Director January 13, 2012 Dee Freeman Secretary Subject: NOTICE OF DEFICIENCY Stormwater Management Permit No. SW7060819 Garris Evans Lumber Company — New Bern Site Craven County This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1 .1003 for failing to comply with terms, conditions and limitations of a Stormwater Management Permit No. SW7060819. On January 6, 2012, Mr. -Scott Vinson of the Washington Regional Office performed an inspection to determine the status of compliance with Stormwater Permit SW7060819 as a result of a complaint received through the Craven County Planning Department, Permit Number SW7060819 was issued to you on October 3, 2006 for the Garris Evans Lumber Company — New Bern Site, located on Garner Road off US Hwy 70 south of James City, Craven County, North Carolina. As a result of the site inspection and DWQ file review, the following observations and violations are noted: 1. Permit Condition #1.5., DWQ observed that a small graveled area located on the left after entering the gate to the storage area was not properly draining to the wet detention pond by means of the interior drop inlet and piped collection system. This is a violation of Permit Number SW7060819 Condition ##I.5. which states, "The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system per approved plans." Required Response This Office requires that you respond to this letter in writing to the address listed at the bottom of the letterhead within 10 calendar days of receipt of this Notice. Please provide a written "Plan of Action" which outlines the actions you will take to correct the following violation(s) and a time frame for completion of those actions. This office requires that the violations, as detailed above, be abated and properly resolved and that all built -upon area runoff be directed into the stormwater control system, ie wet detention pond. Please note also that the above violation addresses the Division of Water Quality's requirements of treatment of built -upon area runoff from your development but most likely will not resolve the drainage issues on your neighbor's property. Griffin ) dated April 8, 2010: Dirk, see attached pictures from the Garris Evans location in New Bern. First picture is overall shot ofponr. Notice the abundance of cattails. These have been sprayed but control of cattails this bad will be an ongoing project throughout the year. They just keep conning up all during the season. Also, notice outlet structure with debris guard and pvc orifice pipe in place. Next series of pictures shows sediment buildup in front of inlet pipe that we are scheduling to be cleaned out early next week. Last picture shows outlet ditch that we removed check darn and cut cattails so water can flow on to road ditch. Let me know if you need any more information. My previous inspection back in January only turned up some minor compliance issues but were immediately corrected by the owner. Al was correct in his August 8 email, it appears that Garris Evans altered the drainage patterns by raising their site by 3-5 feet in areas immediately behind and adjacent to the Williams' property. This could very well have blocked some drainage, thereby causing flooding under certain rain events where there had been less or none in the past. This is where I believe page 2 of the 1988 Pendergrast v Aiken letter would apply. It could also be that the downstream DOT culvert is becoming inadequate for the drainage basin during large storm events as development grows. Craven County planning contacted DOT some time ago to ask that they look into this situation. I believe they did & told them that the pipes and culverts appeared to adequately sized for their minimum design storm (25yr.) and were draining appropriately, but would try to get back out to the site during or immediately after a large rain event. I do not believe DOT will be increasing any of the culverts any time soon. In my opinion the elevation of the Garris Evans property behind your home has caused the rainwater that runs off your home to get trapped on your back property line. Also, when the State right of way ditch in the front of your property backs up it may spill into your yard. 3) Rear property line overflow pipe that runs along ro ert y line between 409 and 411 Garner Road. As pointed out in the attached document from Craven Soil & Water Conservation District, the 18 inch plastic pipe that runs along the property lines of 409 and 411 Garner Road installed to carry water from the rear of the lots to the State right of way ditch was installed with no grade on the pipe. This pipe needs to be installed on a grade to allow for gravity flow, so water from the rear of your yard can flow to the State right of way ditch. Until the drainage back up problem is resolved along the State right of way ditch, this pipe may allow water from the road to back up into your yard. Until the following issues are resolved, YOU -may want to consider the following recommendations to mitigate damages to your borne. 1) When you replace your duet work for your heating and air system, it is recommended for you to install that duct work in the attic of your home. It is also recommended that you elevate your heat prnnp at least two feet off the ground to prevent water from entering the heat pump. 2) To mitigate all damages associated with this drainage problem it is recommended that you elevate your Koine to at least two feet above the highest adjacent grade of your property. My husband and I cant keep doing these unnecessary repairs. We are also grandparents raising grandchildren ages 2,3,4,E and have our own child which is 10 years old . Very simple it not right at all .Also there are only 2 Black American families on this road and our property is the only one that flood. Unfortunately we not wealthy people. I cant relocate , move the house or continue to repeat these repairs yearly due to negligence,disrespect,inhumane behavior which Mr.. Evans display.We need your help. I received the report prepared by Patrick Baker and have reviewed it. I have spoken on the phone with who I believe is the property owner who has experience the most flooding and is driving this issue. At this point I do not know specific rain events when this area has flooded, other than extreme rain events which are off the charts of something we would design for, which I explained to the property owner. I told her that I want to see this drainage system functioning in a significant rain event to see if the pipe under Old Cherry Point Highway is part of the problem (is it clogged, is it flowing full, is the outlet downstream of the pipe unobstructed, etc.), and since I talked to her a month or so ago we have not had a significant rain event, just light rains. If observation shows any sign that this pipe is part of the problem then I will send a request to our Hydraulics Unit to investigate the site to determine whether the pipe is properly sized. One item not mentioned in the Baker report, but discussed at length with the property owner and which stuck out like a red flag when I visited the site, is that Garris Evans lumber company was recently built behind her house. Do you know how much new impervious surface was created when that site was constructed? They hauled in'lots of fill dirt to raise the elevation of the lot (now higher than many of the property owners lots along Garner Road), created lots of impervious roof tops and parking areas (that used to soak in the ground) which drain to a stormwater pond, probably designed for a 10 year storm (NCDOT crosslines are designed for a 25 year storm), which overflows to the roadway ditch. She told me that she didn't have these types of flooding problems before Garris Evans was built, so based on what she told me and what I saw I'm thinking the flooding issue may be a result of the Garris Evans facility and not the pipe under Old Cherry Point Highway. Has the County talked with Garris Evans and, if so, what do they say? Has anyone checked their stormwater permit and made sure that their facility was constructed as designed and permitted? When the next significant rain event occurs I will personally visit this site (or have someone in my office do so if my schedule doesn't allow) and will let ya'11 know what I find. If you want I'll give you a call when headed out that way. But until that time or when someone can provide us dates that flooding occurred which did not involve a hurricane or tropical storm I do not think that any action is warranted. NCDENR NOV — Site Inspection Dear Mr. Evans: Ensineers I'lanncrs Surveyors lrs RECEIVED FEB - 8 2010 0WQ-{ AR As requested, I performed an onsite inspection of the Gams Evans Lumber Company facilities located on Garner Road in New Bern, NC in order to respond to a Notice of Violation (NOV- 2009-PC-1031) issued by the North Carolina Department of Environment and Natural Resources (NCDENR). The intent of the inspection was to document the existing conditions and record any items that need be addressed to comply with the stormwater permit SW7060819 issued by NCDENR. The deficiencies are as follows: 1. The approved permit plans require that a debris guard be installed on the outlet structure. Please see sheet 5 of the approved plans for details of the debris guard installation. 2. The PVC tee and orifice assembly is currently missing from the outlet structure. A new tee shall be installed in accordance with orifice detail on sheet 5 of the approved plans. 3. During construction, a rock check dam was installed in the outlet ditch beyond FES 24 (sheet 3). The check dam and accumulated silt is causing the pond to retain water above the designed permanent pool elevation. Now that the site has been stabilized, the check darn and accumulated silt needs to be removed and the ditch restored to design grades in order to facilitate proper drainage. The following comments pertain to the Wet Detention Basin Operation and Maintenance Agreement: 4. The entire BMP perimeter shall be cleaned of trash and debris. Several plastic bottles and other trashes were noted around the perimeter. 5. The grass around the perimeter of the pond shall be mowed to a height of approximately 6" and maintain cover to prevent erosive gullies. The grass appears to be mowed very short and was patchy in places. 6. The inlet pipe has significant debris at its outlet into the pond. It should be cleaned and sediment accumulation removed. 7. Continue to monitor the sediment level in the pond as required by the permit. The permanent pool design elevation is 23.0'. The bottom elevation of the forebay and main 107 Fast Second Street. The proposed project will construct a retail lumberyard facility with warehouse, office, sales and covered outdoor storage space. Phase one of this project will provide a parking lot and stormwater wet detention facility that has been sized to treat runoff from all of the proposed impervious area on this site. The existing site, which has been recombined from several lots has several single family dwellings with the associated outbuildings and driveways which have been accounted for in the impervious area calculations for this site. The parking on the north and west of the main sales building will be collected in curb and gutter and conveyed via curb inlets and drainage piping to the proposed wet detention stormwater facility located toward the eastern portion of the site. The lumber storage yard and outdoor storage sheds will be collected by drain inlets located in the gravel storage yard and conveyed to the wet detention facility via storm drain piping as well. The existing topography for the site is primarily flat, and on site native soils consist of Leaf soils (La) which is classified as a Group D soil hydrologically. Currently, stormwater on the existing site is collected via drainage swales which discharge into the roadside swales on Garner Road and Old Cherry Point Road.before eventually making its way into an unnamed tributary of the Neuse River. The NCDOT storm drainage system along Garner Road and Old Cherry Point Road currently consists of open drainage swales with intermittent driveway culverts of various sizes. In order to achieve 90% TSS solids removal on this site, the wet detention facility has been sized using the SA/DA ratio state in the table provided by NCDENR for use without a 30' vegetated filter. The design method described in the NCDENR "Stormwater Best Management Practices" Manual for wet detention basins was used. Drainage pipe flows were calculated using the rational method (Q=CIA). These flumes discharge into curb inlets and drain inlets located around the site.. The on -site detention pond will store and treat the runoff volume associated with the "first flush" or first inch of runoff calculated using the "Simple Method" shown in the BMP Manual. The outlet structure for the dry detention basins is a concrete riser with four open sides and a solid slab top with a removable galvanized frame and grate. The clear open area between the throat of the riser and the top slab is set at four inches. Tile outlet device for the basin was sized to release the 1st inch of runoff volume over a drawdown period of 2 to 5 days. r.nr.♦ JIAPRIVATE vans, David Iffownship 7 Lumber YardlPermits\Stornnvatcr Management Plan.doc The throat elevation of the outlet for wet detention basin is typically set to impound the I" inch storage elevation (El. 24.75) however, since grade clearances on this site are limited, the elevation has been set to elevation 25.10 to allow for ample support and cover of the outlet pipe in the wall of the outlet stnlcture. This additional height will allow the wet detention facility to impound more runoff volume thereby providing better treatment of the storn-►water runoff. The 1.75 inch diameter orifice was designed to allow for the drawdown period to fall between the required 2 to 5 days. The design storage volume provided (24,020 cubic feet) is greater than the required volume (19,034 cubic feet). Wet Detention Maintenance The maintenance needs of any particular wet pond are highly depend on the condition of the water shed that contributes runoff to the pond. Maintenance should always include minimizing erosion problems and pollutant export to the pond from the contributing watershed. Maintenance Requirements are as follows: 1. Debris and litter control checks for the inlet, outlet and orifice obstructions after every storm producing runoff. 2. Provisions for routine vegetation management/mowing and a schedule for these activities. 3. Checks every 6 months, or more frequently, for: - Sediment buildup and the need for removal - Erosion along the band and the need for reseeding or stabilization and, if reseeding is necessary, a reseeding schedule. - Erosion at the inlet and outlet and methods of stabilization. - Seepage through the dam - Operation of any valves or mechanical components During construction of this project, the North Carolina Sedimentation Pollution Control Act and the Rules and Regulations promulgated pursuant to the provisions of this act must be adhered to. Attached are the specifications for Seeding and Mulching and Erosion and Pollution control. These specifications explicitly describe procedures to minimize offsite sedimentation and erosion during the construction phase of the project. Phase one of this project will provide a parking lot and stormwater wet detention facility that has been sized to treat runoff from all of the proposed impervious area on this site. The existing site, which has been recombined from several lots has several single family dwellings with the associated outbuildings and driveways which have been accounted for in the impervious area calculations for this site. The parking on the north and west of the main sales building will be collected in curb and gutter and conveyed via curb inlets and drainage piping to the proposed wet detention stormwater facility located toward the eastern portion of the site. The lumber storage yard and outdoor storage sheds will be collected by drain inlets located in the gravel storage yard and conveyed to the wet detention facility via storm drain piping as well. The existing topography for the site is primarily flat, and on site native soils consist of Leaf soils (La) which is classified as a Group D soil hydrologically. Currently, stormwater on the existing site is collected via drainage swales which discharge into the roadside swales on Garner Road and Old Cherry Point Road.before eventually making its way into an unnamed tributary of the Neuse River. The NCDOT storm drainage system along Garner Road and Old Cherry Point Road currently consists of open drainage swales with intermittent driveway culverts of various sizes. In order to achieve 85% TSS solids removal on this site, the wet detention facility has been sized using the SA/DA ratio state in the table provided by NCDENR for use with a 30' vegetated filter. The vegetated filter for the wet detention facility is located east of the driveway shown nearest to the intersection of Garner Road and Old Cherry Point Road. The design method described in the NCDENR "Stormwater Best Management Practices" Manual for wet detention basins was used. Drainage pipe flows were calculated using the rational method (Q—CIA). These flumes discharge into curb inlets and drain inlets located around the site. The on -site detention pond will store and treat the runoff volume associated with the "first flush" or first inch of runoff calculated using the "Simple Method" shown in the BMP Manual. The outlet structure for the dry detention basins is a concrete riser with four open sides and a solid slab top with a removable galvanized frame and grate. The clear open area between the throat of the riser and the top slab is set at four inches. The outlet device for PAPRIVATETvans, David Jr\Township 7 Lumber Yard\Permitslstormwater Management Plan.doc the basin was sized to release the I" inch of runoff volume over a drawdown period of 2 to 5 days. The throat elevation of the outlet for wet detention basin is typically set to impound the I" inch storage elevation (El. 24.75) however, since grade clearances on this site are limited, the elevation has been set to elevation 25.10 to allow for ample support and cover of the outlet pipe in the wall of the outlet structure. This additional height will allow the wet detention facility to impound more runoff volume thereby providing better treatment of the stormwater runoff. The 1.75 inch diameter orifice was designed to allow for the drawdown period to fall between the required 2 to 5 days. The design storage volume provided (24,254 cubic feet) is greater than the required volume (19,034 cubic .feet). Wet Detention Maintenance The maintenance needs of any particular wet pond are highly depend on the the condition of the water shed that contributes runoff to the pond. Maintenance should always include minimizing erosion problems and pollutoant export to the pond from the contriutiong watershed. Maintenance Requirements are as follows: 1. Debris and -litter control checks for the inlet, outlet and orifice obstructions after every storm producing runoff. 2. Provisions for routine vegetation management/mowing and a schedule for these activities. 3. Checks every 6 months, or more frequently, for: - Sediment buildup and the need for removal - Erosion along the band and the need for reseeding or stabilization and, if reseeding is necessary, a reseeding schedule. - Erosion at the inlet and outlet and methods of stabilization. - Seepage through the dam - Operation of any valves or mechanical components During construction of this project, the North Carolina Sedimentation Pollution Control Act and the Rules and Regulations promulgated pursuant to the provisions of this act must be adhered to. Attached are the specifications for Seeding and Mulching and Erosion and Pollution control. These specifications explicitly describe procedures to minimize offsite sedimentation and erosion during the construction phase of the project.
