Box 15564 New Bern, NC 28561 Subject: Stormwater Permit SW7041107 Broad Creek Mini Storage Craven County Dear Mr. Avolis: This is in response to your letter dated October 18, 2005 to Ms. Amy Franklin concerning Broad Creek Mini Storage. Originally the requirement for a sedimentation and erosion control plan approval is what triggered the requirement for a State stormwater permit: A State stormwater permit is required unless we receive a statement from the Division of Land Resources that the project does not require a sedimentation and erosion control plan. If you can submit documentation from the Division of Land Resources that the project does not require a sedimentation and erosion control plan, the owner can then request that the State stormwater permit be rescinded. Due to the presence of'wetlands on the site, the owner has scaled back the proposed development to disturb less than one acre of land. Please accept this letter as formal notification that the original site design has been modified to disturb less than one acre of land on this property. Due to wetland conditions, no additional land disturbing activities or development will occur on this site beyond those presented on the project plans. Since the development is less than one acre in size, no Coastal Stormwater permit is needed.
