Please find attached the Engineer's Certification for Sounds Edge Plaza I have attached 2 D size
drawings The first is the original design document The second is the as built survey provided tome by
the current owner's agent The survey confirms the placement of the catch basins and other structures
according to the plan Please note that several of the originally proposed buildings have not been
constructed at this time I have informed the current owner that the development must adhere to the
permit and its conditions including the limits on impervious surfaces of 50,325 square feet Changes to
the development layout will require a permit modification
I have also informed the current owner that he will be required to submit an application for

I've attached the requested Name/Ownership Change form Please complete, sign and forward the form to the
new owner for their signature However, you need to be aware that although you sold the project, you are still
the permittee of record until the Division approves your request to transfer, therefore, you are still responsible
for providing the Designer's Certification (also attached) The project should have been certified before you
sold it Now if you sold the property before you developed it and the new property owner simply carried out the
approved development plans, then of course the new owner would be the one to provide the designer's
certification
It is also possible that you and the new property owner can work out the financial details of who pays for what
in order to comply with the permit and get this permit transferred over to the current owner However the two of
you choose to resolve it is fine with me, but there are several things that need to be taken care of — a site
inspection for compliance with the permit, submitting the certification of the permitted stormwater system, and
transferring the permit These actions were your responsibility under the permit

9 PROJECT DESCRIPTION -
The applicant's project is located along N C State Highway 210, between Greensboro Street and Goldsboro Street,
approximately 0 20 mile north of the intersection of N C Hwy 50 and N C Hwy 210, adjacent to Stump Sound, in Surf City,
Pender County To find the property, take Highway 17 North from Wilmington and turn right on N C State Highway 50
(approximately 30 miles from Wilmington) Head east on Hwy 50 and turn left onto Hwy 210 at the intersection of Hwy 210
and Hwy 50 The property is located on the western side of Hwy 210, approximately 0 20 mile from the intersection of Hwy 210
and Hwy 50
The applicant has submitted an Express CAMA Permit Application to develop approximately 1 58 acres, located between
Highway 210 and the AIW W, adjacent to Yow's Channel and Stump Sound The subject property is currently divided into two
parcels, however, the applicant maintains ownership of both The two parcels (later referred to as "the property") would
ultimately be combined to form a single tract The high ground portions of the nroperty are currgiltly being graded for
construction authorized by CAMA Major Permit 464-06 Small stands of Southern Wax Myrtle (Merica cer fora) and Yaupon
(Ilex vomitoria) exist on the water ward side of the property, along the property lines bordering Yow's Channel The property
has approximately 360 linear feet of shoreline bordering Yow's Channel The high ground vegetation is bordered by
transitional species including Sea Oxeye (Borrichtafrattescens) and Grounsel-bush (Baccharus halms folic) High coastal marsh
vegetation including Black Needle Rush (Juntas roemarianus), Spike Grass (Distichlis spicata) and Sea Lavender (LInIo11i1!!n,
spp , exist in the inter -tidal zone Salt Meadow Grass (Sparttna patens) complete the transition to the waters edge where Smooth
Cordgrass Marsh (Spathna alterniflora) is the predominant species The northern shorchne is stabilized by a bulkhead,
however, the southern shoreline is not A 10 x 90' boardwalk exists adjacent to the concrete pads and provides access to a 6 x
112' section of floating dock The boardwalk and floating dock run parallel to the shoreline, and span from west to east The
waterbody at this location is approximately 150' from edge of marsh to edge of marsh A commercial building (Tiading
Company) is located in the southwest corner of the property According to the applicant the Trading Company would be left
undisturbed
The existing floating dock was authorized under CAMA Major Permit # 128-93 This perimit authorized the installation ofa 6 x
112' floating dock that could accommodate no more than 10-slips
The waters of Yow's Channel and Stump Sound, adjacent to tine project site, are classified as SA by the North Carolina Division
of Water Quality They are designated as a Primary Nursery Area (PNA) by the N C Division of Marine fisheries, and
according to maps provided by the Shellfish Sanitation Section, they are CLOSED to the harvest of shellfish
PROPOSED PROJECT
The applicants are requesting a Major Modification to their existing State Permit #64-06 The applicant is proposing to
shift the existing dock approximately 12' to the east and add a 6' x 18' section of floating dock to the existing dock The
applicant is also proposing to install five (5) finger piers measuring approximately 2' in width and 18' in length with eleven
(11) mooring pilings The docking facility would have 10 boat slips The water depth at the end of the docking facility
would be approximately —6' @ Normal Low Water (NLW)
10 ANTICIPATED IMPACTS
The proposed installation of the floating dock addition, (5) finger piers and (11) mooring pilings would incorporate
approximately 282 ft Z of Estuarine Waters and Public Trust Area

(Menca cerifera) and Yaupon (Ilex vomitona) exist on the water ward side of the property, along the property lines bordering
Yow's Channel The property has approximately 360 linear feet of shoreline bordering Yow's Channel The high ground
vegetation is bordered by transitional species including Sea Oxeye (Borrichia frutescens) and Grounsel-bush (Baccharus
halunifnha) High coastal marsh vegetation including Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis

dock The boardwalk and floating dock run parallel to the shoreline, and span from west to east No modifications and/or
changes to the boardwalk and/or floating dock are proposed under this permit application A commercial building (Trading
Company) is located in the southwest corner of the property According to the applicant, the Trading Company would be left
undisturbed
According to the Surf City Zoning and Planning Department, the project site is located within the Town's Central Business
District Therefore, development is not limited to the area landward of the 30' Coastal Shoreline Buffer Development within
designated Urban Waterfronts are not required to meet the Rules pertaining to the 30' Buffer, as defined in 15A NCAC 7H
0209 (Coastal Shoreline Area of Environmental Concern (AEC)), provided that the applicant can demonstrate that he/she has
met the Specific Use Standards described in 15A NCAC 7H 0209 (g)(4)(A) According to the applicantion package, and by
issuance of a high -density State Stormwater Permit (#SW805I019) from the Division of Water Quality, the applicant has
demonstrated that Stormwater runoff from the proposed residential and commercial units, swimming pool, driveways and
parking areas would be collected and diverted away from the adjacent waters of Yow's Channel The location of the
stormwater collection system will be discussed in the proposed project section of the Field Investigation Report
The waters of Yow's Channel and Stump Sound, adjacent to the project site, are classified as SA by the North Carolina
Division of Water Quality They are designated as a Primary Nursery Area (PNA) by the N C Division of Marine Fisheries,
and according to maps provided by the Shellfish Sanitation Section, they are CLOSED to the harvest of shellfish

PROPOSED PROJECT
fhe applicant proposes to develop the property by constructing two-5 story residential/commercial buildings, six-3 story
residential buildings with associated driveways and parking areas, swimming pool, boardwalk, stormwater collection system and
utilities
Three entrance/exit drives would be constructed for access in and out of the complex One of the drives would consist of gravel
material and would be for the sole use of accessing the proposed duplexes located along the southern shoreline The gravel drive
would provide access to the duplex parking areas located beneath each of the duplex units A second drive would be
constructed adjacent to the gravel drive, and would enter the property from a private drive located between the applicant's
property and Beach House Marina The second drive would be 26' wide at it's entrance and would give way to an asphalt
parking area located north of the trading company the parking area would provide twenty-eight 16' wide parking spaces The
second drive would provide drive through access and connect to the third proposed drive located off New River Dave The third
driveway would provide access to a second asphalt parking area located on the eastern side of the property This driveway would
serve the residential and commercial buildings
Two stormwater infiltration beds would be located beneath the asphalt parking areas and a third bed would be located beneath
the gravel driveway The beds would be approximately 15' x 120' in size, and would be located in the center of each parking
area, outside of the 75' Estuarine Shoreline AEC These infiltration beds would collect stormwater runoff from the
residential/commercial buildings, parking areas and driveways A third bed, located beneath the gravel drive and irrunediately
adjacent to the 75' Estuarine Shoreline AEC, would collect storwater runoff from the proposed swimaung pool, duplexes and
surrounding area
A 5' x 315' concrete sidewalk would be constructed within the property boundary along New River Dave The sidewalk would
provide access to the residential/commercial buildings via a pedestrian crossing that would cut through eastern parking area A
raised wooden boardwalk would be constructed along the landward side of the proposed residential/commercial buildings The
boardwalk, varying in length and width, would extend south from the area] ust north of the commercial building to the proposed
swimming pool A second wood boardwalk (4' x 125') would be constructed immediately north of the Trading Company The
boardwalk would tie in to the existing wood ramp located on the northern side of the Trading Company, and would provide
access to the parking areas
A swimming pool (15' x 35') is proposed between the residential duplex units and the residential/commercial buildings An 8' x
10' concrete apron would encompass the swimming pool, providing access to the connecting wooden boardwalk
Approximately 113 of the swimming pool and concrete apron would be located within the 30' Coastal Shoreline Buffer As
proposed, neither the pool nor the concrete apron would extend beyond the plane of the upper limits of coastal wetlands
In addition to the swimming pool and apron, all of the residential duplex units and the residential/commercial buildings would
encroach into the 30' Coastal Shoreline Buffer The residential/commercial buildings (each with a footprint equal to 50' x 83')
would connect via an enclosed breezeway The maximum building height for these structures would be approximately 60' (as
measured from the first floor foundation to the top of the roof) A portion of the eastern most building would extend to the
landward edge of the existing bulkhead (location of Mean High Water (MHW)) On average, the residential/commercial
buildings would be located approximately 10' landward of MHW
The six 3-story residential duplex units would be located along the northern shoreline, partially within the 30' Coastal Shoreline
Buffer The duplex units, each with a footprint measuring 20' x 36', would run from north to south The closest portion of any
of the duplexes would be approximately 20' landward of the MHW line Each duplex unit would have an 8' x 20' uncovered
deck on each floor, with the exception of the upper deck which would be 10' x 20' 1 he open decks would be located on the
north side of the units, adjacent to Yow's Channel Each unit would have it's own wooden boardwalk, located on the ground
floor, that would provide access to the existing boardwalk and pier The residential duplex units and residential/commercial
buildings would create a density of 16 4 units per acre

construction, operation and maintenance of three underground infiltration trenches in
compliance with the provisions of 15A NCAC 2H 1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until November 28, 2015, and
shall be subject to the following specified conditions and limitations
1 DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater
runoff as described in Section 16 on page 3 of this permit The stormwater
control has been designed to handle the runoff from 50,325 square feet of
impervious area This trench system must be operated with a 50' vegetated filter
3 The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans There is no allotment for future built -upon
area at the site
4 All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the protect
will be recorded showing all such required easements, in accordance with the
approved plans
5 The runoff from all built -upon area within the permitted drainage area of this
protect must be directed into the permitted stormwater control system

If. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
2 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
3 The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and revegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of bypass structure, filter media, flow
spreader, catch basins, piping and vegetated filter
g A clear access path to the bypass structure must be available at all times
4 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ The records will indicate the date,
activity, name of person performing the work and what actions were taken
5 The facilities shall be constructed as shown on the approved plans This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data

6 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations
7 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
8 Access to the stormwater facilities shall be maintained via appropriate
easements at all times
9 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Project name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further subdivision, acquisition, lease or sale of all or part of the project
area The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
10 The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction
11 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction
12 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
III GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate
The approval of this request will be considered on its merits and may or may not
be approved The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request

2 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
3 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
4 In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
5 The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility
6 The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
7 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
8 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit
9 The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days

Sounds Edge Plaza is a proposed mixed use development The project includes
an existing retail store, 6 duplex townhomes, a mixed use building and associated
parking
All parking areas will be asphalt except for the duplex parking area which will be
slate Water and sewer will be provided by the Town of Surf City The tract is currently
cleared except for the existing retail store and its parking area
2 0 Proposed Land Disturbing Activity
The plans call several structures to be built and parking areas to be graded and
paved Utility work will proceed as needed There are no wetland areas within the
project boundary There are coastal wetlands adjacent to the project boundary in the rear
of the project These areas have been delineated by CAMA and a COE Jurisdictional
Determination is under way Theses areas run along the shoreline of the property and are
directly adjacent to an existing bulkhead The project area is 1 59 acres
3 0 Drainage Basin Delineation
The drainage basin includes all the area on the property within the mean high
water mark This area corresponds with the project boundary 73% of the project area is
proposed to be impervious
4 0 Soils
The predominant soil is Newhan sand Vincent Lewis has visited the site and a
letter from a registered soil scientist is included The data shows the infiltration rate to be
greater than the 52 in/hr minimum
5 0 Wetlands
As discussed above, no wetlands will be disturbed for this project
