All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or renewed. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On August 5, 2009, the Governor signed Session Law 20097406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at. any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit, which was set to expire on November 10, 2008, shall now be effective from the date of issuance until November 10, 2012, which includes all available extensions. State Stormwater Management Permit €#SW8 980347 for the subject project was last issued on November 10, 1998 to Mr. Yuzo Ito and expired on November 10, 2012 as noted above. Per 15A NCAC 211.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at S505.00. If this is still an active project, please complete and submit a renewal application prior to February 8, 201.9. Please note that if they have not already been submitted to the Division, the permit renewal request must be accompanied by the required Designer's Certification and the recorded documents (if applicable). Please be advised that you are required to comply with the terms; conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 21-1 .1003 and North Carolina General Statute 143-214.7 until you submit the required Permit Transfer Application form to the Division and receive approval from the Division to transfer the permit or, if the site has not been built, submit a request to rescind the permit and receive approval. This includes providing the necessary operation and maintenance of the permitted stormwater system. This permit expires on 11/10/2008. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should be completed and submitted along with your renewal application. You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day. The drainage basin area includes only the actual infiltration basin to the top of the side slopes. The area outside the basin will be graded to route runoff away from the basin as shown by drainage direction arrows added to the Stormwater Plan. We have included a revised basin runoff volume calculation per our telephone conversation. 2. Section 3, #7 of the application has been corrected to show no offsite area draining to the basin. 3. A revised Operation and Maintenance Plan for the infiltration pond is enclosed. 4. Rip rap is shown along the basin top and side slopes to prevent erosion from water running off the roof overhang. 5. The existing grade of 10.2' is also the finish grade. This elevation is shown on the plans. The site is flat, with a contour interval of less than 1.0 foot. 6. The infiltration basin will not be used as a temporary erosion control measure. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: The drainage basin area referred to under Section 3, #6 in the application is not the area of the proposed treatment device. It is the drainage area to the system, which is generally the project area. The project area is listed as 6,444 square feet in the calculations. Please revise. 2. FYI- Section 3, #7 of the application requests that you describe how the OFFSITE area was derived. You need not describe how you derived the proposed onsite impervious areas. The Operation and Maintenance PIan is lacking a few items. Please specify that the maintenance interval for inspecting the basin is after every runoff producing rainfall event, or at least monthly, whichever comes first. Trash removal, mowing, collection system repair, and reseeding are not addressed at all. Please find attached the standard O & M for infiltration ponds. Please have Mr. Ito sign and return it. 4. The current proposal is to let the water run off the roof overhang into the basin. Have you considered the extent of erosion that will be created at the top of the basin, and the continual maintenance involved? Please specify some type of erosion control device or riprap at the top of the basin to control the potential erosion. 5, Per the architect drawings submitted as a part of the calculations, the existing grade is 10.2'. Please note on the plans that the existing grade is 10.2' MSL. If the infiltration basin is used as a temporary erosion control measure, the basin must be cleaned out and returned to design condition. Excessive silting of the basin will result in clogging and shorten the life of the basin. Please note that this request for additional information'is in response to a preliminary review. The requested information should be received by this Office prior to November 7, 1998, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. . South Boardwalk & Pier House proposes construction of a fishing pier extending into the Atlantic Ocean. Part of the proposed construction is an elevated pier house constructed on piles. Since the construction is within CAMA's jurisdiction, CAMA requires a stormwater management permit as a condition of issuing a CAMA permit. A soils evaluation was conducted by Soiltech Engineering, Inc. (see enclosed Infiltration Test Report). The results show an infiltration rate of 1.5 inches per minute and a seasonal high water table greater than 72 inches below land surface. The small size of the site and the dryness of the soils preclude the installation of an infiltration basin with a bypass for excess flow through a vegetative filter. Therefore, an infiltration basin will be constructed which is sized to retain the volume of runoff generated from impervious surfaces by a 25- year, 24-hour storm (8" rainfall). The infiltration basin is located beneath the building, allowing runoff from the roof edges to fall directly into the basin. Adequate building floor height is provided to allow equipment access for maintenance of the basin. The area contributing runoff to the South Boardwalk & Pier house infiltration basin consists of the rooftop of the building and the basin area outside the building roof line extending to the top of the side slopes. The site area beyond the top of the side slopes shall be graded to route overland runoff away from the basin.
