Dear Beaufort County Schools and Mr. Boyd:
On April 23, 2010 this Office received the Designer's Certification for the repairs to the
Chocowinity Primary School wet pond. The plan revision components were received in
February 2010 and have been approved. The Division considers this violation closed.
Please continue to inspect and monitor your site for compliance with both the permit and
O&M requirements. At the date of last inspection, a healthy groundcover was in the
process of being established (site had been seeded) but had not yet stabilized the site.
Fine grading and re -seeding work may be required to establish groundcover and prevent
erosion.
Thank you for your cooperation and conscientious effort to help safeguard the waters of
the State. If you should have any questions regarding these matters, please contact either

Dear Beaufort County Schools:
This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1
.1003 for failing to comply with terms, conditions and limitations of a Stormwater Management Permit
No. SW7041213.
On August 28, 2009, Amy Adams of the Washington Regional Office performed an inspection to
determine the status of compliance with Stormwater Permit SW7041213. Permit Number SW7041213
was issued to you on April 6, 2005 for the Chocowinity Primary School located at 606 Gray Road,
Chocowinity, Beaufort County, North Carolina.
As a result of the site inspection and DWQ file review, the following observations and violations are
noted:
1. Condition 46-- Failure to Submit a Designer's Certification
Title 15A NCAC 214 .1008 0) requires that upon completion of construction, the designer for the type of
stormwater system installed must certify that the system was inspected during construction, was
constructed in substantial conformity with plans and specifications approved by DWQ, and complies with
the requirements of this Section. As of the date of this letter, DWQ has not reccived.this certification.
II. Conditions 2-4-- Failure to Provide Operation and Maintenance
Conditions 2-4 of Stormwater Permit SW7041213 requires that the permittee shall provide the operation
and maintenance necessary to operate the storm Nvater controls at optimum efficiency. **Specific
operation and maintenance failures are noted in the Comments section oflour inspection report. Also,

1. This Office requires that you respond to this letter in writing to the address listed at the
bottom of the letterhead within 30 calendar days of receipt of this Notice. Please provide a
written "Plan of Action" which outlines the actions you will take to correct the noted
violation(s) and a time frame for completion of those actions.
Thank you for your immediate attention to this matter. Please be advised, these violations and any
continuing or future violations are subject to a civil penalty assessment of up to $25,000.00 per day
for each violation pursuant to North Carolina General Statute 143-215.6A.This office requires that
the violations, as detailed above, be properly resolved. Should you have any questions regarding these

1. A Designer's/Engineer's Certification has not been received for this project. Please have an Engineer certify that your system is
built in accordance with the approved plans and specifications.
2. 2 drop inlets (in bus parking, in grass between bus and teacher parking) are obstructed by debris. These inlets should be kept
clear of debris and/or grass overgrowth,
3. Several areas surrounding the pond have poor grass cover. Good grass cover should be established to stabilized the soils and
reduce the risk of sediment entering the SW BMP.
4, Grass in the swales, areas surrounding the pond and the pond side slopes should be maintained at a height of approximately 6
inches. ROUND -UP OR OTHER GRASS KILLERS SHOULD NOT BE USED NEAR POND OR SWALES.
5. The inlet swale to the pond is highly eroded and is actively "headcutting". This is a serious problem and should be immediately
addressed.
6. Two black PVC pipes are discharging into the pond that are not shown on the approved plans. Please identify the source of
these discharges.
7. The forebay is rapidly filling in on the southern end at the inlet swale due to severe erosion. Please survey your forebay depths
to verify the sediment removal elevation has not been reached. If so, please excavate back to original design depths.
8. The forebay berm appears to have some minor settling. Watch the berm condition and repair any erosional channels that may
form.
9. The side slopes of the pond are heavily eroded. These areas should be re -graded and re -seeded immediately.
10. The outlet structure bypass (top of structure) is clogged by debris, The trash grate should be checked regularly and cleared of
any debris that may obstruct water flow.
1 I . Some erosion was noted around the outlet pipe where it meets the pond side wall. This should be addressed.
12. The terminal end of the outlet pipe could not be located due to heavy vegetated growth. This vegetation should be cleared and
the outlet monitored for signs of damage or erosion.
