Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this modified permit now references DEMLR as the Division responsible for
issuance of the permit.
The Wilmington Regional Office -received a modified Stormwater Management Permit Application for
The Hamptons Phases I and 11 on April 1, 2015 with final information received on August 31, 2015.
Staff review of the plans and specifications has determined that the project, as proposed, will comply
with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding modified
Permit No. SW8 031026 dated September 1, 2015, for the construction of the built -upon areas and
BMP's associated with the project.
The modifications covered by this permit include:
1, The construction of 45,690 sf for the Amenity Center. The Amenity Center is allocated 74,000 sf
of BUA. The remaining BUA for future development within the Amenity Center is 28,310 sf.
2. The addition of a total of 14 new lots to the permit, 1171-1184. The permit now covers 492
single family lots.
3. The renumbering of lots due to duplicate and incorrect numbering.
4. BUA allocations for future development within the multi -family areas and the Amenity Center
have been specified.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010.
The law extended the effective period of any stormwater permit that was set to expire during this time
frame to three (3) years from its current expiration date. On.August 2, 2010, the Governor signed
Session Law 2010-177, which granted an extra year for a total of four (4) years extension.
Accordingly, this permit shall now be effective from the date of issuance until February 13, 2022, which
includes all available extensions, and shall be subject to the conditions and limitations as specified
therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management
system will result in future compliance problems.

If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North
Carolina General Statutes. Per NCGS 143-215(e) the petition must be filed with the OAH within
thirty (30) days of receipt of this permit. You should contact the OAH with all questions
regarding the filing fee (if a filing fee is required) and/or the details. of the filing process at 6714

FOR THE
construction, operation and maintenance of eight (8) wet detention ponds in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land Resources
and considered a part of this permit.
This permit shall be effective from the date of issuance until February 13, 2022 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described in Section 1.6 of this permit. The eight (8) approved wet detention ponds have
been approved to treat a maximum amount of built -upon area as indicated in the chart
below:

3. The subdivision is permitted for 492 lots, each limited to a maximum amount of built -
upon area (BUA) as follows: (129) Lots 441-569 are limited to a maximum of 7,500
square feet each; (362) Lots 822-1184 are limited to a maximum of 5,000 square feet
each.
4. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.

5. The runoff from all built -upon areas within the permitted drainage areas of this project
must be directed into the appropriate permitted stormwater control system.
6. The following design elements have been permitted for this wet detention pond
stormwater facility, and must be provided in the system at all times.

01 Where the drainage area lines split a lot into 2 or more sections, the lot BUA totals shown above reflect that split.
The permittee must assure that these lot BUA splits are maintained as provided in the Lot BUA Inventory for each
pond, which is incorporated as an enforceable part of this permit.
II. SCHEDULE OF COMPLIANCE
1. The facilities must be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.
2. The permittee shall monitor the project on a routine basis to ensure that the built -upon
area for the subdivision and for each lot does not exceed the maximum allowed by this
permit. The permittee shall notify any lot owners who are not in compliance with the
permitted maximum BUA limit in writing and shall require timely resolution and follow-up.
3. The permittee shall review all proposed lot plans for compliance with the permitted per
lot BUA limit. Any approvals given by the permittee do not relieve the permittee or the
homeowner of the responsibility to maintain compliance with the permitted BUA limit.
The maximum permitted per lot built -upon area may not be revised without prior
approval from the Division.

4. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
5. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
6. The permittee. shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Redesign or addition to the approved amount of built -upon area.
C. Further subdivision or sale of all or part of the project area shown on the
approved plans.
d. Acquisition of adjacent or additional property or future phases under a common
development plan.
e. Changes to the grading of the site, adding pipe where none was approved, filling
in or altering any drainage conveyance shown on the approved plan.
f. Construction of any future development phases shown on the approved plans.
7. The Director may determine that other revisions to the project should require a
modification to the permit.
8. All stormwater collection and treatment systems must be located in either public rights —
of —way, dedicated common areas or recorded drainage easements. The final plats for
the project will be recorded showing all such required rights -of -way, common areas and
easements, in accordance with the approved plans.
9. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
10. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
11. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications, and
other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
12. Permanent seeding requirements for the stormwater control must follow the guidelines
established in the North Carolina Erosion and Sediment Control Planning and Design
Manual.
13. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at optimum
efficiency. The approved Operation and Maintenance Agreement must be followed in its
entirety and maintenance must occur at the scheduled intervals.
14. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DENR. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
15. The permittee shall maintain unencumbered access to all components of the approved
stormwater system at all times.

16. Prior to the sale of any lot,'the following deed restriction statements must be recorded:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 031026 Modification, as issued
by the Division of Energy, Mineral and Land Resources under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded without
the express written consent of the State of North Carolina.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division.
f. The maximum built -upon area allowed per lot is as follows:

This allotted amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front lot line
and the edge of the pavement. Built upon area includes, but is not limited to,
structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking
areas, but does not include raised, open wood decking, or the water surface of
swimming pools.
g. Lots within 401 or CAMA's Area of Environmental Concern may be subject to a
reduction in their allowable built -upon area due to 401 or CAMA regulations.
h. All runoff on the lot must drain into the permitted system. This may be
accomplished through providing roof drain gutters, which drain to the street,
grading the lot to drain toward the street, or grading perimeter swales and
directing them into the pond or street. Lots that will naturally drain into the system
are not required to provide these measures.
i. Built -upon area in excess of the permitted amount will require a permit
modification.
17. A copy of the recorded deed restrictions must be submitted to the Division within 30
days of the date of recording the plat, and prior to selling lots. The recorded copy must
contain all of the statements above, the signature of the Permittee, the deed book
number and page, and the stamp/signature of the Register of Deeds.
18. Decorative spray fountains will be allowed in the stormwater treatment system, subject
to the following criteria:
a. The fountain must draw its water from less than 2 foot below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing, may
be used only if they draw water from the surface in the deepest part of the pond.
C. The falling water from the fountain must be centered in the pond, away from the
shoreline. -
d. The maximum horsepower for the fountain's pump is based on the permanent pool
volume. The maximum pump power for a fountain in any one of these ponds is
listed in Design Standard 1.6(m) of this permit.
III. GENERAL CONDITIONS
1. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement action as set forth
in North Carolina General Statute 143, Article 21.
2. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective actions, including those actions as may be required by this
Division, such as the construction of additional or replacement stormwater management
systems.

3. This permit is not transferable to any person or entity except after notice to and approval
by the Director. The permittee shall submit a completed and signed Name/Ownership
Change Form, accompanied by the supporting documentation as listed on the form, to
the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or
more of the following events:
a. An ownership change including the sale or conveyance of the project area in whole
or in part, except in the case of an individual lot sale that is made subject to the
recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
4. The permittee is responsible for compliance with all of the terms, conditions and
limitations of this permit until such time as the Director approves the transfer request.
5. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR
personnel. The facility must be in compliance with all permit conditions. Any items not in
compliance must be repaired or replaced to design condition prior to the transfer.
Records of maintenance activities performed to date will be required.
6. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal), which have jurisdiction.
7. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and re -issuance or termination does not
stay any permit condition.
8. Permittee grants permission to staff of DENR to access the property for the purposes of
inspecting the stormwater facilities during normal business hours.
9. A copy of the approved plans and specifications shall be maintained on file by the
Permittee at all times.
10. The permittee shall submit a permit renewal application at least 180 days prior to the
expiration date of this permit, accompanied by the required documents and application
fee.

8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.

For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, Iot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
protective covenants forms can be downloaded from htti2://12ortal.ncdenr.org/web/Ir/state-stormwater-
forms dots. Download the latest versions for each submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.

protective covenants for this project, if required, shall include all the items required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming

Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition-
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs widlin
2 to 5'days as designed.
2. Repair eroded- auras immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed..
3. Inspect and repair the collection system (i.e. catch basins, piping, swaies, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (Le.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated -sediments. p

(N.C. Department of Environment, Health and Natural Resources, Febiruary 1999) and Administrative Code
Section: 15 A NCAC 2H .1008:

docunnentation is attached. If the applicant has designated an agent in the Stormwater Management Permit

Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment amumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded- areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed..
3. inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (Le.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated -sediments.
When the permanent pool depth reads 3- 75 feet in the main pond, the sediment shall be removed.

The wet detention basin system is defined as the wet detention basin, pretreatment .including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool accm within
2 to 5 -days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative coves, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed..
3. Inspect and repair the collection system (i.e. catch basins, piping, s-vales, riprap, etc.) quarterly to maintain
proper firactioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth, is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (ie.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated -sediments.
When the permanent pool depth reads 3 .r%S feet in the main pond, the sediment shall be removed.
When the pennanent pool depth reads 3.75 feet in the forebay, the sediment shall be removed.

NARRATIVE
DESCRIPTION:
The project site is a 261 acre tract located in Brunswick County. The soils of the
site consist of partially wooded and clayey — sandy soils and grades ranging from 0% to
5%. Approximately 15 acres will be graded to allow construction of a Amenity Center and
Phase 11 Single Family Expansion with paved parking and paved access. The runoff from
the site is estimated using the rational method 10-year design storm and rainfall data for
the area. Construction is scheduled to begin as soon as all permits and approvals are
obtained.
EROSION CONTROL MEASURES:
The attached plans and specifications outline the requirements for erosion control
measures. Silt fencing will be provided where stormwater would be expected to sheet
flow from disturbed areas directly to adjacent property. Gravel check dams will not be
provided unless the Contractor has to temporarily discharge into an open ditch instead of
the proposed storm drain outfall. The detention pond will be used as a silt basin during
construction and restored to its design contours prior to completion. A gravel construction
entrance will be constructed at the new Oglethorpe Drive entrance. Maintenance will be
provided by the grading contractor and developer.
STORMWATER MANAGEMENT MEASURES. -
The project site is located in .Brunswick County. Land disturbing on the site will
exceed one acre, which requires the site to comply with the State and Brunswick County
Regulations. The stormwater runoff from the development will be directed to the
previously permitted stormwater detention pond. The stormwater detention pond was
designed to accommodate this site at 36.65% impervious area lot coverage.
CONSTRUCTION SEQUENCE:
The Contractor will install the gravel construction entrance and silt fence prior to
beginning any clearing and grading operations. Additional silt fence will be installed when
and if conditions warrant during construction. The existing detention pond/silt basin will
be used for erosion control. Disturbed areas will be landscaped or seeded upon
completion.
EROSION CONTROL NOTES AND MAINTENANCE PLAN
1. All erosion and sediment control measures will be checked for stability and
operation following every runoff -producing rainfall, but in no case, less than once
every week and within 24 hours of every half -inch rainfall.
2. All points of egress will have construction entrances that will be periodically top -
dressed with an additional. 2 inches of #4 stone to maintain proper depth. They
will be maintained in a condition to prevent mud or sediment from leaving the
site. Immediately remove objectionable material spilled washed or tracked onto
the construction entrance or roadways.
3. Sediment will be removed from hardware cloth and gravel inlet protection, block
and gravel inlet protection, rock doughnut inlet protection and rock pipe inlet
protection when the designed storage capacity has been half filled with sediment.
Rock will be cleaned or replaced when the sediment pool no longer drains as
designed. Debris will be removed from the rock and hardware cloth to allow
proper drainage. Silt sacks will be emptied once a week and after every rain
event. Sediment will be removed from around beaver dams, dandy sacks and
socks once a week and after every rain event.
4. Diversion ditches will be cleaned out immediately to remove sediment or
obstructions from the flow area. The diversion ridges will also be repaired.
Swales must be temporarily stabilized within 21 calendar days of cease of any
phase of activity associated with a swale.
5. Sediment will be removed from behind the sediment fence when it becomes half
filled. The sediment fence will be repaired as necessary to maintain a barrier.
Stakes must be steel. Stake spacing will be 6 feet max. with the use of extra
strength fabric, without wire backing. Stake spacing will be 8 feet max. when
standard strength fabric and wire backing are used. If rock filters are designed at
low points in the sediment fence, the rock will be repaired or replaced if it
becomes half -full of sediment, no longer drains as designed or is damaged.
6. Sediment .will be removed from the sediment basin when the design storage
capacity has been half filled with sediment. Rock will be cleaned or replaced
when the sediment pool no longer drains or if the rock is dislodged.
Land Quality Requires:
7. All seeded areas will be fertilized, reseeded as necessary and mulched
according to specifications in the vegetative plan to maintain a vigorous, dense
vegetative cover. All slopes will be stabilized within 21 calendar days. All other
areas will be stabilized within 15 working days.
Water Quality Requires:
8. All seeded areas will be fertilized, reseeded as necessary and mulched
according to specifications in the vegetative plan to maintain a vigorous, dense
vegetative cover. All perimeter dikes, swales, ditches, perimeter slopes, all
slopes steeper than 3' horizontal to 1' vertical (3:1) and all high quality water
(HQW) zones shall be provided temporary or permanent stabilization with ground
cover as soon as practicable but in any event within seven (7) calendar days
from the last land -disturbing activity. All other disturbed areas shall be provided
temporary or permanent stabilization with ground cover as soon as practicable
but in any event within fourteen (14) calendar days from the last land -disturbing
activity.
9. Flocculants will be used to address turbidity issues. The pumps, tanks, hoses
and inject systems will be checked for problems or turbid discharges daily.
10. Refer to new NPDES rules regarding basin outlet structures and skimmers shall
withdraw water from the surface.
SECTION 02920
SOIL EROSION AND SEDIMENTATION CONTROL
1. GENERAL
1.1 Contractor shall take every reasonable precaution throughout construction to
prevent the erosion of soil and the sedimentation of streams, lakes, reservoirs,
other water impoundments, ground surfaces, or other property as required by State
and Local regulations.
1.2 The Contractor shall install all required silt fences, and construction entrances at
the initiation of work, and have these measures reviewed and approved by the local
permit authority prior to clearing and grading operations.
1.3 The Contractor shall, within 21 days of suspension or completion of land disturbing
activities, provide permanent protective covering for disturbed areas. Temporary
and permanent erosion control measures shall be coordinated to assure
economical, effective, and continuous erosion and siltation control throughout the
construction and post -construction period. Use the specified seed for both
temporary and permanent seeding.
2. PRODUCTS
2.1 Asphalt for anchoring mulch shall be Type SS-1 Emulsion.
2.2 Fertilizer shall be 10-10-10 grade or equivalent.
2.3 Lime shall be dolomitic agricultural ground limestone containing not less than 10
percent magnesium oxide.
2.4 Mulch shall be small grain straw, hay, wood chips, asphalt emulsion, jute or other
suitable material free of undesirable weed seed.
2.5 Phosphate shall be 20 percent superphosphate or equivalent.
2.6 Seed shall be 20% carpet grass, 24% Bermuda, 20% turf Fescue, 10% Creeping
Red Fescue, and 24% Annual Rye grain. Bermuda seed shall be hulled for warm
weather planting and unhulled for cool weather planting. Purity of seed shall be a
minimum of 98 percent and germination shall be a minimum of 85 percent.
2.7 Silt fence shall consist of NCDOT Class A fabric supported by metal posts spaced
not more'than 6 feet on center. The bottom of the fabric shall be buried a minimum
of 6 inches.
2.8 Gravel for check dams shall be #57 washed stone.
2.9 Aggregate for construction entrance shall be #4 washed stone.
2.10 Stone rip rap for check dams and erosion control shall be NCDOT Class A or B as
shown.
3. EXECUTION
3.1 - General: Take every practicable measure during construction or suspension to
work to minimize erosion and siltation. Measures should include good construction
practices, temporary physical barriers to sediment travel, settling basins for new
ditches, and establishment of vegetative cover.
3.2 Construction Practices
3.2.1 Avoid dumping soil or sediment into any wetland or watercourse.
3.2.2 Maintain an undisturbed vegetative buffer where possible between a natural
watercourse and trenching and grading operations.
3.2.3 Avoid equipment crossings of streams, creeks, and ditches where practicable.
3.2.4 Grade all cut, fill and ditch slopes to minimum slope of 3:1, unless otherwise shown
or directed.
3.3 Temporary Physical Barriers are required where sedimentation on offsite property
or excessive erosion is a problem.
3.3.1 Mulch shall be used for temporary stabilization of areas subject to excessive
erosion and for protection of seedbeds after planting where required.
1. Apply grain straw and hay at a rate of 75 to 100 pounds per 1,000 square feet
and wood chips at a rate of 500 pounds per 1,000 square feet. Jute and mesh
should be installed as per manufacturer's instructions.
2. Asphalt emulsion for slope stabilization should be applied at a rate of 1,000
gallons per acre. Asphalt emulsion used for anchoring straw should be applied
at a rate of 150 gallons per ton of straw.
3.3.2 Silt Fences shall be used at the base of slopes to restrict movement of sediment
from the site. Clean silt fence of accumulated sediment after each rainfall event
or when it exceeds a depth of 0.5 feet above natural grade.
3.3.3 Stone Check Dams, placed at the discharges of creeks, ditches, and swales, shall
consist of Class A or Class B erosion control stone at minimum two feet high and
three feet thick across the watercourse, with a one foot thick layer of gravel on
upstream side. Remove sediment if accumulated to a depth of 1.0 feet at upstream
face.
3.4 Vegetative Cover: Establish and maintain permanent vegetative cover on all
unpaved areas disturbed by the work.
3.4.1 Preparation of Seedbed: Areas to be seeded shall be scarified to a depth of 4
inches and until a firm, well pulverized, uniform seedbed is prepared. Lime,
phosphorous and fertilizer shall be applied during the scarification process in
accordance with the following rates:
Lime: 45 pounds per 1000 square feet
Phosphorous: 20 pounds per 1,000 square feet
Fertilizer: 17 pounds per 1000 square feet
3.4.2 Seeding: Disturbed areas shall be seeded with 2 to 3 pounds per 1000 square feet
of the specified seed mixture. Seed shall be worked into the bed to a depth of 114
inch. Regrade and seed eroded areas immediately
3.4.3 Mulch all areas immediately after seeding. Mulch shall be applied and anchored as
specified hereinbefore. Reapply as necessary to retain cover until grass is
established.
3.5 Construction Entrance: Provide an aggregate drive, 20 feet wide by 50 feet long by
6 inches thick at each entrance to the site used by construction vehicles, until such
time as the permanent roadway is constructed. Remove soil if accumulated to a
depth greater than 0.5 inches.
3.6 Maintenance: The Owner and Contractor shall be responsible for maintaining all
temporary and permanent erosion control measures. Temporary structures shall
be maintained until such time as vegetation is firmly established in the area
protected by the structure. Permanent streambank protection and grassed areas
shall be maintained until completion of the project. Areas that fail to show a
suitable stand of grass or which are damaged by erosion shall be immediately
repaired.

The enclosed response package was amassed based on the numerous emails between Norris
& Tunstall Consulting Engineers and you on or around March 11, 2015. We have been waiting
for an updated Master Plan to be prepared and provided by the original engineer of record,
Houston & Associates. The bulk of the enclosed package was gleaned by NCDENR file review
and has been concisely consolidated at your request. We offer the following responses to the
items below:
1. Provide an update Master Plan.
The updated Master Plan was provided to N&T by Houston & Associates. N&T has added
additional information as requested.
2. Provide an updated drainage area plan.
A color coded drainage area plan has been overlaid on to the aforementioned master
plan.
3. Update N&T drawings to reflect updated lot numbering found in updated Master
Plan.
All N&T plans have been updated.

4. Due to the removal of a portion of the previously planned Oglethorpe Drive and the
subsequent addition of lots in the proximity of Oglethorpe Drive, it is necessary to
review ponds #1, #2, and #4 to verify that modification does not result in an
increase in permitted BUA. If any results in a BUA increase then N&T will provide
updated pond calculations.
There is no increase in BUA to pond #1 all existing and permitted lots shall be routed and
drain to pond #1 as previously planned. There is a net decrease in pond #2 due to the
removal of previously permitted roadway and its replacement with one new lot (#1004)
with a BUA allotment of 5000 SF. Any excess BUA has been inventoried in the future
category resulting in no change to the total BUA of pond #2. The addition of lots in pond
#4 drainage area reduce the previously permitted future multifamily allocation. These lots
also reduce the total area of multifamily tract B. The development of the Amenity area
was previously accounted for in the future BUA allocation. The Amenity area future
allocation is being reduced from 1.70 acres to 0.65 acres for the development of a
Clubhouse/Amenities Center with pool and outdoor activity areas. Based on the
aforementioned explanations for Ponds #1, #2, and #4 no revision to the previously
approved pond calculations are necessary.
5. Clarify if the future Amenity Parking Lot is included within this modification.
Yes, the future lot is accounted for in this project modification. See N&T plans specifically
the Amenities area site data table for calculations.
6. Clarify the total number of lots within this permit.
As previously discussed, a total of 478 lots were previously permitted. These lots are
contained in both Phase I and Phase II. N&T has proposed an additional 13 new lots.
Numbered from Lot # 990 thru Lot #1002 and Lot # 1004. The resultant new total number
of lots is 491.
7. Provide Lot numbers — BUA inventory per pond drainage area.
The requested lot inventory spreadsheet has been provided i Ma requested format.

8. Verify BUA on lots that are already developed. BY.
Specifically, the large home currently under construction. In discussing, the BUA
inventory on developed lots, the builder has indicated that all permitted BUA allotments

are adhered to and each plan is reviewed by the architectural review board (ARB) for
stormwater compliance as well as additional architectural requirements. Prior to
development of each house, a site plan is required and is reviewed by the ARB. The
large home site went through the same review process. The owner has purchased
multiple lots and their combined BUA allocation ensure that the development remains
under the permitted BUA threshold.
9. Clarify the remaining BUA for Pond #4.
Inventory of pond #4 has been reviewed and updated since future allocation is being
utilized for this modification. See the Master Plan with BUA inventory summary.
10. Review and revise deed restrictions to coincide with the updated Master Plan.
It is our understanding that the deed restrictions coincide with the updated Master Plan.
11. &12. Clarify Future./ Offsite Areas and HOA Ownership.
A portion of both multifamily tracts "A" and "B" were previously identified as offsite. No
allocation was provided for portions of each site. For example, Tract "A" has a total
permitted BUA of 23.37 AC of which only 2.805 AC is to be routed to Pond #4 of the
existing system. The remaining BUA is to be treated offsite. Currently, it is our
understanding that all Common Areas, Amenity Areas, BMPs, Streets, and Etc. will be
turned over to and maintained by the POA. The structuring of future development areas
and their associated POAs is currently undecided since the multifamily component of this
development is not performing as well as the single family components. Thus the
developers are considering converting previously identified multifamily areas to single
family. If this were to occur then that would be an expansion to the current POA structure.
13. Provide pertinent modification information.
An updated permit modification application with fee is provided for your use. A lot
inventory and Master Plan with BUA inventory are provided for your use. Drainage area
inventory tables have been provided with the application to make revisions/modifications
of this permit easier in the future where by the tables may be switched out without the
need to rewrite the entire permit each time.
14. Verify /update owner address. APR 0 1 2015
The owner's address has been updated on the permit application. BY., —

Linda, you have all the deed restrictions for current permit prior to our small modification. The pervious master plan that we used to
develop our current master plan (dated 1013/07) had duplicate lot #s listed in several locations which generated comments from
NCDENR regarding duplicate lots listed. During my file review I copied an overall sheet with an approval stamp dated 2/13108. The lot
numbering on this sheet matches the deed restrictions you have. indicated that you have in your possession.
I will update our updated master plan to reflect these correct lots numbers. The lot numbers for the new lots will change but everything
else is matching up. I will send you updated information on anything that pertains to the incorrect lot numbers. Sorry for the confusion
Mason, I will get with you to give you the corrected lot numbers for the new lots.

Thank you for that explanation. I am aware that we will only have copies of the recorded documents for those lots that
are in the phases which are currently under construction.
What 1 am trying to say, and apparently not very well, is that in the stormwater file, I can only locate a signed
PROPOPSED covenant document for the following permit versions:
The January 6, 2004 permit covered 113 lots in Section 1, 2 and 5 at 8000 sf; and 415 lots in Section 3 & 4 at
5000 sf.
2. The February 13, 2008 permit covered 478 lots — lots 441-569 at 7500 sf; and lots 822-1170 at 5000 sf. Since this
permit version replaced the January 6, 2004 version, the document provided for the 2004 version is null and
void.
There is no proposed document which includes BUA limits for Lots 1L-45L; 82L-125L; 1-91; or 143-232. Some of these
lots may have been covered by the 2004 proposed restrictions under different lot numbers, but if those lot numbers no
longer match up with the new plan, that's a problem. The only valid deed restriction document in force right now only
covers lots 441-569 and Lots 822-1170. That old document is no longer valid and needs to be revised to include the lots
that were renumbered and the new lots such that it matches up with the lot numbers on the master plan.
I think I understand more of what you were trying to convey to me from the beginning, which is that there is a recorded
restriction already in place for Lots 822-1170 at 5,000 sf. So the 13 lots that were added as 991-1002 and 1004 would
already be subject to that same restriction, and did not need to have another piece of paper signed to restrict them to
what was already recorded. I agree with that, but what I am trying to get is a proposed BUA limit statement which
includes all of the lots, including Lots 1L-45L; 82L-125L; 1-91; and 143-232.

Of course They do not have the restrictive,covenant for the entire subdivision
the entire subdivision has not been developed and those maps have not been recorded
I have sent to them the sections as they were brought in with supplemental declaration. Those supplemental declaration include the
required restrictions of impervious area and the language that was required at the time those maps were recorded and those lots
offered for sale
All of the lots that were in existence when you started this work were covered in Supplemental recorded restrictive covenant that
includes the imperious coverage restriction that applies to each lot in each section
Hence the lots created with the new work are the only ones to be subjected to the new restrictive covenants at this time The other
developed lots are already subjected to restrictive covenant with the imperious coverage restriction in the supplemental declaration
I am having Chris prepare the supplemental declaration to include these current lots at this time
once they have been recorded I will send to Linda a copy of them
at that point she will have supplemental declarations covering all of the lot being offered for sale
Give me a call if you have any questions or if you need any additional explanation for Linda
In the meantime
as I say Chris has instructions from me to prepare a supplemental declaration covering the lots using the exact language to be included
in the permit
Also I am having restrictive covenant the Supplemental Declaration for the lots added at Smithfield and they will also be recorded
and mailed to Linda

Hey Jody. I received the proposed new deed restriction statement. I think there may have been a miscommunication or
misunderstanding. My intent was that all of the lots as listed on the Master Plan (see highlighted text from my August 4
email below) , would be listed on the new deed restriction statement, not just 991-1002.
The document should also list lots 1L — 45L; 82L —125L; 1-91, and 143-232 in addition to Lots 441-480; 822-969; and
991-1002 and 1004.
The 2008 restrictions only listed 441-569 and 822-1170. No mention of the others. That's why I needed a new document
with'ALL of the lots listed.

You must have ESP — I'm working on it now. I do have one question about the Amenity Center BUA, What I'm trying to
accomplish is to "group" all the BUA associated with the Amenity Center together and assign it a maximum BUA limit in
the permit. So far, based on the information you provided earlier, this is what I come up with:
a. The total BUA for the Amenity Tract is 74,000 sf. That is the number I want to put on the application and into the
permit. It will be further broken down into "existing" and "future" as follows in the permit
b. Of that total, 45,690 sf is already built. This 45690 "existing" is broken down as below:

c. This leaves 28,310 future.

Attached is an updated inventory sheet for DA #s 1-4. Below is my explanation of how I determined a few of the values contained
within..... I know its confusing as it was an arduous task for me to go back through the old permit & plans to determine these
allocations.
DA#1: yes you are correct MF tract B to DA #1 / Pond #1 should be reduced to match future inventory of 27,233
DA #4: This on was a bit complicated but I will try to walk you through what I found during our review of the original permit & plans....
The original total BUA allocation was found listed on Houston & Associates Overall Storm Water Plan as 1.70 AC. I extended
this to be approximately 74,000sf
On sheet C2 of N&T plans we have a Amenities "Area Site Data Table". It lists a current total proposed development of
45,690sf. (This total includes the dashed side lot which will be constructed at a later date)
o So the remaining Future BUA for the Amenity Center Area is ,... 74,000sf — 45,690sf = 28,310sf. This maybe utilized
for some future development on the Amenity site to the East of the Club/ Pool House in the proximity of the notes on
N&T Sheet C2
The TOTAL FUTURE INVENTORY for DA #4 is 147,495sf. Based on knowing this TOTAL & the remaining Amenity BUA that
leaves MF tract A with 147,495sf — 28,310sf = 119,185sf
I have corrected the values for MF Tract A (to Pond 4) & MF Tract B (to Pond 1) on the attached sheet. I will be dropping off 2 new
color coded Master Plan sheets to you tomorrow. I had to update the MF Tract A (to Pond 4) value to the previously stated 119,185sf.
Further explaining the DA #4 inventory.... The values for the impervious surfaces for our proposed Amenity area development are
included in the DA #4 Inventory Totals...
i.e. DA #4 Bldgs/ Lots =»» LOTS = 852,000sf

I've attached my marked up page. it's a bit convoluted, but I think I understand everything except the Amenity Area and
the 27233 sf vs the 29233 sf future for Pond #1. 1 just want verification that the 27233 amount in the DA column is the
amount that should be referenced at the bottom of the page.
Regarding the Amenity Area, it would be easier to approve future construction within the Amenity Area if it is assigned a
maximum amount of BUA in the permit. Then we just start approving subsequent plan revisions and subtract from the
"bank balance". I read somewhere in the documents that the sidewalk and parking area totals within the Amenity Area
had been included in the sidewalk and parking totals for the Pond, and were not split out. I'd like to know those splits.
Those are my 2 main concerns.

As previously discussed, the intent of this revision/modification is not to change any permitted
allocations but to utilize the current permitted future allocation for new development. Norris &
Tunstall received comments on May 14, 2015 and offer the following responses:
1. The adjustment is noted and we have updated our records
2. Delineate all relevant boundaries...
a. Application pages for the project inventory have been updated to reflect that Offsite
Area "E" will remain as currently permitted.
b. Update BUA summary on DA/Master Plan Sheet:
i. "Phase II Small Lots" category has been updated with the correct lot # ranges
and correct lot total.
ii. "Phase I Large Lot" category has been updated with the correct lot # range.
c. The typo was corrected for Pond #3 Drainage Area total.
d. The typo was corrected for the DA #6 "Buildings" category.
3. Technical Information
a. All references to 491 lots have been updated to 492 lots.
b. The "Lot BUA Inventory" has been reviewed and updated based on comments and
cross referencing with previously provided inlet DA breakdown found during file review
by Linda Lewis. We offer the following responses based on information provided to
N&T pertaining to the previously approved design.
i. Lot # 1004 was added to both Ponds 1 & 2 inventories.
ii. Lot # 909 was added to Pond #5 inventory
iii. Pond #6 inventory was updated to include Lots 37,312, and 93L-122L.

*All inventories have been updated based on comments provided below and
aforementioned cross referencing of previously provided DA breakdown. All inventories
now include subtotals and totals for ease of use.
c. Pond #1 inventory has been reviewed and corrected.
d. Pond #2 inventory has been updated to include Lot #1004. There is no Lot # 1005
identified within Pond/DA #2; as such there is no inventory accounting for its BUA.
e. Pond #3 inventory has been reviewed and corrected.
f. Pond #4 inventory has been reviewed and corrected. Building & Lot inventory is listed
in the notes at the bottom of the permit application basin information sheet.

4. We have notified our client that there are still two outstanding pond certifications (#1 and

These certifications will be provided by others since N&T was not contracted to perform

We are packaging & sending a response package to Mr. Lewis for the above subject project. In item #4 of the attached comment letter,
she indicates a need for Designer's Certifications for Pond #1 & Pond #4. These items were originally requested in a NOI-notice of
inspection letter dated January 27, 2014. These items should have been provided by Houston & Associates. if you wish N&T to perform
these certifications then we will need survey & outlet structure information for each pond so we may compare as -built results with the
original design drawings. Please be aware that Mrs. Lewis cannot issue the NCDENR permit update without the items of the NOI being

Dear Mr. Anderson:
The Wilmington Regional Office received previously requested information regarding the
modified State Stormwater Management Permit Application for The Hamptons at Brunswick
Plantation on April 1, 2015..A preliminary in-depth review of that information has determined
that the application is not complete. The following information is needed to continue the
stormwater review:
The name of the receiving stream is Cawcaw Swamp. The schedule of classifications
has no stream identified as Caw Caw Canal. I've made that adjustment on the
application.
2. 02H. 1 003(g)(5) and 02H.1005(d) - Delineate all relevant boundaries including drainage
areas, SHWT, coastal wetlands, property/project boundaries and drainage easements.
Coastal wetlands above the mean high waterline must be excluded from the project
area prior to calculating density. The revised drainage area map appears to contain a
few errors:
a. Drainage Area "E" was previously approved as "offsite" drainage to Pond #4. This
latest map suggests that it is now part of DA 1. Is that correct? If so, you will need to
provide revised pond calculations for DA 1 and adjust the application information for
DA 1. If Offsite Area "E" will remain offsite to Pond #4, then please update the
application form to list the offsite drainage area as 236,967 sf'(5.44 acres) and revise
the onsite drainage area back to 3,793,079 sf.
b. The summary of the proposed built -upon area on the DA I Master plan needs to be
corrected:
i. Several lot numbers are missing within the "Phase 2 Small tots" category. Based
on the DA map, the lots in this category should be 1-91, 143-232, and 970-990
for a total of 202 lots.
ii. The lots in the "Phase 1 Large Lots" category should be 441-480. The summary
currently shows Lots 444-480.
c. The previously approved drainage area for Pond #3 was 1,759,223 sf, but this
modification proposes 1,175,223 sf. This appears to be a typo based on the fact that
the percent impervious remained the same despite the apparent loss of 584,000 sf of
drainage area.
d. The "Buildings" total fisted on the application for DA 6 is only 82,501 sf. This also
appears to be a typo based on the fact that there are quite a number of lots in DA 6
and the previous permit allowed 829,501 sf for buildings.

3. 02H. 1 003(g)(7) — Provide technical information showing final numbers, calculations,
assumptions, drawings and procedures associated with the stormwater management
measures including but not limited to: Built -upon area, runoff coefficients, runoff volume,
runoff depth, flow routing, inlet and outlet configuration (if applicable), and other
applicable information as specified.
a. It appears that there are 492 lots now, not 491. Please revise and resubmit any
documents that refer to 491 lots.
b. The "Lot BUA Inventory" for each pond is missing a few lots. Please assure that the
BUA listed on the application includes the missing lots:
i. Pond #1 and Pond #2 are missing Lot 1004.
ii. Pond #5 is missing Lot 909.
iii. Pond #6 is missing Lot 37, Lot 31 L and Lots 93L-122L.
iv. There are 2 inventories labeled for Pond #1, but the lot numbers for the last
listing appear to be for Pond #8. Although Lot 37 has been accounted for in DA
8, the DA map says Lot 37 is located DA 6.
c. The Lot BUA Inventory for Pond #1 (without the missing Lot 1004) adds up to
359,000 sf, but the application only lists 358,000 sf.
d. The Lot BUA Inventory for Pond #2 (without the missing Lot 1004) adds up to
146,000 sf, but the application lists 150,000 sf. Will 4,000 sf of Lot 1005 be
accounted for in Pond #2?

I don't know without going through it all again and right now, I'm a little pressed for time. I'd just review all the previous
emails and make sure everything's been addressed. In skimming those emails, there are issues with:
1. Drainage area
2. Lot numbering

5. Future areas that are really offsite areas
6. Whether subsequent changes should be permitted as offsites or approved as plan revisions. if the HOA will

understand that this is a tough file to review & we are cleaning it up. I have compiled a list of "items of need based" on several emailed
sets comments below. Please review my synopsis and add anything I may have missed.

+ Revise N&T drawings & DA map to reflect updated lot numbering from above
• Review & Revise Deed restrictions as needed to coincide with updated Master Plan

Thank Jody. I drove out there last week to inspect. The pond slopes look OK. I didn't see the outlet structures.
I saw that MONSTER house off Balfour Drive almost finished. WOW! That probably took up at least 3 lots — you might

maximum per lot multiplied by however many lots they own.

Thanks for being so understanding. It seems like every time I look at this plan, I see something new that I didn't see
before.
I think you are adding a total of 14 new lots. I just noticed Lot #1004 is situated between Lots 844 and 894 in the Pond
#2 drainage area and takes the place of the previously permitted Fordham Road that is being removed as part of this
plan revision. So for Pond #2, you're removing some road, adding a new lot, and adding sidewalk. Please breakdown the
lot BUA, road BUA and sidewalk BUA totals for Pond #2 and if there is a net increase in BUA as a result of these changes,
you will need to evaluate Pond #2 as part of this plan revision.
Regarding the master plan and lot numbers, I've got an approved phase map in the file with different lot numbers. The
lots numbered as 1-20 on the DA map are numbered 989-970 on the phase map. You've started your numbering from
the lot across from the amenity center (i.e., Lot #1 on the DA map) as #970, but the phase map shows lot #989 as the lot
across from the Amenity Center (i.e., Lot #1 on the DA map). You've just reversed the numbering, but you skipped over
Lot #988. Is there a reason why Lot #988 was skipped? If there is no lot 988, then the deed restrictions will need to be
amended to eliminate reference to 988 and the lot count in the permit will need to be adjusted. If lot 988 has not been
created elsewhere, may I suggest that you renumber your lots to include 988?
This permit currently covers a maximum of 478 lots. Lot numbers 992-1004 are currently permitted along North Balfour
Drive within the Pond #6 drainage area. By duplicating these same numbers for the 12 new lots on the east side of
Oglethorpe in the Pond #4 drainage area, you are introducing an element of confusion that can only be resolved by an
updated lot number and drainage area map. If the number of lots in DA #6 is to remain as currently permitted, then this
permit will have to be modified to add all the new lots (total of 14) .
If I have to add 14 lots to the permit, then I believe this plus all the other changes requires a modification rather than a
plan revision. Although you are using future allocation to cover the BUA being assigned to the new lots that drain to
Pond #1 and #4, this revision will also affect Pond #2 and will have to be evaluated. Please provide a signed permit
application, $505 fee, revised pond calculations for Ponds 1 & 2, revised pond supplements where necessary, a revised
DA map and a revised lot number map. Please note that Pond 1 has a future BUA allocation which you may draw from
to cover any added BUA, but Pond 2 has no future allocation. Any net increase of BUA will require new calculations to
demonstrate that Pond 2 is adequately sized.

the owner will have to request a CAD file from the original engineering firm. We will provide the requested updated Master

A couple of additional observations regarding this plan revision:
It appears that the lot numbering has been changed. In order to keep up with the total number of lots and which
lots drain to what pond, please provide a revised overall, subdivision plat with the correct lot numbers shown. I'd
like to add a chart to the permit that lists the lots by number within each pond drainage area with their max.
permitted BUA limit and the BUA split between different drainage areas. I'm using the current approved DA map
to count up the lots. For example. Lot 93 is limited to a maximum BUA of 7500, of which 4,000 drains to Pond #4
and 3500 drains to Pond #6. It has been my experience that where an undeveloped lot could drain to 2 different
drainage areas, depending on how it's graded and where the driveway is located, it's safest to double -count the
BUA in both drainage areas. Lots that straddle 2 drainage areas need additional review by the developer to
assure that the correct BUA split amounts have been directed to the correct pond. If the lot BUA has been
double -counted, the developer doesn't have to worry about an accurate split, since it doesn't matter.
2. As previously requested, you will need to provide a new drainage area map which clearly shows the Amenity
Center and the 13 new lots within the drainage area of Pond #4. You can report the new lot numbers on the
revised drainage area map, if you prefer.
3. In going through the file, it appears that the original intent of the permittee was to require the Amenity Center
and the Multi -family tracts to obtain a separate offsite permit when they developed instead of a plan revision.
It's important to consider utilizing offsite permits for those buildings or projects whose ownership will be
retained by the developer after the master permit is transferred to the HOA. By continuing to permit via plan
revisions, the developer may need to back out certain parts of the project in the future and get an offsite permit
before transferring the master permit to the HOA.
4. 1 apologize if I have already asked you this question, but does the 45690 sf BUA allocation for the Amenity
Center cover the future parking lot shown on the proposed plans? Can you provide a breakdown?
5. This last revision will add a total of 13 new lots. You've taken the existing permitted 20 lots (1-20 originally) on
the west side of Oglethorpe Drive and created 21 lots (970-991 now). Those 20 lots were assigned a maximum
BUA of 5000 sf in the original permit, but only 2000 sf for each lot was accounted for in the total 789,000 sf lot
BUA for Pond #4. The remaining 3,000 sf was accounted for in Pond #1. Will the added lot also direct 2000 sf to
Pond #4 and 3000 sf to Pond #1? If so, then Pond #1 will need to be evaluated as part of this plan revision for
this change. Pond #1 is currently permitted with a future BUA allocation of 29, 233 sf. All of the runoff from the
5,000 sf assigned to the 12 new lots added to the east side of Olgethorpe will drain to Pond #4.

A couple of additional observations regarding this plan revision:
1. It appears that the lot numbering has been changed. In order to keep up with the total number of lots and which
lots drain to what pond, please provide a revised overall subdivision plat with the correct lot numbers shown. I'd
like to add a chart to the permit that lists the lots by number within each pond drainage area with their max.
permitted BUA limit and the BUA split between different drainage areas. I'm using the current approved DA map
to count up the lots. For example. Lot 93 is limited to a maximum BUA of 7500, of which 4,000 drains to Pond #4
and 3500 drains to Pond #6. It has been my experience that where an undeveloped lot could drain to 2 different
drainage areas, depending on how it's graded and where the driveway is located, it's safest to double -count the
BUA in both drainage areas. Lots that straddle 2 drainage areas need additional review by the developer to
assure that the correct BUA split amounts have been directed to the correct pond. If the lot BUA has been
double -counted, the developer doesn't have to worry about an accurate split, since it doesn't matter.
2. As previously requested, you will need to provide a new drainage area map which clearly shows the Amenity
Center and the 13 new lots within the drainage area of Pond #4. You can report the new lot numbers on the
revised drainage area map, if you prefer.
3. In going through the file, it appears that the original intent of the permittee was to require the Amenity Center
and the Multi -family tracts to obtain a separate offsite permit when they developed instead of a plan revision.
It's important to consider utilizing offsite permits for those buildings or projects whose ownership will be
retained by the developer after the master permit is transferred to the HOA. By continuing to permit via plan
revisions, the developer may need to back out certain parts of the project in the future and get an offsite permit
before transferring the master permit to the HOA.
4. 1 apologize if I have already asked you this question, but does the 45690 sf BUA allocation for the Amenity
Center cover the future parking lot shown on the proposed plans? Can you provide a breakdown?
5. This last revision will add a total of 13 new lots. You've taken the existing permitted 20 lots (1-20 originally) on
the west side of Oglethorpe Drive and created 21 lots (970-991 now). Those 20 lots were assigned a maximum
BUA of 5000 sf in the original permit, but only 2000 sf for each lot was accounted for in the total 789,000 sf lot
BUA for Pond #4. The remaining 3,000 sf was accounted for in Pond #1. Will the added lot also direct 2000 sf to
Pond #4 and 3000 sf to Pond #1? If so, then Pond #1 will need to be evaluated as part of this plan revision for
this change. Pond 91 is currently permitted with a future BUA allocation of 29, 233 sf. All of the runoff from the
5,000 sf assigned to the 12 new lots added to the east side of Olgethorpe will drain to Pond #4.

Hey Jody. I'm going through the permit and the drainage areas and I have more information, but I am more confused
now. I think part of my confusion is that there is no Multi -family Tract "A" shown on the approved DA map. There are
only Tracts B, C and E. Although the application indicates a 6,3309 acre BUA allocation for MF Tract "A", there is no
correlating Tract A on the DA map. I think MF area "A" must be located within Tract "B" on the DA map.
The calculations for Pond 4 contain a list of the total area and the total impervious area for each Basin I.D. number 400-
450 that correlates to the approved DA map. In that list is included a total DA (9,0441 acres) and a total BUA for Tract
"B" (6.3309 acres). The Amenity Area you want to add is located in Tract "B". As further explanation, please note that
the Pond 4 calculations include a total DA area for Tract B of 9.0441 acres which is 20% of the 45.226 acres that
comprises Tract B.
The 9.5359 acres listed on the application for Pond 4 as future is not exactly all future development. This number
includes 3.2050 acres of BUA associated with Tract E which was accounted for as offsite (from the backs of existing lots
in the developed Brunswick Plantation). That 3.2050 number represents the actual impervious area associated with
Tract E that is draining to Pond 4 and is not a "future" allocation that can be given away to another development. It
would have been much clearer if the total tract area of 5.4428 acres for Tract E had been listed on the application as
offsite rather than future. So as near as I can tell from all this research is that what us available as true future
development in Pond 4 is 6.3309 acres and that it is located in a 9.0441 acre piece of Tract B.
For your application then, the total drainage area within Tract B that drains to Pond 4 cannot exceed 9.0441 acres. What
is the project area acreage associated with the Amenity Center and the 12 lots?
The maximum future BUA allocation you have to work with is 275,774 sf. Accounting for the 60,000 sf for the 12 new
lots and the 45,690 sf for the Amenity Center, that leaves 170,084 sf for additional future BUA in the 9.0441 acre area of
Tract B draining to Pond 4. Agreed?
The 2008 approved plans only accounted for 20 lots along the south side of Oglethorpe Drive, numbered 1-20. Your new
plans show that there will now be 21 lots (970-991) in that same space, so you should probably account for 13 new lots
at 5000 sf instead of 12??

1. Please provide a detailed narrative of the proposed changes. The summarized

the plan revision application is just not enough information to be able to determine the

of the proposed changes or to approve them.
2. It appears that BUA limits will need to be revised. However, no detailed
information regarding
those BUA allocation changes was provided with the application and no revised deed
restriction
statement reflecting these changes was submitted.
3. How many new lots are being added?
4. Is the BUA for the Amenity Area, the Phase II roads and lots and the added lots,
being taken
from the future BUA allocations or switched out from the multi --family allocation?
Currently only
Ponds 1, 3 and 4 have future allocations. You will need to document where the BUA was
switched out and/or how much future BUA allocation you are using up for these proposed
changes and additions.
Please be prepared to submit a permit modification and the applicable $505.00 fee if
it's determined
that this is beyond the scope of a plan revision. The application did not provide an
email address for
Mason Anderson, so please be so kind as to forward this email to him.

When we were contracted to provide design for this project we reviewed NCDENR files & made copies of plans & permit
information. Permit information that I reference in the project description below is from permit modification SW8 031026
found in the file dated 2-13-08. The corresponding plans were developed by Houston & Associates and were stamped as
received 10-3-07 & 2-8-08.
The proposed revision is as follows:
The Amenity Area & Multi -Family Tract A are both permitted to Pond #4.
o Amenity Area and Future MF are identified in overall permit heading as having a total impervious allocation
of 1,039,607sf/ 23.866Ac.
■ Pond #4 has a listed future allocation of 415,383sf/ 9.5359Ac. New Lots 992-1000 will reduce this
allocation by 60,000sf/ 1.377Ac (12lots x 5000sf/ tot). The Amenity area will further reduce this
allocation by 45,690sf/ 1.049Ac. The updated Future allotment will be 309,693sf/ 7.11Ac.
Construction of Oglethorpe Dr. was identified on plans as part of Phase 2 and is adjacent to both Amenity area and
Multi -family Tract A. It is accounted for in the Streets inventory line for Pond #4. (1 totaled all Street inventory lines
which = 16.66Ac which matches street inventory on plan sheet 1 of 1 stamped received on 2-8-08.)
o Previously planned lots along Oglethorpe Dr. adjacent to Ph1 stormwater pond 1 wiil drain to system as
previously designed and are inventoried in the Lots inventory line for Pond #1.
New lots along the North side of Oglethorpe Dr. will be cut out of Future Multi -Family Tract A & will utilize a small
portion of impervious allocation tipped for Multi -Family Tract A. This new section of lots will be numbered 970-1003.
Current permitted deed restrictions indicate that lots numbered 822-1170 have a 5000sf allotment:
o No modification to Deed Restriction is proposed.

I am reviewing the plan revision application for the subject project that the Division received and accepted on
September 29, 2014. 1 have the following comments:
1. Please provide a detailed narrative of the proposed changes. The summarized information on the plan revision
application is just not enough information to be able to determine the extent of the propose_ d changes or to
approve them.
2. It appears that BUA limits will need to be revised. However, no detailed information regarding those BUA
allocation changes was provided with the application and no revised deed restriction statement reflecting these
changes was submitted.
3. How many new lots are being added?
4. Is the BUA for the Amenity Area, the Phase II roads and lots and the added lots, being taken from the future BUA
allocations or switched out from the multi -family allocation? Currently only Ponds 1, 3 and 4 have future
allocations. You will need to document where the BUA was switched out and/or how much future BUA
allocation you are using up for these proposed changes and additions.
Please be prepared to submit a permit modification and the applicable $505.00 fee if it's determined that this is beyond
the scope of a plan revision. The application did not provide an email address for Mason Anderson, so please be so kind
as to forward this email to him.
Please provide the requested information prior to December 1, 2014, in order to continue with the review of this plan
revision / modification.

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to snaking public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to carry out our day-to-day program obligations. Please read
carefully the following guidelines signing the form.:
Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment to review the files. Ai Pointments will be scheduled
between 9:00am and 3:00pm. Viewing time ends,at 4:45pm. Anyone arriving without_an
appointment may view the files to the extent that time and staff supervision is available.
You must specify files you want to review by_ facility name. The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
Cost per copy is $.05 cents. Payment may be made by cheek money order, or cash at the
reception desk Copies totaling $5.00 or more can be invoiced for our convenience.
4. TILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be. taken from
the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a
misdemeanor for which you can be fined up to $500.00. No o briefcases, large totes, etc. are
pemutted in the file review area.
S. In accordance with General Statue 25-3-5I2, a $25.00 processing fee will be charged and
collected for checks on which payment has been refused.
