Not Compliant North River Club Stormwater Permits State Stormwater Management Permit Numbers SW8 050543, SW8 070207, SW8 051107, SW8 061113, SW8 080718 Carteret County Dear Gentlemen On January 30, 2015 the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received a request to transfer the five State Stormwater Permits for the North River Club listed below These permits are currently issued to The Guide Group, LLC and are proposed to be transferred to the Beaufort Club Group, LLC 1 SW8 050543 North River Club Master Plan and Golf Course 2 SW8 070207 North River Club Golf Course Clubhouse Facility 3 SW8 051107 North River Club, Section 1 4 SW8 061113 North River Club, Section 2 5 SW8 080718 North River Club, Section 3 On March 27, 2015, Brian Lambe of DEMLR inspected the subject projects to determine the status of compliance The file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit Please find copies of the "Compliance Inspection Report" for each permit attached to this letter As indicated in the attached inspection report, the following deficiencies must be resolved Ownership The transfer form has been signed by the proposed permittee, but not by the current permittee Please either a Submit transfer forms signed by the current permittee, or b Establish that the proposed permittee is the rightful permittee by submitting the appropriate documentation per Session Law 2013-121 i The Department may transfer a permit without the consent of the permit holder to a successor - owner of the property on which the permitted activity is occurring or will occur 1 The successor -owner of the property submits to the Department a written request for the transfer of the permit 2 The Department finds all of the following a The permit holder is one of the following i A natural person who is deceased ii A partnership, LLC, corporation, or any other business association that has been dissolved iir A person who has been lawfully and finally divested of title to the property on which the permitted activity is occumng or will occur iv A person who has sold the property activity ii The permit holder shall comply with all terms and conditions of the permit until such time as the permit is transferred m The successor -owner shall comply with all terms and conditions of the permit once the permit has been transferred iv Notwithstanding changes to law made after the original issuance of the permit, the Department may not impose new or different terms and conditions in the permit without the prior express consent of the successor -owner 2 Signature Authority, Beaufort Club Group, LLC Casey Pernell has signed the transfer forms for the proposed permittee, but he is not listed on the NC Secretary of State's Annual report as being a manager of the organization Per 15A NCAC 02H 1003(e)(1) please either submit transfer forms signed by Mr Thomas A Saieed, Jr or Lonnie C Poole Ili, or submit a letter from one of them which says that Mr Pemell can sign permitting documents on his behalf 3 Deed Restrictions Please submit copies of the recorded deed restrictions not submitted to this office by April 30, 2015 then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed If the property covered by this permit has been/will be sold or legally conveyed to another entity or if the permit holder has changed its name and/or mailing address, or if the project name has been changed, it is your
