Dear Mayor Dunn,
On August 6, 2020, staff from the North Carolina Department of Environmental Quality(NCDEQ)
conducted a compliance audit of the Town of Stallings'National Pollutant Discharge Elimination System
(NPDES)Municipal Separate Storm Sewer System (MS4)Permit. The audit resulted in NCDEQ issuing
Notice of Violation number NOV-2020-PC-0364(NOV)to the Town on September 15,2020.As of the
date of this notice, none of the required response actions detailed in the NOV have been completed.
The Town of Stallings is in violation of the following permit conditions:
1)Failure to Submit a Stormwater Management Plan
The permittee failed to submit a plan in response to notification from NCDEQ. [Part III, Item C]
2)Failure to Provide Information
The permittee failed to furnish information requested by NCDEQ to determine compliance with the
permit. Specifically,the permittee failed to submit the:NOV response letter, Council Resolution, Self-
Audit, and Draft SWMP. [Part V, Section A,Item 7]
This Recommendation for Enforcement is being sent to the Director of the Division of Energy,Mineral,
&Land Resources. These violations and any future violations are subject to a civil penalty
assessment of up to $25,000 per day for each violation.Regardless of penalty assessments, NCDEQ
requires all violations to be properly resolved. Should you have any questions regarding this matter,
