Following is a list of actions that we have undertaken to correct the deficiencies noted in your report following the April 1, 2014 inspection and those that will be completed in the near future. 1. Maintain stormwater pond: Removal of the vegetation around the perimeter of the pond has been completed. Above and underground wires/cables on the banks of the pond perimeter are in the process of being located by NC811. Once the wires/cables have been located and/or removed, we will be able to remove roots and stumps from the pond area perimeter and replant the area with grass. 2. Excavation of pond vegetation: We are in the process of selecting a contractor to dredge beneath our marina docks as part of a dock rebuilding project scheduled to begin this Fall. Our permits allow for dredging between October 1, 2014 and April 1, 2015. We plan to use the same contractor to excavate the stormwater pond vegetation with work on the site to begin on or after October 1, 2014. 3. Depth of pond: We are in the process of checking the pond depth against the approved plan to determine if the pond needs to be cleaned out. If it needs to be cleaned out, we plan to excavate the pond on or after October 1, 2014, as above. DEMLR file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Maintain stormwater pond. Remove all vegetation and establish grassed slopes and swales. 2. Determine if pond needs to be cleaned out by checking depths and comparing to approved plan. Please inform this Office in writing before May 1, 2014, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by May 1, 2014 then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. If the project has changed its name, ownership, or mailing address, it is your responsibility to submit a completed and signed Name/Ownership Change form to DEMLR at least 30 calendar days prior'to making the changes. Please include the name, mailing address and phone number of the person or entity that is now responsible for this permit on the Name/Ownership Change form. Per the terms and conditions of the permit, and Stormwater Regulation 15A NCAC 2H.10080), which stipulates the following: "Upon completion of construction, the designer for the type of Stormwater system installed must certify that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by the Division and complies with the requirements of this Section prior to issuance of the certificate of occupancy." As of this date, our records indicate the required designer's certification has not been received. Construction is considered complete at the time the project is occupied by an owner or tenant for its intended use. Please submit the required certification by March 24, 2012. Operation of the stormwater system prior to submission of the required certification and/or failure to submit the certification are considered violations of the permit, and are subject to enforcement action, per NCGS 143-215.6A. On January 4, 1993, Regional Office Staff conducted a compliance inspection of the project's stormwater facilities and found constnietion completed and the facility occupied. To date, our records indicate that the required Professional Engineer's Certification has not been received. No diversion swale exists, nor is there an 8" drawdown pipe constricted. The grassed Swale is full of trash and is generally dismally maintained. 3. The pond surface area appears to be less than shown on the approved plan. The visit was extremly informative and provided the type of positive problem solving that is greatly appreciated by a small company attempting to deal with the numerous requirements present in today`s business enviornment. The subject of the visit was to discuss the 4 Jan 93 compliance inspection' of the Town Creek Marina s±ormwater project. The results of the inspection were forwarded in a letter dated 6 Jan 93, subject: Notice of Inspection. The letter detailed the present violations and the lack of reoeipf of the required Professional Engineer's Certification. Additionally the letter required action by Town Creek before 27 Jan 93 so that "initiation of appropriate enforcement action" would not take place. During the discussions while on site there were several suggestions, one of which was how a now plan developed by an engineering firm might use the present retaining wall that has been a part of the construction for the new dry stack facility. The wall could alleviate the 3:1 required slope of the pond and reduce the actual width requirement so as to keep all of the parking spaces as constructed and now marked. ` A follow up telephone call to Ms. Lewis at 2:00 pm on 29 January reflected that the visit yesterday suffices for the 27 January suspenseWe will follow up with our new plan of action. That plan will identify the new engineering firm that will prepare the revision to our Drainage and Erosion Control Plan, what specific actions we will take and the approximate dates that Town Creek wil1. be able to accomplish those tasks. Based on our review of the project plans and specifications, we have determined that the Town Creek Marina stormwater control system complies with the Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The runoff will be treated in a detention pond sized to achieve 90 % reduction in Total Suspended Solids. Any modification of the plans submitted to and approved by this Office or further development of this site regardless of the fact that the modification may be less than 1 acre, will require an additional Stormwater SubmittallModification and approval prior to initiation of construction. Modifications include but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces, addition of built -upon surfaces, redesign or further subdivision of the project area. This Certification shall be effective from the date of issuance until rescinded. The project shall be constructed and maintained in accordance with the plans and specifications approved by the Wilmington Regional Office. 'r.. e•. _ ,fir • �� Operation and Maintenance Manual. for Storm Water Retention Facility General: The storm water management system for this site is designed as a wet detention facility. The system consists of the wet detention pond located adjacent to the dry stack building with a drawdown tube and drilled plug orifice, a temporary storm water storage area which is the grassed area on the interior of the central parking lot, overflow diversion swale and driveway culverts and pipe systems. operation: The wet detention pond is designed to maintain a permanent water pool with an average depth of 3 feet. The pond and grassed area on the interior of the parking lot are designed to temporarily store an amount of water equivalent to 1 inch of storm water run-off from the impervious areas. In the event of a 1 inch rainfall, the wet detention pond' is designed such that the water surface will rise approximately 1.3 feet above the normal pool level. This increase in water depth will slowly recede to the normal pool level in a 2 to 3 day time period. This drawdown time is controlled by an 8 inch diameter PVC drawdown pipe with an orifice at the intake In rain events which produce more than the 1 inch run-off, a diversion Swale is provided to direct this increased discharge to the pipe system leading off site. This diversion system is designed based on the 10 year frequency storm event, therefore flooding in excess of:the available storage within the wet detention pond and the parking lot interior island should be relatively infrequent. Maintenance: Several areas will need attention by marina operations personnel for the continued performance of this system as designed and as required by the Division of Environmental Management. These items are detailed as follows: 1. Grassing around the wet detention pond and in the interior island shall be maintained to prevent the evasion of these areas. The areas shall be periodically mowed to maintain the aesthetic quality of the site and to prevent a reduction in capacity of the storm water system. 2. Iandscaping of the area around the wet detention pond and the interior island shall be of the type and located such that they will not reduce the capacity or operation of the storm water system. 3. Following each rain event at the site, the drawdown tube orifice shall be checked for accumulation of debris and cleared of any blockage that is present. If the water level following a rain event fails to recede to the normal pool elevation within the 2 to 3 day time period the engineer mist be notified as soon as possible. If the water level fails to recede within a period of 5 days following a rain event the marina operator must notify the Division of Environmental Management, 7225 Wrightsville Avenue, Wilmington, N.C., (919) 256-4161. 4. Storm drainage pipes and culverts shall be inspected periodically for debris and sand build-up. These shall be cleaned as necessary to provide for the conveyance of storm water as designed. 5. The wet detention pond depth shall be maintained at the design depth. The pond shall be inspected a minimum of every 6 months and cleaned as necessary. 6. No modifications shall be made to the system without notification of the engineer or without approval from the Division of Envirorwnental Management. The Certification of Compliance with Stormwater Regulations states: A professional engineer must certify that the stormwater system has been installed in accordance with the approved plans and specifications upon completion of construction. On October 28, 1991, Regional Office Staff conducted a compliance inspection of the subject project's stormwater facilities and found construction completed and the facility occupied. To -date our records indicate that the required Professional Engineer's Certification has not been received. Additionally, the following conditions were observed during the inspection and also establish violations with the Certification: 1. The detention basin is approximately 2' deep. The basin does not provide a minimum of a 3' permanent pool plus storage capacity of 1" of runoff from impervious surface. 2. An outlet structure with a controlling orifice could not be located. 4. The outlet pipe is covered with sediment and vegetation. The effluent end is cracked and part has broken off. 5. The basin is choked with cattails. Necessary maintenance has not been provided as required in the Operation and Maintenance Plan. 6. The "vegetative filter" does not provide sufficient vegetation to remove solids. Rather, exposed sediment is picked up by untreated runoff routed through the "filter" and carried directly into the watercourse. Operation of the stormwater system prior to submission of the required certification and the above conditions are violations of 15A NCAC 2H.1003 and are subject to enforcement action pursuant to NCGS 143-215.6, including the assessment of civil penalties. Failure to provide the required Engineer's Certification and a "plan of action" (which designates the date by which the above items will be permanently corrected), prior to December 9, 1991 will result in initiation of appropriate enforcement action by this Office. The action may include a recommendation that the Stormwater Certification be revoked and/or a recommendation for the assessment of civil penalties.
