Stormwater Permit No. SW3200601
Speedway Substation
Cabarrus County
Dear Ms. Shaw:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on June 24, 2020. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
The signing official for the Applicant, Swinerton Builders is not listed on the Secretary of
State information page (Section III, 1a & Section VI 11). Please provide official
documentation showing that Jennifer Kirby can sign on behalf of Swinerton Builders.
2. Based on the USGS topographic map of the area, it appears that there are surface waters
located within the project area (Section IV, 6, Section VI, 8h & Section VI, 8p). The
drainage feature in the southeastern corner of the property, downstream of the off -site
pond is shown on the USGS topographic map so it should be considered in accordance
with 15A NCAC 02H .1017(10). Please include the surface waters in the Application,
show the surface water area (in acres or square feet) in the plan set, and include the
requisite vegetated buffer.
3. Please ensure that the proposed percent impervious area is calculated correctly (Section
IV, 8). The Application indicates that there are 1.35 acres of new BUA proposed and that
the total project area is 10 acres (1.35 ac / 10.0 ac = 13.5% not 13.7%). Please revise as
needed for consistency.
4. There appears to be an inconsistency in the amount of proposed BUA that will be added
for this project. Section IV, 10 of the Application ant the calculations show that there will
be 1.35 acres (1.02 acres + 0.33 acres) of proposed BUA whereas the Plans (C0.0),

Section IV, 8, and the Stormwater Narrative indicate that there will be 1.37 acres of
prosed BUA. Please revise for consistency.
5. Generally with a low density project, the drainage area, as reported in Section IV, 10, is
taken to be the entire site (Since there are no proposed SCMs). However, in cases where a
low density project spans multiple watersheds (Such as this project), the entire site area is
still reported in Section IV, 10, but is divided among the watersheds (We do not require
drainage areas to a POA to be shown unless there are State quantity requirements for a
project, but this project does not have any). Since there is no proposed BUA located
outside of the shown drainage areas, the "Total Drainage Area" line of the table in
Section IV, 10 can be updated so that the sum of this value for the two drainage areas
adds up to the project area, 10.0 acres (Section IV, 7). The "On -site Drainage Area" and
Proposed Impervious Area" lines will need to be updated as well.
6. It is strongly recommended to complete a Supplement EZ form and O&M Agreement
form since the provided form has not been updated since 2009 (Section V). Both forms
can be found at the following link: https://deq.nc.gov/about/divisions/energy-mineral-
land-resources/energy-mineral-land-permit-guidance/stormwater-bmp-manual. If you
decide to keep using the provided Low Density Supplement, please make the
following changes to the form:
a. First Page:
i. Allowable Built Upon Area Per Lot - This value should be in square
feet and should be taken from the "Uniform Lot Size" calculation on
the second page of the form. Also, the maximum allowable BUA
percentage for this project is 24% (Please refer to 15A NCAC
02H .1017(4) for more information). This should also be changed in
the Stormwater Narrative.
b. Second Page:
i. Please complete the "Uniform Lot Size" calculation at the top of the
page.
7. Please provide original initials on all included items of the Supplemental Requirements
Checklist (Section VI) per the Application.
8. Section IV, 3 - This item is required, but either has been provided (In the form of the
Low Density Supplement Form), or will be provided (In the form of a Supplement-EZ
Form and an O&M Agreement Form). Please initial this item.
9. Please provide a USGS topographic map clearly showing the project area (Section VI, 6).
10. Please dimension the Project Area Boundary on the plans and include the bearings and
distances (Section VI, 8i).
11. Please delineate the wetlands on the plans or provide a note stating that no wetlands exist
(Section VI, 8m). It is noted that there is a note in the General Notes that states wetlands
will not be affected by this project, however a note stating that there are no wetlands on -
site must be included if there are no wetlands on -site.
12. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:

Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to August 27, 2020, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW3200601 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
