 16, 2001, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. You will not receive an acknowledgment of the time extension, however, the project must be submitted by the date indicated in your request letter.
