REGAN Secretary TRACY DAVIS Director The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Helms Port on December 1, 2017. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding modified Permit No. SW8 140211, dated January 16, 2018, for the construction, operation and maintenance of the BMP's and built -upon areas associated with the subject project. The following changes are included in this modified permit: 1. A new lot numbering scheme has been provided to reflect the recorded plats and deed restrictions. 2. The receiving stream index number has been corrected to 18-87-25.7. 3. Trench bottom elevations A-G were revised to reflect as -built conditions. 4. Calculations for Basin H were provided to waive the bypass and vegetated filter requirements. 5. Future BUA was reduced in both the Pond 1 and Pond 2 BUA allocations to account for additions and changes to the road layout. 6. Added the secondary BMP infiltration basin design criteria for the 2 wet detention ponds to the permit. This permit shall be effective from the date of issuance until March 6, 2022, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, and the procedures for changing of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until March 6, 2022 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Design Standard Conditions 1.9, 1.10 and 1.11 of this permit. The subdivision is permitted for 159 lots, each allowed a maximum amount of built -upon area as listed in Schedule of Compliance Condition 11.9 of this permit. 3. The total maximum amount of built -upon allowed for this project is 1,247,556 square feet, as listed in the application documents. 4. The infiltration basin (DA-H) has been designed to meet the Alternative design criteria by infiltrating the 10 year 24 hour storm volume without overtopping at Y2 of the reported infiltration rate, therefore, an offline bypass and vegetated filter are not required. 5. Each of the two (2) wet detention ponds must be operated with a secondary BMP infiltration basin designed to infiltrate the 1 year 24 hour pre/post volume difference discharged from each pond. All stormwater collection and treatment systems must be located in either public rights -of -way or dedicated common areas or recorded drainage easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. 7. The project shall provide and maintain a 50-foot-wide buffer adjacent all surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers, and the mean high water line of tidal waters. 8 The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. 9. The receiving stream for all of the permitted BMP's is Masonboro Sound, CPF24, Stream Index Number 18-87-25.7, classified SA ORW. 10. SCHEDULE OF COMPLIANCE The permittee shall not alter any aspect or any component of the approved stormwater drainage and collection system, or pipe any ditches or swales shown on the approved plans, except for a minimum driveway pipe, unless and until the permittee shall have submitted a modification to the permit and received approval from the Division. Additionally, the permittee shall not allow any homeowner, lot owner, builder or developer to alter any aspect or any component of the approved stormwater collection system or to pipe any ditches or swales shown on the approved plans, except for minimum driveway crossings, unless and until the permittee shall have submitted a revision to the permit and received approval from the Division. 2. The permittee shall routinely monitor the project to ensure that the proposed built -upon area for the entire project including lot BUA, streets, recreation facilities and sidewalks, does not exceed the permitted maximum allowable built - upon area. Where the permittee finds a noncompliance with the permit on an individual lot, the permittee shall notify the lot owner in writing, requiring remediation of the noncompliance within a reasonable time frame, and shall follow-up to ensure that the noncompliance has been resolved. 3. The permittee is responsible for approving and monitoring all driveway pipe installation on individual lots. The permittee shall assure that all piping shall be that minimum amount and diameter necessary to adequately pass the drainage underneath the driveway, while maintaining a 3.1 side slope. 4. The permittee shall not approve any lot plan where the permitted maximum BUA limit is exceeded, or where piping of ditches or swales is proposed, or where excessive driveway piping is proposed, without first submitting a permit modification and receiving approval from the Division. 5. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further subdivision, acquisition, or sale of all or part of the project area. d. Filling in, altering, piping, relocating, regrading, redirecting, resizing, or removing any runoff conveyance measure (piped or vegetated) shown on the approved plan. e. The construction of any future BUA listed on the application. f. The construction of any areas of #57 stone or permeable pavement for BUA credit. g. Any other revision/modification as determined by the Director. 7. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. Page 4 of 9 State Stormwater Management Systems Permit No. SW8 140211 B. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Infiltration systems should not be used as erosion control devices, due to the potential clogging. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 140211, as issued by the Division under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. For the maximum built -upon area per lot see table below: Lot Numbers Built -Upon -Area 1-22 4,000 23-106 6,500 107-159 4,500 This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. All affected lots shall provide a 50-foot-wide buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers, and the mean high water line of tidal waters. h. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. i. All runoff on the lot must Brain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. j. Built -upon area in excess of the permitted amount will require a permit modification. k. Any individual or entity found to be in noncompliance with the provisions of a storrmwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. 10. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. Page 5 of 9 State Stormwater Management Systems Permit No. SW8 140211 11. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 12. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, the permittee shall cause a certification from an appropriate designer for the system installed, to be submitted, certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 13. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function as designed. The approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals listed in the O&M Agreement. 14. Prior transfer of the permit, the stormwater facilities must be inspected by the Division and must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 15. The facilities shall be constructed, operated and maintained in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data as attached to and on file with the Division. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Permit Transfer Application Form, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions, b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; 2. The permittee shall submit a completed and signed Permit Update Form to the Division at least 30 days prior to any one of more of the following events: a. A name change of the current permittee; b. A name change of the project; c. A mailing address change of the permittee; 3. The permittee is responsible for compliance with all of the terms and conditions of this permit until such time as the Director approves the transfer request. 4. Any individual or entity found to be in noncompliance with the provisions of a storrmwater management permit or the requirements of the Stormwater Rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. Permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have Jurisdiction. 7. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 8. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 9. The Permittee grants permission to staff of the DEQ to access the property for the purposes of inspecting the stormwater facilities during normal business hours. 10. Approved plans, supplement forms, O&M Agreements and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of this permit, the supplement forms, the Operation and Maintenance Agreements, and the approved plans and specifications shall be maintained on file by the Permittee at all times. 11. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal application shall include the required application, appropriate application fee and documentation. Permit modified, updated and reissued this the 16th day of January 2018. All the built -upon area associated with the project is graded such that the runoff drains to the system. 4. All roof drains are located such that the runoff is directed into the system. 5. The outlet/bvnass structure elevations are ner the annroved plan. 6. The outlet structure is located per the approved plans. 7. Trash rack is provided on the outlet/bypass structure. 8. All slopes are grassed with permanent vegetation. 9. Vegetated slopes are no steeper than 3:1. 10. The inlets are located per the approved plans and do not cause short- circuiting of the system. 11. The permitted amounts of surface area and/or volume have been provided. 12. Required drawdown devices are correctly sized per the approved plans. 13. All required design depths are provided. 14. All required parts of the system are provided, such as a vegetated shelf, a forebay, and the level spreader / vegetated filter strip. 15. REGAN Secretary TRACY DAVIS Director The Wilmington Regional Office received and accepted an application to transfer the State Stormwater Management Permit for Helms Port on August 15, 2016. The subsequent compliance inspection conducted on September 22, 2016, indicated that there were still some compliance issues that needed to be addressed. A follow up inspection was conducted on December 15, 2016. The resolution of the identified compliance issues will require a modification to the permit. Therefore, the August 15, 2016 Transfer Application is here,vith returned. After the modification is approved and issued, you will need to resubmit your request to transfer the permit by completing and submitting the new permit transfer application form available on our websrte at: htti)s://deo.ne.itov/about/dilvisions/energy-mineral-land-resources/ener[zy-n ineral- land-rules/stonnwater-program/post-construction. A $505.00 fee will also be required at the time that the new is On July 3, 2017, the Division received some of the additional information items that were requested on January 3, 2017. A review of that information has determined that the following items are needed to move forward with a modification to the permit: 1. Please provide a completed and signed stormwater permit application form. The revised trench supplements and a check for $505.00 were previously provided. 2. Please sign, seal and date the revised trench calculations. Please show the calculation details regarding the trench volumes. These revised calculations appear to be simply a list of the results. There is not enough information provided to understand how those listed results were obtained. Two scenario examples are presented below for Trench A. The volume provided in Trench A will depend on what is selected as the trench height: the "top of trench" (7.5) or the "bypass weir" (8.32). Scenario #1 uses the top of trench elevation 7.5 to determine how much volume the as - built trench holds: 104(L) x 12(W) x 4.5(H) = 5616 cf. Pipe volume = (pi x 1.5 x 188) = 1329 cf. 5616 —1329 = 4287. If the voids ratio is 0.4, then 4287 x 0.4 = 1715 Total trench volume = 1715 + 1329 = 3044 cf. The net effective trench height is (8.32 - 3) 5.32 feet. 104(L) x 12(W) x 5.32(H) = 6639 cf. Pipe volume = 1329 of (unchanged) 6639 -1329 = 5310. If the voids ratio is 0.4, then 5310 x 0.4 = 2124 Total trench volume = 2124+1329 = 3453 cf. Unfortunately, neither of the trench volumes determined by these calculation scenarios matches up with the 2930 cf provided volume reported on the supplement and the calculations for Trench A. Please note that I stopped by the project on December 15, 2016 before I left on vacation to check on the infiltration basin in the back close to the clubhouse. 1 have not had a chance to write up the inspection report yet. The basin was still full of water and sediment plumes ware noticeable. The drainage area is not stabilized yet due to the ongoing construction, and the silt fence that is installed on those lots has been cut for access and is overtopping in places. The street in front of those lots is deep in sediment, which is clogging up the catch basins as the sediment -laden runoff is transported to the infiltration basin with each large rain event. I suspect that this sediment is blinding off the bottom of the infiltration basin to the point that infiltration of the design storm is probably not happening. If the permittee wants us to transfer the oermit to the HOA, then he needs to institute tighter control on the builders and conduct more frequent monitoring to assure that the silt from the lots under construction is not getting into the infiltration system. If those infiltration systems (basin and trenches) were used for Erosion Control, they must be restored to design condition. If builders have allowed sediment to escape into the street and into the infiltration systems over the last 3 years or so of construction, then the permittee will need to restore all of the infiltration systems to design condition and remove all that sediment before the permit can be transferred. If that was your intent, please provide the supporting calculations. The original calculations in the file only contain the HydroCAD reports for the 3.85" storm. Please note that the SA waters options from the TRW group work product documents did not become effective until March 2014, which is a month after this permit was issued. There was apparently no official document that allowed the VFS to be waived before then, except as allowed under the 4 options outlined in Chapter 16 of the BMP Manual. I am checking with Annette to make sure. The plans appear to show that the overflow from all of the trenches and Basin H is discharged (via riprap lined swale or piped) directly into SA ORW waters. All of those conveyances would need to end at least 50 feet from the MHW line (i.e., the edge of the buffer) and you would need to demonstrate a non -erosive velocity through the buffer, in addition to meeting one of the four options listed in Chapter 16 of the BMP manual to waive the offline bypass and VFS requirement. In addition, neither the Mean High Water Line nor the 575' ORW AEC is labeled on the plans. No density calculations were provided to support the 25% cap for high density within the 575' AEC. Without this information, it is impossible to make a determination of compliance in order to transfer the permit. (This can be emailed as an attachment) 2. Two sets of revised detail drawings which include the raised storage elevation to 8.0 for Basin H. (This must be submitted full-size since we cannot print out plan -size sheets). The modified permit is drafted and can be issued upon receipt of these items by December 4, 2017. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Only 3 of the proposed streets are listed in the tax record, so I have to assume that no lots have been conveyed on those streets. Have there been some recent conveyances that have not made it onto the tax rolls yet? Under the session law, you need to provide verification that more than 50% of the lots are conveyed, which means at least 80 lots need to be conveyed to individuals other than builders. Make sure these things are in place before your client requests a transfer. Once they are complete and your client is ready to send us the transfer application you can call us for an inspection OR you can send in the transfer application and we will inspect during our technical review of the application. Do you still want an inspection at this point (because this is a partial PE cert) or do you want to wait till the other items are complete?
