We find the plan to be acceptable with modifications and hereby issue this letter of Approval with Modifications. The Modifications Required for Approval are listed on the attached page. This plan approval shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.na.gov/NCGO1. Please direct questions about the NOI form to Annette Lucas at Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Initially, DEMLR will not charge a fee for coverage under the NCGO1 permit. However, on or after May 1, 2019, a $100 fee will be charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh. The approved E&SC plan as well as any approved deviation. 2. The NCGOI permit and the COC, once it is received. 3. Records of inspections made during the previous 30 days. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. In addition, it would be helpful if you notify this office of the proposed starting date for this project. Your cooperation is appreciated. Plan approval is for land disturbance shown on the Raw Water Pump Station plans and line installation as shown on plans containing Sheets C1 thru C28. 2. The excavation/dredging operations within Lake Tillery shall always comply with the Division of Water Resources Rules and Regulations. 3. If the Fiber Filtration Tubes fail to properly contain sediment in the existing drainage channels (e.g. non -flowing streams), then more sufficient measures shall be provided. Such measures would consist of a rock dam with minimum 3' height and 4' crest width located at the downstream edge of the disturbed limits. Another alternative would be to provide an adequately sized temporary pipe to convey or flume the upstream run-off through the disturbed area. 4. Stone outlets in the silt fence shall be provided for low-lying areas and/or where silt fence crosses drainage ditches. 5. If the proposed grass -lined channels fail to properly stabilize channels, adequately sized rip -rap shall be provided for stabilization. 6. On Sheet C4, the silt fence shall be extended along edge of roadway to North to contain slope from near STA 30+50 to near STA 31+50. Stone outlets in the silt fence shall be provided where crossing ditch lines. 7. On Sheet C5, a more adequate measure shall be provided in lieu of stone outlet in silt fence near STA 43+00. On Sheet C23, a more adequate measure shall be provided in lieu of stone outlet in silt fence near STA 221+70. A rock dam with a minimum 3' height and 4' wide crest width shall be provided across channel or an adequately sized temporary pipe could be used to flume water across disturbed area. 8. On Sheet C7, the Fiber Filtration Tubes shall extend across entire drainage channel near STA 63+00. In addition, the entire drainage channel shall be stabilized with rip -rap. 9. On Sheets C I I & C12, a minimum 25' undisturbed stream buffer shall be provided between disturbed area and along top of stream bank between STA 107+00 to STA 110+00.
