REGAN Secretary BRIAN WRENN Director Michael Duval, PE McAdams 3430 Toringdon Way, Suite 110 Charlotte, NC 28277 NORTH CAROLINA Environmental Quality February 26, 2020 Subject: Request for Additional Information Stormwater Permit No. SW3210101 The Glenns Union County Dear Mr. Duval: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Major Modification Application for the subject project on January 5, 2021. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please revise the SWU-101 Application to address the following comments: a. Please enter the name and title of the signing official for the applicant. Please note that the signing official muse be a principal executive officer of the level of vice president or an authorized representative [15A NCAC 02H .1040(1)]. b. Please provide documentation from the NC Secretary of State or other official documentation stating that the signing official for the property owner meets the signatory requirements above. c. Please provide a phone number and email address for the property owner. d. The Property Owner Authorization was not complete. Please fill in all fields and submit a newly signed copy. e. Please complete the Applicant Certification. This is required for all permit applications. 2. On the existing conditions plan, please show the boundaries of all surface waters, wetlands, regulatory flood zones, protected vegetated setbacks and protected riparian buffers or a note that none exist [15A NCAC 02H .1042(2)(g)(iii)]. The scale on Sheet C3.00 appears incorrect. It currently says 1" = 80', but appears to be at the same scale as Sheet C2.00 (1" = 100'). 4. Please show a maintenance access and easement on the design plans that meets the requirements of MDC 8 & 9 [15A NCAC 02H. 1050(8) & (9)]. Please submit an Operation Maintenance Plan and Agreement that meets the requirements of General MDC 11 and 12 [15A NCAC 02H .1050(11) & (12), .1042(2)0)]. The O&M EZ form can be used to meet this requirement and can be found on the Stormwater Design Manual website. 6. Please submit a Supplement EZ form with the design data for the site. The Supplement EZ form can be found on the Stormwater Design Manual website. 7. Please submit a deed restriction form [15A NCAC 02H .1003(7)]. A sample form can be found on the Post -construction Stormwater Forms website. 8. Please address the following comments regarding the sand filter: a. Sand Filter MDC 1 requires a separation distance of two feet from the bottom of the system. Please submit a geotechnical report showing that the required separation is provided [15A NCAC 02H .1056(1)]. b. The calculations used to size the sand filter are from an old version of the Stormwater Design Manual and do not meet the current MDC. According to MDC 2 and 3, the sand chamber must be sized to store at least half of the design volume below the first outlet [15A NCAC 02H .1056(2) & 3]. 9. Please address the following comments regarding the wet pond: a. The stage storage calculations shown in the Stormwater Impact Analysis (Page 65 of the PDF document) are incorrect. The table shows the contour area at El. 575 as less than at El. 574. b. The water quality elevation and drawdown time were based on the 1-year storm event, not the 1" storm event. The wet pond must be designed based on the 1" storm event. c. The forebay is only 11 % of the main pool volume. Wet pond MDC 5 requires it to be 15-20% of the main pool volume [15A NCAC 02H. 1053(5)]. 10. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: hgps:Hedocs.deg.nc.gov/Forms/SW_Project Submittal Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to March 28, 2021, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW3210101 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
