Inspection dated January 26`6, 2017 for the Compass Pointe West Commercial Project (SW8 080107). Please note that
site construction is currently underway and once construction is complete the two pond systems will be appropriately
certified. It is anticipated that the ponds will be complete and certified by summer 2017. 1 trust that this email
satisfactorily addresses your request for a written plan of action and timeline for resolution.

On January 23, 2017, the Wilmington Regional Office of the Division of E-nergy, Mineral and Land
Resources (DEMLR) performed a file review of Compass Pointe West Commercial to determine the
status of compliance with the State Stormwater Management Pen -nit Number SW8 080107. DEMLR file
review revealed that the site is NOT in compliance with the terms and conditions of this permit. Please
find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which
summarizes the findings of the recent inspection.
As indicated in the attached inspection report; the following deficiencies must be resolved:
1. Engineers certification(s) for two (2) wet detention ponds have not been submitted to this
Office.
In order to bring this project into compliance, please submit the requested engineer's certification(s).
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by February 24, 2017, are considered violations of the
permit. if the requested information is not submitted to this office by the due date, then DEMLR staff
will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity
found to be in noncompliance with the provisions of a stormwater management permit or the stormwater
rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of
civil penalties of up to S25,000 per day.

Dear Mr. Haley:
ECS Carolinas, LLP (ECS) recently conducted an estimation of the Seasonal High Water Table
(SHWT) for the proposed stormwater best management practice (BMP) areas at Compass
Pointe — West Entrance in Leland, Brunswick County, North Carolina. This letter, with
attachments, is the report of our estimation.
Field Testing
On October 6, 2014, ECS met with Mr. Matt Haley with Cape Fear Engineering in order to
locate the requested boring locations. ECS then conducted an exploration of the subsurface
soil and SHWT conditions at eleven requested locations shown on the attached Boring Location
Plan (Figure 1). The purpose of this exploration was to estimate the SHWT of the in place soils
for the design of the proposed stormwater BMP areas. ECS explored the subsurface soil and
groundwater conditions by advancing one hand auger boring into the existing ground surface at
the requested boring locations. ECS visually classified the subsurface soils and obtained
representative samples of each soil type encountered. ECS recorded the SHWT and
groundwater level observed at the time of each hand auger boring. The attached SHWT sheet
provides a summary of the subsurface conditions encountered at each hand auger boring
location.
The groundwater level and the SHWT were estimated at each boring location below the existing
grade elevation. The elevations were provided by Cape Fear Engineering. Below is a summary
of each boring location.

All bearings and distances for the Project Boundary have been added to sheet 1-1. Boundary lines L31-
L39 represent the common border dividing the Proposed West Commercial Project and the previously
permitted West Tract Project. A note has been added on sheet I-1 to explain this. The heavy
continuous line shown overlapping the West Tract Project Boundary is merely a sheet index box
labeled in the lower left corner.

(a) Cape Fear Engineering surveyed the top of bank for Alligator and Mineral Branch where the
streams meander near the wet detention basins. This top of bank surveyed on July 31, 2015 and
August 3`d, 2015 has been added to the plans and a 50 ft. stream buffer has been shown.
(b) The geometry of both wet detention basins has been slightly altered to ensure that the basin's top
of bank is not within the 50' stream buffers shown. New supplement forms, pond, and routing
calculations have been provided with this response as a result of these changes. No changes have
been made to pond bottom, sediment cleanout elevation, or normal pool elevation for either basin,
and thus revised 4&M agreements are not necessary.

(c) The concrete, roadway bridge over Alligator Creek was constructed in 2008 under the supervision
of Gary Mitchell. Several conversations took place during the initial permitting in regards to
401/404 permits and NCDENR was actively involved. It was determined that the bridging of non -
navigable water or wetlands of the United States with a normal pile supported structure did not
require a 404 or 401 permit.
(d) The roadway bridge over Alligator Branch is concrete, and the surface area of the bridge (:L6240
sf) has been added to the impervious allocation for Pond 42 under the "Roads" category, and the
"Future" impervious allocation has been reduced by the same amount such that there is no change
to overall impervious area proposed. The proposed golf cart bridge is to be wooden and slatted and
therefore is considered pervious. No wetlands will be disturbed during its construction.

I have a few questions for you on West Commercial:

I am looking through these to get a feel for it for next week. I just wanted to let you know that the 2008 permit
(attached) is issued to Hood Creek, LLC because I see that the applicant listed for Monday's meeting is CP Brunswick,
LLC. If the permit needs to transfer owners that will complicate things for Monday because we can't do transfers in
Express. (Of course the 2/1/08 permit is issued to ZDV, Inc., and I don't see that a transfer was done. I am not sure what
happened there. And, the 8/22/08 permit has a deed restriction requirement and I don't see that it is a
subdivision. Lots of questions on the history of this one.) Anyway, another heads up...

STORMWATER NARRATIVE
This submittal is to modify the Temporary Drive/Access and Commercial Center stormwater
permit (SW8 080107) which is part of the Compass Pointe West Tract master plan. It is intended
to rename the permit: Compass Pointe West Commercial. The proposed project is located on the
north side of US Highway 74/76 approximately one -tenth of a mile WNW of the east end of
Malmo Loop Road (SR 1417) within Brunswick County, North Carolina.
An asphalt entrance road, associated sidewalk and utilities are to be installed between US
Highway 74/76 and the existing concrete bridge over Alligator Branch at the north end of the
project site.
Below is a summary of the changes included in the proposed modification.
• The project boundary has been expanded to 31.72 acres to include areas of future
commercial development
• The project is now proposed as high density development
• An asphalt entrance road, sidewalks, and utilities will be constructed
• Ponds 41 and 42 have been designed to replace the current wet detention basin and
temporary sediment traps.

Ponds #1 and 42 are new stormwater ponds to be constructed to treat runoff from the Compass
Pointe West Commercial project site. Upon completion of pond construction, these ponds will be
certified.
