March 30, 1993
Mr. James E. Butler, PE
Department of the Navy - Atlantic Division
Naval Facilities Engineering Command

Norfolk, Virginia 23511-2699
Dear Mr. Butler:
3620 Si% FORKS ROAD
RALEIGH. N.C. 27509

In accordance with your written request of tifarch 25, 1993, I am enclosing
for your information a copy of The North Carolina Engineering and Land
Surveying Act, G. S. 39C.
I will refer your attention to G. S. 39C-25 which provides limitations on the
application of the Statute. Paragraph 6 specifically exempts "Practice by
members of the armed forces or employees of the government of the
United States white engaged in the practice of engineering or land
surveying solely for said government on government -owned works and
projects."
This exemption should not be construed as to allow engineering services to
be provided to the Department of the Navy by non -registered contract
employees. For any such circumstance, a North Carolina registrant would
need be in responsible charge of any engineering services to be provided for
a North Carolina project.
I trust this information will be of some service and ask that you contact me
if this office can be of further assistance.
Sincerely,
r
J ry T. Carter
