This is in response to the February 7,2019 receipt of additional information requested for the ai6e reference
project and the items have been addressed as follows:
1. 15A NCAC 02H.1003(2)(a): Since this Is a Low Density Project, the proposed Outporcel #1 will also need to meet the low
density threshold. The submitted plans indicate that the total area for the proposed outparcel #1 is 41,425 square feet.
The submitted documentation indicates that the BUA allocation for the proposed Outporcel #1 is 15,000 square feet. This
would be a density of 36.2% which is above the maximum density of 30% that this area is subject to. Please reconsider
either the BUA allocation or total area of Outporcel #1 to ensure the outparcel will remain et or below the maximum 30%
density threshold and update the application package appropriately. `
Outparcel III has been increased to 50,094.89 sf allowing ISAW square feet of Impervious or 29.94% of the lot.
2. 15A NCAC 0214.1042(2)(o)(iv):
a. As discussed during the submittal meeting, the total pervious gravel area for each Dralnage Area will need to be
documented. The "On -Site Pervious Grovel" raw In the table In the narrative indicates that DA1 includes 51,275 square
feet of pervious gravel. The pervious gravel areas called out on the plans in DA1, however, only add up to 38,233 square
feet. Please confrrm the pervious gravel in each drainage area and update the application package appropriately. if the
51,275 square feet includes ALL of the pervious gravel in DA1, the total pervious gravel oreo for DA2 can simply be added
to the "On -Site Pervious Gravel" row under the DA2 column in the BUA table In the narrative.
The total pervious gravel updates are reflected In the narrative and plans to reflect DA1 with SIA46 SF and DA2 with
103,7115F.
b. The "On -site Sidewalks" row In Section IV.10 of the application indicates that the total sidewalk area for the entire
project is 3,911 square jeer. Sidewalk allocation, however, is only proposed in DA1, with a total of 1,258 square feet.
Please confirm the correct total "On -site Sidewalks" area and ensure it Is represented consistently throughout the entire
application package.
The narrative and application have been revised reflecting the correct sidewalk area proposed at 1,281 SF.

The House of Silk Flowers is a 7.96-acre tract located approximately eight miles north from the intersection
of NC 101 and US 70 in Beaufort (Attachment 1A & 1B). The initial permit was issued when chlorides testing was
conducted to determine the salinity of waters % mile from the site. It was determined the project was not subject to
the SA rules, allowing 30% coverage. The permit was issued February 15, 2001 under SW8 000523 (Attachment 2) as
a Low -Density Stormwater Project with 79,279 square feet of proposed impervious. The application attached to the
permit provides the maximum proposed impervious allowable of 84,421 square feet and states that 65,340 square
feet (1.5 acres) already existed on the tract, totaling 149,761 square feet.
The permitted tract ultimately drains to the south west, under NC 101 and eventually to an unnamed
tributary of Eastman Creek (Stream Index 21-24-1), Class SA;HQW. Robb Mairs with DWR reviewed the project
location and determined the extent of saltwater influence is within an unnamed tributary of Eastman Creek which is
within one half mile of the project (Attachment 3), but not within 575'. Existing impervious areas were located by E.
Glenn Corbett, PLS of The Cullipher Group, PA. The area of existing buildings and paved surfaces is 128,530 square
feet with an additional 38,233 square feet of gravel surfaces. These gravel areas result in an overage of allowable
impervious for the tract to remain low density. Therefore, the existing gravel will be removed, and pervious gravel
constructed per G.S. 143-217.7 (b2) to be compliant with the Low -Density permit. Built upon area allocations are
shown in the table below under 2019 Adjusted BUA Drainage Area J.
The Permitee also proposes an expansion to the north of the existing facility and this drainage area, DA 2, is
proposed as low density. The expansion will include a 100' x 240' building with dual truck wells and pervious gravel
constructed per G.S. 143-217.7 (b2). There is a connecting sidewalk located within Drainage Area 1 which is included
within the allowable impervious for the low -density drainage area, DA 1. The connecting service and parking areas
also proposed within Drainage Area 1 to access the expansion will be pervious gravel to avoid exceeded the low -
density threshold.

Erosion and Sedimentation Control Measures
The following measures are proposed for the site. if it becomes evident that additional erosion and
sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and
excavation activities within a certain area will be protected as soon as that activity is complete.
1. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or as deemed
necessary by the engineer to ensure that off -site sedimentation is controlled.

2. Seeding — All disturbed areas will be seeded within 7-14 days following const ;on in accordance w the
seeding schedule shown on the plans.
3. Stone Construction Entrance — Existing gravel and asphalt on site to take the place of a stone construction
entrance. One will only be provided if erosion becomes transporting sediment offsite becomes an issue.
4. Temporary Sediment Traps — Sediment traps will be constructed as shown on plans and serve to trap sediment
and prevent from the sediment moving off -site.
5. Temporary Diversion Ditches —Temporary diversion ditch to be installed on both the north and south sides of
wetland once tree removal is completed in the area of the proposed ditch. The ditches will temporarily
transport runoff from the site to the constructed pond. Ditches shall remain in place until storm drainage
system is constructed to the pond. Ditches to be cleaned out and filled once storm drain is in operation.
Erosion Control Specifications
1. Temporary Gravel Construction Entrance:
a. Clear the area of vegetation and grade for positive drainage.
b. Install geotextile fabric and place stone to the required dimensions.
c. Use 2" to 3" stones, free of fines.
2. Silt Fence
a. Use a synthetic filter fabric of at least 95% by weight of polyolefins or polyester, which is
certified by the manufacturer or supplier as conforming to the requirements in ASTM D 6461.
b. Posts for sediment fences should be 1.25 lb/linear foot minimum steel with a minimum length
of 5 feet and projections to facilitate fastening the fabric.
c. For reinforcement of standard strength filter fabric, use wire fence with a minimum 14 gauge
and a maximum mesh spacing of 6 inches.

1. All erosion and sediment control measures shall be checked for stability and effective operations following
every runoff producing rainfall event or at least once per week. Repairs required shall be completed
immediately to the dimension and functions indicated on the plans.
2. Sediment shall be removed from behind the sediment fencing when it becomes 0.5 feet deep at the fence.
The fence shall be replaced or repaired as necessary to maintain a barrier.
3. All seeded areas shall be fertilized, seeded and mulched within 7 days of disturbance. Disturbed areas shall
be fertilized, reseeded and mulched as necessary to establish and maintain a dense vegetative cover.

Coastal Stormwater Regulations
The North Carolina Division of Environmental Management implemented coastal stormwater regulations in
coastal counties on January 1, 1988 and most recent codified effective January 1, 2017. These regulations are detailed
in 15 NCAC 021-1.1019 Coastal Counties. These rules allow for a development to be considered under various options.
The existing permit was approved under the 1995 stormwater regulations found in title 15A NCAC 21-1.1000 and
.1005(3)(a). The expansion is submitted for approval consideration under 15A NCAC 02H.1003(2) Low Density
Development and G.S. 143-214.7(b2).

Dear Mr. Chaanine and Ms. Chaanine:
The Wilmington Regional Office received and accepted a modified Express State Stormwater
Management Permit Application for the subject project on February 4, 2020. A preliminary in-depth
review of that information has determined that the application is not complete and that additional
information is needed. To continue the review, please provide the following additional information in a
single, hard copy submittal package:
� 15A NCAC 02H.I 003(2)(a): Since this is a Low Density Project, the proposed Outparcel # l will
also need to meet the low density threshold. The submitted plans indicate that the total area for
the proposed Outparcel #1 is 41,425 square feet. The submitted documentation indicates that the
BUA allocation for the proposed Outparcel # 1 is 15,000 square feet. This would be a density of
36.2%, which is above the maximum density of 30% that this area is subject to. Please reconsider
either the BUA allocation or total area of Outparcel # l to ensure the outparcel will remain at or
below the maximum 30% density threshold and update the application package appropriately.
2. 15A NCAC 02H.1042(2)(a)(iv):
As discussed during the submittal meeting, the total pervious gravel area for each
Drainage Area will need to be documented. The "On -Site Pervious Gravel" row in the
table in the narrative indicates that DA l includes 51,275 square feet of pervious gravel.
The pervious gravel areas called out on the plans in DA 1, however, only add up to 38,233
square feet. Please confirm the pervious gravel in each drainage area and update the
application package appropriately. If the 51,275 square feet includes ALL of the pervious
gravel in DA 1, the total pervious gravel area for DA2 can simply be added to the "On -
Iz/Site Pervious Gravel" row under the DA2 column in the BUA table in the narrative.
The "On -site Sidewalks" row in Section IV.10 of the application indicates that the total
sidewalk area for the entire project is 3,911 square feet. Sidewalk allocation, however, is
only proposed in DA1, with a total of 1,258 square feet. Please confirm the correct total
"On -site Sidewalks" area and ensure it is represented consistently throughout the entire
application package.
3. Due to the relatively minor nature of these comments, the express additional information review
fee has been waived.
Please remember to confirm that any revised information is presented consistently throughout the
application documents including calculations, supplements, narrative, and plans. Please also remember to
provide two hard copies of any updated documents per 15A NCAC 02H.1042(2).
All of the requested information listed above should be received in this Office by February 14, 2020, or
the application will be returned as incomplete. If additional time is needed to submit the requested
information, please email your extension request prior to this due date to the email address provided

below with a justification and a date of when the requested information will be submitted, which shall be
no later than 5 business days past the original due date. Please remember that extension requests delay the
issuance of the finalpermit. Also, please note that only two letters requesting additional information is
allowed in the State Stormwater Program. If the information is not satisfactorily provided after the
second request, the project will be returned. if the project is returned and you wish to re -submit to the
Express Program, you will need to reschedule the project through the Express Coordinator for the next
available review date and will need to resubmit all required items at that time, including the application
fee.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

The House of Silk Flowers is a 7.96-acre tract located approximately eight miles north from the intersection
of NC 101 and US 70 in Beaufort (Attachment 1A & 113). The initial permit was issued when chlorides testing was
conducted to determine the salinity of waters Y2 mile from the site. It was determined the project was not subject to
the SA rules, allowing 30% coverage. The permit was issued February 15, 2001 under SW8 000523 (Attachment 2) as
a Low Density Stormwater Project with 79,279 square feet of proposed impervious. The application attached to the
permit provides the maximum proposed impervious allowable of 84,421 square feet and states that 65,340 square
feet (1.5 acres) already existed on the tract, totaling 149,761 square feet.
The permitted tract ultimately drains to the south west, under NC 101 and eventually to an unnamed
tributary of Eastman Creek (Stream Index 21-24-1), Class SA;HQW. Robb Mairs with DWR reviewed the project
location and determined the extent of saltwater influence is within an unnamed tributary of Eastman Creek which is
within one half mile of the project (Attachment 3). Existing impervious areas were located by E. Glenn Corbett, PLS
of The Cullipher Group, PA. The area of existing buildings and paved surfaces is 128,530 square feet with an
additional 38,233 square feet of gravel surfaces. These gravel areas result in an overage of allowable impervious for
the tract to remain low density. Therefore, the existing gravel will be removed, and pervious gravel constructed per
G.S. 143-217.7 (b2) to be compliant with the Low -Density permit. Built upon area allocations are shown in the table
below under 2019 Adjusted BUA Drainage Area 1.
The Permitee also proposes an expansion to the north of the existing facility and this drainage area, DA 2, is
proposed as low density. The expansion will include a 100' x 240' building with dual truck wells and pervious gravel
constructed per G,S. 143-217.7 (b2). There is a connecting sidewalk located within Drainage Area 1 which is included
within the allowable impervious for the low -density drainage area, DA 1. The connecting service and parking areas
also proposed within Drainage Area 1 to access the expansion will be pervious gravel to avoid exceeded the low -
density threshold.

Coastal Stormwater Regulations
The North Carolina Division of Environmental Management implemented coastal stormwater regulations in
coastal counties on January 1, 1988 and most recent codified effective January 1, 2017. These regulations are detailed
in 15 NCAC 02H.1019 Coastal Counties. These rules allow for a development to be considered under various options.
The existing permit was approved under the 199S Stormwater regulations found in title 15A NCAC 2H.1000 and
.1005(3)(a). The expansion is submitted for approval consideration under 15A NCAC 02H.1003(2) Low Density
Development and G.S. 143-214.7(b2).

I am looking through the Express request for the subject project to try and get a date scheduled and have a couple of
items that need additional clarification.
First, I am trying to understand the extent of the project subject to the SA requirements. It is clear that the existing Low
Density, while currently within % mile of SA waters, is not subject to SA requirements due to it previously being
approved as outside of SA water requirements. The extent of the proposed additional area, Drainage Area 2, subject to
SA requirements, however, is not as clear. The narrative indicates that this proposed area is outside of SA requirements,
but also indicates that the wet pond is designed for the 1-year 24-hour storm as well as provides justification for not
utilizing an infiltrating system, which are SA design requirements. Furthermore, the map showing the extent of saltwater
influence (Attachment 3) that Robb Mairs reviewed, indicates that the proposed additional area, Drainage Area 2, is
within % mile and draining to SA waters (if the point indicated on the map is the point Robb Mairs determined is the
extent of saltwater influence). Can you please clarify the applicability of the SA water requirements to the proposed
Drainage Area 2? If it is determined that the proposed Drainage Area 2 is subject to the SA requirements, please also
confirm that all of the requirements listed in 15A NCAC 02H.1019(7)(c) for discharging SCMs will be met.
Additionally, I noticed that the proposed applicant, Nabil Chaanine, owns the property being added, however, does not
own the currently permitted property, which is owned by Chaanine Ventures, LLC. Depending on what the owner plans
to do with this addition, there are a couple of options to proceed with permitting this major modification. These options
are:
1) Mr. Chaanine (individual) and Chaanine Ventures, LLC. both sign the application as co -applicants and will
therefore become co-permittees. This will eliminate the need for a transfer application to be submitted at the
time of the major modification submittal. If in the future Mr. Chaanine (individual) transfers ownership of the
added property/project to Chaanine Ventures, LLC., however, a transfer application will then need to be
submitted to have him removed from the permit as a co-permittee.
2) A transfer application is submitted at the same time as the major modification to be logged in after the approval
of the modification. The parcel owned by Mr. Chaanine (individual) can either be transferred to Chaanine
Ventures, LLC. for the LLC to have sole responsibility and ownership or Mr. Chaanine (individual) can retain
ownership of that parcel, but must sign as the "property" owner for that parcel.
As soon as the above items are clarified, we should be able to get a date scheduled for this project.

The House of Silk Flowers is a 7.96-acre tract located approximately eight miles north from the intersection
of NC 101 and US 70 in Beaufort (Attachment 1A & 18). The initial permit was issued when chlorides testing was
condu� cted to determine the salinity of waters %mile from the site. It was determined the project was not subject to
t e� SA rul The permit was issued February 15, 2001 under SW$ 000523 (Attachment 2) as a Low Density
Stormwater Project with 79,279 square feet of proposed impervious. The application attached to the permit
provides the maximur; 1proposed impervious allowable of 86,572 square feet and states that 65,340 square feet (1.5
acres) already existed on the tract, totaling 151,912 square feet.
The permitted tract ultimately drains to the south west, under NC 101 and eventually to an unnamed
tributary of Eastman Creek (Stream Index 21-24-1), Class SA;HQW. Referencing the Post -Construction Stormwater
Permitting Map a portion of the permitted low -density drainage area is shown within h mile of SA water body,
however additional acreage north is outside SA requirements. We had Robb Mairs with DWR review the roject
location and determined the extent of saltwater influence is within an unnamed tributary of Eastman Creek closer to
the project (Attachment 3). Existing impervious areas were located by E. Glenn Corbett, PLS of The Cullipher Group,
PA_ The area of existing buildings and paved surfaces is 128,530 square feet with an additional 38,233 square feet of
gravel surfaces. These gravel areas result in an overage of allowable impervious for the tract to remain low density.
Therefore, the existing gravel will be removed, and pervious gravel constructed per G.S. 143-217.7 (b2) to be
compliant with the Low -Density permit. Built upon area allocations are shown in the table below under 2019
Adjusted BUA Drainage Area 1.
The Permitee also proposes an on to the north of the existing facility and this drainage area, DA 2, is
proposed as high densitYand is treated by a stormwater pond with storage designed for the 1- ear 24-hr storm. The
soils in this area are mostly Tm (Tomotley) which are poorly drained, have high runoff and less than 12-inches
separation from the water table. These soil characteristics are not conducive for infiltrating SCMs.
A 100' x 240' building with dual truck wells and paved yards is proposed within the expansion. There is a
portion of the proposed building and a connecting sidewalk located within Drainage Area 1 which have been included
in the allowable impervious for the low -density drainage area, DA 1. The connecting service and parking areas also

threshold.

Coastal Stormwater Regulations
The North Carolina Division of Environmental Management implemented coastal stormwater regulations in
coastal counties on January 1, 1988 and most recent codified effective January 1, 2017. These regulations are detailed
in 15 NCAC 02H.1019 Coastal Counties. These rules allow for a development to be considered under various options.
The existing permit was approved under the 1995 stormwater regulations found in title 15A NCAC 2H.1000 and
.1005(3)(a). The expansion is submitted for approval consideration under 15A NCAC 02H.1003(3) High Density
Development, G.S. 143-214.7(b2), 15A NCAC 02H.1050 MDC for all Stormwater Control Measures and .1053 MDC for
Wet Ponds.

The Wilmington Regional Office received a complete Stormwater Management Permit Application for House of
Silk Flowers on January 22, 2001. Staff review of the plans and specifications has determined that the project, as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC'2H.1000.. We are forwarding
Permit No. SW8 000523 dated. February 15, 2001, for the construction of House of Silk Flowers.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein, and does not'supercede any other agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must
be in the form of a written petition, con' orming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and biinding.

15A NCAC 2N .1000 (hereafter referred to as the "storinwater rules ") and the approved storrnwater management
plans and specifications, and.other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part,of this permit for House of Silk Flowers.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific
conditions and limiiations:
I. DESIGN. STANDARDS
1. This permit covers the constructio o 7 27 uare fee of built -upon area.
2. The overall tract built -upon area percentage for the project must b maintained at 30% as required by
Section .1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are
enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum
side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division.
5. No piping is -allowed except:
a. That minimum amount, necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access.
6. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines
established in the North Carolina. Erosion and Sediment Control Planning and Design Man'Lial.
7_ Roof drains must terminate at least 30' from the Mean High Water line.

ii. SCHEDULE OF COMPLIANCE
1. ProEccts covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all
impervious areas and surface waters.
2. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
3. The Director may notify the perniittee when the permitted site does not meet one or more of the minimum
requirements of the permit; Within the time frame specified in the notice, the perinittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
4. Prior to the sale -of this project, in whole or in part, the following deed restrictions must be recorded with
the Office of the Register of Deeds and submitted to DWQ:
a. "Construction of additional built -upon area in excess of 79,279 square feet will require a permit
modification."
b. "Construction of additional impervious areas such that low density requirements are no longer met
must be submitted to DWQ and a permit modification must be issued prior to construction. An
appropriate engineered system will be required to collect and treat the runoff from all built -upon area
associated with the project, including that area permitted under the loud density option."
C. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this
development, except for average driveway crossings, is strictly prohibited by any persons."
d. "A minimum of 30' of vegetated buffer area'shall be provided between surface waters and all.
impervious surfaces."

6. Projects within CAMA's Area of Environmental Concern (AEC) are subjectto a reduction of the permitted
amount of built -upon area due to CAMA jurisdiction within the AEC.
7. A copy of the recorded 'restrictions must be received by this Office within 30 days of the date of sale.
8. The following items will require a modification to the pem-.it. Revised plans, specifications and calculations
must be permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of size.
b. Project.name change.
_ • C. Transfer of ownership.
d. Redesign or addition to the approved amount of built: -upon. area.
C. Further subdivision, acquisition, or We of the project area. The project area is defined as all property
owned by the permittee, for which Sedimentation and Erosion Control. Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
9. The.Director may determine that other revisions to the project should require a modification to the permit_

10. Swales and other vegetated conveyances shall be constructed in.theii• entirety, vegetated, and be operational
for their intended useprior to the construction of any built -upon surface.
11 During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other
vegetated conveyances will be repaired immediately.

12. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted
stnrmwater management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetatin g of the sideslopes.
d. Immediate repair of eroded areas.
C. Maintenance of side slopes in accordance with approved plans and specifications.
13. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been
constructed in accordance with the approved plans.
14. The permittee shall submit all information requested by the Director or his representative within the time
frame specified in, the written information request.
I11. GENERAL CONDITIONS
Failure to abide by the conditions and limitations contained in this permit.may subject the Pemmittee-to an
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes
143-215.6A to 143-215.6C.
The pennit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or tenninated for cause. The filing of a request for a
permit modification, revocation and reissuance, or termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit,
revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations
contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; andNorth Carolina
General Statute 143-215.1 et. al.
The permit is not transferable to any person except after notice to and approval by the Director. The Director
may require modification or revocation and reissuance of the permit to change the name and incorporate
such other requirements as may be necessary. A forma] pen -nit request must be.submitted to the Division
of Water Quality accompanied by the appropriate fee, documentation from both parties involved,,and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits,
and may or may not be approved.
The permittee: grants permission to DENR Staff to enter the property for the purpose of inspecting all
components of the stormwater management facility.
The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days.
The issuance of this permit does'not preclude the Permittee from complying vrith any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state and federal)
which have jurisdiction.

Hey Ginger,
Thanks for the email and the project location. Our Division is often asked to locate the extent of SA -waters to assist our
environmental engineers with state stormwater project applications they receive. In this case, I determined the
approximate extent of saltwater influence on the vegetation within this un-named tributary (UT) to Eastman Creek (SA;
HQW), through our Non -Discharge GIS aerial photography (see attached). I also drew in an approximate 0.5 mile radius
from the project site using Google Earth (see below). Even though this is a UT, all waters have a classification, and in this
case it is SA -Waters to the point of tidal influence (15A NCAC 02B .0301(i)(B). I would also be happy to meet with you
on -site as well to locate the extent of tidally influenced waters in relation to the project site.

No I have not requested an SA call. We plan to keep the current tract (drainage area 1) as low density and the expansion

Has there already been a point determined from DWR from which to draw the SA line? it sounds like they did the
salinity test to make the SA call for the existing permit years ago, and that the expansion will be permitted under the
2017 rules. Since we aren't doing the salinity test anymore, we draw that point from where DWR calls it. The online
map is a good starting point, but if it is going to be this close we should probably have Robb weigh in on exactly where
the point is located. I have cc'd him. Also, will this project continue to be low density?

It varies depending on how many engineers we have to review and how many applications we get. By
law, we have 90 days upon receipt of a complete application.
This is not a good time of year to submit an application and expect a permit before 2020. I'm retiring
in a few days, and this is typically when everybody decides to get that project submitted before the
end of the year. The only problem is that there will only be 4 of us to review all those applications and
we'd like some time off to enjoy the holidays with our families, too.

Unless we get a lot of help very soon, the applications we already have in house probably won't be
permitted before the end of this year.

Before I requested the permit transfer from the sole proprietor to the LLC, I asked Georgette if that
required a transfer or if it could be done as an "update" to the permit information. It was determined
that ownership of the property from a sole proprietor to an LLC requires a transfer application. If you
want to go express with the modified permit application, you will need to submit the transfer
application at the scheduled Express meeting for the modification. The transfer will be processed
after the modification is issued.
Please note that Express is scheduled out into 2020 at this time.

Part of the confusion regarding SA and the'/2 mile is that in 2000, the chlorides test was being used
to determine the salinity at a point in the water body of interest which was at least'/2 mile (as the crow
flies) from the site. If the salinity was less than 500 ppm, the project was not subject to the SA rules.
Today of course, it's different. DEMLR no longer determines stream classification or salinity — both
are functions of DWR. DEMLR is not going to change the density level for the current 6.6 acre project
area. That will stay as previously approved, which, based on all the information in the file, is
supposed to be 30% low density. However, if you add more project area, then the 2017 rules will
apply to that added project area. If the DWR map now says the project is within '/2 mile of and
draining to SA waters, then the SA rules will apply to the added project area.
Please also note that the permit is in the name of Bill Chaanine. Based on the Carteret County GIS,
the entity Chaanine Ventures, LLC is listed as the owner, at 413 Blair Point Road. There appears to
have been an ownership change and a mailing address change since the permit was issued. The first
order of business will be to transfer ownership of the permit and update the mailing address before
we can accept a modification.
You can submit the transfer and the modification applications together, with their separate fees, with
the understanding that the transfer will be processed first and the modification will be entered and
reviewed after the transfer is issued.

The attached permit has the project as 30% listed on page 2 of the permit and again on page 1 of the low density
supplement, while 25% was used in the calculation section on page 2. Since the project drains to SA waters (Eastmans
Creek) but was allowed 30% this suggests it was not within the SA jurisdiction at the time of permitting. The Owners
would like to expand their project to the north however we are unsure which program applies for 2019. The project is
located off Hwy 101 in Beaufort just north of Laurel Road. Please advise and let me know if you have any questions.

Has there already been a point determined from DWR from which to draw the SA line? It sounds like they did the
salinity test to make the SA call for the existing permit years ago, and that the expansion will be permitted under the
2017 rules. Since we aren't doing the salinity test anymore, we draw that point from where DWR calls it. The online
map is a good starting point, but if it is going to be this close we should probably have Robb weigh in on exactly where
the point is located. I have cc'd him. Also, will this project continue to be low density?
