Subject: Regarding Property Flooding During Heavy Rains
Susan,
I visited the Garris Evans Lumber site (Craven Co,) again last week and found the site to be in compliance with their State
SW permit, SW7060819. My previous inspection back in January only turned up some minor compliance issues but were
immediately corrected by the owner. Al was correct in his August 8 email, it appears that Garris Evans altered the
drainage patterns by raising their site by 3-5 feet in areas immediately behind and adjacent to the Williams' property.
This could very well have blocked some drainage, thereby causing flooding under certain rain events where there had
been less or none in the past. This is where I believe page 2 of the 1988 Pendergrast v Aiken letter would apply.
It could also be that the downstream DOT culvert is becoming inadequate for the drainage basin during large storm
events as development grows. Craven County planning contacted DOT some time ago to ask that they look into this
situation. I believe they did & told them that the pipes and culverts appeared to adequately sized for their minimum
design storm (25yr.) and were draining appropriately, but would try to get back out to the site during or immediately
after a large rain event. I do not believe DOT will be increasing any of the culverts any time soon.
If you have any questions please call or write,
Scott

Ms. Massengale,
Garris Evan company was not incompliance with the storm water permit and was directed to do repairs. Yes
,their may be other factors that began when Garris Evans company built next door to me.[ have lived here for
20 years and have never experience any FLOODING. Again I say that on Garner Rd, there are only two AFRO
American Families and the only two properties that FLOOD this is STRANGE to use. It sounds like your job is
represent companies bringing revenue into North Carolina, and not hard working average income families like
myself that are being negatively impacted by the States decision to approve these establishments with no
regards to others .

Hello Mrs. Williams,
1 received a copy of your email today and have spoken with staff about your issue.
You may remember that the Division of Water Quality was involved with a multi -agency review of your situation back in
2010 that included representatives from the Department of Transportation and the Natural Resources Conservation
Service.
At present there are two businesses located near you that have stormwater permits from our agency. My understanding
is that the lumber company is in compliance with their stormwater permit. Another nearby business had problems with
their stormwater system and were directed to make repairs. We received an engineer certification stating that those
repairs had been properly made and that the system is in full compliance. DWQ staff is expected to do a follow-up
inspection to verify system compliance with its permit. However, it has not been determined if this company, compliant
or not, is contributing to the flooding you are experiencing. There are other possible factors that might affect the water
flowing on your property.
I intend to write to you again after the inspection has been completed so you will have the most current information.
Sincerely,
Susan Massengale

1 a111 writing this letter to give you my official opinion and provide you with recommendations
regarding your drainage problem at your'honle at 411 Garner Rd. It is my understanding that you have
been experiencing these drainage problems for the past 4 years.
Your drainage problem is three fold and they are outlined below,
1) Problems associated with the outlet pilie at the intersection of Old Cherry Point Road and Garner
Road. According to the attached report produced by Patrick Baker with Craven Soil & Water
Conservation District, the 24 iltch culvert at this location has accumulation of vegetative debris
at the inlet of this culvert, which restricts the flow of water into this culvert. He also has some
conecre}s with the placement of this pipe, because the water that is coming to this culvert from
Garner Road has to make a %,cry sharp turn which would greatly restrict the flow of water trying
to cross under Old Cherry Point Road. We will make contact with NCDOT regarding this
concern and you may also want to contact Gordy Eure at 514-4716.
2) Garris Evans Lumber Company_ property elevation. In my opinion the elevation of the Garris
Evans property behind your home has caused the rainwater that runs off your home to get
trapped on your back property line. Also, when the State right of way ditch in the front of your
property backs up it may spill into your yard.
3) Rear property line overflow pipe that runs along ro ert y line between 409 and 411 Garner
Road. As pointed out in the attached document from Craven Soil & Water Conservation
District, the 18 inch plastic pipe that runs along the property lines of 409 and 411 Garner Road
installed to carry water from the rear of the lots to the State right of way ditch was installed with
no grade on the pipe. This pipe needs to be installed on a grade to allow for gravity flow, so
water from the rear of your yard can flow to the State right of way ditch. Until the drainage back
up problem is resolved along the State right of way ditch, this pipe may allow water from the
road to back up into your yard.
Until the following issues are resolved, YOU -may want to consider the following recommendations to
mitigate damages to your borne.
1) When you replace your duet work for your heating and air system, it is recommended for you to
install that duct work in the attic of your home. It is also recommended that you elevate your
heat prnnp at least two feet off the ground to prevent water from entering the heat pump.
2) To mitigate all damages associated with this drainage problem it is recommended that you
elevate your Koine to at least two feet above the highest adjacent grade of your property.
I hope this summary gives you some insight on your drainage problem. If you have any questions
do not hesitate to give me a call.
Sincerely,
Richard Chad Strawn, CFM, CZO

John,
Thank you for the photos. The work looks good. I don't recall if we discussed the need for seeding the fill dirt, but
you're going to want to overseed the soil as soon as you can to keep it stabile and in place during rain events. I am
following up with NCDOT and the county planning office and will keep you informed as to any potential outcome.

water from flowing down the hill. The newly added dirt is at least 8" higher than the previous elevation. This can be
seen by looking closely at the blocks at the diesel tank. There is also a picture of the cleaning done by the outlet pipe

Dear Governor,
I am requesting your assistance with this flooding problem .I have contacted several of Gov. offices seeking
help. My family and I have been residing at 411 Garner rd. road for 20 yrs. this is our only home.
Since Garris Evan Lumber yard company has been permitted to build my property has been flooding, it is
impossible to maintain our dwelling under these circumstances. I've contacted the owner of the lumber yard
he practically curse me out. I talk to Steve Tyson via email and phone , He doesn't return phone calls nor does
he respond to emails. Chad Straun at Craven County planning has been providing me with information and
assisting me regarding the flooding . We spent $10.000. last year to replace heating system and duct work,
$5000.00 replacing floors and flooring, ect and these funds came from working numerous hours of overtime
at our place of employment. My husband and I cant keep doing these unnecessary repairs. We are also
grandparents raising grandchildren ages 2,3,4,E and have our own child which is 10 years old . Very simple it
not right at all .Also there are only 2 Black American families on this road and our property is the only one that
flood. Unfortunately we not wealthy people. I cant relocate , move the house or continue to repeat these
repairs yearly due to negligence, disrespect, inhumane behavior which Mr.. Evans display. We need your help.
Any assistance provided would be greatly appreciated.

Subject: RE: old Cherry Point -Gamer Rd. Pipe
Jason,
I thought that you and I had talked about this issue but, for the record, here is where I believe this project stands.
I received the report prepared by Patrick Baker and have reviewed it. I have spoken on the phone with who I
believe is the property owner who has experience the most flooding and is driving this issue. At this point I do
not know specific rain events when this area has flooded, other than extreme rain events which are off the charts
of something we would design for, which I explained to the property owner. I told her that I want to see this
drainage system functioning in a significant rain event to see if the pipe under Old Cherry Point Highway is part
of the problem (is it clogged, is it flowing full, is the outlet downstream of the pipe unobstructed, etc.), and
since I talked to her a month or so ago we have not had a significant rain event, just light rains. If observation
shows any sign that this pipe is part of the problem then I will send a request to our Hydraulics Unit to
investigate the site to determine whether the pipe is properly sized.
One item not mentioned in the Baker report, but discussed at length with the property owner and which stuck
out like a red flag when I visited the site, is that Garris Evans lumber company was recently built behind her
house. Do you know how much new impervious surface was created when that site was constructed? They
hauled in'lots of fill dirt to raise the elevation of the lot (now higher than many of the property owners lots along
Garner Road), created lots of impervious roof tops and parking areas (that used to soak in the ground) which
drain to a stormwater pond, probably designed for a 10 year storm (NCDOT crosslines are designed for a 25
year storm), which overflows to the roadway ditch. She told me that she didn't have these types of flooding
problems before Garris Evans was built, so based on what she told me and what I saw I'm thinking the flooding
issue may be a result of the Garris Evans facility and not the pipe under Old Cherry Point Highway. Has the
County talked with Garris Evans and, if so, what do they say? Has anyone checked their stormwater permit and
made sure that their facility was constructed as designed and permitted?
When the next significant rain event occurs I will personally visit this site (or have someone in my office do so
if my schedule doesn't allow) and will let ya'11 know what I find. If you want I'll give you a call when headed
out that way. But until that time or when someone can provide us dates that flooding occurred which did not
involve a hurricane or tropical storm I do not think that any action is warranted.
You note below that DWQ sent in a request to know where the process is. Can you explain their interest in this
issue?
Sincerely,

Garris Evans Lumber Company -- New Bern Site
Stormwater Project No. SW7060819
Craven County
On September 13, 2010, the Washington Regional Office received a plan revision for Stormwater
Management Permit Number SW7060819. The revisions include showing the placement and proper drainage
of what was shown as "Future Gravel" areas on the original approved plans and will now have a concrete slab
with two (2) buildings. The buildings and concrete are proposed to properly drain to the wet detention pond.
There is no increase to the built upon area from the original permitted design issued on October 3, 2006. It has
been determined that a formal permit modification is not required for the proposed plan revision changes. We
are forwarding you an approved copy of the revised plans for your files. Please add the attached plans to the
previously approved plan sheets.
Please be aware that all terms and conditions of the permit issued on October 3, 2006 remain in full
force and effect. Please also understand that the approval of this revision to the approved plans for the subject
State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be submitted
to and approved through the Division of Water Quality prior to construction. The issuance of this plan revision
does not preclude the permittee from complying with all other applicable statutes, rules, regulations or
ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

Dear Mr. Vinson:
Engineers

Stitrveyors
Please accept the enclosed plan sheet and modified sheet 2 of 4 (form SWU-101 Version 3,99) as
modification to the currently approved stormwater plan SW7060819 issued October 3, 2006. Please accept
this submittal'ajid'discard-the previously requested'n3odificatiori'submitied"August-10, 2010.
Pursuant to the conditions of the previously issued permit, this modification shows the addition of a 20,815
square foot concrete slab on existing gravel with two 9,200 square foot buildings constructed on the slab.
There is no net increase in impervious since the concrete slab is being placed on existing gravel. The
revised permit sheet and plan also indicate these changes and the corrected numbers. The modified plan
also shows the addition of swales that will drain roof water to existing drop inlets. The existing drop inlets
drain to the stormwater treatment facility.
Please note that the impervious numbers for drainage area one differ slightly from the approved plan due to
modifications made to restore compliance after a Notice of Violation issued December 30, 2009 (NOV-
2009-PC-1031.) The conditions of this NOV have since been satisfied. At that time some minor
discrepancies in calculations were corrected. The actual amount of impervious area has not exceeded the
amount of impervious area allocated by the permit.
If you have any questions, please feel free to call or email me. Thank you for your comments and I look
forward to hearing from you regarding this project soon.

As requested, I performed an onsite inspection of the Gams Evans Lumber Company facilities
located on Garner Road in New Bern, NC in order to respond to a Notice of Violation (NOV-
2009-PC-1031) issued by the North Carolina Department of Environment and Natural Resources
(NCDENR). The intent of the inspection was to document the existing conditions and record
any items that need be addressed to comply with the stormwater permit SW7060819 issued by
NCDENR. The deficiencies are as follows:
1. The approved permit plans require that a debris guard be installed on the outlet structure.
Please see sheet 5 of the approved plans for details of the debris guard installation.
2. The PVC tee and orifice assembly is currently missing from the outlet structure. A new
tee shall be installed in accordance with orifice detail on sheet 5 of the approved plans.
3. During construction, a rock check dam was installed in the outlet ditch beyond FES 24
(sheet 3). The check dam and accumulated silt is causing the pond to retain water above
the designed permanent pool elevation. Now that the site has been stabilized, the check
darn and accumulated silt needs to be removed and the ditch restored to design grades in
order to facilitate proper drainage.
The following comments pertain to the Wet Detention Basin Operation and Maintenance
Agreement:
4. The entire BMP perimeter shall be cleaned of trash and debris. Several plastic bottles
and other trashes were noted around the perimeter.
5. The grass around the perimeter of the pond shall be mowed to a height of approximately
6" and maintain cover to prevent erosive gullies. The grass appears to be mowed very
short and was patchy in places.
6. The inlet pipe has significant debris at its outlet into the pond. It should be cleaned and
sediment accumulation removed.
7. Continue to monitor the sediment level in the pond as required by the permit. The
permanent pool design elevation is 23.0'. The bottom elevation of the forebay and main

pond elevation is 15.5'. Sediment shall be removed when the sediment volume reaches
25% of the total design volume (elevation 17.38').

that once these invasive plants cover more than 50% of the pond perimeter, the plants
shall be removed by wiping pesticides on the stem. Pesticides shall not be sprayed.
Once these items are addressed, we will prepare an engineer's certification and submit it to
NCDENR -in order to fully comply with the conditions of the stormwater permit.
Please do not hesitate to call should you have any questions regarding the findings of this

Thank you for your recent comments regarding the stormwatcr review for the proposed Garris Evans
Lumber Company located near the intersection of Gamer Road and Old Cherry Point Road in New Bern. In
response to you letter dated September 14, 2006 please find the following revised plans and comment
responses.
Cotntnent #I
Please mote on the plans that all roof drains are to be directed to pond. The stornnvctter r•trttoff frol)r the
warehouse on the southwest corner of the project along with all the other buildings should be directed to
the forebay of the pond.
Response # I
Please find that a note has been added to the grading plan that states that all roof drainage shall be directed
toward the forebay of the stonnwater quality pond. This note has bcen, added to each of the structures finish
floor elevation note to direct the prospective contractor.
Conanent #?
Please provide the required 3:1 length ividth ratio in the pond or provide justification to why this
r-equirenrent has not been met.
Response #2
Please find that the proposed pond has been revised to include an earthen "finger" that will increase travel
length for stonnwater runoff and make the final length to width ratio 5.78:1. Thank you for bringing this

defect in the design to our attention.
Enfiincers / Planners / Surveyors
The run ff f tali the fiaure parking area in the NW corner of the project as ivell as the f aure gravel area
needy to be directed to the forebay of the pond. It does not appear that the future parking area will be
directed into the forebay of the pond.
Response #3
Based on this comment, please Find the DI No. 5A has been added to the plan and flow arrows have been
added to the grading of the future parking area to indicate the intended direction of the drainage. It is our
intention that the future gravel area will be graded such that all runoff generated by the gravel yard will be
picked up in the stormwater drainage network and conveyed to the forebay of the pond for treatment.
Comment ##4
Please reduce the forebay size to between I8-22% of the total permanent pool volume. Currently 5, 7G1 cf is
about 37% of the permanent pool volume of 15, 457cf.
Response #4
Please find on the enclosed revised drawings and on the updated wet pond supplement that the grading of
the forebay has been revised to account for a smaller percentage of the permanent volume of the pond. The
revised supplement lists the exact numbers that will show the new percentage is about 18.3%.
Please provide a cross section detail of the 30' long vegetated filter, including a flow spreader mechallh ni
and dimensions. Also include the non erosive flow calculations for the 10 year, storm through the filter to
help determine the mininnon width of the filter.
Response #5
Please find on the enclosed plans the revised grading of the proposed stormwater quality pond. With this
version of the proposed pond, we have increased the depth ol` the pond to 7.5'. Using this depth and the
80.6% impervious percentage, it can be interpolated from the Coastal County Surface Area to Drainage
Area ratio chart that a surface area percentage of 2.8% would be required to meet the sizing requirements
for a 90% TSS removal BMP structure. Since we have provided approximately 3.37% SA/DA at our
permanent pool elevation, our revised pond layout with the provided depths meets the size requirements that
will allow us to construct the pond without a vegetative filter. Based on these new properties of the pond,
we have not provided the cross sectional detail your comments requested.
I am also enclosing with this package the revised wet detention basin supplement, a revised stormwater
application and revised surface area sizing requirements and worksheets that we have used to resize and
more properly describe the proposed project. The numbers that have changed do not affect the signature

Dear Mr. Evans:
This office received a Coastal Stormwater permit application and plans for the subject project on
August 29, 2006. A preliminary review of the project indicates that before a State Stormwater permit can
be issued the following additional information is needed.
:- Please note on the plans that all roof drains are to be directed to pond. The stormwater runoff
from the warehouse on the southwest corner of the project, along xvith all the other buildings
should be directed to the forebay of the pond.
Please provide the required 3:1, length : width ratio to the pond or provide justification to Nvhy
this requirement has not been met.
i The runoff from the future parkin_ area in the NW corner of the project as well as the future
gravel area needs to directed to the forebay of the pond. It does not appear that the future parking
area will be directed into the forebay of the pond.
Please reduce the forebay size to benveen 18-22% of the total permanent pool volume. Currently
5,761cf is about 37% of the permanent pool volume of 15,457cf.
Please provide a cross sectional detail of the 30' Iona vegetated filter, including-2 flow spreader
mechanism and dimensions. Also include the non -erosive flow calculations for the 10-%7. storm
through the filter to help determine the minimum width of the filter.
The above requested information must be received in this office prior to September 22, 2006 or
your application will be returned as incomplete. The return of this project will necessitate r esubrnfnal of
all required items inciuding.the application fee. If you need additional time to submit the required
information, please mail or fax your request for time extension to this office at the Letterhead
address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A-NCAC 2H.1000 and North
Carolina General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.
Please reference the Stormwater Project Number above on all correspondence. If you have
questions, please feel free to contact me at (252) 948-3848,
Sincerely,

Stormwater Management Plan
No. 7 Township, Craven County, North Carolina
August 2006 (revised September 2006)
uwQ
FEW #
The proposed project area consists of 6.81 acres, located on Garner Road near the
intersection of Garner Road (SR 1121) and Old Cherry Point Road (SR 1113). The
proposed project will construct a retail lumberyard facility with warehouse, office, sales
and covered outdoor storage space. Phase one of this project will provide a parking lot
and stormwater wet detention facility that has been sized to treat runoff from all of the
proposed impervious area on this site.
The existing site, which has been recombined from several lots has several single family
dwellings with the associated outbuildings and driveways which have been accounted for
in the impervious area calculations for this site. The parking on the north and west of the
main sales building will be collected in curb and gutter and conveyed via curb inlets and
drainage piping to the proposed wet detention stormwater facility located toward the
eastern portion of the site. The lumber storage yard and outdoor storage sheds will be
collected by drain inlets located in the gravel storage yard and conveyed to the wet
detention facility via storm drain piping as well.
The existing topography for the site is primarily flat, and on site native soils consist of
Leaf soils (La) which is classified as a Group D soil hydrologically. Currently,
stormwater on the existing site is collected via drainage swales which discharge into the
roadside swales on Garner Road and Old Cherry Point Road.before eventually making its
way into an unnamed tributary of the Neuse River. The NCDOT storm drainage system
along Garner Road and Old Cherry Point Road currently consists of open drainage swales
with intermittent driveway culverts of various sizes.
In order to achieve 90% TSS solids removal on this site, the wet detention facility has
been sized using the SA/DA ratio state in the table provided by NCDENR for use without
a 30' vegetated filter. The design method described in the NCDENR "Stormwater Best
Management Practices" Manual for wet detention basins was used.
Drainage pipe flows were calculated using the rational method (Q=CIA). These flumes
discharge into curb inlets and drain inlets located around the site.. The on -site detention
pond will store and treat the runoff volume associated with the "first flush" or first inch
of runoff calculated using the "Simple Method" shown in the BMP Manual.
The outlet structure for the dry detention basins is a concrete riser with four open sides
and a solid slab top with a removable galvanized frame and grate. The clear open area
between the throat of the riser and the top slab is set at four inches. Tile outlet device for
the basin was sized to release the 1st inch of runoff volume over a drawdown period of 2
to 5 days.
r.nr.♦
JIAPRIVATE vans, David Iffownship 7 Lumber YardlPermits\Stornnvatcr Management Plan.doc
The throat elevation of the outlet for wet detention basin is typically set to impound the
I" inch storage elevation (El. 24.75) however, since grade clearances on this site are
limited, the elevation has been set to elevation 25.10 to allow for ample support and
cover of the outlet pipe in the wall of the outlet stnlcture. This additional height will
allow the wet detention facility to impound more runoff volume thereby providing better
treatment of the storn-►water runoff. The 1.75 inch diameter orifice was designed to allow
for the drawdown period to fall between the required 2 to 5 days. The design storage
volume provided (24,020 cubic feet) is greater than the required volume (19,034 cubic
feet).
Wet Detention Maintenance
The maintenance needs of any particular wet pond are highly depend on the condition of
the water shed that contributes runoff to the pond. Maintenance should always include
minimizing erosion problems and pollutant export to the pond from the contributing
watershed.
Maintenance Requirements are as follows:
1. Debris and litter control checks for the inlet, outlet and orifice obstructions after
every storm producing runoff.
2. Provisions for routine vegetation management/mowing and a schedule for these
activities.
3. Checks every 6 months, or more frequently, for:
- Sediment buildup and the need for removal
- Erosion along the band and the need for reseeding or stabilization and, if
reseeding is necessary, a reseeding schedule.
- Erosion at the inlet and outlet and methods of stabilization.
- Seepage through the dam
- Operation of any valves or mechanical components
During construction of this project, the North Carolina Sedimentation Pollution Control
Act and the Rules and Regulations promulgated pursuant to the provisions of this act
must be adhered to. Attached are the specifications for Seeding and Mulching and
Erosion and Pollution control. These specifications explicitly describe procedures to
minimize offsite sedimentation and erosion during the construction phase of the project.

Garris-Evans Lumber Company
Garner Road and Old Cherry Point Road AUG 2 9 2006
Stormwater Management Plan
No. 7 Township, Craven County, North Carolina ®WQ-VVARO
August 2006
The proposed project area consists of 6.81 acres, located on Garner Road near the
intersection of Garner Road (SR 1121) and Old Cherry Point Road (SR 1113), The
proposed project will construct a retail lumberyard facility with warehouse, office, sales
and covered outdoor storage space.
In order to achieve 85% TSS solids removal on this site, the wet detention facility has
been sized using the SA/DA ratio state in the table provided by NCDENR for use with a
30' vegetated filter. The vegetated filter for the wet detention facility is located east of
the driveway shown nearest to the intersection of Garner Road and Old Cherry Point
Road. The design method described in the NCDENR "Stormwater Best Management
Practices" Manual for wet detention basins was used.
Drainage pipe flows were calculated using the rational method (Q—CIA). These flumes
discharge into curb inlets and drain inlets located around the site.
The outlet device for
PAPRIVATETvans, David Jr\Township 7 Lumber Yard\Permitslstormwater Management Plan.doc
the basin was sized to release the I" inch of runoff volume over a drawdown period of 2
to 5 days.
The throat elevation of the outlet for wet detention basin is typically set to impound the
I" inch storage elevation (El. 24.75) however, since grade clearances on this site are
limited, the elevation has been set to elevation 25.10 to allow for ample support and
cover of the outlet pipe in the wall of the outlet structure. This additional height will
allow the wet detention facility to impound more runoff volume thereby providing better
treatment of the stormwater runoff. The 1.75 inch diameter orifice was designed to allow
for the drawdown period to fall between the required 2 to 5 days. The design storage
volume provided (24,254 cubic feet) is greater than the required volume (19,034 cubic
.feet).
Wet Detention Maintenance
The maintenance needs of any particular wet pond are highly depend on the the condition
of the water shed that contributes runoff to the pond. Maintenance should always include
minimizing erosion problems and pollutoant export to the pond from the contriutiong
watershed.
Maintenance Requirements are as follows:
1. Debris and -litter control checks for the inlet, outlet and orifice obstructions after
every storm producing runoff.
