Dear Mr Campagna
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they
are modified Please note that this letter references DEMLR as the Division responsible for
compliance with the permit
The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR)
issued a high density stormwater management permit to you on March 17, 2000 for the construction
of a building a parking with runoff to be treated in a wet detention pond On October 10, 2019, the
Division conducted a file review of the project, located at 3405 Merchant Court in New Hanover
County in response to an email requesting our assistance in tracking down the stormwater permit for
this site DEMLR file review revealed that the site is not in compliance with the administrative terms
and conditions of this permit A physical inspection of the permitted stormwater facilities will be
conducted in the near future Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recent inspection
As indicated in the attached inspection report, the following deficiencies must be resolved
1 The permit has expired and must be renewed The Division notified Parkway Business Park,
LLC by letter on March 29, 2011 that the subject permit would be effective until March 17,
2014 and requested that a renewal application and fee be submitted by September 17, 2013
No response was received
2 It appears that the property has been conveyed from one LLC to a new LLC, both of which you
manage This is considered an ownership change that requires submission of a completed and
signed Permit Transfer Application to the Division in order to document the transfer of the
permit to the new LLC owner
3 The pond has never been certified by an appropriately licensed designer The Division issued
a Notice of Violation (NOV-2010-PC-0127) on February 16, 2011 to Parkway Business Park,
LLC, requesting that the required certification be provided, but no response was received The
original design engineer, Ward Andrews, passed away several years ago A physical inspection
of the pond will be conducted in the near future

signed Permit Transfer Application Form to the Division of Energy, Mineral and Land Resources 30-
60 calendar days prior to making any of the below listed changes This form is available on our

f A name change of the owner / permittee,
g A name change of the project,
h A mailing address change of the permatee,
Please be advised that as the permittee, you are required to comply with the terms, conditions and
limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative
Code 2H 1003 and North Carolina General Statute 143-214 7, including the renewal of the permit, the
transfer of the permit, certification of the permitted stormwater system, and the continued operation
and maintenance of the permitted stormwater system at design condition
Failure to provide the requested information, or to respond to this letter with a plan of action,
including a timeline to resolve the identified deficiencies, by November 10, 2019, are considered
violations of the permit If the requested information is not submitted to this office by the due date,
then DEMLR staff will re -inspect the site and may issue a second Notice of Violation Please also note
that any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement action as set forth in NCGS
143 Article 21, including the assessment of civil penalties of up to $25,000 per day

Here's a copy of the SW$ 000219 permit Based on the calculations in the file, there is very little
extra surface area and volume in the pond, HOWEVER, the proposed amount of built -upon area
approved for this pond includes a Future Building allocation of 2256 sf
We wrote our permits a bit different back then than we do today This permit only mentions the total
approved BUA of 34,291 sf You have to go into the file documents to see that a portion of that total
amount is reserved for a future building

The previous owner of 3405 Merchant Court is Parkway Business Park, LLC I have four permits
issued to this entity, but I think the one you are interested in is SW8 000219 — Lot 2 Parkway

This permit expired on March 17, 2014 and has not been renewed
1 see from the NHC tax record that Camp Group, LLC purchased the property in January 2013 1 am
sorry that the original permittee did not apply to transfer the permit to the new owner at that
time Since Parkway Business Park, LLC is still active with the NCSOS, your client should contact
Mr Richard Campagna at 311 Judges Road, #12F, Wilmington to discuss getting Mr Campagna to
sign off on both a renewal application and a permit transfer application If he refuses, we have the
ability to transfer the permit to your client without his signature, as long as your client agrees to
address any compliance issues
Once the permit is in your client's name, we can accept an application to renew it (if needed) and to
modify It to accommodate a building expansion

On August 5, 2009, the Governor signed Session Law 2009-406 This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010 The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension
Accordingly, Stormwater Permit # SW8 000219 which has already expired on March 17,
2010, is now in effect until March 17, 2014 Please resubmit the renewal application
and fee at least 180 days prior to March 17, 2014, which would be September 17, 2013
A copy of the Renewal Application can be obtained from the following website

On February 4, 2011, Wilmington Regional Office personnel performed a Compliance
Inspection and file review of the subject project, located at Merchant Dr in Wilmington, New
Hanover County, North Carolina The inspection was performed to determine the status of
compliance with Stormwater Permit Number SW8 000219, issued to you on March 17, 2000
The project has been found in violation of Stormwater Permit Number SW8 000219, issued
pursuant to the requirements of 15A NCAC 2H 1000 The violations found are
1 Failure to certify the stormwater system A file review revealed that this office
has not received a Designers Certificate
Permit condition states that upon completion of construction, prior to issuance of a Certificate of
Occupancy, and prior to operation of this permitted facility, a certification must be received from
an appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation Any deviations from the approved plans and specifications must be
noted on the Certification
This Office requests that you respond to this letter in writing within 30 calendar days of receipt
of this Notice Your response should be sent to this office at the letterhead address Your

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8000219 to
Lot 2 Parkway Business Park for a High Density Project on March 17, 2000 This permit expires on March
17, 2010 Section 1003(h) of 15 A NCAC 2H 1000 (the stormwater rules) requires that applications for
permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied
by a processing fee, which is currently set at $505 00 If this is still an active project please complete and
submit the enclosed renewal application before the expiration date if this project has not been
constructed and a permit is no longer needed, please submit a request to have the permit rescinded If
you have sold the project, or are no longer the permittee, please provide the name, mailing address and
phone number of the person or entity that is now responsible for this permit Enclosed is a form for
change of ownership, which should be completed and submitted if the property has changed hands
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer for
the system installed This is to certify that the permitted facility has been installed in accordance with the
permit, the approved plans, specifications and supporting documentation Please include a copy of the
certification with your permit renewal request and processing fee Enclosed is a copy of a sample
certification Also enclosed 1s a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater
treatment facility without a valid permit, are violations of NC General Statute 143-215 1 and may result in
appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day

I have your letter of February 29, 2000 requesting additional
information on Lot 2, Parkway Business Park, project No. SW 000129. !`11��d1
1. There are no wetlands on this site and it has been noted on
the plans.
2. Building and parking lot dimensions have been shown on the
plans.
3. Dimensions for permanent pool contour and forebay have been
shown.
4. Grass cover on pond banks will be as shown on the plans.
5. Forebay volume is calculated as 20% of the permanent pool
volume shown on the supplement.
6. Ibmporary pool volume is 3,739 cue ft. and calculations are
shown on the enclosed sheet.
7. Permanent pool volume is 6.505 cu. ft. which is a total of
the main basin and the forebay volumes. Calculations are shown on the
enclosed sheet.
8. No lines have been left blank on the supplement.
9. 7he pond detail has been corrected to show the permanent
pool elevation as 34.2 ft.
A new and corrected Wet Detention Basin Supplement is enclosed.

Parkway Business Park on February 14, 2000 A preliminary review of that information has determined
that the application is not complete The following information is needed to continue the stormwater
review
Dehneate all wetlands on, site, or note on the plans that none exist
2 Provide building and parking lot dimensions
Provide the dimensions for the permanent pool contour, and the forebay wall placement
4 Indicate the type of grass cover to be planted on the pond slopes Complete note 49
5 The forebay volume is supposed to be based on approximately 20% of the 'Permanent Pool
Volume" as shown on the supplement Your engineer shows it as 20% of the first inch
volume, which has not been an acceptable method for over a year Please revise
6 The supplement reports the "Temporary Pool Volume" provided as 3,478 cubic feet Please
indicate in the calculations how this number was derived Based on the surface areas
provided, the volume is larger than that
The "Permanent Pool Volume" is reported as 7,910 cubic feet on the supplement Please
indicate how this volume was derived This calculation assumes that the forebay wall is not
yet in place, and that the depth of the pond is constant
If a requirement listed on the supplement does not apply, please mark it "N9A", do not leave
it blank
9 The pond section detail shows the permanent pool elevation as 34 24, but all other

requested information should be received by this Office prior to March 29, 2000, or the application will be
returned as incomplete The return of a project will necessitate resubmittal of all required items, including
the application fee
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90
days from the receipt of a completed application to issue the permit
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215 1 and is subject to enforcement action
pursuant to NCGS 143-215 6A

Maintenance activities shall be performed as follows
After every significant runoff producing rainfall event and at least monthly
a Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition _
b Check and clear the onfice of -any -obstructions such -that drawdown,of the temporary pool occurs
within 2 to 5 days as designed _
Rep,ur eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed
Inspect and repair the collection system (i a catch basins, piping, swales, nprap, etc ) quarterly to
maintain proper functioning
4 Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below) Removed sediment shall be disposed
of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality
(i a stockpiling near a wet detention basin or stream, etc )

The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments
When the permanent pool depth reads 3.75 feet in the main pond, the sediment shall be removed
When the permanent pool depth reads 2.25 feet in the forebay, the sediment shall be removed
