showing that Christopher Loutit was president from 6/27/15 to 6/18/16 (see attached.) Will this satisfy your comment
pertaining to comment #4? The project was submitted in May, so he was still the president at the time.

I'm reviewing your comments for the stormwater permit for Figure Eight. When the application was submitted, Mr.
Loutit was the president, however he has since stepped down (about 1-2 weeks ago). Can I submit something showing

FOR COMMENT
Board Secretary Kim Nettles called the Special Meeting of the Board of Directors at
Figure Eight Island Yacht Club to order at 10:10am. In attendance were board members
Jim Douglas, Frank Golden, Kim Nettles, Carter Lambeth, along with newly elected
board members Christopher Loutit and Jeffery Davis. This assembled group represented
a quorum. Also present were Yacht Club General Manager Peter Gushanas. Ken
Cameron was absent for the start of the meeting, but connected by conference phone at
10:50am. Board members Mike Murray and newly elected board member Kate Phillips -
Connelly were absent. Peter phoned Mrs. Phillips -Connelly to invite her to the meeting
after the announcement of the election results, but he was unable to reach her.
Nominations and Election of Officers of the Board of Directors
• Kim made a motion to approve the following slate of officers to serve for the board
term 2015 — 2016.
President — Christopher Loutit
Vice President — Carter Lambeth
'rreasurer —Mike Murray
Secretary - Kim Nettles
Jim seconded the motion and after a vote the motion was unanimously approved.
President Christopher Loutit continued to lead the meeting.
The reading of the minutes from the May 31, 2015 Regular Meeting of the Board of
Directors was waived. Christopher moved to approve the minutes as corrected, Carter
seconded the motion and after a vote the motion passed with a unanimous vote.
Christopher led a discussion of possible appointments of Committee Chairs for this
season. After a discussion the chairmanships of committees was established as the
following:

May 1 June Applicants for New Membership - Jim reviewed the membership report with
the board. The following members have applied for membership to the club:
• Christopher and Donna Aldridge - acquired Charter, 316 Beach Road North.
• Henry and Lynne Blackburn, Jr. activated warrant, 204 Beach Road North
• Cameron and Dr. Hadley Callaway - Senior membership (formerly 316 BRN)
• Garnett, Jerre - Senior membership (formerly 21 Pipers Neck Road)
After discussion, Jim made a motion to approve the above membership requests, after a
second and vote, the motion passed unanimously.
Another request was discussed and tabled until the next meeting.
Former Member Request(s) for exception to Senior Guest policy;
1. Gordon Grubb. After reviewing the request. Frank made a motion to approve the
member's request. After discussion, Carter seconded the motion and the motion passed
with a unanimous vote. Peter was instructed to relay the board's decision to the Grubb
family.
2. Hillman "Denny" Bass- A follow up letter from Mr. Bass was reviewed. Carter moved
to deny the request. After discussion the motion was seconded and the motion passed
unanimously. Peter was instructed to contact Mr. Bass and relay the decision of the
board.
Ken joined the meeting at 10:50am
Member Survey - Peter distributed a draft survey for the board members to review. A
discussion followed. It was decided that a subcommittee be formed headed by Frank
Golden to study and make recommendations. It was noted that time is of the essence.
Frank will take action this week and report to Peter in advance of the target date of July
7.
The next Regular Meeting of the Board of Directors is scheduled for Saturday, July 18,
2015 at IOam.
Christopher called for Executive Session at 11:06 am and Peter left the room
The board came out of executive session at 11:20am.
Christopher moved that the meeting be adjourned, finding no objections, the meeting was
adjourned at l 1:25am.

Treasurer Mike Murray called the Special Meeting of the Board of Directors at Figure Eight
Island Yacht Club to order at 10:47 AM, Present in addition to Mike Murray were Ken
Cameron, Jeff Davis, Frank GoIden, Carter Lambeth, Christopher Loutit and Steve Williams.
The assembled group constituted a quorum. Absent were Kate Phillips -Connolly and Mary
McCabe. Club Manager Peter Gushanas and Accountant Paula DuRant were also present.
Murray proposed that Frank Golden be named President, Carter Lambeth Vice -President,
himself Treasurer, and Ken Cameron Secretary. Golden further proposed that while Cameron
would be named Secretary, Paula DuRant should be in attendance as necessary to record the
meetings going forward. The motion was made to approve as proposed, seconded and passed
unanimously.
Approval of minutes - The reading of minutes from the Regular Meeting of the Board on
Saturday May 14, 2016 was waived. Lambeth made a motion to approve the minutes as written,
and it was seconded. The minutes were unanimously approved.
Appointment of Committee Chairs — Golden began the discussion by suggesting that the
Committee Chair appointments be postponed until the next meeting, however, upon further
consideration and input from the Board, appointments were made as follows:
Finance — Mike Murray
Governance — Carter Lambeth
Nomination — Christopher Loutit
Membership — Kate Phillips -Connolly
Long Range Planning — Steve Williams
Building & Grounds -- Jeff Davis

A motion was made to accept the chairpersons as proposed, Lambeth seconded it and the
appointments were unanimously approved.

Golden seconded the motion and the Board voted unanimously to approve as new members, the

The Wilmington Regional Office received and accepted a State Stormwater Management Permit:
Application for Figure Eight — Bridge Road Re -Alignment and Tennis Courts on May 16, 2016. A
preliminary in-depth review of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:
Project Area [15A NCAC 021-1.1003(g)(5) and 021-1.1005(d)]: I understand that this project is
inside a larger tract per the deed submitted. However, the project area still needs to be Oil the
plans so that projects that are in the vicinity, or projects which will be located. in the vicinity in
the future, can avoid overlap. Please clarify the location of boundaries of the project area oil the
plans. (For clarification, I am also looking to make sure that the project maintains the overall
25% nzaxinrum impervious far OR IYI The application shows that the percent impervious is 4.5%
with a 24.74ac project area.)
Please remember that a change to one number may have a domino effect on other numbers. Please check
all plans, calculations and forms to ensure that the numbers are consistent throughout.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to September 20, 2016, or the application
will be returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee.
I you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information„which shall be no later than 30
days past the original due date. The Division is allowed 90 days from the receipt of a completed
application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement

Dear Ms. Johnson:
On behalf of the Figure Eight Island Yacht Club, Inc., we are submitting a response to your comments dated
June 30, 2016 for the above referenced project. Your comments are listed below with our response provided
in bold bullets. Thank you for allowing the additional 30-day extension request.
1. Project Area: Please show the bearings/distances for the project area.
• Given the deed research, there is no recorded subdivision lines for this property, but
referenced as Deed Book 1231, Page 0739 "Causeway Tract #8", which was included in the
Narrative as submitted in May. The project is included entirely within this Causeway Tract.
See highlighted Deed References within Narrative.
2. Calculations:
(a) General:
L Curve Numbers and Supporting Data: for instance, the pre -development CN for DA #2 was
excluded from the package.
• There is only one pre -development drainage area (see "Ex. Drainage Area" on Sheet C-3.2).
The SCS CN determinations were performed within HydroCAD on this re -submittal, but
remain approximately the same with the exception of existing imperviousness being
Ignored In the new analysis.
ii. 10 year 24 hour storm depth: Please show this value and its use in the calculations resulting in
2,073 cf (Basin #1) and 8,498 cf (Basin #2).
• The 10-year 24-hour depths and volumes have been revised as a result of the SHWT
elevation corrections. The new stage -storage values are 5.05' @ 1,951 cf (Basin #1) and
6.06' @ 8,089 cf (Basin #2).
iii. Drawdown Time: The "drawdown time" value is shown in the calculations, but the drawdown
calculation is not. It is unclear which volume the value of days to drawdown refers to (the
required 1 year 24 hour pre/post, or the 10 year 24 hour option #4 volume)
• The drawdown time was calculated using the 10 year 24-hour runoff volume and has been
made clear in the revised calculations.
iv. Connected or Disconnected: Please clarify if you have completed calculations for connected or
disconnected impervious area (curve number compositing).
• The calculations are for disconnected impervious area. For this project, the impervious is
considered "unconnected" since the impervious coverage is over 30% according to NRCS

v. Basin Volumes: Please show the volume provided at the storage elevations (4.61 msl for Basin #1
and 5.07 msl for Basin #2). Data for the 1' increment is provided (3.0 msl, 4.0 msl, 5.0 msl, etc),
but the exact volume provided at the storage elevation is not provided.
• Since these values have been changed, please see attached HydroCAD for the 10-yr analysis
where the stage -storage is highlighted.
(b) SHWT:
i. Boring Location: Both boring lots submitted were taking inside the footprint of Basin #1. Please
submit the data supporting the design for Basin #2.
• Given the consistent nature of the soils and the distance of 430 ft between the two basins,
Basin #1 was used as the primary soils reference for Basin #2. The higher SHWT depth of
51" was used for both basins and the same infiltration rate of 12 in/hr was used given only
half this rate was used in the design for both. NHC Engineering Dept. has issued a permit
using this justification as well.
ii. Existing Grade: Please provide the existing grade of each boring in addition to the depth to the
SHWT and the resultant SHWT elevation.
• The approximate existing elevations of the borings are as follows. Boring #1 = 6.0-ft and
Boring #2 = 7.0-ft. Ref. LMG Soil Testing Report and existing contours on the plans.
However, prior calculations used elevations of 6.0-ft for both basins. These revised designs
have raised the bottom of the basins as a result of these corrected elevations. As stated In
the Narrative and above, the higher SHWT of 51" was used for both basins.
Low Density Supplement: Please submit the low density supplement.
• The low density supplement is included with this submittal.
%.4" Applicant: Please submit documentation that Mr. Loutit is the current President, and therefore has
signature authority. The most common documentation submitted is election minutes.
Mr. Loutit was the president at the time of submittal, however since, he has since stepped
down. Please see the enclosed meeting minutes showing the dates that he was President,
as well as e-mail correspondence between Gretchen Merix of Paramounte and yourself
and NCDENR for reference. Mr. Peter Gushanas, registered agent, general manager, and
COO for the Club, has signed the Low -Density Supplement, so please update the permit
correspondence to reference Mr. Peter Gushanas (m f8i e.com).

DA2 was excluded from the package.
H. 10yr24hr Storm Depth: Please show this value and its use in the calculations
resulting in 2,073ef (Basin hI) and 8,448cf (Basin 92).
iii. Drawdown Time: The "drawdown time" is value shown in the calculations, but
the drawdown calculation is not. It is unclear which volume the value of the days

SUBMITTED FOR REVIEW
Treasurer Mike Murray called the Special Meeting of the Board of Directors at Figure Eight
Island Yacht Club to order at 10:47 AM. Present in addition to Mike Murray were Ken
Cameron, Jeff Davis, Frank Golden, Carter Lambeth, Christopher Loutit and Steve Williams.
The assembled group constituted a quorum. Absent were Kate Phillips -Connolly and Mary
McCabe. Club Manager Peter Gushanas and Accountant Paula DuRant were also present_
Murray proposed that Frank Golden be named President, Carter Lambeth Vice -President,
himself Treasurer, and Ken Cameron Secretary. Golden further proposed that -while Cameron
would be named Secretary, Paula DuRant should be in attendance as necessary to record the
meetings going forward. The motion was made to approve as proposed, seconded and passed
unanimously.
Approval of minutes - The reading of minutes from the Regular Meeting of the Board on
Saturday May 14, 2016 was waived. Lambeth made a motion to approve the minutes as written,
and it was seconded. The minutes were unanimously approved.
Appointment of Committee Chairs — Golden began 'the discussion by suggesting that the
Committee Chair appointments be postponed until the next meeting, however, upon further
consideration and input from the Board, appointments were made as follows:

A motion was made to accept the chairpersons as proposed, Lambeth seconded it and the
appointments were unanimously approved.
Membership -- Murray made a motion to approve the following families for membership.
Golden seconded the motion and the Board voted unanimously to approve as new members, the
following applicants:
Thomas & Margaret Glaser (Greensboro, NC) at 429 Beach Road North
James & Melissa Stanley (Lynchburg, VA) at 517 Beach Road North
McGowan & Kimberly Collie (Raleigh, NC} 17 Backfin Point
New Business —Golden brought up various concerns regarding the upcoming Wells Fargo PGA
Golf Tournament to be held in 2017 at neighboring Eagle Point Golf Club. He pointed out the
need to identify and coordinate with point -persons at Eagle Point, PNCC, Wells Fargo, etc., as
there are growing in regarding FBIYC's role and participation opportunities related to the
event. Particularly, issues such as transportation, parking, fees, use of the Club by non-members,
etc., will need to be addressed. Gushanas and others expressed the need for very careful
consideration and thought as the Board must decide on the Club's stance in regards to all issues
presented. Gushanas furthermore shared that he had already received two communications from
Members requesting/questioning services that the Club may provide. The group agreed that
Golden would be the logical point -person from the Yacht Club and that he would work toward
identifying and establishing contact with other point -persons as mentioned above. He will keep
the Board appraised.
Golden then brought to the attention of the Board, a letter that had been received from the
children of a deceased Charter Member. As recently named owners of the property, the four
siblings do not wish to purchase additional memberships as dictated by the By-laws of the Club
in regards to memberships and property ownership, but rather wish to have one Membership in
the name of all four siblings. Gushanas provided further background on past practices, citing
that this was not at all an unusual situation and would continue to be a common issue as the
aging island population passes on their property to their heirs. A lengthy discussion ensued and
various responses and options were contemplated. Ultimately, it was agreed that the Board
would uphold the By-Laws.and deny the request. Lambeth made a formal motion to deny the
request, Davis seconded it and the motion was passed unanimously. Gushanas will reply to the
family regarding the Board's decision on the matter.
Further discussion ensued on the matter in general and it was suggested that the Governance and
Membership Committees give further thought and consideration to situations such as this. It was
further decided that a Committee would be formed to further this initiative and will consist of
Lambeth, Phillips -Connolly and Loutit.
In regards to the scheduling of the next BOD meeting, Golden asked Murray if he needed a
meeting on July 16 . In response, Murray brought up concerns with the position that our current
accountants, Cherry Bekaert, have taken in preparing our annual tax returns. He gave a brief
history of the philosophies of our prior firm, McGladrey, vs, those of Cherry Bekaert and what
he believes to be the resulting overstated tax liability assessed to the Club. He proposed we file
an extension of our State taxes and that we interview Bernard Robinson & Company, the firm
representing many Country Clubs throughout the state, including Greensboro County Club. It
was further suggested that perhaps an Executive Committee be formed to decide on who would
ultimately prepare the Club's tax returns. Murray will work to schedule a meeting with Bernard
Robinson & Co. and the timing of such will determine when the next meeting of the Board will
be scheduled.
Gushanas communicated that of the current Club bank accounts, the only account requiring an
update to the signature card, is on our account ending in -9058 at BB&T. It was agreed that
Treasurer, Michael Murray will replace the current signer of record (who is no longer on the
Board of Directors).
Murray began a discussion regarding the election of the major employee healthcare provider for
2016-17. He shared with the group that a polling of the employees indicated that they are
extremely happy with BCBS and that the proposed BCBS increase was certainly acceptable at
less than $5,000.00/year. His recommendation was that the Club remain with BOBS. Lambeth
made a motion to approve, Cameron seconded it, and after a vote, the motion passed
unanimously.
DuRant also passed around a Worker's Comp Board Exclusion form to be signed by all Board
Members as required by our new carrier, Zenith.
Before adjourning, Golden,on behalf of himself, fellow Board Members and the entire
Membership of Figure Eight Island Yacht Club, extended his appreciation and gratitude to
Christopher Loutit for sharing his time, talents, guidance and wisdom during his tenure as
President.
It was determined that no Executive Session was necessary and Golden moved to adjourn the
meeting, Cameron seconded it and as there were no objections, the meeting was adjourned at
1 1:41 AM.
Subsequent to adjournment, Board Members were given the Final CONFLICT OF INTEREST
DISCLOSURE STATEMENT, GIFT POLICY DISCLOSURE FORM, and BOARD OF
DIRECTORS CONFIDENTIALITY AGREEMENT to sign: Additionally, the new Board
Members were given the CONFLICT OF INTEREST POLICY for signature.

Upland Development
1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property, including the road realignment and parking,

3) Any development or land disturbing activity that is considered non -water dependent is not authorized
within 30 feet of the normal high water level unless specifically exempted by Coastal Resource
Commission (CRC) regulations in place at the time of such development.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environmental Quality, hand Quality Section, 127 Cardinal Drive
Extension, Wilmington, NC 28405.
4) In order to protect water quality, runoff from the construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
5) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
Stormwater Management
6) A stormwater management permit from the Division of Energy, Mineral and Land Resources will be
required for the authorized project. A copy of the stormwater management approval shall be obtained
and a copy provided to the Division of Coastal Management prior to the initiation of any development
activities authorized by this permit.
General
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
8) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Permittee is advised that if the parking lot, infiltration basin, or any other sources
of pollution are located within 100' of the existing well, the well will not be allowed as a public
water supply source. Contact the Division of Water Resources, Public Water Supply Section, at
(910) 796-7368 for additional information.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination.

PROJECT DESCRIPTION
The project site is located at 15 Bridge Road on Figure Eight Island, adjacent to Banks Channel and Middle
Sound, in New Hanover County. To locate the project site from Market Street (U.S. Highway 17) turn onto
Porter's Neck Road and travel northeast approximately 1.5 miles. Turn right onto Edgewater.Club Road (SR
1402) and travel east approximately 1.5 miles until you reach the Figure "8" Island guard gate, Once you get
clearance, the island is accessed from the mainland at the end of Edgewater Club Road, by private bridge over
the Atlantic Intracoastal Wate►way (AIWW). The project site includes an earthen causeway, which traverses
Middle Sound. Continue to travel east for. approximately 0.5 miles until you reach the eastern end of the
project site, which will be located on your left. Existing structures on the eastern end of the project site
includes a yacht clubhouse, associated parking, pool, tennis courts, open water marina, timber bulkhead and
boat -ramp.
The project site is approximately 24 acres and approximately 6 feet to 7 feet above normal high-water (NHW),
which is vegetated primarily with Wax Myrtles, Cedar Trees, native grasses and ornamental landscaping., The
project site has approximately 7,564 feet of shoreline frontage along. Banks Channel to the south and Middle
Sound to the north, which is stabilized by vegetation along the causeway and by a timber bulkhead adjacent to
the yacht clubhouse. Located waterward of the highground is an area of coastal wetlands consisting primarily
of Salt Meadow Grass. (Spartina patens) and Smooth Cordgrass (Spartina aitemiflora) ' ranging from
approximately 40 feet to 200 feet in width (See sheets 1.°through.3 of 5 and Project Narrative).
The Wilmington -New Hanover County 2006 Land Use Update Plan classifies adjacent waters and high ground
portion of the property as Conservation. The waters 'of Banks Channel and Middle Sound are classified SA-
ORW by the Division of Water Resources. They are designated as a Primary Nursery Area (PNA) by the N.C.
Division of Marine Fisheries and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to relocate existing tennis courts and a section of the main access road along
causeway. The applicant states that in order to. relocate the existing tennis courts, an approximately 370 foot
section of the roadway along the causeway (Bridge Road) would be realigned from the center portion of the
causeway to the southern portion of the causeway: Three (3) new clay tennis courts along with associated
sidewalks, 12 parking. spaces and stormwater.infiltration basins would be constructed. The application states
that the existing clay tennis courts would remain (See sheets 1 through 5 of 5 and Project Narrative).
10. ANTICIPATED IMPACTS
The proposed development would impact appiroximately 130,680 sq, ft. of highground area within the. 575'
ORW-Coastal Shorelines Area of Environmental Concern. The application indicates that a total of
approximately 19.8% of the SA-ORW shoreline would be covered by the existing and proposed built upon area
and would be located greater than 30 feet landward of the NHW line.

Purpose
Construction and development of Figure Eight Island Yacht Club amenities began in the late
seventies/early eightie.s.'The Club has been undergoing continual growth and changes and
constantly evaluates opportunities for expansion with achievable permit expectations. The design
intent and main objective of the proposed permit request is to provide expansion opportunities
directly adjacent -to the western boundary of the Figure Eight Island Yacht Club, primarily adjacent
to the main pool area. To achieve this, relocation of the existing tennis courts and realignment of
the main access road would be required. We believe this proposal is achievable based upon the
design team's evaluation of existing conditions and current regulatory setbacks and requirements.
Existing Conditions
The Club sits on the causeway to Figure Eight Island on a parcel totaling 23.99 acres as measured
from mean high water (New Hanover County parcel R04500-005-001-000,15 Bridge Road),
Middle Sound abuts the parcel to the north and south, and the Atlantic Intracoastal Waterway abuts
the parcel to the west, Middle Sound is classified as Outstanding Resource Waters (ORW) by the
NC Environmental Management Commission, and, the entire parcel is located within the 575'
Coastal Shoreline AEC. Beach Road, which provides access from the bridge to Figure Eight
Island, is located within the parcel. The parcel also contains various buried utilities, two production
wells, a gravel access to a boat launch area, the club and its associated amenities, The parcel is
largely landscaped with grasses and ornamental shrubs, excepting a coastal wetland fringe along
Middle Sound and the AIWW. There are no current stormwater management features on the
property,- presumably due to development preceeding the state's coastal stormwater regulations.
Proposed Work
This application requests upland work in the Coastal Shoreline AEC to allow for relocation of the

tennis courts west of their current location, Relocation of the courts will allow for potential future
expansion of the clubhouse, although the existing tennis courts will remain until that time. In order
to place new tennis courts in the proposed location, an approximately 370 foot section of Bridge
Road will be realigned. Twelve parking spaces with one handicap space, will be provided at the
tennis courts along with sidewalk access from the parking area. -Stormwater run off from the new
impervious area and realigned road will be collected in vegetative swales and discharged into an
infiltration basin. Grading for the proposed courts,- roadwork and stormwater management will
disturb a 3.04 acre area, Stormwater and sedimentation and erosion control permits applications
will be submitted to the NCDENR by Paramounte Engineering, Wilmington, NC, for review
concurrent with this NC CAMA application.
