Dear. Mr. Harrison:
Effective August 1, 2013 the State Stornwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of L-'nergy; \9ineral and Land Resources (DEi\,ILR). All previous references to
DWQ will remain in older storm -water permits issued prior to August 1, 2013 until they are modified;
transferred. or renewed. Please note that this letter references D1 NI1,R as the Division responsible for issuance
of the permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This ]a", impacted any development approval
issued by the former Division of Water Quality under Article 21 of Chapter 1,13 of the General Statutes; N'',hich
was current and valid at any point between January 1, 2005, and December 31, 2010. `fhe law extended the
effective period of any storrnwater permit that was set to expire during this Unie frame to three (3) years from
its current expiration date. On August 2, 2010; the Governor signed Session Lary 2010-177. which granted an
extra year for a total of four (4) years extension. Accordingly, this permit, x+which was set to expire on
December S, 2014, sliall now be effective from the date of issuance until December S, 2018, which includes all
available extensions.
State Stormwater Nlanagerttent Permit 4SWS 041 122 for the subject project was last issued on December S,
2004 to APAC-Atlantic, Inc. — Coastal Carolina Division and expired on December S, 201 S as noted above.
Per 15A NCAC 2H.1045(3) (the siorlinvarer rules), applications for permit renewals shall be submitted 180
days prior to the expiration of a pennit and must be accompanied by a processing fee, which is currently set at
S505.00. If this is still an active project, please complete and submit a renewal application prior to April 9,
2019. The renewal application cart be found at the following website under the Applications Forms section:

Additionally, a review of the North Carolina Secretary of State corporation's database revealed that this
corporation has a new address and new point of contact. Please submit a completed Permit Information Update

Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater
klanagernent Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina
General Statute 143-214.7 until you submit the required Permit Transfer application form to the Division and
receive approval from the Division to transfer the permit or, if the site has not been built, submit a request to
rescind the permit anti receive approval. This includes providing the necessary operation and maintenance of

of the permit.

On behalf of our client APAC — Atlantic, Inc. (APAC), CATLIN Engineers and Scientists
(CATLIN) has enclosed for your review a Revised Stormwater Management Permit Application
Package with request for express turnaround for the proposed project at the Deppe Asphalt Plant
located on Highway 17 North in OnSlbw County, North Carolina. This revised package has been
prepared based on a letter from your office dated November 29, 2004 that requested additional
information pertaining to this project.
We have reviewed your request for additional information and offer the following responses to the
requested information:

1. Please either delineate all wetlands on site, disturbed or undisturbed, or note on the
plans that none exist.
Acknowledged. Wetlands have been identified on the attached Construction Drawings as
determined by others. Please refer to Sheets 2 and 3 of the Construction Drawings for
location.

2. Please provide more temporary pool volume in both ponds. Per the calculations,
neither of the ponds provides sufficient volume to store the first inch.
Acknowledged. The Wet Detention Basin Supplement Forms SWU-102 provided in the
original submittal package listed the minimum temporary pool design volumes. These
forms have been revised with the actual temporary pool volume. The volume of runoff
produced by the first inch of rainfall has been calculated using the "Simple Method" (Ref:
Storrnwater Best Management Practices, NCDENR, 1999, page 6-7). These calculations
have been provided on page 3 of 5 of the calculations for each respective drainage area.
Please refer to "Additional Revision Page 2" of the attached calculations for each respective
drainage area for the actual temporary pool volume calculations. The actual temporary pool
volumes were calculated using the dimensions illustrated on the Construction Drawings.
3. Please provide calculations which demonstrate how it was determined that the
required minimum forebay volume had been provided in the pond.
Acknowledged. The Wet Detention Basin Supplement Forms SWU-102 provided in the
original submittal package listed the minimum required forebay volumes. The actual
forebay volume calculations have been provided on "Additional Revision Page I" of the
attached calculations for each respective drainage area. The actual volumes were calculated
using the dimensions illustrated on the Construction Drawings. The forebay volumes for
each wet detention basin have been updated on the Wet Detention Basin Supplement Forms
S WU-102 in order to illustrate the actual volumes.
4. Please add the nearest intersection of two major roads to the vicinity map. A major
road is any 1, 2, or 3 digit NC, US or interstate highway.
Acknowledged. Please refer to Sheet 1 of the Construction Drawings for the requested
information.
5. Please either provide a trash rack over the three orifices, or indicate on the riser detail
that they will be reverse sloped in order to keep floating debris from clogging them up.
Acknowledged. Please refer to Sheet 4 of the Construction Drawings. The detail has been
updated to show the trash rack covering the orifices.
6. I've never permitted a pond where the exact minimums required were provided, down
to the last cubic foot and square foot. You certainly don't have to provide some wiggle
room, but it's probably best in case things come up during construction. It's rare that
a pond gets build exactly to the dimensions provided, so it's best to slightly over -design
than not to have enough.
Acknowledged. As previously stated, the Wet Detention Basin Supplement Forms SWU-
102 provided in the original submittal package listed the minimum required volumes.
However, the basins illustrated on the Construction Drawings were slightly larger than the

minimum calculated volumes. The calculations for each respective drainage area have been
revised/updated to reflect the actual design volumes as opposed to the minimum volumes.
Subsequently.. CATLIN has revised the Wet Detention Basin Supplement Fornis SWU-102
for each respective drainage area. Please note that the basins illustrated in this revised
submittal package have been slightly altered to provide additional capacity, if needed during
constructiori.
7. APAC-Atlantic, Inc. is a registered corporation with the Secretary of State, however,
APAC-Atlantic, Inc. Coastal Carolina Division is not. If it is your intent that the latter
be the permittee, please have it registered with the Secretary of State. If not, please
revise the application to reflect the correct corporate name.
Acknowledged. The application has been revised to state that the permittee is APAC-
Atlantic, Inc.
The attached revised permit application package has been revised throughout to reflect the changes
discussed in the above responses to comments. If you require additional information, or have any

The Wilmington Regional Office received an Express Stormwater Management Permit

November 29, 2004. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater
review:

Please note that this request for additional information is in response to a preliminary
review. The requested information should be received by this Office prior to December
6, 2004, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this
letter. The request must indicate the date by which you expect to submit the required
information. The Division is allowed 90 days from the receipt of a completed
application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not

Dear Mr. Weaver:
On behalf of our client APAC Atlantic, Inc., (APAC) CATLIN Engineers and Scientists
(CATLIN) has been requested to prepare a Stormwater Management Permit Application
with express turnaround for the proposed project at the Deppe Asphalt Plant located on
Highway 17 North in Onslow County, North Carolina. A general site location map (USGS
Topographic Quadrangle) has been included. This letter is to inform you of our intent to
submit this application with a request for express turnaround review. As part of the express
turnaround request, APAC and CATLIN would like to request a pre -application submittal
meeting on November 15, 1004. The following is a brief narrative of the proposed methods
of stormwater treatment and control.
The APAC property in Deppe. North Carolina includes roughly 14.4 acres of land for the
operation of an Asphalt Concrete (AC) plant and associated activities. The site is currently
undergoing redevelopment activities. For the development of a stormwater management
strategy, proposed final contours will divide the property into two distinct drainage areas,
'A' and B'. The intent of the design will be to prevent untreated stormwater from leaving
the site, to control the velocity of runoff, and to ensure non -erosive flow. These design
requirements will be met by the following means:
On -site stormwater will be treated by means of grassed swales and two wet
detention ponds with a design 85% pollutant removal efficiency for each drainage
area.
Grassed swales will be designed w/ roughly a l% slope, and a length to exceed 100
feet per acre of drainage area.

Wet detention ponds will have been designed to control. at a minimum, the first inch
of rainfall and draw down over a period of 2 to 5 days.
An earthen berm will be utilized to ensure that ston-nwater will be conveyed to the
designed treatment structures. (i.e. swales, wet detention basins, etc.)

Package with request for express turnaround for the proposed project at the Deppe Asphalt

is attached. This package was prepared based on recommendations made by your office
during a meeting with representatives of CATLIN and APAC on November 15, 2004.

Ms. Linda, I've been trying to contact you on the above referenced Site and
letter that we've received from your office from Oct 15, 2004.
I had called your office in Aug and was told that the NPDES Stormwater
permit that we have for the Asphalt plant NCG 160097 would be sufficient
for this project as we were redoing the ground from an already existing
site.
I assume we have to have another permit to request from your letter and
anticipate the permit application to be done prior to the Nov 15th and
turned in to you for your review. I do how ever have a questions about the
site. we have been on hold for the last two months waiting on the Erosion
and Sedimentation Control Plan Approval, and at the time we were under the
impression that we didn't need anything else for this site as we were told
above we had everything else. While waiting We asked Carol Miller if we
could start paving prior to the approval and she felt it was ok to pave
because it was ground cover. although three days ago she called and told
Catlin Eng. that we should ask you if we could pave as there may be a
stormwater reason not to pave yet. Can we pave the areas of truck traffic
in the 1st stage area A prior to receiving this permit? This would stop a
lot of Erosion and sedimentation from possibly leaving the site although we
have it contained per our permits. It would also help us control the dust
from the trucks entering and leaving the plant site. Please let us know
what we can do if anything.

just a heads up since you have not approved anything to date. we did approve
the E&SCP, but with the usual condition that all other necessary permits be
obtained. I have advised the consultant with Catlin & Assoc. that they may be in
violation if they start adding any impervious prior to the storm water permit
issuance (I'm pretty sure it is high density), but apparently Catlin is not doing
their storm water. They (APAC) have given me every indication that they will
start paving immediately, but MAYBE they will heed my warning.

We required a plan after they exceeded an acre and have
twice. I don't think they have a storm water permit, but
know if you need any additional info.

Dear Mr. Harrison:
On August 17, 2004, the Wilmington Regional Office received' a copy of the Notice of
Receipt of an Erosion and Sedimentation Control Plan for the subject project. The
North Carolina Administrative Code requires any project that must receive either
Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to
apply for and receive a Stormwater Management Permit by the Division of Water
Quality. Any construction on the subject site., prior to receipt of the required permit, will
constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement
action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans,
completed application form, fee, and supporting documentation, or a written response
regarding the -status of this project and the expected submittaf date must be received in
this Office no later than November 15, 2004. Failure to respond to this request may
result in the initiation of enforcement action, and construction may experience a
subsequent delay..
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control
Plan approval letter must NOT be.considered the Coastal Stormwater Management
Permit, which will be signed by the Water Quality Supervisor. Please reference the
Project Number above on all correspondence. If you have any questions, please

NOTICE OF RECEIPT OF EROSION & SEDIMENTATION CONTROL PLAN

Dear Mr. Harrison:
This office has received a soil erosion and sedimentation control plan for the project listed below which was
submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A,-57(4)},
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must
obtain approval of a soil erosion control plan prior to the commencement of said land -disturbing activity (NCGS 11 3A-
54(d)(4)1. The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the
approving authcrity must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan
if the submitted plan is complete. Commencement or continuation of a land -disturbing activity under the jurisdiction
of this Act prior to the approval of an erosion & sediment control plan is a violation of the Act.
A copy of any erosion and sediment control plan which could involve the utilization of ditches for the.purpose
of de,.vaterina or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ). It is
suggested that you contact the Division of Water Quality at (910) 395-3900 if the ditches shown on your plan will
lower the water table.
We have performed a preliminary review of your submitted plan and have determined that additional information
,.-rill be necessary before a final review can be completed. Enclosed is a checklist of items that must be submitted
before we can comolete the review process. Failure to provide the additional information may result in disapproval
of your plan.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal
and Mate water quality laws, regulations and rules.
If you have questions or need additional information, please do not hesitate to contact this office. Your
cooperation in this matter is appreciated and we look forward to working with you on this project.
