All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or renewed. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit, which was set to expire on August 12, 2012, shall now be effective from the date of issuance until August 12, 2016, which includes all available extensions. State Stormwater Management Permit #SW8 970839 for the subject project was last issued on August 12, 2002 to Benser, LLC and expired on August 12, 2016 and as noted above. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. Please complete and submit a renewal application prior to October 17, 2016. Please note that if they have not already been submitted to the Division, the permit renewal request must be accompanied by the required Designer's Certification and the recorded documents (if applicable). Additionally, a review of the North Carolina Secretary of State corporation's database revealed that the LLC was administratively dissolved. Please note that Pursuant to NCGS 55-14-05(a), a dissolved corporate entity continues its corporate business but may not carry on any business except those acts necessary to wind up and liquidate its business and affairs. Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina'General Statute 143-214.7 until you submit the required Name/Ownership Change Form to the Division and receive approval from the Division to transfer the permit. This includes providing the necessary operation and maintenance of the permitted stormwater system. Director Subject: Notice of Deficiency and Request for Permit Transfer NOD 2012-PC-0150 The Enclave Stormwater Permit No. SW8 970839 New Hanover County Dear Mr. Allen: Dee freeman Secretary On February 23, 2012, the Wilmington Regional Office of the Division of Water Quality (DWQ) issued a Notice of Inspection for the Enclave in New Hanover County in order to resolve compliance issues with Stormwater Management Permit Number SW8 970839 modified on August 12, 2002. A recent DWQ tile review has revealed that a response to this letter has not yet been received. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the previous inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. A written response with a schedule to bring this site into compliance in response to the Notice of inspection sent on February 23, 2012 has not been received. Section 11.14 of the permit requires the permittee to respond within the provided timeframe with a written time schedule to bring this site into compliance. The stormwater collection system to the north and west of the property couldn't be identified during the site inspection through the brush and debris. Please restore the collection system to ensure and demonstrate that the runoff is directed to the infiltration basin. Section 1.5 of the permit requires the runoff from all built -upon area within the permitted drainage area of this project to be directed into the permitted stormwater control system. Section 11. 13 requires the permittee to maintain compliance with the proposed built -upon area and ensure that the runoff from all built -upon area is directed to the permitted system. 3. During the file review, it was discovered that the permittee, Benser, LLC, was administratively dissolved through the Secretary of State on August 26, 2010. Pursuant to N.C. Gen. Stat. § 55-14-05(a): A dissolved corporation continues its corporate existence but may not carry on any business except that appropriate to wind up and liquidate its business and affairs, including: (5) Doing every other act necessary to wind up and liquidate its business and affairs. Even though Benser, LLC has dissolved, as the permitted of record, it is your responsibility to verity the site is constructed as per all the permit conditions, initiate the permit transfer to an appropriate legal entity, such as a Home Owners Association, and remain responsible for all permit compliance until the transfer is approved. Once the compliance items are resolved and the site is found to be in compliance, transfer the permit to the new owners. Section 111.9 of the permit requires the permittee to notify DWQ within 30 days of any name, ownership, or mailing address changes. Section ill. 9 of the permit notes that it is not transferable and that a formal permit request must be submitted to the Division for approval. DWQ file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. If the other "Name/Ownership Change Form" is used, the permit will be transferred once all the criteria in the form is met and the proposed permittee chooses one of the options below: a. Option 1: Port City Commons Owners Association, Inc accepts the transfer of the current permit. Port City Commons Owners Association, Inc should be made aware that a first time transfer is free and the permit conditions remain the same as when the permit was originally issued under 15A NCAC 2H .1005 effective September 1, 1995 (change if necessary), which is commonly referred to as the 1995 Coastal Rules (change if necessary). b. Option 2: If Port City Commons Owners Association, Inc refuses the current permit then they will have to apply for their own permit. If they do not apply for a permit they will be issued a Notice of Violation (NOV) including possible fines for owning and operating a treatment system and discharging to surface waters without a permit. This option will not be advantageous to Port City Commons Owners Association, Inc because the new permit will be issued under the 2008 Coastal Stormwater Rules (Session Law 2008-211) unless a vested right is presented which allows the project to be reviewed under the 1995 Coastal Rules. However, keep in mind that vested rights are not granted to sites that are in violation. This means the pond must be designed according to the standards in Session Law 2008-211 and the latest version of the Stormwater Best Management Practices (BMP) manual. As a result, changes in permit conditions and technical changes, such as the increase in the design storm from 1.0 to 1.5 inches, may require significant and costly physical changes to the BMP(s) currently serving the project. All costs associated with the permit application, the possible NOV, the design and the construction for changes to the ponds will be the sole responsibility of Port City Commons Owners Association, Inc. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. C. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 4 State Stormwater Management Systems Permit No. SWS 970539 Modification 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. Prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Responsibility for compliance with all permit conditions remains with the Permitter until such time as the Division approves the formal permit request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The pennittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. C. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. Decorative spray fountains will not be allowed in the ponds. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 4 State Stormwater Management Systems PerMit Ng. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. Dear Sir; This letter constitutes Notice of Violation of Section 7-7(4), Section 7-18(a), Section 7-18(e), Section 7-180), Section 7-21(a)(1), and Section 7-21(a)(3) of New Hanover County's Soil Erosion and Sedimentation Control Ordinance. Section 7-7(4) Prior Plan Approval states: No person shall initiate any land -disturbing activity on a tract if more than one acre is to be uncovered unless, thirty or more days prior to initiating the activity, an erosion and sedimentation control plan for such activity is filed with and approved by the County. Section 7-18(a) Erosion and Sedimentation Control Plans states: An erosion control plan shall be prepared for all land -disturbing activities subject to this ordinance whenever the proposed activity is to be undertaken on a tract comprising more than one acre, if more than one acre is to be uncovered. 4 John Berent February 19, 1998 Page Two Section 7-18(e) Erosion and Sedimentation Control Plans states: The County will review each complete plan submitted to them and within 30 days of receipt thereof will notify the person submitting the plan that it has been approved, approved with modifications, approved with performance reservations, or disapproved. Failure to approve or disapprove a complete erosion and sedimentation control plan within 30 days of receipt shall be deemed approval. Denial of a plan must specifically state in writing the reasons for a denial. The County must approve or deny a revised plan within 15 days of receipt, or it is deemed to be approved. If, following commencement of a land -disturbing activity pursuant to an approved plan, the County determines that the plan is inadequate to meet the requirements of this ordinance, the -County may require such revisions as are necessary to comply with this ordinance. Section 7-180) Erosion and Sedimentation Control Plans states: Any person engaged in land -disturbing activity who fails to file a plan in accordance with provisions of an approved plan shall be deemed in violation of the ordinance. Section 7-21(a)(1) Civil Penalties states: Any person who violates any of the provisions of this ordinance, or rules or orders adopted or issued pursuant to this ordinance, or who initiates or continues a land -disturbing activity for -which an erosion control plan is required except in accordance with the terms, conditions, and provisions of an approved plan, shall be subject to a civil penalty of not more than $500.00. No penalty shall be assessed until the person alleged to be in violation has been notified of the violation by registered or certified mail, return receipt requested, or other means reasonably calculated to give actual notice. The notice shall describe the violation with reasonable particularity, specify a reasonable time period within which the violation must be corrected , and warn that failure to correct the violation within the time period will result in the assessment of a civil penalty or other enforcement action. If, after the allotted time period has expired, the violator has not completed corrective action, a civil penalty may be assessed from the date of receipt of the Notice of Violation. However, no time period for compliance need be given for failure to submit an erosion control plan for approval or for obstructing, hampering or interfering with an authorized representative while in the process of carrying out his official duties. Each day of continuinp violation shall constitute a separate violation. Section 7-2.1(a)(3) Civil Penalties states: Any person who fails to submit an erosion control plan for approval as required by this ordinance shall be subject to a single noncontinuing civil penalty of not more than one thousand dollars ($1,000). Any person who is subject to a civil penalty under this subdivision may be subject to additional civil penalties for violation of any other provision of this ordinance, or rules or orders adopted or issued pursuant to this ordinance. r John Berent February 19, 1998 Page Three Corrective measures needed: Stop all work on site except that which includes the installation of the erosion control measures. The site was once an established cemetery and all gravesites were supposed to have been moved back in or about 1939. Additional research made more recently suggested that there were still gravesites remaining. A specialist was hired to complete a site investigation. The process involves digging 4' wide by 24' deep trenchs, approximately 6' o.c., only where evidence of possible gravesite depressions are exhibited. If skeletal remains are uncovered, they are marked. All trenches are then backfilled and smoothed awaiting future procedure for gravesite removal. Silt fencing shall be installed downhill from any areas being disturbed.
