Thank you for your letter. Following is a list of actions that we have undertaken to correct the
deficiencies noted in your report following the April 1, 2014 inspection and those that will be completed
in the near future.
1. Maintain stormwater pond: Removal of the vegetation around the perimeter of the pond has been
completed. Above and underground wires/cables on the banks of the pond perimeter are in the process
of being located by NC811. Once the wires/cables have been located and/or removed, we will be able to
remove roots and stumps from the pond area perimeter and replant the area with grass.
2. Excavation of pond vegetation: We are in the process of selecting a contractor to dredge beneath our
marina docks as part of a dock rebuilding project scheduled to begin this Fall. Our permits allow for
dredging between October 1, 2014 and April 1, 2015. We plan to use the same contractor to excavate
the stormwater pond vegetation with work on the site to begin on or after October 1, 2014.
3. Depth of pond: We are in the process of checking the pond depth against the approved plan to
determine if the pond needs to be cleaned out. If it needs to be cleaned out, we plan to excavate the
pond on or after October 1, 2014, as above.

On April 1, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected Town Creek Marina in Carteret County to determine the status
of compliance with the State Stormwater Management Permit Number SW8 880401. DEMLR
file review and site inspection revealed that the site is not compliant with the terms and
conditions of this permit. Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recent
inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Maintain stormwater pond. Remove all vegetation and establish grassed slopes and
swales.
2. Determine if pond needs to be cleaned out by checking depths and comparing to
approved plan.
Please inform this Office in writing before May 1, 2014, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by May 1, 2014 then DEMLR staff will re -inspect the site
and issue a Notice of Violation if the listed deficiencies have not been addressed.
If the project has changed its name, ownership, or mailing address, it is your responsibility to
submit a completed and signed Name/Ownership Change form to DEMLR at least 30 calendar
days prior'to making the changes. Please include the name, mailing address and phone
number of the person or entity that is now responsible for this permit on the Name/Ownership
Change form.

On May 7, 2004, the Division of Water Quality issued a Stormwater Management Permit
to you for the construction and operation of the built -upon area and BMP's for the
subject project. Per the terms and conditions of the permit, and Stormwater Regulation
15A NCAC 2H.10080), which stipulates the following:
"Upon completion of construction, the designer for the type of Stormwater
system installed must certify that the system was inspected during
construction, was constructed in substantial conformity with plans and
specifications approved by the Division and complies with the
requirements of this Section prior to issuance of the certificate of
occupancy."
As of this date, our records indicate the required designer's certification has not been
received. Construction is considered complete at the time the project is occupied by an
owner or tenant for its intended use. Please submit the required certification by March
24, 2012. Operation of the stormwater system prior to submission of the required
certification and/or failure to submit the certification are considered violations of the
permit, and are subject to enforcement action, per NCGS 143-215.6A.

The Division of Coastal Management forwarded your letter of February 27, 2012 to me on Monday, March 19. The
letter requested a designer's certification for the stormwater management permit issued to Town Creek Marina on
May 7, 2004. Cameron Weaver subsequently provided copies of related documents from the DENR permit files.
We have located a designer's certification prepared by Lawrence Sneeden, Jr. P.E. dated November 7, 1995 for the
stormwater retention basin authorized for this project. We are aware this is not the certification you requested.
However, 1 am including a copy with this letter since Cameron indicated it was not in the Department's files.
We are continuing to work to identify and contact the designer of the May 7, 2004 permit modification to ascertain
the status of the certification requested.in your letter. We have contacted the original engineers for the 1988 project
(McKim and Creed) for assistance in identifying the designer of the 2004 project and are waiting for their response.
Your letter requested that the certification for the 2004 project be submitted by March 24. We would like to request
additional time to research this project and contact the appropriate professionals. I will be in touch with you as soon
as we are able to make progress.

This Certification is pursuant to the revised application for Town Creek Marina received on
February 25, 1994, with additional information received on March 28, 1994. Based. on our review of
the project plans and specifications, we have determined that the Town Creek Marina stormwater control
system complies with the Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The runoff
will be treated in a detention pond sized to achieve 90% reduction in Total Suspended Solids.
Any modification of the plans submitted to and approved by this Office or further development
of this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces,
addition of built -upon surfaces, redesign or further subdivision of the project area.
This Certification shall be effective from the date of issuance until rescinded. The project shall
be constructed and maintained in accordance with the plans and specifications approved by the
Wilmington Regional Office. This Certification does not supersede any other permit or approval. The
developer is responsible for obtaining any and all permits and approvals necessary for the development
of this project. This could include the Division of Coastal Management under CAMA requirements, the
Division of Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge
and Fill Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of Engineers 404 Wetland
Permit, NPDES Stormwater Permit if disturbing five acres or more, local. County or Town Agency
permits under their local ordinances, or others that may be required.

On April 15, 1988, a Certification of Compliance with Stormwater Regulations, Number 880401,
was issued to you for Town Creek Marina, located in Morehead City. As stated in the Certification of
Compliance:
A professional engineer must certify that the stornwater system has been installed
in accordance with the approved plans and specifications upon completion of
construction.
On January 4, 1993, Regional Office Staff conducted a compliance inspection of the project's
stormwater facilities and found constnietion completed and the facility occupied. To date, our records
indicate that the required Professional Engineer's Certification has not been received. Additionally, the
following conditions were observed during the inspection and are in violation of the Certification:
1. The pond has not been built as shown on the approved plan. No diversion swale exists,
nor is there an 8" drawdown pipe constricted. The pond essentially has no outlet control
and is not detaining the first inch of runoff.

2. The grassed Swale is full of trash and is generally dismally maintained.
3. The pond surface area appears to be less than shown on the approved plan.
Operation of the stor awater system prior to submission of the required certification and the above
conditions are violations of 15A NCAC 2H.1003 and are subject to enforcement action pursuant to NCGS
143-215.6A including the assessment of civil and criminal penalties.
Failure to provide the required Engineer's Certification and. a "plan of action" which designates
the date by which the above item(s) will be permanently resolved, prior to January 27, 1993, will result
in the initiation of appropriate enforcement action by this Office. That action may include
recommendations for the assessment of penalties and/or revocation of the Certification.

On behalf of the owners and the President, Dewitt Sperau, I
would like to thank both Mr. Dave Adkins and Ms. Linda Lewis who
provided the courtesy visit to Town Creek Marina from 4:30 to
6:00pm on 28 January 1993. The visit was extremly informative
and provided the type of positive problem solving that is greatly
appreciated by a small company attempting to deal with the
numerous requirements present in today`s business enviornment.
The subject of the visit was to discuss the 4 Jan 93
compliance inspection'
of the Town Creek Marina s±ormwater
project. The results of the inspection were forwarded in a
letter dated 6 Jan 93, subject: Notice of Inspection.
The letter detailed the present violations and the lack of
reoeipf of the required Professional Engineer's Certification.
Additionally the letter required action by Town Creek before 27
Jan 93 so that "initiation of appropriate enforcement action"
would not take place.
During the discussions while on site there were several
suggestions, one of which was how a now plan developed by an
engineering firm might use the present retaining wall that has
been a part of the construction for the new dry stack facility.
The wall could alleviate the 3:1 required slope of the pond and
reduce the actual width requirement so as to keep all of the
parking spaces as constructed and now marked.

A follow up telephone call to Ms. Lewis at 2:00 pm on 29
January reflected that the visit yesterday suffices for the 27
January suspenseWe will follow up with our new plan of action.
That plan will identify the new engineering firm that will
prepare the revision to our Drainage and Erosion Control Plan,

our project located at Town Creek Marina. As I explained to you over the
phone, I am one of the owners so, for that reason, I am writing to you on my
stationery as I do not have any Town Creek stationery in Raleigh at this
time.
Dee Sperau is recuperating from his operation and should be back at work in
the next few weeks but, in the meantime, we have engaged a plumber to
relocate the sewer line that is presently running through the pond. They
were scheduled to pump the pond down this morning in order that he can
view exactly what needs to be done. I would hope that this could be
accomplished in the next few days, at which time we can then complete the
project in accordance with the plans and specifications dated in March, 1994.
I certainly appreciate your patience with us in accomplishing this supposedly
simple task, and I hope that we will be able to notify you in the next few
weeks that this is completed.

On March 28, 1994, a Certification of Compliance with Stormwater Regulations, Number 880401,
was issued to you for Town Creek Marina, located in Off West Beaufort Road in Beaufort. As stated in
the Certification of Compliance:
A professional engineer must certify that the stormwater system has been installed
in accordance with the approved plans and specifications upon completion of
construction.
On September 28, 1994, Regional Office Staff conducted a compliance inspection of the project's
stormwater facilities and found that construction to deepen the pond and add the approved outlet structure
had not begun. Our records indicate that the required Professional Engineer's Certification has not been
received.
The plans approved on March 28, 1994, have not been constructed. The existing non -compliant
outlet structure has not been replaced, nor has the pond been excavated to provide the approved depth
and permanent pool surface area.

our revised plan of action. The General Contractor that
constructed our present drainage pond and system was passed the
Sepia we received in March of this year. He has passed that
document to the engineering firm for construction changes and
plan modifications that will be workable and can be submitted to
your organization. As soon as the revised drawings are received,
Town Creek Marina will forward them to your office.
Initial indications from the contractor reflect that there
will be additional storage capacity with the new plan. I have
been told today that the sepia will be delivered to us on or
about24 July, 1993. As soon as possible after reviewing the
document we will forward it to you to accomplish the change.

determined that the problems had never been resolved, and that additional action would be necessary to
bring this site into compliance with the Certification issued on April 15, 1988.
On July 30, 1993, this Office sent you a letter outlining the actions necessary to bring this site
into compliance with the approved plans for Town Creek Marina's detention pond. Since that date, we
have not heard from you regarding the actions you are taking to get the detention pond constructed as
designed and approved.
You are required to build the pond as approved, or you must submit any changes in design to this
Office for approval prior to construction. Please take the necessary actions to get this problem resolved
immediately prior to the need for enforcement action.

The following actions will be undertaken in order to bring the Wet Detention Pond at
Town Creek Marina into Compliance with Stormwater Project #SW8 880401.
1. Cattails and rushes will be removed and pond dredged to the required 6 feet.
2. Landscape contractor will be hired to maintain perimeter of pond.
As of the date of this letter bids have been requested from several local contractors for
pond dredging to be completed by October 31, 2000. Once dredging has been comleted,
Parker Landscaping, Inc. of Morehead City, NC has been retained to maintain area
surrounding the Detention Pond on a monthly basis in order to keep the cattails and
rushes from returning.

report summarizes the findings of a recent inspection of the project's stormwater controls conducted on July 17,
2000 to determine compliance with the modified Stormwater Certification of Compliance Number SW8 880401
issued to Town Creek Marina on March 28, 1994.
I have enclosed copies of the Certification of Compliance, the application, and the operation and
maintenance agreement, which was signed by Mr. Dee -Witt Sperau on behalf of Town Creek Marina.
A summary of the findings and comments are noted under Section 6 of the report. Please inform this Office
in writing before August 27, 2000 of the specific actions that will be undertaken and the time frame required to
correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement

This Certification is pursuant -to the revised application for Town Creek Marina received on
February 25, 1994, with additional information received on March 28, 1994. Based on our review of
the project plans and specifications, we have determined that the Town Creek Marina stormwater control
system complies with the Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The runoff
will be treated in a detention pond sized to achieve 90 % reduction in Total Suspended Solids.
Any modification of the plans submitted to and approved by this Office or further development
of this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater SubmittallModification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces,
addition of built -upon surfaces, redesign or further subdivision of the project area.
This Certification shall be effective from the date of issuance until rescinded. The project shall
be constructed and maintained in accordance with the plans and specifications approved by the
Wilmington Regional Office. This Certification does not supersede any other permit or approval. The
developer is responsible for obtaining any and all permits and approvals necessary for the development
of this project. This could include the Division of Coastal Management under CAMA requirements, the
Division of Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge
and Fill Permit and/or a Sewer Extension/ Collection Permit, U.S. Army Corps of Engineers 404 Wetland
Permit, NPDES Stormwater Permit if disturbing five acres or more, local County or Town Agency
permits under their local ordinances, or others that may be required.

Attached for your review are three copies each of plans and
calculations for the modification of the Stormwater retention
pond for this project. This modification is required by your
office to bring the project into compliance with it's stormwater
management plan approval.
We are proposing to excavate the pond to the dimensions
shown, remove the existing outlet structure (with regrets), and
to install a new outlet structure. It is our belief that these
improvements will bring the project into full compliance with
your current regulations.
Our plans are based on -an actual field survey of the
k existing retention pond area only and not the full facility. The
original design plans were used to estimate the site area and
impervious area. The proposed pond surface area and storage
volume is approximately 5 percent greater than minimum to account
for any discrepancies in the constructed project.

Operation and Maintenance Manual.
for
Storm Water Retention Facility
General: The storm water management system for this site is designed as a
wet detention facility. The system consists of the wet detention pond
located adjacent to the dry stack building with a drawdown tube and drilled
plug orifice, a temporary storm water storage area which is the grassed
area on the interior of the central parking lot, overflow diversion swale
and driveway culverts and pipe systems.
operation: The wet detention pond is designed to maintain a permanent
water pool with an average depth of 3 feet. The pond and grassed area on
the interior of the parking lot are designed to temporarily store an amount
of water equivalent to 1 inch of storm water run-off from the impervious
areas. In the event of a 1 inch rainfall, the wet detention pond' is
designed such that the water surface will rise approximately 1.3 feet above
the normal pool level. This increase in water depth will slowly recede to
the normal pool level in a 2 to 3 day time period. This drawdown time is
controlled by an 8 inch diameter PVC drawdown pipe with an orifice at the
intake
In rain events which produce more than the 1 inch run-off, a diversion
Swale is provided to direct this increased discharge to the pipe system
leading off site. This diversion system is designed based on the 10 year
frequency storm event, therefore flooding in excess of:the available
storage within the wet detention pond and the parking lot interior island
should be relatively infrequent.
Maintenance: Several areas will need attention by marina operations
personnel for the continued performance of this system as designed and as
required by the Division of Environmental Management. These items are
detailed as follows:
1. Grassing around the wet detention pond and in the interior island
shall be maintained to prevent the evasion of these areas. The
areas shall be periodically mowed to maintain the aesthetic quality
of the site and to prevent a reduction in capacity of the storm
water system.
2. Iandscaping of the area around the wet detention pond and the
interior island shall be of the type and located such that they will
not reduce the capacity or operation of the storm water system.

3. Following each rain event at the site, the drawdown tube orifice
shall be checked for accumulation of debris and cleared of any
blockage that is present. If the water level following a rain event
fails to recede to the normal pool elevation within the 2 to 3 day
time period the engineer mist be notified as soon as possible. If
the water level fails to recede within a period of 5 days following
a rain event the marina operator must notify the Division of
Environmental Management, 7225 Wrightsville Avenue, Wilmington,
N.C., [phone].
4. Storm drainage pipes and culverts shall be inspected periodically
for debris and sand build-up. These shall be cleaned as necessary
to provide for the conveyance of storm water as designed.
5. The wet detention pond depth shall be maintained at the design
depth. The pond shall be inspected a minimum of every 6 months and
cleaned as necessary.
6. No modifications shall be made to the system without notification of
the engineer or without approval from the Division of Envirorwnental
Management.

with Mr. Street Lee from McKim and Creed Engineering this
morning. Mr. Street provided us with the proper plans to
construct the remainder of the approved stormwater system.
Town Creek's plan of action for correcting the items noted in
your letter of November 7th, 1991, will be as follows:
1- Retain a contractor to comp etc t.1)f-� ori,gi nal plan
approved by your office in April. 1988.
- Reshaping and enlargement of the detention basin, with
incorporation of the grassed detention Swale.
- Construction of control orifice as designed.
- Clean up and repair outlet pipe area.
- Clear out basin and implement monitoring and mainten-
ance plans to assure future compliance.
- Rework "Vegetative Filter" to provide proper vegetation
for .removal of solids as required.
2-Coordinate through McKim and Creed to assure that the
construction phase is completed in a satisfactory manner.

Dear Mr. Henley:
On April 15, 1988, a Certification of Compliance with
Stormwater Regulations, Number 880401, was issued for the subject
marina. The Certification of Compliance with Stormwater
Regulations states:
A professional engineer must certify that the stormwater
system has been installed in accordance with the approved
plans and specifications upon completion of construction.
On October 28, 1991, Regional Office Staff conducted a
compliance inspection of the subject project's stormwater
facilities and found construction completed and the facility
occupied. To -date our records indicate that the required
Professional Engineer's Certification has not been received.
Additionally, the following conditions were observed during the
inspection and also establish violations with the Certification:
1. The detention basin is approximately 2' deep. The
basin does not provide a minimum of a 3' permanent pool
plus storage capacity of 1" of runoff from impervious
surface.
2. The detention basin surface area is estimated at 20' by
50' which significantly differs from the design of 38'
by 158'.

3. An outlet structure with a controlling orifice could
not be located.
4. The outlet pipe is covered with sediment and
vegetation. The effluent end is cracked and part has
broken off.
5. The basin is choked with cattails. Necessary
maintenance has not been provided as required in the
Operation and Maintenance Plan.
6. The "vegetative filter" does not provide sufficient
vegetation to remove solids. Rather, exposed
sediment is picked up by untreated runoff routed
through the "filter" and carried directly into the
watercourse.
Operation of the stormwater system prior to submission of
the required certification and the above conditions are
violations of 15A NCAC 2H.1003 and are subject to enforcement
action pursuant to NCGS 143-215.6, including the assessment of
civil penalties.
Failure to provide the required Engineer's Certification
and a "plan of action" (which designates the date by which the
above items will be permanently corrected), prior to December 9,
1991 will result in initiation of appropriate enforcement action
by this Office. The action may include a recommendation that the
Stormwater Certification be revoked and/or a recommendation for
the assessment of civil penalties.
