Attached is the application update for Marshall that was signed yesterday along with the original submittal of the renewal request. Questions about yesterday's submittal can be directed to Robert Wylie. At Marshall this action is intended to redirect some existing upland flow (mostly wooded/vegetated with light industrial activity) away from the ash basin drainage to facilitate closure activities. The flow that will be redirected is currently permitted under NPDES as part of the NPDES permit NC0004897 so it seems as if a minor modification could be an option to issuance. With that action, the renewal could sit until the Department is ready to issue from our perspective. I also spoke with Robert Wylie about Asheville. We have contracts in place with a third party to complete the renewal application and submittal in October of this year. Given the amount of items needed to be completed, there does not seem to be a clear path to expediting that to complete in the next two weeks. We can discuss that one when I give you a call tomorrow but I wanted to give you a heads up on that. It seems that acting on the amendment request from January of this year is preferable and then, as with Marshall, you could hold the renewal until the time the agency is ready to issue the renewals. I think the approach listed below is viable to work through these 4 sites and will plan on suggesting same to the Department management next week if you don't object. Dan River— Minor mod to redirect flows as planned. Asheville — Act on renewal request submitted in January, 2020 to have amendment in place January 1, 2021. Duke will submit renewal in timeframes required by the permit but the Department can choose hold renewal until Department is ready to issue without concern from us. Marshall - Minor mod to relocate NPDES permitted flows from current discharge point in permit NC0004897 to new location under NCS000548. These are existing NPDES flows and existing activities: just redirection. Belews Creek — Same concept as with Marshall above. Flows to be re -directed currently exist but are released at a different point. I will give you a quick call tomorrow as discussed so let me know if there are concerns with this approach.
