PROJECT DESCRIPTION The applicant's project is located along N C State Highway 210, between Greensboro Street and Goldsboro Street, approximately 0 20 mile north of the intersection of N C Hwy 50 and N C Hwy 210, adjacent to Stump Sound, in Surf City, Pender County To find the property, take Highway 17 North from Wilmington and turn right on N C State Highway 50 (approximately 30 miles from Wilmington) Head east on Hwy 50 and turn left onto Hwy 210 at the intersection of Hwy 210 and Hwy 50 The property is located on the western side of Hwy 210, approximately 0 20 mile from the intersection of Hwy 210 and Hwy 50 Detailed, site specific information can be found in the Field Investigation Report, prepared by Jason Dail and circulated on March 20, 2006 However, a summary of the existing site conditions, as they appear today, are as follows The high ground portion of the property is mostly cleared of vegetation and is relatively flat with an elevation of 6 0' to 8 0' above Mean High Water (MHW) Small stands of Southern Wax Myrtle (Merica cerifera) and Yaupon (Ilex vomitoria) exist on the water ward side of the property, along the property Imes bordering Yow's Channel The property has approximately 435 linear feet of shoreline bordering Yow's Channel The high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichla frutescens) and Grounsel-bush (Baccharus hahmifolia) High coastal marsh vegetation including Black Needle Rush (Juncus roemarranus), Spike Grass (Distichhs spicata) and Sea Lavender (Limonrum, spp , exist in the inter -tidal zone Salt Meadow Grass (Spartina patens) completes the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniora) is the predominant species A portion of the shoreline (approximately 215' beneath the existing boardwalk or "spine" and along on the far northern property boundary) is stabilized by a bulkhead, however, there is a portion of the shoreline in between that is naturally stable There is an existing asphalt driveway and parking area that extends onto the property from N New River Drive (NC Hwy 210) The asphalt driveway and parking area provides vehicular access to the two existing condominium units located along the southern edge of the property According to the applicant's agent, the asphalt drive and parking area are owned by Blue Water Community Association, whose registered agent is the same as Heritage L LLC's In addition, there are two existing condominium structures located along the southern property boundary that were part of six total units that were originally permitted under CAMA Major Permit #64-06 As indicated by the permittee, the four remaining condo buildings will be constructed at a later date (LAMA Major Permit still active and will be discussed below) Similarly, the proposed site plans show the location of two "proposed buildings" along the northern property boundary These too, were permitted under the initial CAMA Major permit, but have not been constructed to date Currently, the existing water dependent structures include a 10' x 90' boardwalk which runs parallel to the western shoreline The boardwalk, or "spine", provides access to five (5) 4' x 26' finger piers As permitted, the existing docking facility provides dockage for up to ten (10) vessels On May 1, 2006, A CAMA Major Permit (64-06) was issued to Dan Deacon for construction of "Sounds Edge Village", a commercial/residential development located in Surf City, Pender County Permit No 64-06 authorized construction of a number of townhomes, several commercial buildings, a swimming pool, boardwalk, stormwater system and other amenities and utilities On September 8, 2006, the permittee modified the active CAMA permit to include the reconfiguration of the existing docking facility (which predated the issuance of CAMA permit 64-06) The modified permit (major modification) authorized a maximum of ten (10) docking spaces On January 14, 2008, the permit was again modified (minor modification) This modification included the construction of two finger piers and tie pilings along the entire length of the existing dock The most recent permit activity includes a transfer of CAMA permit 64-06, from Dan Deacon to Heritage 1, LLC This transfer was approved on June 12, 2013, and is scheduled to expire on December 31, 2013 To date, the only development activities that have taken place on -site include the construction/re-configuration of the docking facility, as well as the construction of two condominiums (one building our of four) The permittee maintains he is moving forward with the original development plans (as permitted), as well as the plans requested below Heritage I, LLC Page Three According to the Surf City Zoning and Planning Department, the project site is located within the Town's Central Business District Therefore, development is not limited to the area landward of the 30' Coastal Shoreline Buffer Development within designated Urban Waterfronts are not required to meet the Rules pertaining to the 30' Buffer, as defined in 15A NCAC 7H 0209 (Coastal Shoreline Area of Environmental Concern (AEC)), provided that the applicant can demonstrate that he/she has met the Specific Use Standards described in 15A NCAC 7H 0209 (g)(4)(A) The waters of Yow's Channel and Stump Sound, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality They ARE designated as a Primary Nursery Area (PNA) by the N C Division of Marine Fisheries, and according to maps provided by the Shellfish Sanitation Section, they are CLOSED to the harvest of shellfish PROPOSED PROJECT The applicant proposes to eliminate the previously authorized swimming pool and decking, and install several access walkways, a fixed "spine" (boardwalk along entire length of shoreline), seven finger piers and twelve (12) tie -pilings A total of twelve (12) additional docking spaces would be added to the existing ten (10) slip docking facility As proposed, the applicant would eliminate the previously approved swimming pool and associated decking Originally, the swimming pool was to be installed between the proposed condo units and the commercial buildings, however, the applicant has since decided to eliminate this feature Based on the revised plans, a "proposed property line" has been established in the area where the pool was to be initially located For now, the entire shoreline property is one parcel, however, the applicant's agent has indicated that the property will be subdivided (split) in the future, separating the residential side from the commercial side As indicated by the applicant's agent, the division of the property will not affect the development as Heritage I, LLC will retain ownership of both parcels In addition, the permittee is proposing to install sever (7) wooden access walkways which would extend from the condo and commercial units to the proposed boardwalk and/or dock spine These walkways would be 6' in width and approximately 20'-25' in length The walkways would extend from the western (water side) of the condo units to the existing, and proposed, fixed boardwalk As mentioned above, the walkways would connect to an elevated boardwalk and/or "spine" that would run the entire length of the shoreline (+/- 435 linear feet) A new section of fixed boardwalk would connect to the existing boardwalk along the southern side and extend approximately 110' toward the south, all the way to the common property line shared with Beach House Marine (waiver attached allowing encroachment) Similarly, a 176' section would connect along the northern side of the existing boardwalk and extend toward the north, terminating at the common property line shared with the Town of Surf City (their waiver is also attached) The entire boardwalk would measure 6' in width A total of seven (7) new finger piers would be installed as part of the new proposal, three extending from the new southern section and four from the northern section The finger piers would measure 4' x 26', and would be installed perpendicular to the proposed spine A total of twelve (12) tie -pilings would accent the proposed docking facility The tie -pilings would be installed immediately outboard of the terminal end of the proposed fingers, as well as in between the finger piers It should be noted that the proposed northern section of boardwalk would be located a distance of 10'-15' offshore of the edge of marsh and would restrict access to open water area by cutting across a small embayment located along the northern portion of the property Fortunately, the boardwalk/spine would be fixed and elevated and small craft would still be allowed to access the otherwise restricted area Heritage I, LLC Page Four Water depths surrounding the proposed structures range from -2 4' to -7 6, relative to Normal Low Water (NLW) As proposed, at total of twenty-two (22) slips would be constructed at this facility 10.
