Through the CAMA Major permit review, it has come to our attention that the water body classification and the stormwater control system design presented in the permit application do not reflect the fact that the site is within '/2 mile of, and draining to, Class SA waters. The application indicates that the receiving stream is Morgan's Creek, class SC waters, in the White Oak River Basin. The site, however, drains to Newport River, which is classified SA HOW. Discharging stormwater control systems generally cannot be approved on sites that are within '/z mile of, and draining to, Class SA waters. Since the proposed site plan will result in a reduction of impervious area (from 44,076 to 25,363 sq ft) and constitutes redevelopment of a site previously without stormwater management, the permitted control measure will not need to be modified. Carteret County Dear Mr. Brady: The Division received a copy of a plan for the redevelopment of another portion of the previously permitted redevelopment project called Morgan Creek Landings Condominiums. The original plans approved on January 12, 2006, for Morgan Creek Landings Condominiums show an existing mostly rocked area extending out into the harbor area that was not being disturbed. This area is now being redeveloped into a proposed spa. The existing rock will be removed resulting in a net decrease in BUA for that area. The project is part of a common plan of development and regardless of its individual disturbance being less than 1 acre, it does require a modification to the existing permit and approved plans. The permit will need to be modified to account for the decreased BUA within that area to support the redevelopment status. Additionally, since the overall project (including the condos) is still high density, some type of stormwater treatment will need to be provided. Please submit a revised permit application, supplements, 2 sets of layout and grading plans, and the required application fee. Construction of the project may not commence until the modification has been approved. Wilmington, NC 28405 Re: (Permit No. SW8 060103 We have reviewed the work that is being proposed by the developers for Morgan's Creek Landing in Morehead City in the area of the peninsula as shown. It is our understanding that provisions for sod and landscape material include less than one (1) acre of disturbance, and therefore does not require a stormwater or erosion control permit. However, we are providing a silt fence around this portion to prevent any disturbance into the adjacent marsh areas. Originally this peninsula area was a graveled impervious surface which is to be removed by the developer. Returning this peninsula to landscape creates an overall reduction in impervious surface area. By this same reasoning and for the percentage of impervious surface being less than 25%, it was felt that formal stormwater or erosion control permitting would not be required. EDA pa is writing this letter to inform you of our interpretation and would appreciate your concurrence. We look forward to hearing from you. We will be following up with you within 7 days as to your opinion on this matter. We also make ourselves available to come and meet to discuss with you to expediate a decision. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 23,596 square feet of impervious area. There is no allotment for future built -upon area at the site. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per the approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 4. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 6. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated swale. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 7. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. in the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. Permit issued this the 12th day of January 2006. PROJECT SUMMARY: The applicant proposes to demolish the existing structures, and redevelop the property by constructing one building, providing thirty condominium units with associated driveways, parking areas, utilities and bulkhead. Radio Island Development, LLC C/o Doug Brady Page Two 9. PROJECT DESCRIPTION EDA, P.A., representing Radio Island Development, LLC, has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located at the intersection of Old Causeway Road and Morgan Road, on Radio Island, adjacent to Morgan's Creek, in Morehead City, Carteret County. To find the property, take Highway 70 east from Kinston to Morehead City. Continue along Highway 70 towards Beaufort and cross the Morehead City high rise bridge. The property will be located on the right hand side of the road, on Radio Island, at the corner of Old Causeway Road and Morgan Road, adjacent to Morgan's Creek boat basin. The subject property is bordered by residential and commercial properties. Historically, or at least for the past 20-25 years, the project site operated as the Lane's Marina Sales and Service facility, providing sales, service and storage for recreational and commercial boaters. Currently, the property contains the remains of the old Lane's Marina Sales and Service facility. A dilapidated sales/service buildings and parking area are the only remaining structures located on the high ground portion of the tract. Operations at the site have been decommissioned for approximately 5 years. A good majority of the high ground at this site is built upon and there is very little vegetation on the tract. A marginal amount of vegetation (consisting mostly lawn grasses and transitional wetland species) exists along the eastern and southern property boundaries. Elevation at the site ranges from 4-6 feet about Mean High Water. The southern property line/shoreline (bordering Morgan's Creek) is stabilized by rip -rap material. The applicant has indicated that the rip -rap would be removed and a new bulkhead would be installed for shoreline stabilization. According to the applicant's agent, a general permit has been obtained from the Division of Coastal Management's Morehead City Office for bulkhead construction. The applicant indicates that the property is approximately 10.2 acres in size. However, approximately 8.01 acres of the property is located below the Mean High Water (MHW) line. The tract, on which the development is being proposed, is approximately 1.7 acres and is isolated (or separated by MHW) from the remaining high ground areas. The applicant has not provided a submerged land claim for the property located below MHW and our record search indicates that no submerged land claim has been ever been filed for the property. The tract contains a very thin strip of coastal wetlands along the eastern and southern property boundaries. Smooth Cordgrass Marsh (Spartina alterniflora) exists along the waters edge, adjacent to the dilapidated bulkhead and rip -rap material. Salt Meadow Grass (Spartina patens) is located within the transition zone leading to the high ground. According to Carteret County, the CAMA Land Use Classification for the area, within and around the project site, is Developed/Residential. The waters of Morgan's Creek, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to the Division of Environmental Health, Shellfish Sanitation Section, the area'located within Morgan's Creek is CLOSED to the harvesting of shellfish. PROPOSED PROJECT The applicant proposes to remove the existing garage, gravel /paved parking areas and driveways, and redevelop the 199 acre tract by constructing a single building, providing thirty condominium units with associated driveways, parking areas and utilities. The three story building (325'(1) x $5'(w) x 50'(h)) would be centrally located on the property and partially located within the 75' Area of Environmental Concern (AEC), however, no portion of the structure would be located within the 30' Coastal Shoreline Buffer. A covered, unenclosed stairwell would be located at each end of the building, provided access to the units. The proposed project, Morgan's Creek Landings Condominiums, will be three -stories, with open-faced, garage level parking. The project has been reviewed by the Planning Council of the Town of Morehead City (comment letter attached). The Town requires no further changes. Currently, 1.5 of the ten acres is disturbed, with one acre of impervious area (including parking and a rundown, vacant commercial supply structure). The proposed project includes 0.7 acres of impervious area and 1.3 acres of disturbed area. Additionally, in accordance with the Town of Morehead City open space requirements, a significant portion (9.0 acres) of the parcel has been designated as open space and will remain natural and pervious. As such, the proposed development will result in a reduction of impervious area. Various site factors have driven the decision to utilize dual compartment, stormwater sand filter filtration trenches in the project, including the topography of the site and the proximity to SC waters. The proposed design incorporates three identical sand filtration trenches, which are located at finish floor grade in the garage. As the filtration trenches are under the structure, sheet flow run- off to the sedimentation chamber trench grates will be minor. The majority of impervious surface run-off will be collected from roof surfaces, as the roof drain leaders boot underground and drain directly into the sedimentation chamber. Run-off will collect in the sedimentation chambers, where solids will settle out. Once the run-off in the sedimentation chambers reaches the level of the weir, additional stormwater will then flow over the weir into the sand filtration chambers. The run-off will filter through the 18" layer of sand. The sand filters are sized to draw down the first I" in 24- hours, ultimately draining into the SC waters of Morgan Creek. DRAINAGE AREA: The design of the infiltration filters is based on the drainage area (largest) to the filters, 8,270 sq ft or 0.189 acres. The property is zoned RMF- Residential Multi - Family. The property covers ten -acres along Old Route 70, adjacent to Radio Island along the SC waters of Morgan Creek and Beaufort Harbor. The proposed project, Morgan's Creek Landings Condominiums, will be three -stories, with open-faced, garage level parking. The project has been reviewed by the Planning Council of the Tow of Morehead City (comment letter attached). No further changes are required by the Tonw. Currently, 1.5 of the ten acres is disturbed, with one acre of impervious area (including parking and a rundown, vacant commercial supply structure). The proposed project includes 0.7 acres of impervious area and 1.3 acres of disturbed area. Additionally, in accordance with the Town of Morehead City open space requirements, a significant portion (9.0 acres) of the parcel has been designated as open space and will remain pervious. As such, the proposed development will result in a reduction of impervious area. Various site factors have driven the decision to utilize stormwater sandfilter infiltration trenches in the project, including the topography of the site and the proximity to SC waters. The proposed design incorporates triple sand infiltration trenches, which are located at finish floor grade in the garage. The garage impervious surfaces flow to the trench grates and into the sedimentation chambers. The roof drain leaders drain directly into the sedimentation chamber, where the solids will settle out. As the sedimentation chambers fill, the run-off weir flows into the filtration chamber. The sand filters are sized to draw down in 24-hours, ultimately draining into the SC waters of Morgan Creek. UNDERGROUND INFILTRATIONTRENCH OPERATION AND MAINTENANCE AGREEMENT After every nmoff producing rainfall event and at least monthly inspect the bypass/overflow stricture for blockage and deterioration and the infiltration system for erosion, trash accumulation, grass cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash and blockages as needed to maintain system performance. Remove accumulated sediment annually or when depth is reduced to 75%, of the original design depth. Restore depth to original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. 4. The water level in any monitoring wells will be recorded after a- 1 inch rainfall event and at least once a month. Chronic high water table elevations (within 1 foot of the bottom of the system for a period of three months) shall be reported to DWQ immediately. 5. If DWQ determines that the system is failing, the system will immediately be repaired or replaced to original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 21-1 .1000 must be designed, approved and constructed. Remove accumulated sediment from the infiltration system annually or when depth in the unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over - excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the infiltration system. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the depth at the benchmark reads 4.3 , the accumulated sediment shall be removed from the system. Depending on the types of activities occurring within the drainage area, most sand filters will show a decreased capacity for filtration after a few years. At least once a year, each filter must be inspected after a 1" design storm event to determine if the filter bed is passing the runoff within 24 hours. 2. The property is zoned RMF- Residential Multi - Family. The property covers ten -acres along Old Route 70, adjacent to Radio Island along the SC waters of Morgan Creek and Beaufort Harbor. The proposed project, Morgan's Creek Landings Condominiums, will be three -stories, with open-faced, garage level parking. Currently, 1.5 of the ten acres is disturbed, with one acre of impervious area (including parking and a rundown, vacant commercial supply structure). The'proposed project includes 0.7 acres of impervious area and 1.3 acres of disturbed area. Additionally, in accordance with the Town of Morehead City open .space requirements, a significant portion (9.0 acres) of the parcel has been designated as open space and will remain pervious. As such, the proposed development will result in a reduction of impervious area. Various site factors have driven the decision to utilize stormwater sandfilter infiltration trenches in the project, including the topography of the site and the p xlo mity to SC waters. The proposed design incorporates dual sand infiltration trenches, which are located at finish floor grade in the garage. The garage impervious surfaces flow to the trench grates and into the sedimentation chambers. The roof drain leaders drain directly into the sedimentation chamber, where the solids will settle out. As the sedimentation chambers fill, the run-off weir flows into the filtration chamber. The sand filters are sized to draw down in 24-hours, ultimately draining into the SC waters of Morgan -Creek. As the site currently includes no stormwater treatment, we feel that proposed stormwater system not only adequately treats the stormwater from the site, but also results in improved quality of stormwater into the SC waters.
