Howes Secretary Subject: NOTICE OF VIOLATION Freedom Homes Stormwater Project No. SW8 950611 Brunswick County Dear Ms. Simmons: On January 18, 1996, Wilmington Regional Office personnel performed a Compliance Inspection of the project known as Freedom Homes, located off Highway 17 Bypass in Shallotte, Brunswick County, North Carolina. The inspection was performed to determine the status of compliance with Stormwater Management Permit Number SW8 950611, issued to you on September 12, 1995. The project has been found in violation of Stormwater Management Permit Number 950611, issued pursuant to the requirements of your NCAC 2H.1000. The violations found are: 1. Failure to construct the detention pond per the approved plans prior to construction of impervious surfaces. 2. The outlet structure has not been constructed. 3. Minimum pond depth has not been provided. 4. The side slopes are very eroded. The approved Operation and Maintenance plan is not being followed. 5. Provide a written "Plan of Action" which outlines the actions you will take to correct the violations and a time frame for completion of those actions, on or before February 18, 1996. 2. Construct the pond per the approved plans. 3. Provide regular maintenance for the pond. 4. Provide the Engineer's Certification upon completion of the project. Failure to provide the "Plan of Action" by February 18, 1996, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil and criminal penalties, pursuant to NCGS 143-215.6A. A preliminary review of that information has determined that the submittal for the subject project is not complete. The following information is needed to continue the stormwater review: 1. Based on your revised calculations, the total amount of proposed impervious area is 2.2 acres. Please revise the submittal form (initial and date). 2. My calculation of orifice size falls between 1.2" and 1.9", while you propose 4" . My calculation is based on rearranging the orifice equation to solve for area, using the average head. Your method has been used by other engineers, with the same results, therefore, I will do what I did with them.
