Site plans prepared by James Peltier, PE, with EMH&T dated received on October 20, 2020. Conditions of Approval: 1. Due to disturbance of this project being greater than 1 acre, all NPDES requirements must be followed. This includes performing self -inspections, and maintaining reports. (NPDES permit attached). The applicant will be required to evaluate periodically Staff's concerns on how the temporary sediment basing will transitioned to permanent stormwater. At some point, it may be necessary for the applicant to revised related plans to include a new temporary sediment basin to meet NPDES requirements for the amount of disturbance proposed. As of April 1, 2019, all new construction activities of one acre or greater are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit (NC Department of Environmental Quality). This form must be submitted prior to commencement of any land -disturbing activity. The NOI Form may be accessed at deg.nc.eov/NCG01. After you submit a complete and correct NOI Form, a COC will be emailed to you within 3 business days. Once you have received the COC you are required to call the Town of Boone Planning and Inspections Department to schedule a preconstruction meeting. At this meeting Town Staff will review your copy of the COC and review the plans and permit associated with the approved development. The contractor responsible for the land disturbing activity is required to be at this meeting. Page 1 of 4 Planning & Inspections Department 680 W. The applicant is responsible for ensuring all design professionals and contractors follow the approved plans and specifications. 3. All improvements must be made in accordance with the communication, plans, permits, reports, details and specifications listed in the first itemized list above. Any condition(s) attached to these plans, permits, reports, details and specifications must be followed. Prior to commencement on any modification of the approved plan, please submit a request for review and approval. 4. Conditions related to UDO Section 15.69.01 Temporary Use General Regulations: a. Only those improvements and modifications minimally necessary for the temporary use to function are permitted. b. In the event the property owner fails to remove a temporary structure within the described time frames after the permit authorizing its use has been terminated, the Town may remove the said temporary structure at the expense of the owner, and may seek to recover through collection efforts or a civil action against the owner, the costs of removal, court costs and attorney fees. c. A sight triangle ten feet (10') by seventy feet (70') must be observed at all intersections of driveways or streets with adjacent streets. 5. Conditions related to UDO Subsection 15.69.08 Temporary Staging: a. Elements used in the staging, other than protective fencing, shall be placed on the lot in such manner that it meets all required setbacks. Note: Once the Town of Boone accepts dedication of the new street, all structures in the temporary staging area will be required to meet a 20' street setback. This will require the relocation of at least one construction trailer and several of the large portable storage containers. b. The location and placement of the staging area must be placed so as to minimize any negative effects on adjacent properties. c. All elements related to the temporary staging must be removed by the next business day following the issuance of a Certificate of Occupancy or Certificate of Completion for the project in which the staging area was permitted for. Note: this approval is tied to the permit for phases R-3 through R-5 and C1 through C-3 as shown on the plans for Conditional District Zoning. This condition requires that ground cover be established immediately once all elements of the temporary staging has been removed. 6. The applicant shall monitor the gate to avoid stacking issues with vehicles entering the site. Stacking of vehicles waiting to enter the site because of closed gate is prohibited. 7. The applicant shall add tree protection fencing at the drip lines or closest pavement edge within the dripline for the 59" White Oak, 45" White Oak, and the 55" White Oak on the side not protected by construction fencing. Please note, parking is not allowed in this area. 8. All signage as shown on the plan is not approved. Note: all signage is required to be permitted separately. Please submit a separate permit application for each sign. 9. The applicant shall install additional silt fence on the outer disturbance of the proposed ditch #1 as shown on Sheet C300. 10. The applicant shall install for each construction entrance a construction driveway meeting the standards forth in the NC Erosion and Sedimentation Control Manual. Public Works -Services (828-268-6230): a. A traffic control plan must be submitted to the Public Works Department for any projects which contain work within a public street or sidewalk. This plan is required to be submitted at least three days prior to any lane or sidewalk closure. b. In accordance with Town Code Section 96.04, all persons engaged in doing work that creates any dangerous condition or obstruction in the public right-of-way of any street or sidewalk shall take whatever action is necessary, including the placement of barricades and warning signs or devices, to warn the traveling public of the condition or obstruction. Therefore, all work within or abutting any public right-of-way or public easement for streets or sidewalks must be conducted in conformance with the US Department of Transportation Federal Highway Administration's Manual on Uniform Traffic Control Devices-MUTCD (http://mutcd.fhwa.dot.gov/). This includes, but is not limited to: i. Providing complete and proper signage and traffic control devices to warn the traveling public of construction. ii. All lanes of traffic, including sidewalks, shall be maintained at all times in compliance with the standards set forth in the MUTCD. c. In accordance with Town Code Section 96.09 any infrastructure disturbed or damaged during the course of construction shall be restored to its original condition. i. All open cuts on streets and sidewalks shall be backfilled and traversable prior to removing any related lane closure devices. ii. At the end of each of phase of construction where work in the public street or sidewalk is complete, the applicant must immediately return the public street or sidewalk to previous conditions. d. All lanes of travel, including sidewalks, shall be open during non -working hours. e. The applicant is required to coordinate any closing of any driveway with affected property owners. Ingress and egress shall be maintained to all property owners affected by the project. f. In accordance with Town Code Section 96.05 no parking or material storage shall be allowed along any public street or right-of-way. g. Any violations of these conditions (a-f above) may subject the applicant to the enforcement action and penalties set forth in UDO Article 12 and the penalties set forth in Town Code Section 96.99. 12. The Project Manager is responsible for coordination of all design and construction monitoring activities related to the project. This shall include but is not limited to: a. Coordination of design, including ensuring that adequate consideration is given in the design of recommendations made by professionals who performed preliminary exploration of site conditions, and b. Ensuring all final certifications indicating that the project was constructed in compliance with the approved design documents are completed. 13. Upon completion and prior to final inspections, the Project Manager shall ensure that the following final certifications and verifications are submitted to the Planning and Inspections Department: a. The project engineer shall submit a written certification that the project was constructed in compliance with the approved plans and specifications. b. The project engineer shall submit a written certification that the land disturbing activity was completed in compliance with the approved plans and specifications. 14. All fees associated with this project must be paid prior final inspections. 15. It is a condition of approval that there is a right to physical inspection of the development. Staff may perform random independent inspections of the development to ensure compliance with the approved plan. 16. Contact the Planning and Inspections Department (828-268-6960) for final inspections when the project is complete. 17.
