This Division issued state Stormwater Permit SW7060624 to Liverman's Metal Recycling on
September 28, 2006. Under Part 11.6 (Schedule of Compliance), this permit requires a certification
that the permitted facilities have been constructed according to the approved plans and
specifications. Upon reviewing our files, that certification has not been submitted to our office.
Please provide a copy of the certification or a statement that the project has not been completed to
this Office at the letterhead address within 30 days of receipt of this letter.
Regarding the Federal Stormwater Permit requirements, after searching our database, I did
not find a stormwater permit for Liverman's Metal Recycle facility in Bertie County. The State of North
Carolina has issued several general permits to cover stormwater discharges associated with
industrial activities. One of the following permits may apply to your operation:
(1) NCG100000 issued for establishments engaged in auto wrecking and salvage yards;
(2) NCG130000 issued for establishments engaged in the wholesale trade of non-metal waste
(3) NCG200000 issued for establishments engaged in the wholesale trade of scrap metal.
I have enclosed print outs for each of these categories. You can find additional information at our
website about these permits. I plan to visit your operation in the near future to review these matters.

What activities are covered by this general permit?
• NCG200000 allows stormwater point source discharges associated with establishments primarily engaged in assembling,
breaking up, sorting, and wholesale trade of scrap metal [ a portion of standard industrial classification (SIC) 50931;
• Specifically excluded activities include: Used Motor Vehicle Parts [ SIC 50151, Automobile Wrecking for Scrap [ a portion of SIC
5093], and Non -Metal Waste Recycling [ a portion of SIC 50931. (Those are covered under NCG100000)
What are the key permit requirements?
• Implement a stormwater Pollution Prevention Plan (SPPP);
• Provide secondary containment for all bulk storage of liquid materials;
• Perform, document, and report analytical and qualitative monitoring during a representative storm event semi-annually; and
• Perform analytical monitoring twice per year for any vehicle maintenance area, if present.
What has changed since the last renewal?
Some of the major changes since the last renewal include:
• Semi-annual analytical monitoring with benchmarks replaces annual monitoring with cut-off concentrations;
• Refinements and clarifications to the SPPP requirements; refer to Part 11, Section A;
• New analytical monitoring parameters including pH, Cu, Fe, Zn and 0&G:
• Tiered response requirements for benchmark exceedences based on analytical results, and direction to notify the DWQ
Regional Office in the event of four benchmark exceedances (Fe not included), Benchmarks are not limits;
• Semi-annual qualitative monitoring during a representative storm event:
• Semi-annual (instead of annual) vehicle maintenance analytical monitoring with benchmarks (if required);
• Requirement to use forms provided by the Division to record qualitative monitoring results; and
• Requirement to submit an annual monitoring summary to the DWQ Regional Office by March 1 of each year.
What are BMPs, and why are they important?
The SPPP should include Best Management Practices (BMPs) to control discharge of pollutants from a
facility's stormwater outfalls. BMPs include a variety of things that help minimize potential for pollutants to get into the storm -
water draining from a facility. There are different types of BMPs:
Non-structural (practices or activities) BMPs include.
* Eliminating exposure of materials and equipment wherever possible by moving them to indoor locations.
* Practicing good housekeeping on -site. Handle and store materials at the facility in an orderly fashion.
* Exchanging hazardous materials for non -hazardous ones wherever possible.
* Establishing routine leak & maintenance checks to minimize chance of spills. Clean up spills immediately,
* Establishing bulk storage tank protocols that minimize the risk of spills during loading and unloading.
* Maintaining wash pads and keeping them clean of paint chips, debris, and particles.
Structural (equipment or devices) BMPs include.
* Containment or diversion dikes around loading/unloading areas and around bulk liquid storage containers.
* Roofs and secondary containment around materials stored outside so that stormwater cannot contact them.
* Oil -water separators, detention basins, infiltration devices, vegetated buffers and filter strips.

be representative and why, and
include aN supporting documenta-
tion and a site map. Or fill out and
send in the ROS Request Form on

Monitoring under all NPDES permits
must be conducted in accordance
with test procedures approved un-
der federal regulations in 40 CFR
§136. All labs certified by North
Carolina perform analysis in accor-
dance with those procedures. N.C.
certification requirements do not
apply to stormwateronly dis-
charges, but data gathered under
an NPDES permit must conform to
federal requirements. Using a certi-
fied lab is one way to ensure com-

Note that pH is a field parameter
and must be measured within 15
minutes. You must train on -site
staff to measure pH using approved
methods or contract with commer-
cial services. All entities with field

If I'm sampling my discharge,
do I do qualitative monitoring
at the same time?
Yes, see permit requirements. It is
most practical and convenient to do
both at the same time.
DWQ personnel from the Regional
Office may visit your site and want
to see that you have your NPDES
permit, an acceptable SPPP, and
evidence that you are following
your SPPP. These inspections may
be routine or the result of public
complaints.
Take compliance seriously!
Facilities that violate stormwater
permit conditions are subject to
fines. Civil penalties of up to
$25,000 per day may be assessed

What is it?
NCG100000 is a general permit allowing stormwater runoff
to be discharged from auto wrecking and salvage yards. The
stormwater permit program is administered by the Division
of Water Quality (DWQ), Stormwater Permitting Unit.
Why is this permit important?
Stormwater permits are required for many businesses that
have a potential to pollute North Carolina's streams, rivers,
and lakes. .For several common industries, DWQ provides
general permits so that businesses don't have to spend extra
time and money to develop a special, individual permit. In
addition to auto wrecking and salvage yards, general permits
have been developed for industries such as mining sites,
ready -mix concrete sites, construction sites, and landfills.
Who needs it?
• Auto salvage yards (Used Auto farts —SIC 5015) and
scrap yards (Scrap and Waste Materials— SIC 5093)
• Excludes wholesale metal waste and scrap operations (a
subset of SIC 5093; covered by a different permit, NCG20)
So remember, compliance with this
permit helps protect our lakes,
streams, rivers, and coastal waters.

What does this permit require me to do?
Among other things, the permit
requires the owner/operator to

rain water (oils, anti -freeze,

23]; Printing, publishing, and allied industries
[SfC 271; Converted paper and paperboard prod-
ucts [SIC 2671; Paperboard containers and boxes
[SIC 2651; Miscellaneous manufacturing industries
[SIC 391; Leather and leather products [SIC 311;
and Rubber and miscellaneous products [SIC 301;
and similar activities (see permit.) Excluded:
Leather tanning and finishing [SIC 3111 and Tires
and inner tubes [SIC 3011.
NCG070000 allows stormwater discharges
associated with activities classified as establish-
ments primarily engaged in: Stone, Clay, Glass,
and Concrete Products [standard industrial classi-
fication (SIC) 32]; similar activities. Excluded:

NCG110000 allows stormwater discharges
associated with activities classified as Treatment
Works treating domestic sewage or any other sewage
sludge or wastewater treatment device or system,
used in the storage, treatment, recycling, and recla-
mation of municipal or domestic sewage, with a design
flow of 1.0 million gallons per clay or more, or facilities
which are required to have an approved pretreatment
program under Title 40 CPII §403, including lands
dedicated to the disposal of sewage sludge that is lo-
cated within the confines of the facility.
NCG130000 allows stormwater discharges
associated with activities classified as establishments
primarily engaged in: wholesale trade of non-metal
waste and scrap (hereafter referred to as the non-
metal waste recycling industry, a portion of standard
industrial classification (SIC) 5093); similar activities.
Excluded: wholesale trade of metal waste and scrap,
iron and steel scrap, and nonferrous metal scrap;
waste oil recycling; and automobile wrecking for
scrap.

This office received a Coastal Stormwater permit application and plans for the subject project on
August 29, 2006. A preliminary review of the project indicates that before a State Stormwater permit can
be issued the following additional information is needed.
➢ Please note that in the volume calculation to determine the minimum temporary pool volume
required, it appears that 16.87 acres of drainage area to the wet pond was used instead of the
proposed 20.46 acres, thereby computing the 11,883cf of volume required. If 20.24 acres of
drainage area is used in the Simple or "Rv" Method then approximately 14,400 cf of temporary
pool volume would be required. Please verify the calculations and total drainage area to the wet
pond and correct application, plans, calculations and supplement forms as needed_
➢ It appears that the provided permanent pool surface area of 8,112 sf provided meets the minimum
required surface area for a 90%TSS designed pond. Please verify and if this is correct then a
standard flat bottom vegetated filter (not a 3:1 or 4:1 grassed swale) will not be required for the
overflow of the wet pond. Correct page 1 of 4 of the Wet Basin Supplement form as needed.
Please remember to seal, sign and date any revised calculations and plans.
The above requested information must be received in this office prior to September 22, 2006 or
your application will be returned as incomplete. The return of this project will necessitate resubmittal of
all required items including the application fee. If you need additional time to submit the required
information, please mail or fax your request for time extension to this office at the Letterhead
address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North
Carolina General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.

EROSION AND SEDIMENTATION CONTROL
A. DESCRIPTION OF PROJECT
Location of Project
The property is located near Aulander, north of Lewiston on US 11 and 42.
Type of Development
The project is planned to be a metal re -cycling center for ferrous and non-ferrous metals.
Earth Disturbing Activities:
The site is partially wooded and has had some grading work performed prior to discovering the need
for environmental permitting. Plans are to grade the site to drain into sub -surface containment systems
along with a detention'pond and forebay area or stormwater management. Concrete pads will be
constructed to contain the metal products. Buffers along the perimeter will be provided. No change in
drainage patters will take place.
Existing Drainage Patterns:
The property currently drains to the southwest to Wohtom Swamp, which drains to the Roanoke River.
The drainage across the property is westerly away from US 1 land 42.
Proposed Drainage Patterns:
The drainage pattern will remain the same ultimately after having been directed through treatment
systems. During site grading, several sediment trap locations are proposed along with diversion swales
to accommodate the various phases of the project.
Construction Sequence:
Seven sediment traps have been proposed in the phasing of the work. The first work will be the
construction of the road, scales, scale building, non-ferrous building, and receiving pad for electric
motors, transmissions, etc. all north of the main entrance road. The remaining construction consists of
a shop and office building and shredder pad. CIearing and grubbing on most of the remainder of the
site will be performed in anticipation of future rail service and site collection room.
B. EROSION AND SEDIMENTATION CONTROL MEASURES
1. A copy of the latest approved soil erosion and control plan must be on file at the job site. Timely
and proper attention shall be required for prevention of offsite erosion and sedimentation. Various
levels of erosion control are proposed in the plan. If it becomes evident that additional erosion and
sedimentation control measures are needed they shall be installed immediately. A permanent
ground cover, sufficient to restrain erosion, must be provided within the shorter of 30 working or
120 calendar days after completion of the construction or development.
2. A buffer zone, sufficient to restrain sedimentation, must be maintained between the land -
disturbing activity any adjacent property or watercourses. Maintain I Do Not Disturb existing
vegetative cover in areas of no construction.

3. Install a gravel construction pad at the construction entrance as noted on the plans. The pad will
be a minimum of 50 feet long, 20 feet wide and 6" deep of washed #57 stone.
4. All disturbed areas will be seeded within 30 days following construction in accordance with the
seeding schedule as shown on the plans including wastelborrow sites.
B. TIME SEQUENCE OF OPERATIONS
Construction sequence is as noted on the sedimentation and erosion control plan sheet. Construction is
planned to begin June 2006.

NARRATIVE
For
LIVERMAN'S METAL RE -CYCLING, INC.
BERTIE COUNTY, NORTH CAROLINA
Liverman's metal recycling is an existing business currently being operated on a site in
conjunction with an auto -salvage business in Ahoskie, North Carolina. The growth of the
metal recycling business has been enhanced by the prices being paid for both ferrous and
non-ferrous metals. The opening of NUCOR has provided a ready market for ferrous
materials as well as other users in Virginia and North Carolina. The lack of land to
expand and zoning issues has caused the metal recycling portion of the business to obtain
adequate space adjacent to major transportation facilities and still be central to vendors
supplying raw materials to the recycling center.
The planned facilities will be in two stages. The first will be the construction of a
building in which nonferrous materials, aluminum, plastics, copper, brass, etc. will be
collected. The materials collected inside the building will be stored inside until a
truckload of specific materials properly sorted has been obtained. A loading dock will be
provided for the trailers to be parked under and a shelter will be provided for the trailers.
Also in the first phase, a staging pad of concrete will be installed along with drives,
scales, and scale house. The concrete pad will receive larger items such as electric
motors, transmissions, and miscellaneous metal products. They will be sorted and
contained only during the days of operation. All products will be removed daily with no
overnight storage. The areas outside of the staging pad have four inlet areas to receive all
the -drainage from the impervious and non -impervious surfaces. The inlets will be
standard sump catch basins and sod infiltrator systems. The inlets are designed to collect
all solid debris, silt, hydro -carbons, etc. The inlets have been designed to detain the one
inch runoff from the impervious areas and infiltrate through the sod, sand, non -woven
filter and into the #5 stone storage areas. The storage areas are above the S.H.W.T. as the
result of the adjacent ditching and the outlets being provided. The stored water will have
no appreciable infiltration and none is considered in the design. Water must pass through
another filter to enter the drawdown pipes, which allow water to leave the storage stone
and enter an existing -ditch, which will transport the pre-treated -water to a fore -bay
system:. The storage stone has been designed to empty ranging from one to one and one-
half hours.
The fore -bay has been designed to collect 20% of the runoff volume. A 50 GPM pump;
will be provided in the fore -bay to keep the surface water elevation at an elevation of
63.0 MSL`. The elevation will allow for positive grade and positive surface drainage from
the staging area.. The combination of sub-surfaee storage and the pump system should
allow for the majority of rainfalls not to have tail -water elevations in the main ditch and
within the primary areas ditching. Storage has been provided in the ditching and is
expected 'to occur under some rainfalls. The rate of discharge from the stone storage
system will be monitored and adjusted by outlet orifices to maximize the permanent wet -
detention pond storage volume. The true on site storage is twice the required volume and

the stone storage can play on important part to advance the detention pond to function
much as a created wetland by controlling the range of water levels as much as possible.
The primary permanent pool elevation has been established at 64.0 MSL, which is the
approximate existing S.H.W.T. The vegetated bench as been established to provide for
,:.0.75 feet of planting area below the PP elevation and 0.75 feet above the elevation. This
will allow a good mix of plant species to grow.; Some plants prefer to have sub -merged
roots while others thrive better not submerged but with their roots in the static water
zone. There are some very complete sources for the type of plantings to be installed and
consultation with the North Carolina Extension Biological Engineering Section will result
in a list of plant species to be recommended. The drawdown of the temporary storage has
been designed for five days by gravity through a pipe orifice and grassed waterway swale
to NC 11 where sufficient depth is available.
The second_ phase will - be submitted _ later for. approval. It will contain chipping
equipment to chip automobiles into small bits and sort. the products into ferrous, non-
ferrous, and fabric (scruff) containers. The site will allow for large trucks to bring in raw
product and remove the processed material. The chipping equipment has been designed
with water misting equipment, which meets all air quality standards. The collection and
treatment of the runoff product is under design now and will follow at a later date. The
first phase is under pressure for a 'new site and will not be impacted by future
development with the exception for perhaps attaching another wet -detention pond to the
one being requested now.
