NARRATIVE
PROJECT DESCRIPTION
Site previously had a temporary club house (23.5ft x 56.2ft) and a permanently constructed cart shed
(24.4ft x 100.5ft) with a wooden platform. j 3,.i S{

The proposed project will remove the existing club house and cart shed and reconstruct them on the same
site but in different locations. The parking lot, not previously paved will be paved along with the entrance
road and the cart staging area around the club house. Two putting greens will be constructed on the site
totaling 4,000 sq. ft and 6,000 sq. ft, respectively. It is possible that only one 10,000 sq. ft putting green
will be constructed.
There is an existin and on the site which has been used to control storm water runoff since the
construction of the Harbour Pointe Golf course. All runof m to this pond is automa ica y pumped to
several golf course ponds where it evaporates since there is no outlet from these ponds to any stream or
waterway.

Enclosed is a plan sheet showing the proposed new construction and the areas to be paved.
The entire site is basically one drainage basin. The area from the high point of the road to the pond is
delineated on the enclosed "Proposed Site Plan" which is the "Final Grading Plan" sheet 2 of 3.
The "Erosion and Sedimentation Control Plan" was approved on 02 January 1998.
The area to be the site of the new "cart shed" has been delineated by the Corp of Engineers.

Enclosed is a copy of the existing pond at Fairfield Harbour, Harbour Pointe golf course.
According to the calculations the additional runoff after improvements have been made is
2800 cu. ft. from a 1 " storm.
All runoff entering this pond is pumped to the pond near #6 Hole which does not have an
outlet. (None of the ponds on the course have outlets.)
Ponds are maintained by the golf course maintenance department.

Dear Mr. Thorpe,
This letter is a follow-up to our phone conversation on 6 February 2008 at
approximately 8:50 A.M.. This is the situation between MidSouth, Wyndham's
Timeshare and the Property Owners Association:
1) In 2004, MidSouth Golf, LLC filed suit in Craven County Superior Court
to collect back amenities from the timeshare owners. In 2006, a Superior
Court Judge ruled on side of the Timeshare owners. This decision was
upheld by the N.C. Court of Appeals in November 2007. MidSouth has
petitioned the N. C. Supreme Court. Do not know when the N.C. Supreme
Court will render a decision.
2) Hands Across the Harbour, community group against paying amenity
fees, has filed a law suit against MidSouth's right to collect amenity fees
against lot owners. Their decision to file a law suit was the decision by the
Superior Court for the Timeshare. Pending the Timeshare case, the
Superior Court has issued a "stay of these proceedings" in the Superior
and District Courts.
3) Until the Supreme Court renders a decision on the Timeshares, MidSouth
cannot collect amenity fees from the community lot owners. MidSouth
has made a decision to close the Shoreline Golf Course and at the end
of 2008 MidSouth might have to close the Harbour Point Golf Course.

This office has completed its review of the erosion and
Sedimentation control plan for the referenced 2.7 acre
disturbance. We have determined the submitted plan for the
grading associated with the construction of 2 buildings, 2
putting greens and a parking area, if properly implemented, will
meet the minimum requirements of the Act and 'hereby issue tnis-

It appears that land disturbing activities and
installation of sediment control measures and/or devices
have been proposed within the U.S. Army Corps of
Engineers jurisdictional 4 .0 .4 . wetlands. If this is the
case, you must provided this office with documentation
from the COE permitting the land disturbing activity and
the installing of sediment control measures and/or
devices in the wetlands prior to beginning develcyment.
Otherwise, all land disturbing activities *gust be
conducted (and all sediment control measures and/or
devices must be installed) upland of all verified 4.0.4.

MODIFICATIONS
1. Temporary inlet protection must be provided on all
catch basins near or in the construction limits of
this project.
2. The silt fence must be installed as near the
area(s) of disturbance as possible.
In 1973, the Sedimentation Pollution Control Act (copy
available upon request) was enacted. It established a
performance oriented program requiring a project owner or
developer to protect adjoining natural resources and properties,
both during and after construction, from the effects of
accelerated erosion. It is YOUR RESPONSIBILITY to understand and
comply with the requirements of -the Act.
In addition to any above listed modifications or conditions,
the following also apply to the approved plan:
-- an erosion and sedimentation control plan is
only valid for 3 years following the date of
initial approval, if no land -disturbing
activity has been undertaken;
-- a copy of the latest approved soil erosion and
control plan must be on file at the job site;
-- a buffer zone, sufficient to restrain visible
sedimentation, must be provided and maintained
between the land -disturbing activity and any
adjacent property or watercourse;
new or affected slopes must be at an angle
that can be retained by vegetative cover;
-- barren slopes must_ be provided with aground
cover sufficient to restrain erosion within 30
working days of completion of any phase
(rough or final) of grading (RYE GRASS IS NOT
in the approved seeding specifications nor is
it an ACCEPTABLE substitute for the providing
of a ground cover);

-- unless a temporary, manufactured, lining
material has been specified, a clean straw
mulch must be applied, at the minimum rate of
2 tons/acre, to all seeded areas. The mulch
must cover at least 75%of the seeded area and
be either tacked, with an acceptable tacking
material, or crimped in place;
-- a Wrmanent ground cover, sufficient to
restrain erosion, must be provided within the
shorter of 30 working or 120 calendar days
after completion of construction or
development; and,
-- this approval and the financial
responsibility/liability cited in it does not
automatically transfer with a change in
project ownership.
Be advised that to ensure compliance with the approved plan
and the program requirements, unannounced periodic inspections
will be made. If the implemented plan is determined to be
inadequate, this office may require that it be revised to comply
with state law. Failure to comply with any part of the approved
plan or with any requirements of this program, could result in
the taking of appropriate legal action against the financially
responsible party (Harbour Recreation Club, Inc.). One option is
the assessing of a civil penalty of up to $500 per day for each
day the site is out of compliance.
In recognizing the desirability of early coordination of
sedimentation control, we believe it would be beneficial for you
and your contractor to arrange a preconstruction conference to
discuss the requirements of the approved erosion and
sedimentation control. plan. It would be appreciated if you would
contact this office to advise Bill Crew (919-946-6481, ext. 259)
of the construction start-up date, contractor and an on -site
contact person or, please, complete and return the attached
Project Information sheet to the above named. ,
The land -disturbing activity described in this plan may
require approval or permitting from other Federal, State or local
agencies. These could include the U.S. Army Corps of Engineers
under Article 404 jurisdiction, the Division of Water Quality -

by the Division of Water Quality (DWQ). Direct any questions

This office received a Coastal Stormwater permit name change application and check for $505.00. Permit
number SW7971213 issued to Harbour Recreation Club, Inc. on August 25, 1998 expires on August 25, 2008. An
inspection by staff reveals that the wet detention pond shown on the original plans submitted prior to issuance of
this permit misrepresented the actual conditions at the site in that this pond appears to be part of a natural
stream. Also the site was not developed as shown on the approved plans.
To obtain a Stormwater Permit you must submit a request for modification to the existing permit,
application fee of $505.00, two sets of plans and specifications snowing -the'6xistirig`project as constructed and
stormwater treatment units necessary to treat the stormwater runoff from this site. The application package should
be received by this office prior to September 2, 2008. If an application package is not received by this date we may
initiate enforcement action for operation without a permit.

MidSouth Golf, LLC can not forecast a date as to when the N. C. Supreme
Court will be ruling on our case. The court might hear our case or the
court might just rule that they will not overturn the N. C. Court of Appeals.
Superior Court was heard on 26 July 2006, Court of Appeals
29 August 2007. The attorneys for both sides check the web -site for
rulings by the N. C. Supreme Court. After viewing the calendar for the
month of September for the N. C. Supreme Court, as of 13 August 2008,
we are not slated for review.
The requested documents for change of ownership for the permit is
enclosed.

This letter is a follow up to our phone conversation of 11 June 2008. MidSouth is
still pending court action by the NC Supreme Court. The Superior and District
Court cases are on hold due to pending court action by the NC Supreme Court.
Right now MidSouth is operating on a day by day basis. On 10 March 2008 Mid
South was forced to close the Shoreline Golf Course since the course was not
self supporting, MidSouth was losing money. The other amenities are being kept
open on a day by day case. MidSouth is currently operating with fees collected
daily to meet its current expenses. MidSouth's current financial status does not
allow for an engineer firm to come in and work up two sets of plans and
specifications showing the existing project as constructed and stormwater treat-
ment units necessary to treat the stormwater run-off from current sites. If current
financial status does not change soon, MidSouth will be forced to close the
Harbour Pointe Golf Course and maybe the other amenities before the end of
the year. If additional expenses are incurred, then all amenities that are not
ciosed wouid be Torced to close.
At the time MidSouth purchased the amenities from Harbour Recreation Club Inc.
this project was never brought to the table. In 2007 when the first letter from
your office was received, MidSouth did not know what permit your office was
referring to.

The Division of Water Quality, issued a Coastal Stormwater Management Permit, Number SW7971213
for Fairfield Harbor Clubhouse on August 25, 1998. This permit expires on August 25, 2008. Section
.1003(h) of 15 A NCAC'2H .1400 (the stormwaterrules) requires that applications for permit renewals
shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete and
submit the enclosed renewal application in a timely manner. If this project has not been constructed
and a permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

This letter is to update you on the Fairfield Harbour Golf Club {FHGC} ownership's
progress towards rectifying the deficiencies in Stormwater Permit No, SW7971213.
Hazen and Sawyer performed an initial site visit to the FHGC on Wednesday, June 28th
2007, meeting with the Property's Operations Manager Joe Riojas and other golf course
staff.
During the site visit, a preliminary investigation was performed near the Harbour Pointe
Golf Course Club House and parking lot. The location of the collection point for runoff
from the facility was estimated with particular attention paid to locating any stonnwater
inlet and outlet structures. With the help of the course staff it was concluded that the
Stormwater BMP was not properly constructed in this area as designed in the original
high density stormwater permit in August of 1998.
Scope of Services
Hazen and Sawyer is in the process of determining and writing a scope of services and
cost estimate to provide assistance to FHGC ownership in complying with all required
stormwater regulations related to their current pennit, SW7971213. A preliminary scope
would include the following services:
• Acquire a full site survey;
• Determine buffers, wetlands, channel dimensions, flood plain, and other
receiving stream information;
• Design a water quality BMP to function in the original intended capacity;
• Consider upstream and downstream impacts including impacts from surrounding
water bodies to safely release treated stormwater;
• Obtain required NCDENR and, if applicable, Federal permitting;
• Provide construction administration of the proposed BMP;
• Provide as -built certification of the designed BMP post -construction;

Provide the FHGC with operations and maintenance forms as well as
recommended contract services to maintain the BMP.
Schedule of Services
Should FHGC choose to retain Hazen and Sawyer based on the proposed Scope of
Services, we will arrange for a full site survey to be acquired, drainage area delineations
and runoff calculations will be performed, and a Water Quality BMP will be designed to
function in the original intended capacity. Hydraulic and Hydrologic Computer
Modeling will be performed including a stormwater report for your office's review.
Upstream, downstream, and the influences of adjacent water bodies will be taken in to
account when designing all discharges from the BMP. Proper buffers and wetlands
requirements will be incorporated into the design.
Final recommendations based on our analysis will be provided to Fairfield Harbour Golf
Club and, if necessary, broken into a phased strategy for rectification. Once the owner
has agreed to our proposed stormwater solution, a submittal to the Washington Regional
Office of NCDWQ will be provided for your review and approval.
Following approval from your office, construction of the stormwater BMP will begin
with Hazen and Sawyer providing construction administration if desired by the Owner.
Project requirements will include all construction to be inspected with a certified as -
built plan provided to DWQ following construction. An operations and maintenance
plan will be prepared and observed by FHGC once the approved BMP is in service.
Conclusion
Once we are retained by the property owner, Hazen and Sawyer will keep your office
informed during all stages of the project and advancement towards complying with the
existing NCDWQ permit and pond construction. FHGC and Hazen and Sawyer will
cooperate with your office in any way necessary'towards meeting the permit
requirements. In the future, a project schedule will be provided to keep your office
appraised of our progress. Please do not hesitate to call with any comments or questions
