NARRATIVE
TOPSAIL ELEMENTARY SCHOOL
Receiving Stream Name: UT Old Topsail Creek
Stream Class: SA; HQW

DESCRIPTION:
The project site was originally an approximately 40 AC tract located in Hampstead, NC
in Pender County. The soils of the site consist of sandy topsoil, grassed fields and
grades ranging from 0.5% to 2.0%. The original permit for this site was for a Project
Area of 36.6 AC to construct a new Elementary School with paved parking, paved
access, and recreation fields. Construction is complete. This submittal is to bring the
State Stormwater Permit up to date since its original approval in 1991 — SW8 910314.

Project Area: 29.9 AC
Proposed BUA: 13.43 AC (44.9%)
Portions of the 1991 Elementary School Permit (SW8 910314) and New Topsail High
School Permit (SW8 060706) project areas overlap. The Elementary School permit
should have been revised when the High School was submitted.
The 1991 Stormwater Permit (SW8 910314) plans include for a new Middle School
inside the project area but outside of the Phase I limits. The overlapped area of the two
(2) permits (the Elementary Permit and the High School) is due to the fact that the 1991
proposed Middle School was never built. Instead the new High School project took up
some of the future Middle School portion of the 1991 project area.
The above creates a decrease in the Overall Project Area for the Revised SW8 910314
Stormwater Permit.
1.48 AC Area at the Northeast Corner of the Project Area
Since the 1991 permit was issued, a 1.48 AC piece of the Project Area was sold to the
Rocky Point Topsail Water and Sewer District, now Pender County Utilities. The
original permit called for the existing impervious in this area to be removed. It wasn't
removed. At this date Pender County Utilities owns this property. However, NC DOT is
acquiring 26,000 SF of this area for the Hampstead By -Pass. At that time NC DOT will
remove the impervious that lies on the 26,000 SF they acquired.
',The remaining area of 38,469 SF will still belong to Pender County Utilities. Mr.
Anthony Colon, Pender County Utilities Assistant Director has submitted a Plan of
Action to remove the existing concrete slab that remains on their remaining portion.
Pender County Utilities has also agreed to be a Co-Permittee on this State SW
Modification (SW8 910314).
The Co-Permittee solution was determined during a meeting between Pender County
Schools, Pender County Utilities, and the State Division of Environmental Quality (NC
DEQ). Below outlines the solution.
This submittal is being provided to NC DEQ for modification of the SW8 910314 permit,
assuming the impervious surfaces have been removed per the Pender County Utilities
Plan of Action Agreement.

26,000 SF acquired by NCDOT)

The above numbers are shown on the revised plan. The totals of impervious come from
aerials from Pender County and Google Earth. The noted additions to the impervious
from the original Phase I approval include expansion of parking / drive area, addition of
2Rd entrance from US 17, addition of modular classrooms (including the modular
classroom), the addition of Tennis Courts, and now includes the impervious of the utility
department built on the School property associated with the water tower.
It should be noted that when the new Topsail High School was constructed, the old High
School became Topsail Middle School. The old High School (now the Middle School) is
located just to the North of the Elementary School. The old High School predated State
Stormwater. It was originally constructed in 1975.

Re: Pender County Utilities property at 17619 US Hwy. 17 - Plan of Action
Christine,
Per our phone conversations and your letter dated April 13, 2020 regarding the Pender County
Utilities property at 17619 US Hwy. 17 and the adjacent Pender County Schools property;
please read the proposed timeline recommendations for the removal of the concrete slab located
at this site.
I mentioned to you on the letter dated April 17, 2020 that the North Carolina Department of
Transportation is currently working on the purchase of forty percent of the property mentioned
above. Pender County Utilities will be responsible for the remaining sixty percent of the
property in which we have decided to begin planning on the removal of the existing concrete
slab.
To comply with your request, we recommend the following timeline:
• September 30, 2020 — Collection of all bids from qualified contractors to demolish and
haul away concrete surface on the portion owned by Pender County Utilities.
• January 1, 2021- Submission of project requirements and cost to the Pender County
Utilities Director to be inserted in the FY22 operational budget request spreadsheet.
• June 30, 2021— Obtain approval of requested funds from the Board of County
Commissioners to proceed with demolition and hauling.
• August 16, 2021— Award of purchase order number to selected contractor for the
demolition and hauling of concrete.
• October 31, 2021 — Completion and inspection of project.

Dear Ms. Hall:
Pursuant to correspondence between yourself, Pender County Schools, Pender County
Utilities, and T. Jason Clark, P.E. (Norris & Tunstall), we are providing the enclosed permit
modification package, which includes a revised plan sheet and narrative. The enclosed
narrative tries to summarize the situation and the project modification.
This modification was a required part of the request to move a modular classroom in the
summer of 2019. The modular wasn't moved in 2019. However, the school system
needs to add the modular ASAP, to prepare for the beginning of the 2020 fall schedule.
2. The enclosed application, narrative and revised plan sheet clear up the issues to the
best of our knowledge that have gone on since the original approval in 1991 and the
correspondence between all parties.
3. The revised and updated plan sheet demonstrates that the square footage of the
existing BUA does not exceed the permitted low -density maximum amount allowed by
the original permit. You will notice that the project area has become smaller than in the
original permit. This is due in part to the construction of the Topsail High School,
approved under State Stormwater Permit SW8 060706, July 28, 2006. It seems the
Elementary School Permit should have been updated then. The site "project" area is
further reduced due to the sale of 1.48 AC of land to the Rocky Point -Topsail Water and
Sewer District. This 1.48 AC parcel has been the point of contention with this
modification: Pender County Utilities owns this parcel and is now a co -applicant in this

modification. A portion of this parcel is being acquired by NC DOT for the Hampstead
By -Pass and is not included in the project area. Also, in order for this modification to go
through, the Pender County Utilities Department had to provide a Plan -of -Action Letter
to the State to account for the removing of the concrete slab that exists.
4. Aerial photos from Pender County GIS and Google Earth were used to develop the
enclosed plan. The impervious numbers on the application and plans were from a take-
off of the aerials.
5. The Middle School shown on the 1991 plans was never built. Instead, the Middle
School moved to the Old High School that pre -dates the 1991 Elementary School plans.
The old High School was originally built in 1975.
6. 1 walked the site of the Elementary School to inspect the storm drainage piping. The
piping appears to be as originally approved, the best I can tell. There were no visible
storm drainage outlets in the Elementary School site that weren't on the original plan.
Enclosed are two (2) copies of the plan sheet, one (1) copy of the Stormwater Narrative, one
(1) USGS map, one (1) copy of the Deed, the original Division of Water Quality Stormwater
Management Permit application, the original Low -Density Supplement form, and a $505.00
check for the permit review fee. Also enclosed is a copy of the Plan -of -Action Letter provided
by Mr. Anthony Colon, Pender County Utilities.

I have had conversations yesterday with Ken Keel and Anthony Colon at PCU. The option of signing the property over
to the schools wasn't an option that Mr. Keel could sign off on, because, that decision would have to be made by the
Pender County Government Board. That would be a long, dragged out process that would not help anyone in dealing
with this issue right now. What we have decided (and this depends on if you would be in agreement), is, that PCU will be
co-permitees on the Storm Water permit. I believe this was one of the original options you had mentioned. If that is
agreeable to you, Anthony will re -write his action plan to include this, to which, Ken Keel and Mr. Lafon (PCS), will sign.
As soon as we agree, Jason Clark will write up the new application, with co-permitees, and, Mr. Keel and Dr. Hill will sign
and we will get in your hands A.S.A.P..
I wanted to let you know this before the conference call so that we didn't waste any more of your time, and, I did not
want to surprise you with anything. Anthony and I will state all of this in front of all present, so, everyone will be on the
same page. Do you see any problems with this course of action?

Jason,
The plan of action did not address the permitting of the remaining parcel that had been proposed to be removed from
the Topsail Elementary School permit. If the remaining parcel will be returned to the schools, then that change in
ownership should be included in the plan of action and signed off by both entities agreeing to resolve their respective
pieces. (The utilities agreeing to transfer the property and the schools agreeing to accept the property). Once the plan of
action is fleshed out a bit more with this information, and signed off by all parties, it would then allow the modification
to be submitted as you propose.
As for the final question, it seems that all parties are eager to resolve this. I hope that means they are willing to work
together to get this clarification into the plan of action, which would then allow the modification to be submitted in the
near future. 1 will take Linda's original lead on this and as long as an application is in house and is eventually approved.
we will not comment on the timeframe of construction or relocation of the mobile classroom. I'm hoping that we've
worked through the issues and will be able to approve the modification. However, if for some reason the application is
not complete and the requested information is not submitted, we will end up where we are now, which will require
another plan of action. (1 really hope this isn't the case and the modification can be approved.)

I'm trying to help the Pender County Schools System get their permit back into compliance. NCDOT is in the process of
purchasing 40% of the 1.48 Ac parcel that now belongs to the Pender County Utilities. I have read the Plan of Action to
remove the existing impervious from the portion of the parcel not taken by NCDOT provided by Anthony Colon, Assistant
Director Pender County Utilities. It is my understanding that this Plan of Action is acceptable to you or you are considering
it. Your question is what happens to the remaining land that NCDOT doesn't take? It is my understanding that PCU intends to
convey the remaining piece of the 1.48 Ac parcel back to the Schools. The Stormwater Permit for Topsail Elementary School
(SW8 910314) will then include the remaining portion in its Project/Property Area (existing impervious now removed) and can
still be under their allotted 25% impervious, including the Modular Classroom they still need.
How and when would you like the Schools to proceed with their permit? Would you like us to submit now assuming the
above is to be complete OR wait until the Plan of Action is complete? Please advise.
I have another question for you about the Modular that Linda allowed to be moved last summer pending this permit being
brought up to date. That modular wasn't moved last summer, however the schools need to move a modular to the
Elementary school site as soon as possible to be available when schools reopen in the fall. Can you allow them to add this
modular prior to renewing/modifying this 1991 permit (SW8 910314)? Our intent with our previous submittals was to bring
this permit up to date including the modular, until the PCU property became an issue. Please advise if this is something you
can allow or if you also need another Plan of Action from the Schools before you will allow.

The provided action plan does not specify how or when a stormwater permit will be sought for the remaining parcel

Notice of Inspection
On April 13, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) conducted a file review inspection of the subject project to determine the status of
compliance with the State Stormwater Management Permit Number SW8 910314 issued on April 29,
1991. DEMLR file review revealed that the site is not in compliance with the terms and conditions of this
permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to
this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Project Area: The second paragraph of the Certificate of Compliance SW8 910314 requires a
modification to be submitted for the redesign or further subdivision of the project area. In 2002, a
1.48-acre tract from the original project area permitted under SW8 910314 was sold to Rocky
Point Topsail Water & Sewer District, which was later transferred to Pender County Utilities.
The recently submitted major modification to SW8 910314 proposes to subdivide this tract of
land from the original permitted project area. However, neither the accompanying permit
application for this 1.48-acre tract or a plan of action outlining when the accompanying permit
application will be submitted for this tract has been provided. Until an application or plan of
action is provided, the tract must remain as part of this permit. Please work together to either:
a. submit an application for the development on this subdivided 1.48-acre tract;
b. submit a plan of action outlining when a permit application will be submitted; or
c. include the subdivided tract as part of the permit for SW8 910314 and list the new owner
as a co-permittee.
2. Built -Upon Area: The originally approved set of plans for this site notes that the stone in the
vicinity of this 1.48-acre tract would be removed and the area would be restored and stabilized
with vegetation. In reviewing the historical aerial photos available online, it appears that this area
was not restored to a vegetative cover and has been expanded to include concrete pads,
outbuildings, access roads, and a water tower. The second paragraph of the Certificate of
Compliance requires a modification to be submitted for the redesign of built -upon surfaces.
These improvements will either need to be removed and restored to the vegetated condition as
originally approved or included as part of the permit modification or new permit application.
Please be advised that, as the permittee, you are required to comply with the terms, conditions and
limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code
2H .I003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the
permitted stormwater system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by May 15, 2020, are considered violations of the permit.
If the requested information is not submitted to this office by the due date, then DEMLR staff will inspect
the site and may issue a Notice of Violation.

Project Return
The Wilmington Regional Office received and accepted a State Stormwater Management major
modification Permit Application for the subject project on January 10, 2020 and requested additional
information on February 10, 2020 granting 30 days to respond in accordance with 15A NCAC
02H.1042(3)(i). A review of the information submitted on March 19, 2020 has determined that the
supporting information and package is not complete and the permit cannot be issued for the project, as
proposed, for the aforementioned reasons as well as for the following reasons:
3. Low Density Requirements: Since a separate application or plan of action to permit the l .48-acre
tract has not been submitted, the entire project area remains covered under this permit and is
subject to the 25% low density requirement. In order to approve any additional BUA, the site (as
a whole) must demonstrate compliance with these low density requirements.
Per the requirements of Title 15A NCAC 02H.1042(3)(a)(ii) of the Stormwater Management Rules, this
Office is hereby returning the subject application as incomplete. The $505.00 application fee has been
Forfeited and a new fee will need to be provided if you choose to resubmit this application in the future. if
you wish to pursue construction of this proposed project, you must reapply to the Division. Your
application package must include a completed and signed application form; application fee; 2 sets of
signed, sealed and dated site layout and grading plans with details and address the improvements and sale
of the 1.48-acre tract by either including the tract as part of the proposed permit action or by submitting a
second application or plan of action outlining when a permit application will be submitted.
Please note that the permit issued on April 29, 1991 remains in full force and effect. Please be aware that
the construction of any changes to the originally approved and permitted plans prior to the receipt of a
modified permit is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS
143-215.6A.

Pursuant to your comments of February 10, 2020, we offer the following responses.
1. Second paragraph of the Certificate of Compliance approved on April 29, 1991 and 15A
NCAC 02H.1003(b) effective September 1, 1995: A part of this major modification
includes subdividing and removing the 1.48-acre tract sold to Rocky Point Topsail Water
& Sewer District in 2002. The originally approved set of plans for this site notes that the
stone in the existing dumpster area will be removed and the area would be restored and
stabilized with vegetation. In reviewing the historical aerial photos available online, it
appears that this area was not restored to a vegetative cover and has been expanded to
include concrete pads, outbuildings, access roads, and a water tower. These
improvements also appear to have expanded into the proposed property area for the
Topsail Elementary School.
a. Please either include the improvements made within the school property as part
of the site plans or exclude this portion of the project area and demonstrate they
have been included in a separate permit.
Response: We have included the improvements -that the Water and Sewer
District made on the School property. These improvements include
the Water Tower and some gravel to access and maintain the
Water Tower. Pender County Schools is not responsible for the
areas outside their property line. The Water and Sewer District,
now Pender County Utilities, are responsible for bringing the 1.48

AC into compliance with the State Stormwater rules. It is our
understanding that the Utilities Department has been in contact with
you to explain what is happening with this property. The property
or a portion of this property is being transferred to NC DOT as a
part of the Hampstead Bypass. At that time, NC DOT intends to
remove the impervious surface on this property.
We recently discussed including the 1.48 AC in the Schools Permit.
That cannot be done and shouldn't be required as the School
System does not own the property.
b. A review of the stormwater permitting database could not locate a permit for this
subdivided tract of land or these improvements. Since this tract was originally
included in the project area and considered a common plan of development,
please either:
Provide the permit number associated with the additional development on
this subdivided property,
ii. Submit an application for the development on this subdivided parcel, and 1
or
iii. Include the improvements with this modification and list the new owner as
a co-permittee.
Response: The 1.48 AC tract doesn't have its own permit, the School
System is not responsible for this tract, and cannot be
included in the School permit. The Pender County Utilities
Department is the responsible party. It is our understanding
that the Utilities Department has been in contact with you to
explain what is happening with this property. The property
or a portion of this property is being transferred to NC DOT
as a part of the Hampstead Bypass. At that time NC DOT
intends to remove the impervious surface on this property.
The Pender County School System began this issue with the intent of moving modular
classrooms. They intended to do this the right way and contacted your office to proceed.
Their permit had not been revised since the 1991 issuance. We prepared a plan that did what
is required of the School System to revise their permit. It is our opinion that the Schools Permit
should not be held up or the package returned due to a piece of property that is out of their
control.
Enclosed is one (1) copy of the plan sheet, the revised Page 3 of 6 of the previously submitted
permit application, and one (1) copy of the revised Narrative for your continued review and
approval. Please contact us with any additional questions or comments you may have.

DESCRIPTION:
The project site was originally an approximately 40 AC tract located in Hampstead, NC
in Pender County. The soils of the site consist of sandy topsoil, grassed fields and
grades ranging from 0.5% to 2.0%. The original permit for this site was for a Project
Area of 36.6 AC to construct a new Elementary School with paved parking, paved
access and recreation fields. Construction is complete. This submittal is to bring the
State Stormwater Permit up to date since its original approval in 1991 -- SW8 910314.
1991- Original Elementary School Phase I Stormwater Permit - SW8 910314
Project Area: 36.6 AC
Proposed BUA: 3.2 AC (8.7%)
Allowable BUA, Low Density: 9.15 AC (25%)
2006 — New Topsail High School Approved — SW8 060706
Project Area: 29.9 AC
Proposed BUA: 13.43 AC (44.9%)
Portions of the 1991 Elementary School Permit (SW8 910314) and New Topsail High
School Permit (SW8 060706) project areas overlap. The Elementary School permit
should have been revised when the High School was submitted.
The 1991 Stormwater Permit (SW8 910314) plans include for a new Middle School
inside the project area but outside of the Phase 1 limits. The overlapped area of the two
(2) permits (the Elementary Permit and the High School) is due to the fact that the 1991
proposed Middle School was never built. Instead the new High School project took up
some of the future Middle School portion of the 1991 project area.
The above creates a decrease in the Overall Project Area for the Revised SW8 910314
Stormwater Permit. The project area decreases further with the sale of the 1.48 AC
property on the Northeast edge of the property. The 1.48 AC property was sold to the
Rocky Point Topsail Water & Sewer District.

The above numbers are shown on the revised plan. The totals of impervious come from
aerials from Pender County and Google Earth. The noted additions to the impervious
from the Original Phase I approval include expansion of parking 1 drive area, addition of
2nd entrance from US 17, addition of modular classrooms (including the modular
classroom), the addition of Tennis Courts, and now includes the impervious of the utility
department built on the School property associated with the water tower.
It should be noted that when the new Topsail High School was constructed, the old High
School became Topsail Middle School. The old High School (now the Middle School) is
located just to the Northeast of the Elementary School. The old High School predated
State Stormwater. It was originally constructed in 1975.

I have included the gentlemen I spoke to last week with Pender County to this email chain (Mr. Colon and Mr, Proctor).
My understanding is that DOT is only looking to obtain a portion of this parcel. The fate of the remainder of the parcel
was unknown. One option they discussed was the possibility of return the rest of the parcel back to the
school. However, the pending transfer to DOT is really a separate issue from the situation, which is the need for the
mobile classrooms.
As part of the major modification submitted, the amount of BUA was increased to the maximum allowed by the rules
and the project area was adjusted to remove areas now permitted under the high school permit and to exclude this
subdivision to Pender County. If you wish to include the subdivision and sale of this tract to Pender County as part of
this modification, then it would need to be addressed in a permit of its own. Alternatively, the scope of the modification
could be reduced and a plan of action could be submitted identifying the steps (with timelines) that will be taken to
resolve this issue and bring this site back into compliance,

Our deadline for return submittal to you is tomorrow. The only issues with this permit modification are due to the 1,48 Acres
that the Pender County Schools no longer owns. Mr. Nelson and Mr. Rogers with Pender County Schools has met with the
owner of the 1.48 acre parcel, Pender County Utilities. Both entities are Pender County associated, however they are
separate entities and owners. It is our understanding that you have been in conversation with Pender County Utilities. Please
advise if that is not the case.
Per the meetings between the Pender County Schools and the Pender County Utilities, the 1.48 acre parcel ownership will
soon be transferred/sold (I'm not sure) to the NCDOT as it is apart of the Hampstead Bypass area. From the conversations
with Pender County Utilities it is their intent to address the issues with the parcel either themselves or as a requirement for
NCDOT to do so.
The Pender County Schools site can account for the small amount of gravel that is used to maintain/inspect the water tower in
their Overall Permit, since it was built on their property. Not sure how this got constructed on the school property. The area
under the water tower is grass and thus pervious.
Please advise on how the discussions with the Pender County Utilities Dept went and how the school system can proceed with
the permit modification. It is not their responsibility to account for the 1.48 acres they no longer own. It is true that the
permit should of been updated when the 1.48 acres was sold. However, that update would of only be to decrease the Project
Area by 1.48 Acres. That is what they are trying to do now. The school system is doing what is required now, by updating the
permit. Please note this all began because they wanted to move a small modular classroom and wanted to do it correctly.
Please advise asap and if at all possible grant another extension due to the inability of the School System to correct something
that they have no control over.

I'm sorry but I'm not able to grant such a long extension. The max we are allowed to grant is an additional 15 days,

The Wilmington Regional Office received and accepted a modified State Stormwater Management Permit
Application for the subject project on January 10, 2020. A preliminary in-depth review of that
information has determined that the application is not complete and that additional information is needed.
To continue the review, please provide the following additional information in a single, hard copy
submittal packa2e:
Second paragraph of the Certificate of Compliance approved on April 29, 1991 and 15A NCAC
02H.1003(b) effective September 1, 1995: A part of this major modification includes subdividing
and removing the 1.48-acre tract sold to Rocky Point Topsail Water & Sewer District in 2002.
The originally approved set of plans for this site notes that the stone in the existing dumpster area
will be removed and the area would be restored and stabilized with vegetation. In reviewing the
historical aerial photos available online, it appears that this area was not restored to a vegetative
cover and has been expanded to include concrete pads, outbuildings, access roads, and a water
tower. These improvements also appear to have expanded into the proposed property area for the
Topsail Elementary School.
a. Please either include the improvements made within the school property as part of the site
plans or exclude this portion of the project area and demonstrate they have been included
in a separate permit.
A review of the stormwater permitting database could not locate a permit for this
subdivided tract of land or these improvements. Since this tract was originally included
in the project area and considered a common plan of development, please either:
i. provide the permit number associated with the additional development on this
subdivided property,
ii. submit an application for the development on this subdivided parcel, and/or
iii, include the improvements with this modification and list the new owner as a co-
permittee.
Please remember to confirm that any revised information is presented consistently throughout the
application documents including calculations, supplements, narrative, and plans. Please also remember to
provide two hard copies of any updated documents per 15A NCAC 02H.1042(2).

All of the requested information listed above should be received in this Office by February 26, 2020, or
the application will be returned as incomplete. If additional time is needed to submit the requested
information, please email your extension request prior to this due date to the email address provided
below with a justification and a date of when the requested information will be submitted, which shall be
no later than 15 days past the original due date. Please note that only two letters requesting additional
information is allowed in the State Stormwater Program for a total of 30 days to submit the requested
additional information. If the information is not satisfactorily provided after either the second request or
30 days, the project will be returned If the project is returned and you wish to re -submit later, you will
need to resubmit all required items at that time, including the application fee.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

In the instances where the applicant is different than the property owner, it is the responsibility of the property

V. SWALE SYSTEM MAINTENANCE REQUIREMENTS
Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches at
any time; and grass will not be mowed too close to the ground or "scalped".
2. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up,
erosion, and trash accumulation.
Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded
following sediment removal.
4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a
timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope.
5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every
significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts,
velocity reduction devices and piping.
6. Swales will not be altered, piped, or filled in without approval from NCDENR Division of Energy, Mineral
and Land Resources.

DESCRIPTION:
The project site was originally an approximately 40 AC tract located in Hampstead, NC
in Pender County. The soils of the site consist of sandy topsoil, grassed fields and
grades ranging from 0.5% to 2.0%. The original permit for this site was for a Project
Area of 36.6 AC to construct a new Elementary School with paved parking, paved
access and recreation fields. Construction is complete. This submittal is to bring the
State Stormwater Permit up to date since its original approval in 1991 — SW8 910314.

Portions of the 1991 Elementary School Permit (SW8 910314) and New Topsail High
School Permit (SW8 060706) project areas overlap. The Elementary School permit.
should have been revised when the High School was submitted.
The 1991 Stormwater Permit (SW8 910314) plans include for a new Middle School
inside the project area but outside of the Phase I limits. The overlapped area of the two
(2) permits (the Elementary Permit and the High School) is due to the fact that the 1991
proposed Middle School was never built. Instead the new High School project took up
some of the future Middle School portion of the 1991 project area.
The above creates a decrease in the Overall Project Area for the Revised SW8 910314
Stormwater Permit. The project area decreases further with the sale of the 1.48 AC
property on the Northeast edge of the property. The 1.48 AC property was sold to the
Rocky Point Topsail Water & Sewer District.

2nd entrance from US 17, addition of modular classrooms (including the modular
classrooms approved to be moved from the Middle School to the Elementary School in
Summer of 2019), and addition of Tennis Courts.
It should be noted that when the new Topsail High School was constructed, the old High
School became Topsail Middle School. The old High School (now the Middle School) is
located just to the Northeast of the Elementary School. The old High School predated
State Stormwater. It was originally constructed in 1975.

Dear Ms. Scott:
Pursuant to Linda Lewis's September 2019 approval for the school system to relocate a
modular classroom from the Middle School Site to the Elementary School Site, after e-mail
correspondence with Perry Pence (Pender County Schools) and T. Jason Clark, P.E. (Norris &
Tunstall), we are providing the enclosed permit modification package, which includes a revised
plan sheet and Narrative.
1. This modification was a required part of the moving of the modular classroom in the
summer of 2019.
2. The enclosed application, Narrative and revised plan sheet clear up the issues to the
best of our knowledge that have gone on since the original approval in 1991.
3. The revised and updated plan sheet demonstrate that the square footage of the BUA
does not exceed the permitted low -density maximum amount allowed by the original
permit. You will notice that the project area has gotten smaller than in the original
permit. This is due, in part to the construction of the Topsail High School, approved
under permit SW8 060706, July 28, 2006. It seems the Elementary School Permit
should have been updated then. The site "project" area is further reduced due to the
sale 1.48 ac of land to the Rocky Point -Topsail Water and Sewer District.

4. Aerial photos from Pender County GIS and Google Earth were used to develop the
enclosed plan. The impervious numbers on the application and plans were from a take-
off of the Aerials.
5. The confusing part of this involves, what is now the Topsail Middle School. I go over
this in the Narrative to the best of my knowledge. The original plans approved for the
Topsail Elementary School, Phase I also showed a new Middle School. The Middle
School shown on the 1991 plans was never built. Instead the Middle School moved to
the Old High School that pre -dates the 1991 Elementary School plans. The Old High
School was originally built in 1975.
6. 1 walked the site of the Elementary School to inspect the storm drainage piping. The
piping appears to be as originally approved, the best I can tell. There were no visible
storm drainage outlets in the Elementary School Site that weren't on the original plan.
Enclosed are two (2) copies of the plan sheet, one (1) copy of the Stormwater Narrative, one
(1) USGS map, one (1) copy of the Deed, the original Division of Water Quality Stormwater
Management Permit application, the original Low -Density Supplement form, and a $505.00
check for the permit review fee.

The below interpretation is just wrong. I do know the conversations and discussions. The School System approached Linda
about moving a Modular Classroom from one school to the next, a total of 1,728 sf for a total distance of approx. 1400 If with
every intent to do it the right way. They were informed to do this they had to revise their 1991 SW Permit. We had to come
up with a plan of action and develop a strategy to revise the permit to bring it up to date. That involved file investigations,
take -offs, plans and all this email correspondence to move a modular class room. We did this and discussed with your staff.
was our understanding through discussions that the 1991 permit was a low density permit allowing up to 25% impervious
surface and as long as the Elementary school didn't exceed the 25 % number a minor modification (revision) would
apply. Therefore we proceeded in this direction. Its unfortunate for all that Linda is no longer there and its unfortunate that
the office is understaffed. However, to return this submittal after holding it for 3 months is just wrong.

I don't know the details of those conversations with Linda but I discussed the situation with Georgette before sending
this email. Sites are permitted for the amount of BUA requested in the application. Any increase beyond that amount
is considered an increase in BUA and is a major modification per the definition in the rules.
Georgette usually tries to catch issues like this as part of the completeness review but due to the workload and being
short staffed, some submittals had to be taken at face value. Once we get fully staffed, hopefully we'll be able to return
to providing the customer service we'd like to so we can catch these earlier.

Linda's email provides accurate information. The site can be vested to the density limits in place when the permit was
issued (25%). In reading her email, she did not provide specific direction on the type of modification to be
submitted. Per the rules, any proposed increase in the amount of BUA from the original permit (up to the max allowed
under LID) is an increase in the BUA and is required to be submitted as a major modification.

Christine and Georgette,
Please do not return this package. It was submitted October 10, 2019 based on what and how Linda Lewis advised us and the
Pender County School System to move forward. Per Linda's communication the site is allowed the Maximum of 25
BUA. Per communication with Linda and other projects if the site doesn't increase the site BUA above the allowed amount
(25% in this case) a Minor Mod is acceptable. This is why we went in this direction. To up and return the package now after 3
months is unfair and going against what we were asked to do. We provided plan of action and proceeded in the way we
discussed. I have attached the first email from Linda concerning the project and max BUA.
As for the overlap, That is what we tried to show on the plan provided. There was overlap and the overlapped section is now
permitted in the High School Permit. Therefore we decreased the project area to subtract the area that is now permitted in
the High School Permit. We also, therefore reduced the project area (from 36.6 ac to 31.26 ac) from the Elementary School
Permit, keeping the 1991 Allowable 25% BUA.
This is an unnecessary setback to a project that has proceeded as discussed with NCDEQ Staff.
Please consider the above.

I'm taking a look at this minor modification and it appears that the total impervious area is increasing from the
previously approved 3.2 acres of BUA to 7.6.03 acres of BUA. Any increase in BUA is considered a major modification to
the permit per 15A NCAC 02H.1002(23) and (25). Because of this increase, the minor modification will need to be
returned and a major modification package, with an application, supporting documents, and fee must be
submitted. Since the modification is attempting to resolve some compliance issues, please warn your client and begin
preparing the major modification.
Additionally, the submitted exhibit demonstrates an overlap in project area between SW8 910314 and SW8
060706. Please ensure that the modification resolves this overlap. i was also looking at the middle school and there
have been some improvements over the years. Has the BUA at the middle school and outside these permitted
boundaries exceeded 10,000 sf?

Please accept this email as verification that the Division of Energy, Mineral and Land Resources
received a letter from Darren LaFon attached to an email on August 7, 2019. The letter set forth a
Plan of Action to bring about compliance with the Stormwater Management Permit SW8 910314, by
October 31, 2019.
However, the School System needs to move a 1,728 square foot modular classroom now in order to
open for the school year. The School system wants permission from the Division to move that
classroom now before the revised plans are received on October 31, 2019. Since it is a small area,
DEMLR herewith grants permission for the classroom to be moved now.
As stipulated in the Division's email of July 23, 2019, this change will need to be accounted for in the
revised plans and in the final BUA tally which are due on October 31, 2019.

Pursuant to your recent e-mail correspondence with Perry Pence (Pender County Schoo)s)
and T. Jason Clark, P.E. (Norris & Tunstall) in reference to relocating a modular classroom
onsite, we ask that you allow the School System to move forward while we work through the
process of bringing the existing permit up to date. We offer the following Plan of Action.
We will update plans to show the physical limits of all the. BUA on site within the original
permit project area.
2. We will update plans and calculate the square footage of that BUA.
3. Updated plans will demonstrate that the square footage of the BUA does not exceed the
permitted low -density maximum amount allowed by the original permit. If the existing
BUA does exceed the allowed, we will make the necessary site revisions to bring the
site up to regulations by treating any BUA that exceeds the allowed.
4. We will update plans to address all inlets and piping on the site that have been added to
the site and are not shown on the 1991 plans within the original permit project area.
As you are aware Pender County Schools has contacted you in order to relocate an existing
on -site Modular Classroom from Topsail Middle School to Topsail Elementary School. They
need to do this prior to the new school year, as soon as possible. The Modular Classroom is
1,728 SF and will be moved a total of approximately 1,400 LF. The limits of disturbance will be
minimal, just the area around the modular.

We ask that you allow the School System to move this modular classroom as soon as
possible, while we go through the, process to bring the existing permit up to date, with correct
BUA and pipe sizing as you asked.
The site is a very large area and we will rely on aerial photos and google maps to develop our
plan and show the existing impervious on site. We may need survey work done on the site,
which will add time to the final plan.
We have already begun out' work on this project and anticipate having you a full submittal of
plans and revised numbers by October 31, 2019. ' To concur the information in this Plan of
Action, we have provided a space below for the School System to sign as an
acknowledgement. Perry Pence is no longer with Pender County Schools. His replacement
for this project is Darren LaFon.

The SW8 910314 permit is low density, so the amount of built -upon area (BUA) that can
be placed within the property boundaries is limited. The maximum BUA limit for this
project is 25% of the 36.6 acre project area (based on the 1991 application materials).
The plans we have on file are from 1991 and have not been updated at all since
then. From Google, I can see that there are several areas where BUA has been added
that is not shown on the approved plan. Therefore, the plans need to be updated as
follows: 1) to show the physical limits of all the BUA on site; 2) to calculate the square
footage of that BUA; 3) to demonstrate that the square footage of the BUA does not
exceed the permitted low density maximum amount allowed; and 4) to address all inlets
and piping on the site that have been added to the site and are not shown on the 1991
plans.
Most permittees elect to engage a PE or a PLS for low density projects. I cannot
recommend one over the other, but I can tell you that the surface drainage systems,
incidental piping and required plans associated with a low density project can be
designed by a PLS (a professional land surveyor), which may be cheaper than a
PE. However, if an extensive piped collection system has been added, DEMLR may
designate the project as high density, and may require the design and construction of a
primary stormwater control measure (SCM) to treat the runoff. The PLS license does

I think we can work something out.
In exchange for allowing a trailer to be moved in over existing BUA at this site, DEMLR would require
the permittee to provide a written schedule for providing a modified application to address all the
changes that have taken place since the permit was originally issued. If the "existing" BUA that the
trailer will sit on turns out to have been added without approval at some point in the past, then you will
need to take that into account.
The proposed written schedule would be included as part of the plan revision to move the trailer.

We have been contacted by Mr. Perry Pence, Pender County Schools about moving a modular class room from the Topsail
Middle School to the Elementary School. We understand from your below email and copies of the last permit (SW8 910314)
and plan that were permitted in 1991 that there have been revisions to the school sites in the last 28 years. Some of these
changes include the addition of the new High School (SW8 060706). It appears that the project areas overlap in areas. Note,
it appears the SW8 910314 permit was for the Elementary School only, the second part, the Middle School wasn't permitted
or constructed.
We are working on bringing the permits up to date. However, in the mean time the Schools need to be able to move an
existing Modular Classroom from the Middle School to the Elementary School. The modular exists and will not be adding
impervious to the site. This needs to be done in time for the upcoming school year- middle of August at latest. Is there a way
you can allow them to relocate impervious within the site. Knowing that thev/we are correcting the oermits to reflect the
existing conditions?
Please advise what we can do. This is of.great importance to the Schools. We will be glad to meet with you to discuss if
necessary. I have attached a google pdf showing the Modular to be moved and the proposed new location.

Pender County School System trying to move a modular classroom from Topsail
Middle School to Topsail Elementary School. Richard Dutka is no longer with the
school system and he is whom the letter you attached is directed to as the Point of
Contact. I will be handling this project along with Glenn Rogers from the school
system. What exactly do we need to do in order to perform this work in the proper
way. permits filed etc? Is it normal to get an engineering firm involved for a project
such as this in nature.

I attach a copy of the SW8 910314 low density stormwater permit for the elementary school. The
approved plans also show a proposed middle school that is "not in the contract".
Back in July 2014, as per the attached letter, it appears that other classroom additions were
proposed, but our records indicate that no application was received to deal with those additions.
Based on the 2019 application, it appears that an "existing" mobile classroom is being moved from
one school to the other. Please submit a minor modification and a revised plan to show and account
for all of the BUA now located on the elementary school property.

Good morning Pender County TRC members,
As outlined in the Pender County Unified Development Ordinance § 2.9.2 A, the Technical Review Committee shall make
a recommendation on site development submittals. There is one case outlined in this email.
Case # SDP 2019-90
Pender County Schools, applicant and owner, is requesting approval of a minor site plan for the movement of a 1,728
modular classroom from Topsail Middle School to Topsail Elementary School. The subject property is located at 1738S
US Hwy 17 in the Topsail Township and may be further identified by Pender County PIN 3293-87-2994-0000. The subject
property is zoned O&I, Office & Institutional zoning district.
Currently, the property contains Topsail Elementary School and associated improvements. The property is adjacent to
Topsail Middle School. The modular classroom will hook into onsite utilities. No additional improvements are proposed.
All required Federal, State, and local permits will be obtained prior to zoning approval.

- No disturbance of an AEC, SFHA, or designated wetland
