Skvarla, III Secretary Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWO will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that any updated pages or addendums to the permit will now reference DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Castle Hayne Park on July 25, 2014. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 950204 dated July 25, 2014, for the construction of the built -upon areas associated with the subject project, This permit incorporates and includes the following modifications: A 33.15 acre tract has been added at a 24% maximum density. The area -weighted maximum density is 27.26%. Failure to establish an adequate system for operation and maintenance of the stormwater management system, or to transfer the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by fling a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. This permit covers the construction of a total of 1,181,683 square feet of built - upon area, which includes 137,088 square feet of proposed BUA, 834,808 square feet of future BUA allocation and 209,787 square feet of existing/previously permitted BUA. 2. The overall tract built -upon area percentage for the project must be maintained at no more than 27.26%, as required by the stormwater rules. This is a weighted value based on 30% of the 54.09 acre tract and 24% of the 45.42 acre tract. 3. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 4. Projects covered by this permit shall maintain a vegetated buffer adjacent to surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers, and the mean high water line of tidal waters. Within the 54.09 acre project area, the minimum buffer width shall be 30 feet. Within the 45.42 acre tract, the minimum buffer width shall be 50 feet. No piping is allowed except that minimum amount shown on the approved plans, and that minimum amount necessary to direct runoff beneath an impervious surface such as a road or to provide access. 6. All runoff directed into and through the vegetative buffer must flow through the buffer in a diffuse manner. 7. All runoff directed into wetlands shall flow into and through the wetlands at a non - erosive velocity of 2 feet per second or less. 8. Roof drains must terminate at the outer edge of the buffer. 9. The wet pond shown on the plans is incorporated only by reference, and is not an enforceable part of the permit. The wet pond is required by the local government. The pond treats a parking lot that is located in an upland area away from surface waters and drainageways. The drainage from the parking lot is therefore not required to be treated in a wet pond by this low density permit. II. SCHEDULE OF COMPLIANCE No part or component of the approved stormwater management system shall be filled in, altered, or piped, including the vegetated conveyances shown on the approved plans, except for minimum driveway crossings, unless and until the permittee shall have submitted a modification to the permit and received approval from the Division. 2. The permittee is responsible for monitoring the project on a routine basis and verifying that the proposed built -upon area does not exceed the allowable built - upon area. 3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further subdivision, acquisition, or sale of the project area, in whole or in part. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering or piping any vegetative conveyance shown on the approved plan, except for minimum driveway crossings. e. Construction of any designated future development areas. 5. Swales and vegetated conveyances shall be constructed in their entirety, vegetated, and operational for their intended use prior to the construction of any built -upon surface. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or vegetated conveyances will be repaired immediately. 7. The permittee shall at all times provide and perform the necessary operation and maintenance procedures as specified in the signed Operation and Maintenance Agreement, such that the permitted stormwater management system functions as designed and permitted. 8. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 9. The permittee shall submit all information requested by the Director or his/her representative within the time frame specified in the written information request. III. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the terms and conditions of a stormwater management permit or the stormwater rules, is subject to enforcement action in accordance with the procedures stated in North Carolina General Statute 143 Article 21. 2. Approved plans, application, supplements and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. The permittee shall maintain a copy of the approved plans on site at all times. 3. The permit issued shall continue in force and effect until revoked or terminated. 4. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 5. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 6. Unless specified elsewhere, permanent seeding requirements for the vegetated conveyances must follow the guidelines established in the latest version of the North Carolina Erosion and Sediment Control Planning and Design Manual. 7. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, b. Bankruptcy; c. Foreclosure; d. Dissolution of the partnership or corporate entity; e. A name change of the current permittee; f. A name change of the project; g. A mailing address change of the permittee; Page 5 of 6 State Stormwater Management Systems Permit No. SW8 950204 8. The permittee is responsible for compliance with all permit conditions until the Director approves the permit transfer. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party, shall be considered an approved permit transfer. 9. The permittee grants permission to DENR Staff to enter the property during normal business hours for the purpose of inspecting the project for compliance. 10. The issuance of this permit does not preclude the Permittee from complying with and obtaining any and all permits or approvals as required by any statutes, rules, regulations, or ordinances, which may be imposed by any other Local, State or Federal government agency having jurisdiction. Any activities undertaken at this site prior to receipt of the necessary permits or approvals to do so is considered a violation of NCGS 143-215.1, and subject to enforcement procedures pursuant to NCGS 143-215.6. As for the project, I think we will just proceed with putting a statement acknowledging the pond in the permit but not putting requirements on it because I don't think it is required under the law. Hope you are doing well. To answer your question, there are not any surface waters nearby. And it depends on your definition of drainageways. There are some old shallow agriculture ditches around. We had the Corps look at them and they are regulated, however we can move or shift them as we need. I wouldn't consider them drainageways, but you may have a different definition. I see that the pond is being added per local requirements. As far as State requirements, is the new parking lot "away from drainageways and surface waters to the maximum extent practicable" per the 2008 Coastal Rule? If the parking lot is clustered impervious area near surface water or other drainageways, then I will write this pond in as a required item under the LD permit. But, I don't see any water nearby on Sheet 1? If it is just a pond that the county requires but the State doesn't then I will put in a clause acknowledging it, but the permit won't spell out all of the design parameters and maintenance requirements. Please advise.
