The soils of the site consist of sandy topsoil, grassed fields and grades ranging from 0.5% to 2.0%. The original permit for this site was for a Project Area of 36.6 AC to construct a new Elementary School with paved parking, paved access, and recreation fields. Construction is complete. This submittal is to bring the State Stormwater Permit up to date since its original approval in 1991 — SW8 910314. 1991- Ori inaI Elementa School Phase I Stormwater Permit - SW8 910314 Project Area: 36.6 AC Proposed BUA: 3.2 AC (8.7%) Aliowabie BUA, Low Density: 9.15 AC (25%) 2006 -- New Topsail High School Approved -- SW8 060706 Project Area: 29.9 AC Proposed BUA: 13.43 AC (44.9%) Portions of the 1991 Elementary School Permit (SW8 910314) and New Topsail High School Permit (SW8 060706) project areas overlap. The Elementary School permit should have been revised when the High School was submitted. The 1991 Stormwater Permit (SW8 910314) plans include for a new Middle School inside the project area but outside of the Phase I limits. The overlapped area of the two (2) permits (the Elementary Permit and the High School) is due to the fact that the 1991 proposed Middle School was never built. Instead the new High School project took up some of the future Middle School portion of the 1991 project area. The above creates a decrease in the Overall Project Area for the Revised SW8 910314 Stormwater Permit. 1.48 AC Area at the Northeast Corner of the Project Area Since the 1991 permit was issued, a 1.48 AC piece of the Project Area was sold to the Rocky Point Topsail Water and Sewer District, now Pender County Utilities. The original permit called for the existing impervious in this area to be removed. It wasn't removed. At this date Pender County Utilities owns this property. However, NC DOT is acquiring 26,000 SF of this area for the Hampstead By -Pass. At that time NC DOT will remove the impervious that lies on the 26,000 SF they acquired. ',The remaining area of 38,469 SF will still belong to Pender County Utilities. Mr. Anthony Colon, Pender County Utilities Assistant Director has submitted a Plan of Action to remove the existing concrete slab that remains on their remaining portion. Pender County Utilities has also agreed to be a Co-Permittee on this State SW Modification (SW8 910314). The Co-Permittee solution was determined during a meeting between Pender County Schools, Pender County Utilities, and the State Division of Environmental Quality (NC DEQ). Below outlines the solution. This submittal is being provided to NC DEQ for modification of the SW8 910314 permit, assuming the impervious surfaces have been removed per the Pender County Utilities Plan of Action Agreement. 2019 (2020) - Elementary School Phase I Stormwater Permit - SW8 910314 MOD Project Area: 32.5 AC (Original Area minus High School Overlap 3.5 AC and minus 26,000 SF acquired by NCDOT) Proposed: Actual per Aerials + Modular Unit (4,433 SF) BUA: 7.948 AC / 346,207 SF (24.8%) -Includes BUA built by Utilities Dept. on School Property and Gravel Driveway Area on Utilities Dept. to Service the Water Tower - Allowable BUA Low Density: 8.12 AC / 353,959 SF (25%) - FUTURE Allowed = 7,752 SF Since a Major Modification is being Required: Permit for 7.90 AC / 344,341 SF • (25% BUA) The above numbers are shown on the revised plan. The totals of impervious come from aerials from Pender County and Google Earth. The noted additions to the impervious from the original Phase I approval include expansion of parking / drive area, addition of 2Rd entrance from US 17, addition of modular classrooms (including the modular classroom), the addition of Tennis Courts, and now includes the impervious of the utility department built on the School property associated with the water tower. It should be noted that when the new Topsail High School was constructed, the old High School became Topsail Middle School. The old High School (now the Middle School) is located just to the North of the Elementary School. The old High School predated State Stormwater. It was originally constructed in 1975. I mentioned to you on the letter dated April 17, 2020 that the North Carolina Department of Transportation is currently working on the purchase of forty percent of the property mentioned above. Pender County Utilities will be responsible for the remaining sixty percent of the property in which we have decided to begin planning on the removal of the existing concrete slab. To comply with your request, we recommend the following timeline: • September 30, 2020 — Collection of all bids from qualified contractors to demolish and haul away concrete surface on the portion owned by Pender County Utilities. • January 1, 2021- Submission of project requirements and cost to the Pender County Utilities Director to be inserted in the FY22 operational budget request spreadsheet. • June 30, 2021— Obtain approval of requested funds from the Board of County Commissioners to proceed with demolition and hauling. • August 16, 2021— Award of purchase order number to selected contractor for the demolition and hauling of concrete. • October 31, 2021 — Completion and inspection of project. Jason Clark, P.E. (Norris & Tunstall), we are providing the enclosed permit modification package, which includes a revised plan sheet and narrative. The enclosed narrative tries to summarize the situation and the project modification. This modification was a required part of the request to move a modular classroom in the summer of 2019. The modular wasn't moved in 2019. However, the school system needs to add the modular ASAP, to prepare for the beginning of the 2020 fall schedule. 2. The enclosed application, narrative and revised plan sheet clear up the issues to the best of our knowledge that have gone on since the original approval in 1991 and the correspondence between all parties. 3. The revised and updated plan sheet demonstrates that the square footage of the existing BUA does not exceed the permitted low -density maximum amount allowed by the original permit. You will notice that the project area has become smaller than in the original permit. This is due in part to the construction of the Topsail High School, approved under State Stormwater Permit SW8 060706, July 28, 2006. It seems the Elementary School Permit should have been updated then. The site "project" area is further reduced due to the sale of 1.48 AC of land to the Rocky Point -Topsail Water and Sewer District. This 1.48 AC parcel has been the point of contention with this modification: Pender County Utilities owns this parcel and is now a co -applicant in this Ms�Chrlstine Hall 1 NC DEQ Stormwater May 26, 2020 Page 2 modification. A portion of this parcel is being acquired by NC DOT for the Hampstead By -Pass and is not included in the project area. Also, in order for this modification to go through, the Pender County Utilities Department had to provide a Plan -of -Action Letter to the State to account for the removing of the concrete slab that exists. 4. Aerial photos from Pender County GIS and Google Earth were used to develop the enclosed plan. The impervious numbers on the application and plans were from a take- off of the aerials. 5. The Middle School shown on the 1991 plans was never built. Instead, the Middle School moved to the Old High School that pre -dates the 1991 Elementary School plans. The old High School was originally built in 1975. 6. 1 walked the site of the Elementary School to inspect the storm drainage piping. The piping appears to be as originally approved, the best I can tell. There were no visible storm drainage outlets in the Elementary School site that weren't on the original plan. Enclosed are two (2) copies of the plan sheet, one (1) copy of the Stormwater Narrative, one (1) USGS map, one (1) copy of the Deed, the original Division of Water Quality Stormwater Management Permit application, the original Low -Density Supplement form, and a $505.00 check for the permit review fee. Also enclosed is a copy of the Plan -of -Action Letter provided by Mr. Anthony Colon, Pender County Utilities. The option of signing the property over to the schools wasn't an option that Mr. Keel could sign off on, because, that decision would have to be made by the Pender County Government Board. That would be a long, dragged out process that would not help anyone in dealing with this issue right now. What we have decided (and this depends on if you would be in agreement), is, that PCU will be co-permitees on the Storm Water permit. I believe this was one of the original options you had mentioned. If that is agreeable to you, Anthony will re -write his action plan to include this, to which, Ken Keel and Mr. Lafon (PCS), will sign. As soon as we agree, Jason Clark will write up the new application, with co-permitees, and, Mr. Keel and Dr. Hill will sign and we will get in your hands A.S.A.P.. If the remaining parcel will be returned to the schools, then that change in ownership should be included in the plan of action and signed off by both entities agreeing to resolve their respective pieces. (The utilities agreeing to transfer the property and the schools agreeing to accept the property). Once the plan of action is fleshed out a bit more with this information, and signed off by all parties, it would then allow the modification to be submitted as you propose. As for the final question, it seems that all parties are eager to resolve this. I hope that means they are willing to work together to get this clarification into the plan of action, which would then allow the modification to be submitted in the near future. 1 will take Linda's original lead on this and as long as an application is in house and is eventually approved. we will not comment on the timeframe of construction or relocation of the mobile classroom. I'm hoping that we've worked through the issues and will be able to approve the modification. I have another question for you about the Modular that Linda allowed to be moved last summer pending this permit being brought up to date. The originally approved set of plans for this site notes that the stone in the existing dumpster area will be removed and the area would be restored and stabilized with vegetation. In reviewing the historical aerial photos available online, it appears that this area was not restored to a vegetative cover and has been expanded to include concrete pads, outbuildings, access roads, and a water tower. These improvements also appear to have expanded into the proposed property area for the Topsail Elementary School. a. Please either include the improvements made within the school property as part of the site plans or exclude this portion of the project area and demonstrate they have been included in a separate permit. Response: We have included the improvements -that the Water and Sewer District made on the School property. These improvements include the Water Tower and some gravel to access and maintain the Water Tower. Pender County Schools is not responsible for the areas outside their property line. A review of the stormwater permitting database could not locate a permit for this subdivided tract of land or these improvements. Since this tract was originally included in the project area and considered a common plan of development, please either: Provide the permit number associated with the additional development on this subdivided property, ii. Submit an application for the development on this subdivided parcel, and 1 or iii. Include the improvements with this modification and list the new owner as a co-permittee. However, the pending transfer to DOT is really a separate issue from the situation, which is the need for the mobile classrooms. As part of the major modification submitted, the amount of BUA was increased to the maximum allowed by the rules and the project area was adjusted to remove areas now permitted under the high school permit and to exclude this subdivision to Pender County. If you wish to include the subdivision and sale of this tract to Pender County as part of this modification, then it would need to be addressed in a permit of its own. The only issues with this permit modification are due to the 1,48 Acres that the Pender County Schools no longer owns. Both entities are Pender County associated, however they are separate entities and owners. It is our understanding that you have been in conversation with Pender County Utilities. Please advise if that is not the case. Per the meetings between the Pender County Schools and the Pender County Utilities, the 1.48 acre parcel ownership will soon be transferred/sold (I'm not sure) to the NCDOT as it is apart of the Hampstead Bypass area. From the conversations with Pender County Utilities it is their intent to address the issues with the parcel either themselves or as a requirement for NCDOT to do so. The Pender County Schools site can account for the small amount of gravel that is used to maintain/inspect the water tower in their Overall Permit, since it was built on their property. Not sure how this got constructed on the school property. The area under the water tower is grass and thus pervious. Please advise on how the discussions with the Pender County Utilities Dept went and how the school system can proceed with the permit modification. It is not their responsibility to account for the 1.48 acres they no longer own. It is true that the permit should of been updated when the 1.48 acres was sold. However, that update would of only be to decrease the Project Area by 1.48 Acres. That is what they are trying to do now. The school system is doing what is required now, by updating the permit. Please note this all began because they wanted to move a small modular classroom and wanted to do it correctly. A preliminary in-depth review of that information has determined that the application is not complete and that additional information is needed. To continue the review, please provide the following additional information in a single, hard copy submittal packa2e: Second paragraph of the Certificate of Compliance approved on April 29, 1991 and 15A NCAC 02H.1003(b) effective September 1, 1995: A part of this major modification includes subdividing and removing the 1.48-acre tract sold to Rocky Point Topsail Water & Sewer District in 2002. The originally approved set of plans for this site notes that the stone in the existing dumpster area will be removed and the area would be restored and stabilized with vegetation. In reviewing the historical aerial photos available online, it appears that this area was not restored to a vegetative cover and has been expanded to include concrete pads, outbuildings, access roads, and a water tower. These improvements also appear to have expanded into the proposed property area for the Topsail Elementary School. a. Please either include the improvements made within the school property as part of the site plans or exclude this portion of the project area and demonstrate they have been included in a separate permit. A review of the stormwater permitting database could not locate a permit for this subdivided tract of land or these improvements. Since this tract was originally included in the project area and considered a common plan of development, please either: i. provide the permit number associated with the additional development on this subdivided property, ii. submit an application for the development on this subdivided parcel, and/or iii, include the improvements with this modification and list the new owner as a co- permittee. Please remember to confirm that any revised information is presented consistently throughout the application documents including calculations, supplements, narrative, and plans. Instead the Middle School moved to the Old High School that pre -dates the 1991 Elementary School plans. The Old High School was originally built in 1975. 6. 1 walked the site of the Elementary School to inspect the storm drainage piping. The piping appears to be as originally approved, the best I can tell. There were no visible storm drainage outlets in the Elementary School Site that weren't on the original plan. The School System approached Linda about moving a Modular Classroom from one school to the next, a total of 1,728 sf for a total distance of approx. 1400 If with every intent to do it the right way. They were informed to do this they had to revise their 1991 SW Permit. We had to come up with a plan of action and develop a strategy to revise the permit to bring it up to date. That involved file investigations, take -offs, plans and all this email correspondence to move a modular class room. We did this and discussed with your staff. was our understanding through discussions that the 1991 permit was a low density permit allowing up to 25% impervious surface and as long as the Elementary school didn't exceed the 25 % number a minor modification (revision) would apply. Therefore we proceeded in this direction. Its unfortunate for all that Linda is no longer there and its unfortunate that the office is understaffed. Sites are permitted for the amount of BUA requested in the application. Any increase beyond that amount is considered an increase in BUA and is a major modification per the definition in the rules. Georgette usually tries to catch issues like this as part of the completeness review but due to the workload and being short staffed, some submittals had to be taken at face value. The site can be vested to the density limits in place when the permit was issued (25%). In reading her email, she did not provide specific direction on the type of modification to be submitted. It was submitted October 10, 2019 based on what and how Linda Lewis advised us and the Pender County School System to move forward. Per Linda's communication the site is allowed the Maximum of 25 BUA. Per communication with Linda and other projects if the site doesn't increase the site BUA above the allowed amount (25% in this case) a Minor Mod is acceptable. This is why we went in this direction. To up and return the package now after 3 months is unfair and going against what we were asked to do. We provided plan of action and proceeded in the way we discussed. I have attached the first email from Linda concerning the project and max BUA. As for the overlap, That is what we tried to show on the plan provided. There was overlap and the overlapped section is now permitted in the High School Permit. Therefore we decreased the project area to subtract the area that is now permitted in the High School Permit. We also, therefore reduced the project area (from 36.6 ac to 31.26 ac) from the Elementary School Permit, keeping the 1991 Allowable 25% BUA. This is an unnecessary setback to a project that has proceeded as discussed with NCDEQ Staff. Please consider the above. T. Any increase in BUA is considered a major modification to the permit per 15A NCAC 02H.1002(23) and (25). Because of this increase, the minor modification will need to be returned and a major modification package, with an application, supporting documents, and fee must be submitted. Since the modification is attempting to resolve some compliance issues, please warn your client and begin preparing the major modification. Additionally, the submitted exhibit demonstrates an overlap in project area between SW8 910314 and SW8 060706. Please ensure that the modification resolves this overlap. i was also looking at the middle school and there have been some improvements over the years. In exchange for allowing a trailer to be moved in over existing BUA at this site, DEMLR would require the permittee to provide a written schedule for providing a modified application to address all the changes that have taken place since the permit was originally issued. If the "existing" BUA that the trailer will sit on turns out to have been added without approval at some point in the past, then you will need to take that into account. The proposed written schedule would be included as part of the plan revision to move the trailer. Some of these changes include the addition of the new High School (SW8 060706). It appears that the project areas overlap in areas. Note, it appears the SW8 910314 permit was for the Elementary School only, the second part, the Middle School wasn't permitted or constructed. We are working on bringing the permits up to date. However, in the mean time the Schools need to be able to move an existing Modular Classroom from the Middle School to the Elementary School. The modular exists and will not be adding impervious to the site. This needs to be done in time for the upcoming school year- middle of August at latest. Is there a way you can allow them to relocate impervious within the site. Knowing that thev/we are correcting the oermits to reflect the existing conditions? Please advise what we can do. The approved plans also show a proposed middle school that is "not in the contract". Back in July 2014, as per the attached letter, it appears that other classroom additions were proposed, but our records indicate that no application was received to deal with those additions.
