The report summarizes the findings of a recent inspection of the project's stormwater controls conducted on April 21, 2004 to determine compliance with Stormwater Permit Number SW8 021217 issued on June 2, 2003. A summary of the findings and comments are noted under Section 4 of the report. Please inform this Office in writing before May 26, 2004, of the specific actions that will be undertaken and the time frame required to correct the deficiencies. Compliance Issues: Y N ❑ ❑ The drainage area (including offsite) and built -upon area to the permitted system are per the approved plan. No unpermitted offsite drainage enters the system. ❑ ❑ All'the built -upon area associated with the project is graded such that the runoff drains to the system. ❑ ❑ For ponds/infiltration, the outlet/bypass structure relative elevations are per the approved plan. (Must be verified via as -built survey if in question). ❑ ❑ The inlets and outlet structure are located per the approved plans and do not cause short-circuiting. ❑ ❑ A trash rack is provided over the outlet weir and orifice. ❑ D4 All. slopes are grassed with permanent vegetation and are not eroding. ❑ ❑ Vegetated slopes are no steeper than 3:1. ❑ ❑ The approximate amount of permitted surface area has been provided. Required Actions: (Explain each deficiency and what needs to be done to bring the system back into compliance) (a) The trash rack on the outlet structure is not complete. The grate functions well and looks good, however, there is a large opening above the grate. This opening must also be covered with a grate. The opening will allow trash to enter the outlet structure. (b) The slopes of the pond need to be grassed. The grass will help stabilize the slopes and keep them from eroding. (c) There is an abundance of construction generated trash within and around the pond.. This trash can also be seen in the protected 404 wetlands onsite. Trash pickup must be included in your regular maintenance schedule. The trash is not only an eyesore, it can also effect the efficiency of the pond system by clogging the outlet orifice. (d) The silt fences onsite are in a state of disrepair. These must be fixed immediately. Sediment has entered the wetlands on and offsite due to the poor condition and installation of the silt fences. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of approximately 4.83 acres being conducted. - It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 1 13A-50 to 66, and Title 1 5A, North Carolina Administrative Code, Chapter 4. If you feel that you are not .responsible for the following violations, please notify this office immediately. The violations that were found are: 1 . Failure to conduct a land -disturbing activity in accordance with the provisions of an approved erosion and sedimentation control plan. G.S. 113A-61.1. As stated_in the approved .plan, the stormwater pond and collection system is_to_be_utilized.as.a_•_•;,, sediment basin during the construction phases of the project. At the time of the inspection, the stormwater pond had been constructed, but the collection system had not been installed. -Additional grading activities that have taken place prior to the installation of the collection system _'are in; violation of approval condition #9 stated on the letter of approval. Failure on a tract of .more than, one acre, when more than one acre is uncovered, to .provide a permanent ground cover sufficient to restrain erosion on such exposed areas within 15 working days 90 calendar days, whichever is the shorter after completion of construction or development. G.S. 113A-57(3). Off -site sedimentation had occurred in several locations including wetlands in the northeast portion of the tract and along the eastern boundary adjacent to proposed building G. 4. Failure to take all reasonable measures to protect all public and private property from damage by such land disturbing activities. 15A NCAC 4B.0105. All reasonable measures were not taken to protect adjacent public and private property from damage by land disturbing activities. 5. Failure to retain along a lake or natural watercourse a buffer zone of sufficient, width to confine visible siltation by natural or artificial means within the 25 percent of that portion of the buffer zone nearest the land -disturbing activity. G.S. 113A-57(1). The buffer zone is not adequate in areas where off site damage has occurred to wetlands. 6. Failure within 15 working days of 30 calendar days (whichever period is shorter) of completion of any phase of grading to plant or otherwise provide exposed, graded slopes or fills with ground cover, devices, or structures sufficient to restrain erosion. G.S. 113A-57(2). Slopes throughout the project have been left exposed. There has been no effort to provide groundcover to graded slopes. 7. Failure to maintain satisfactorily all temporary and permanent erosion and sedimentation control measures and facilities during the development of a -site.-15 NCAC 4B.01 13. Silt fence has not been properly maintained and has exceeded 50% of its capacity in various areas. To correct these violations, you must: i . Construct stormwater pond and collection system as detailed on the approved plan. 2. Provide adequate groundcover to all exposed and graded areas. 3. Provide adequate buffer zones along wetlands. - 6. Provide groundcover sufficient to restrain erosion on exposed, graded slopes or fills. ' ~Y _ 7. Repair and restore damaged and overloaded silt fence. Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or of':"ground cover sufficient to restrain erosion. These requirements are not satisfied until a standing cover of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or man-made erosion. The initial one day civil penalty could be an assessment of up to $5,000.00. A time period for compliance is not required for this initial one day civil penalty pursuant to NCGS 113A-61.1 (c) and NCGS 113A-64(a)(1). An initial one day civil penalty is being considered for this project. If the violations described in this Notice are not corrected within 20 days following your receipt of this Notice, the Division of Land Resources may take additional appropriate legal. action against you pursuant to NCGS 1 13A-64. That action could be the assessment of additional civil penalties and may result in :the initiation of other remedies as prescribed by the Act. If additional civil penalties are assessed for the violations, the amount may be up to $5,000.00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1). If all violations are corrected within the time period specified for compliance, additional civil penalties or legal remedies will not be pursued. Any new land -disturbing activity associated with this project should not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so that the work can be inspected. You should not assume that the site is in compliance with the Act until we have so notified you. In addition, once compliance has been achieved, all installed measures must be satisfactorily maintained until development is complete and -the site is fully stabilized to avoid further violations of the Act. -- -- -� We solicit your cooperation, and would like to avoid taking further enforcement action. Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil erosion control plan prior to the commencement of said land disturbing activity (NCGS 11 3A- 54(d)(4)]. The act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan. Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act. A copy of any erosion and sediment control plan which could involve the utilization of ditches for the purpose of dewatering or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ), It is suggested that you contact the Division of Water Quality at (910) 395-3900 if the ditches shown on your plan will lower the water table. The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal and State water quality laws, regulations and rules. The inspection and a DWQ file review revealed the following violations. 1 • Failure to comply with State Stormwater Management Permit No. SW8 021217; 2• Failure to comply with conditions of General Water Quality Certification No. 3402; 3- Failure to comply with conditions of General NPDES Stormwater Permit No. NCG010000. SW8 021217 Violations The project has been found in violation of Stormwater Permit Number SW8 021217, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: Fart 11. Section 1 - The stornrwater management system shall be constnrcted in it's entirety, vegetated and Operationalfor its intended use prior to the construction of any built -upon surface. Three buildings are under construction and the stormwater collection system has not been installed. Pond 41 has been excavated, but has not been built according to the approved plan. Part 11, Section 2 - During construction, erosion shall be kept to a minimum and any eroded areas of the system tivill be repaired inzinediately. The sideslopes of the pond are eroding, and sediment is discharging into Section 404 Wetlands. The violations found are: Part 9 - Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to DWQ that providing passage would be impractical. Design and placement of culverts including open bottom or bottomless arch culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in aggradation, degradation or sign f cant changes in hydrology of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested to do so in writing by DWQ. Additionally, when roadways, causeways or other fill projects are constructed across FEMA -design a tedfloodways or wetlands, openings such as culverts or bridges must be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in aggradation, degradation or significant changes in hydrology of streams or wetlands; it appears that the culvert has not been properly constructed. Part 10 - That appropriate sedintent and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; Erosion control devices have not been properly installed or maintained on site. Failure to comply with this condition has resulted in the unauthorized discharge of till material into Section 404 Wetlands. In addition, a NPDES Stormwater Permit No. NCGO 10000 compliance inspection was conducted in response to a Sedimentation Inspection Report sent to DWQ by the NC Division of Land Resources (DLR)• The site inspection and the subsequent review of DLR's Sedimentation Inspection Reports revealed the following violations of NPDES Stormwater Permit NCG010000 issued pursuant to the requirements of NC GS 143-215.1: Item Ill• NPDES Stormwater Permit No. NCGOlO00O Condition Violations Part I Section A part 2 - The Permittee shall implement the plan, which has been approved by the approval at►thority. The approved plan is considered a requirement or condition of this general permit. Deviation frog the The plan, or approved amendment to the plan, shall constitute a violation of the terms and conditions of this general permit except that deviation from the'approved plun will be allowed (1) to Correct all emergency situation where sediments are being discharged off the site or (2) when minor modifications have been made far the purpose of improving the performance of the erosion and sedimentation control measures and notification of the minor modification has been made to the Division of Land Resources (or approved local program). Such a deviation from the approved plan shall be noted on the approved plan maintained at the job site. During active construction, a copy of the approved plan shall be maintained on the site. The site was found in violation of the Approved Sedimentation and Erosion Control Plan on four occasions. The violations included failure to follow the approved plan, insufficient measures to retain sediment on site, failure to take reasonable measures, inadequate buffer zone, graded slopes and fills too steep, unprotected exposed slopes, and failure to maintain erosion control measures. If any visible sedimentation is leaving the disturbed limits of the site, corrective action shall be taken immediately to control the discharge ofsediments outside the disturbed limits. (3) The operator shall keep a record of inspections, Visible sedimentation found outside of the disturbed limits shall be recorded and a brief explanation kept with the records as to the measures taken to control future releases. Any measures taken to clean tip the sediment that has left the disturbed limits shall also be recorded. These records shall be made available to DWQ or authorized agent upon request. A rain gauge is not being maintained on the site• It appeared that no written records are being kept. It also appears that visual inspections have not been performed and corrective action has not been taken to control the discharge of sediments. This Office requires that violations, as detailed above, be corrected immediately. Please note, these violations and any future violations are subject to civil penalty assessment of up to $25,000.00 per day for each violation. This Office requests that you respond to this letter, in writing, within 15 days of receipt of this Notice. Your response should address or include the following items: 1). This particular letter was received and signed for in my office on December 10, 2003. Following is my response as called for on page 3. With respect to item 1, all erosion control measures are in place and have been inspected by Mr. Trentt James. I have attached a copy of his report to this letter. A rain gauge has been installed on the property and written records concerning rainfall are being kept. Additionally, any inspections required after 0.5 inches of rain in a 24- hour period will be noted by me and performed. On December 16, 2003, Trentt James of NCDENR, Land Quality Section performed an inspection of the site and submitted a Sedimentation Inspection Report. Mr. James was pleased with the progress that has been made on the site and has removed the site from notice of violation. There were some minor things that he noted on his report, and the sub -contractor on the job has indicated they will take care of those items as quickly as possible. As far as wetland restoration is concerned, the areas identified in the letter are currently being tended to and will or have been seeded. As indicated above, Mr. James has indicated that the site is under compliance. The stormwater collection system has been installed and is functioning properly. I am terribly sorry that we have failed to comply with our permits. My explanation is quite simple: This is my first venture into development of this sort, and I find myself struggling to get my arms around the entire scope of the project. I do, however, feel we have shown a great willingness to be cooperative with your department and with other departments, and will continue to do so in order to keep this project in compliance. 4 As far as scheduling is concerned, most items have been taken care at the time of the writing of Mr. Shiver's letter or, at least, were well under way to being corrected. I have telephoned your office and left a message — hoping for the benefit of some direct communication to answer any questions. As noted previously, there are some minor items on Mr. James' recent report that we are following up on, and I do have some questions about the wetlands fill, which I would like to address on site. Otherwise, I feel we have already accomplished all of the items referenced. Again, I want to emphasize our willingness to be cooperative so that we may avoid these embarrassing circumstances in the future. Clearwater consist of a 4.83 Acre tract of land that will be developed into residential dwellings with a pool and outside storage facility . The project will be broken into two phases. The first phase will consist of three residential units and a stormwater pond. Phase two will consist of four residential units, a pool, outside storage space, and modification to an existing stormwater pond. II. STOR IWATER MANAGEMENT The project and associated drainage is broken into two phases. A new stormwater pond will be constructed to handle the stormwater from phase I. During construction of phase II an existing pond will be modified to handle the stormwater from phase 1I. The existing pond is currently in place and being utilized by the adjoining property, Camelia Court. The pond was originally oversized for the Camelia Court project. By modifying the depth of the existing pond, the existing additional volume in the pond, can be utilized and still satisfy the SA/DA requirement. The depth will have to increase from 4 feet to 6.2 feet deep. The existing pond is large enough to be modified and maintain minimal side slopes. Both ponds drain to Calico Creek. Calico Creek is a class SC water body. IIL EARTH DISTURBING ACTIVITIES 1]arth disturbing activities will include construction and installation of the wet -detention facilities, associated stormwater drainage, water and sewer facilities, roads, parking lots and buildings. IV. EROSION AND SEDIMENTATION CONTROL MEASURES The following measures are proposed for the site. If it becomes evident that additional erosion and sedimentation control .measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete, i.e., drainage swales, utility easements, etc. A. Sediment pence - Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off -site sedimentation is controlled. B. Sediment Basins- Stormwater detention pond proposed for the site will serve as a sediment basins during the construction phase of development. Stone Construction Entrance - Stone construction entrances will be used to reduce transport of sediment off site. V. CONSTRUCTION SEQUENCE A. Initial Activities: 1.. Initiate clearing and grubbing operations. 2. Install stone construction entrances. 3. Complete clearing and grubbing operation. 4. Install silt fencing at locations shown. 5. Construct stormwater detention ponds including overflow/outlet devices. 6. Rough grade site 7. Install sewer system. 8. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT The wet detention basin system is defined as the wet.detention basin, pretreatment including forebays and the vegetated filter if one is provided. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, vegetated cover, and general condition. b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2 to 5 days as designed. 2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. r 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the permanent pool depth reads 3.35 feet in the main pond, the sediment shall be removed. When the permanent pool depth reads 4.63 feet in the forebay, the sediment shall. be removed. Any erosion control measures that fall within jurisdictional wetland area must be approved by the aforementioned agencies prior to installation or our Section must be notified of a relocation of the measures in question to the transition point between the wetlands and the highlands to assure that the migration of sediment will not occur. If that relocation presents a problems or contradicts any requirements of DWQ, the Corps or the EPA, it is the responsibility of the deve!oper to inform the Land Quality Section regional office so that an adequate contingency plan can be made to assure sufficient erosion control remains on site. Failure to do so will be considered a violation of this approval. 6. Any borrow material brought onto this site must be from a legally operated mine or other approved source. A single use borrow site or an area to waste material is only permissible if it is operated under total control of the Financially Responsible person or firm who is developing this site, is located on or adjacent to this site, and has been incorporated as part of this plan. 7. This permit allows for a land disturbance, as called for on the application plan, not to exceed five (5) acres. Exceedino that acreage will be a violation of this permit and would require a revised plan and additional application fee. Any addition in impervious surface, over that already noted on the approved plan, would also require a revised plan to verify the appropriateness of the erosion control measures and stormwater retention measures. Pge2of2 8. The construction detail for the proposed silt fence requires reinforcing wire and posts a maximum of 8 feet apart. Omission of the reinforcing wire is a construction change that.necessitates more posts needed for support, i.e. the spacing distance needs to be reduced -to no greater than 6 feet apart. 9. Because the stormwater retention ponds are shown on the plan as the primary sedimentation & erosion control devices on this project, it is necessary that the ponds and their collection system be installed before any other grading takes place on site. If that proves to be impractical, a revised plan must be submitted and approved that addresses erosion and sediment control needs during the interim period until the ponds are fully functioning. 10. A graveled construction entrance must be located at each point of access and egress available to construction vehicles during the grading and construction phases of this project. Stream relocations and stream bed and/or bank hardening are considered to be permanent stream impacts. Any activity that results in a loss of use of stream functions including but not limited to filling, relocating, flooding, excavation, dredging and complete shading shall be considered stream impacts. Enumeration of impacts to streams shall include streams enclosed by bottomless culverts, bottomless arches or other spanning structures When a 404 Permit is used anywhere in a project unless the entire structure (including construction impacts) spans the entire bed and both banks of the stream, is only used for a road, driveway or path crossing, and is not mitered to follow the stream pattern. Impacts for dam footprints and flooding will count toward the threshold for stream impacts, but flooding upstream of the dam will not (as long as no filling, excavation, relocation or other modification of the existing stream dimension, pattern or profile occurs) count towards mitigation requirements. Any filling, excavation, relocation or other modification of the existing stream (other than flooding) must re-establish the same dimensions, patterns and profiles of the existing channel (or those of a stable reference reach if the existing channel is unstable) to the maximum extent practical. • Wetlands - Impacts to wetlands as determined by the Division of Water Quality shall be measured as area. Impacts to any stream length in the Neuse, Tar -Pamlico or Randleman River Basins (or any other major river basins with Riparian Area Protection Rules [Buffer Rules] in effect at the time of application) requires written concurrence for this Certification from DWQ in accordance with 15A NCAC 2B.0200. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar -Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 213 .0200. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices; 3. Irrespective of other application thresholds in this General Certification, all impacts to perennial waters and their associated buffers require written approval from DWQ since such impacts are allowable as provided in 15A NCAC 2B. 0212 (WS-1), 2B .0213 (WS-11), 213.0214 (WS-111) and 2B .0215 (WS-IV). Only water dependent activities, public projects and structures with diminimus increases in impervious surfaces will be allowed as outlined in those rules. All other activities require a variance from the delegated local government and/or the NC Environmental Management Commission before the 401 Water Quality Certification can be processed. In addition, a 30 foot wide vegetative buffer for low density development or a 100 foot wide vegetative buffer for high density development WQC #3402 must be maintained adjacent to all perennial waters except for allowances as provided under the Water Supply Watershed Protection Rules. For the purposes of this condition, perennial waters are defined as those shown as perennial waters on the most recent USGS 1:24,000 topographic map or as otherwise determined by local government studies; 4. Additional site -specific stormwater management requirements may be added to this Certification at DWQ's discretion on a case by case basis for projects that have or are anticipated to have impervious cover of greater than 30 percent. Site -specific stormwater management shall be designed to remove 85% TSS according to the latest version of DWQ's Stormwater Best Management Practices manual at a minimum. Additionally, in watersheds within one mile and draining to 303(d) listed waters, as well as watersheds that are classified as nutrient sensitive waters (NSW), water supply waters (WS), trout waters Jr), high quality waters (HQW), and outstanding resource waters (ORW), the Division shall require that extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips (designed according to latest version of the NC DSNR Stormwater Best Management Practices Manual) be constructed as part of the stormwater management plan when a site -specific stormwater management plan is required. For streams classified as Water Supply, High Quality Waters and Outstanding Resource Waters, post -construction, on -site stormwater management shall be required as appropriate and as outlined in 15A NCAC 213 .0104(m) and 2H .1000 to .1007, respectively, in addition to that required in this General Certification. Alternative designs may be requested by the applicant and will be reviewed on a case -by - case basis by the Division of Water Quality. Approval of stormwater management plans by the Division of Water Quality's other existing state stormwater programs including appropriate local programs are sufficient to satisfy this Condition as long as the stormwater management plans meet or exceed the design requirements specified in this condition. This condition applies unless more stringent requirements are in effect from other state water quality programs. • Unless specified otherwise in the approval letter, the final, written stormwater management plan shall be approved in writing by the Division of Water Quality's Wetlands Unit before the impacts specified in this Certification occur. • The facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. • Also, before any permanent building or other structure is occupied at the subject site, the facilities (as approved by the Wetlands Unit) shall be constructed and operational, and the stormwater management plan (as approved by the Wetlands Unit) shall be implemented. • The structural stormwater practices as approved by the Wetlands Unit as well as drainage patterns must be maintained in perpetuity. • No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. 5. Compensatory stream mitigation shall be required at a 1:1 ratio for not only perennial but also intermittent stream impacts that require application to DWQ in watersheds classified as ORW, HQW, Tr, WS-1 and WS-11 unless the project is a linear, publicly -funded transportation project, which has a 150-foot per -stream impact allowance; ,. 6. In accordance with North Carolina General Statute Section 143-215.3D(e), any application for a 401 Water Quality Certification must include the appropriate fee. If a WQC #3402 project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees; In accordance with 15A NCAC 2M .0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands for an entire project. For linear public transportation projects, impacts equal to or exceeding 150 feet per stream may require mitigation. In addition, buffer mitigation may be required for any project with Riparian Area Protection Rules (Buffer Rules) in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required for a project, the mitigation plans must be approved by DWQ in writing before the impacts approved by the Certification occur, unless otherwise specified in the approval letter. The mitigation plan must be implemented and/or constructed before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public. Please note that if a stream relocation is conducted as a stream restoration as defined in The Internal Technical Guide for Stream Work in North Carolina , April 2001, the restored length can be used as compensatory mitigation for the impacts resulting from the relocation; 8. For any project involving re -alignment of streams, a stream relocation plan must be included with the 401 application for written DWQ approval, Relocated stream designs should include the same dimensions, patterns and profiles as the existing channel (or a stable reference reach if the existing channel is unstable), to the maximum extent practical. The new channel should be constructed in the dry and water shall not be turned into the new channel until the banks are stabilized. Vegetation used for bank stabilization shall be limited to native woody species, and should include establishment of a 30 foot wide wooded and an adjacent 20 foot wide vegetated buffer on both sides of the relocated channel to the maximum extent practical. A transitional phase incorporating coir fiber and seedling establishment is allowable. Also, rip -rap, A -Jacks, concrete, gabions or other hard structures may be allowed if it is necessary to maintain the physical integrity of the stream, but the applicant must provide written justification and any calculations used to determine the extent of rip -rap coverage requested. If suitable stream mitigation is not practical on -site, then stream impact will need to be mitigated elsewhere. Please note that if -a stream relocation is conducted as a stream restoration as defined in The Internal Technical Guide for Stream Work in North Carolina , April 2001, the restored length can be used as compensatory mitigation for the impacts resulting from the relocation; 9, Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to DWQ that providing passage would be impractical. Design and placement of culverts including open bottom or bottomless arch culverts and other"structures including temporary erosion control measures shall not be conducted in a manner that may result in aggradation, degradation or significant changes in hydrology of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested to do so in writing by DWQ. Additionally, when roadways, causeways or other fill projects are constructed across FEMA-designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in aggradation, degradation or significant changes in hydrology of streams or wetlands; WQC #3402 10. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual' or the "North Carolina Surface Mining Manual' whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 11, All sediment and erosion control measures placed in wetlands and waters shall be removed and the original grade restored within two months after the Division of Land Resources has released the project; 12. That additional site -specific conditions may be added to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 13. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 14. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse; 15. If this Certification is used to access building sites, all lots owned by the applicant must be buildable without additional fill beyond that explicitly allowed under other General Certifications. The applicant is required to provide evidence that the lots are buildable without requiring additional impacts to wetlands, waters or buffers if required to do so in writing by DWQ. For road construction purposes, this Certification shall only be utilized from natural high ground to natural high ground; 16. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of issuance of the 401 Certification letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401 /Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands , DWQ shall be sent copies of all deed restrictions applied to these lots; 17. When written concurrence is required, the applicant is required to use the most recent version of the Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 18. Concurrence from DWQ that this Certification applies to an individual project shall expire three.years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding Nationwide Permit 18, 39, 41, 42, 43 or 44, whichever is sooner. WQC #3402 Non-compliance with or violation of the conditions herein set forth by a specific fill project may result in revocation of this Certification for the project and may also result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for Individual Certification for any project in this category of activity that requires written concurrence under this certification, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality.
