The permit identifies the expiration date as April 10, 2010. 1 have also attached a letter that acknowledges that the permit expiration date has been extended by 4 years to April 10, 2014. In looking through the file for this project on our server, I noticed there have been some compliance issues surrounding this site. I have attached the latest Notice of Violation as well. In looking at this Notice, it seems that a site visit has not yet been conducted. You may want to request an inspection of the site to see if there are any other outstanding issues. Moving forward, the first step is to transfer the permit to the new property owner (you or the company listed on the deed). The form for initiating the transfer can be found here: htto://r)ortal.ncdenr.ore/c/document librarv/set file?uuid=d2277dff-f8aa-4913-a9a2-fbd740e7d7ce&eroupld=38364 Try to complete Section I of this form to your best abilities, but include a note indicating that this permit is "being transferred per the new Session Law". You can leave Section IV blank or make the same note there as well. Once the permit is in your name, you will need to modify the permit to identify that outparcel as well as renew the permit. The owners of that outparcel will need to get its own "Offsite" permit. It is recommended to modify and renew the permit at the same time since both actions can be handled by one permit fee of $505. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 991115, issued to you on April 10, 2000, The project has been found in violation of Stormwater Permit Number SW8 991115, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: Failure to certify the stormwater system. A file review revealed that this office has not received a Designers Certificate. Permit condition states that upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. To correct these violations you must: Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s) and a time frame for completion of those actions, on or before March 1, 2010. 2. Submit the required Designers Certificate. After meeting with you last month I began trying to correct this situation. As I told you in that meeting I sold the property in 2006 to George Laney. He subsequently filed for bankruptcy and never went any further with the development of the project than we he first purchased it. The property went back to Cape Fear Bank, who later failed and the property became an asset of First Federal out of Charleston, SC. It has been sitting vacant since that time and I had no idea I had any responsibility remaining. I called the engineer, Joey Hill, and asked why the pond was never certified. He replied because the project was never completed and he would have worked with Laney had he continued the development, but, he could do a partial certification for $2500.00. zo During the course of my ownership the retention pond was inspected several times by DEN nd nothing was ever said to me about "certification". After our meeting I discovered the property was under contract to be sold to another art I cont cte him throu h h' attorney, Robert Kennan whose office is in Burgaw. I am at the point now that if the potential buyer does not go forward, and the bank refuses to do anything, then at the price they are offering the property for I will try to buy it myself, clean it up, take care of my issues with you, then put the property back on the market. In order to do this I will have to wait for some other property I am selling to close. That should happen within the next few weeks so with this information I am asking that you extend the deadline you gave me for at least 30 days. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 991115, issued to you on April 10, 2000. The project has been found in violation of Stormwater Permit Number SW8 991115, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: Failure to certify the stormwafer system. A file review revealed that this office has not received a Designers Certificate. Permit condition states that upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. To correct these violations you must: Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s) and a time frame for completion of those actions, on or before March 1, 2010. 2. Submit the required Designers Certificate. Failure to provide the "Plan of Action" by March 1, 2010, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
